Thanks - you're right on that 6 month residency. For others in same boat, I did read that there are no laws that govern this choice on behalf of the embassy. Also if I (USC) hold permesso di soggiorno (permit to stay) will qualify me for this option.

This is part of the logistical plan that has to work for the CR1 to be the correct option.



Hopefully someone has a better answer on this, but i would say you would have to call the embassy to see. I think for the most part the DCF has shown to be geared toward military if you have to have a 6 month residency requirement before doing that since there is a requirement for you to have domicile in the US. For the average person, this isnt really an option since it is hard to have both...unless if you are able to file just before leaving the country to go back to the US. I think later in the process you have to prove the domicile. I think you just need to figure on which way you want to go...fiancee or spouse. Both have their advantages and disadvantages. It is up to you what you will accept.



I can answer this. I am a USC, with permanent residency in Canada. In the I864 instructions, I have to prove the INTENT to reestablish my domicile as I do not have domicile currently. It is possible to do, there are many DCF'rs (I would say majority) that have gone through the process and been approved.

I have been watching the timelines and it is a VERY long wait in Ghana for an interview. Daily prayer and a ton of patience is what I am learning about now. (God grant me patience and do it NOW!) James & Wanda were waiting for a long time.... I think earlier this year during the Presidential elections in Jan/Feb, all cases were held up causing a huge backlong in Que.

Not sure why....

Thanks Malrothien. You gave us light! Now, the situation is, hubby is having difficulty this year RE: job so sometimes he doesn't have job sometime he does. Does NVC will compute his income for this year? Do you think we need a co-sponsor? Though he was just hired today.

It would be best if he filed the taxes. The instructions say that if you were not required to file to include a letter to that effect along with the IRS publication stating that rule but it would just be easier to file the taxes.

You do NOT give up your passport upon entry, other than for a few moments as you clear immigration and have the visa endorsed. You can leave on the next plane out if you wish and use the endorsed visa to re-enter. For travel concerns, Google, "maintaining current resident status".

Wouldn't you have to wait for your GC to be mailed to you before you can enter the US again.

Once your activate the CR1, the I551 stamp can be used in place of the green card up to one year.

According to your timeline you entered the US on Nov 5th... It can take a month or so for the greencard, you can go to the local Social Security office and apply for the card and will get it normally within a week or so...

Interview date has nothing to do with when you receive the green card, it begins to get processed once you enter the USA at the POE

USCIS and the SSA are two completely different entities - the two cards would not come together.

There is no US Embassy or any Embassy of any country in Montreal. Embassies are in Ottawa. The OP is dealing the the US Consulate in Montreal.

Montreal is about 2-3 months back logged. Check the thread CR1/IR1 interview thread in the Canadian regional forum. You will get a good sense of your wait time from there.

My wait time between case completion and interview date was about 3.5months.

You do not need to file an I-129F - in fact, it is too late for you to do so since your I-130 was approved. Ignore that form completely.

When you pay the IV Fee bill and it shows paid, you can submit the DS230 - both parts - with the respective cover sheet printed from the website.

You're on the track for the CR-1, not the K-3 visa. Once you've submitted the DS230, it is about 10-14 days until you are finished with NVC pending no further information being requested. If you were prompted to the pay the fees, you will be 100% fine. If you did pay early, it usually doesn't cause many problems from what I have read here.

4. Also I read something about an OF 169 form?? What is this? Who is this for?

The OF-169 is a consulate specific form regarding what items to bring to the interview.

5. Timeframe from paying $400 Immigrant Visa Fee and submitting I-864 form to when I can send in immigrant visa form?

You can send in the I-864 since you already paid the AOS Fee bill - it is not tied to the IV Fee. Once the IV Fee is shown as paid, print out the cover sheet and submit the DS230.

I thought I was on the right track and understood what I was doing. Now I'm suddenly confused and panicing. I would really appreciate a few people emailing me and helping me to understand when I am in the process and what I need to do. Thank you in advance for you time!
