In addition, a blanket statement of "You do not need a lawyer!" is irresponsible advice.  We have no way of knowing the OP's entire situation, or willingness, or time commitments, or abilities.  Yes, it's exciting to have a self-help resource like VJ; however, it's also true that some people absolutely need outside help.  We don't know what we don't know.  Please keep this in mind. :)

The certification does not state that the person who signs it has translated the documents, rather that they agree that they are accurate translations.

Don't need to be....you yourself could have translated the documents.

 


 

Hopefully these can be of some use and can help you reduce costs as you put together your packets.  We used this site for ours and are thankful for all the input we found here.

It doesn't need to cost anything, anyone can translate.

I think for the purpose of a visa, you lived there. Others in the same situation have gotten one. It takes some time for you to get the proper police certificate from Australia and it requires you to have your fingerprints captured. It has a link for which UK police stations can do your fingerprints, as well as a link to how to obtain police certificates from other countries.

I know for sure others who didn't get the fingerprint version of the Aussie police certificate, were not approved for their visa at the interview. They had to get the correct version and submit it along with their passport later. I am going to PM somebody I think got the Australian certificate and ask him to help with this topic.

Can anyone confirm whether we definitely need fingerprint for australia?

If you require a police certificate from Australia, then you need fingerprints. It says that in your instructions on the London website.

On the page I linked to earlier:

Please note that many countries require fingerprints to process police certificates for immigration purposes (e.g, Australia, Canada, Nigeria). Police certificates completed without the required fingerprints are not valid. In these cases, applicants must not capture their own fingerprints. View the attached PDF file for a list of UK police forces (PDF - 338kb) that offer a fingerprinting service. Applicants should not attempt to to obtain police certificates for the few countries where it is documented that police certificates are not available.

Sad to hear this, but your decision.

 

Just make sure the ex-fiance withdraws the petition properly so you're not showing in the system as having immigrant intent when visiting, or if you have another petition submitted.

Unless USCIS has stated that the letter must be notarized, there's no need to get it notarized.  If the letter is written in the native language, someone (even you, if you're capable) can translate it.  The translator should include the translation certification -- search here for the verbiage and format.

Have your friend read the I-129F instructions. You already stated it, so you already know, you both must be free to marry at the time the petition is filed. You must provide a copy of the divorce decree with the petition.

From what I can tell from the friend, the sister really doesn't want to go back to Russia and had been working towards her "refugee" status in Canada for some time. 

Good luck with that.

 

If I understand the status of the sister, she has a refugee hearing in November.  The Status of her petition will be determined then and she will either be granted Refugee Status, or deportation proceeding wil be begun (I assume it's possible to get an appeal, but I don't know Canadian Immigration...)

OK, then they will know.

 

Sometime in the past few weeks, the American Gentleman "proposed" to the sister and the whole issue of wedding dates started.  The Gentleman would like to be engaged for at least 6 months before they get married.

From what I hear, if the Refugee Hearing goes bad, the sister  may be told she needs her bags packed as she could be deported immediately.

So, after all of that, here's the question my wife posed:

 

If the American Gentleman and the Russian Lady were to marry in Canada, would that stay the deportation?  Again, not knowing Canadian Immigration law, I can't answer my wife.

Most likely not.  Marital status usually has no bearing on immigration status.

 

 

A second question my wife asked was - what kind of Visa would the American Gentleman need in order for the sister to come to America?  A K-3 post wedding?

If they were to become married, then a CR-1.  She would need to be legally residing in Canada to have the interview at the appropriate US Embassy in Canada....if not then her interview would be at the Moscow US Embassy.

 

 

My gut tells me that should the Sisters Refugee Hearing go against her, getting married to the American man will not stop her deportation and the American Man would need to process a K-1 Visa to her back in Russia.

No, if they become married, then the K-1 is off the table.

 

 

I've no experience with any of this and thought I's ask the community's thoughts and opinions.
