IMBRA Special Topics	Problem with CSC RFE	Mine was different from the one posted before. I think CSC has a slightly different form. Mine was 3 pages, one with the NOA, one with instructions and one with the questions. All white. Mine has a green one with NOA and all our information on it. The second one is the IMBRA questionaire and the last one is the i-129f supplemental informations. The first green one has back and front pages. ours the same as Gary! If it doesn't do both of these things, it is not exempt. to the best of my recollection, match.com did charge both the same. now, actually buying in was an option, but in order to do anything other than 'wink' (show interest) then you had to pay a fee. correct me if i'm wrong, Littleone. to answer your question. Yes that is...but I didn't pay anything, my fiance (USC) paid...I got 3 days trial for free I contacted him by then.... well, let's hope to hear the clear definition of Marriage broker.... IMBRA Special Topics	FilipinaHeart.com Responds to my IMBRA Question	I talked to an immigration attorney today. Unfortunately I was told (was pretty sure already though) that the site my fiancee Sheryl and I met through is condsidered an IMB under IMBRA. But he said since we met last year prior to the law going into affect that this would not negatively affect her visa process. So if you met on a site that charges fees for matchmaking, online dating, social referrals etc. between a USC and foreign national clients by providing personal contact information or otherwise facilitating communication between individuals. Then you met through an IMB.... One huge exception to the law is if this type of business is NOT the principal business of the company you met through. For instance Match.com is not considered an IMB because matchmaking and online dating etc. is not it's main source of income. Here are a few of the companies the parent company of Match.com owns. The parent is: IAC/InterActiveCorp They also own: ask.com Home Shopping Network ServiceMagic Ticketmaster to name a few. Yahoo for pretty obvious reasons also meets this exemption to the law. So do a little research on the ownership of your site and see what you can come up with. Unless it was a totally free service. Thank you very much for this information, Dean. If in doubt call the USCIS and ask but I am pretty sure that is the case. I asked a USCIS Officer and he said he cannot tell me if my dating website (mate1.com) is considered an IMB. He said all he can do by law is to read the Law to me over the phone. Cause the truth he implied... is he does not know and nobody know right now. Thanks in advance, Littleone Ok, I am not a lawyer so take this as just my opinion. If you can TRUTHFULLY answer no to the question "Did you meet through a IMB?" then no other info is needed. You should have described how you met in your letter of intent anyway and IMO no other info is needed on that one. One other thing. My lawyer says Yahoo is not a IMB so I would guess that Match.com isn't also. IMBRA Special Topics	Approved IMBRA Waivers	A USC criminal conviction alone is not grounds for denial therefore no waiver is required. I confirmed this with 2 different immigration attorneys also. It seems this case may fall under one of the IMBRA restricted areas. If so, he has to have a waiver or he will be declined. If it were mail fraud, I agree no waiver would be required. For his sake, I hope he files a waiver. You can encourage him not to file a waiver, but I won't. I'm not encouraging anyone not to file a waiver. File away as far as I'm concerned ,it certainly can't hurt. At this point we don't know whether he has multiple K-1's or just criminal conviction or both. But, again a USC conviction alone is not grounds for denial period! Why would need a waiver for something that is not grounds for denial? Think about it. It's not rocket science. our immigration attorney also said the same as Dean, we don't need a waiver request if we don't have multiple K-1. we have waited for the news from CSC since we sent our RFE. Well, the IMBRA makes us scared for denial , but we have positive attitude (try to be positive)... if we have any progress, we will keep you updated... Wish all of us the best... IMBRA Special Topics	source of background check	If you have convictions you will need to provide certified copies of the charges and dispositions from the court having jurisdiction over your case. You will need to do this for every single case that applies to IMBRA. If no convictions than you do not need to provide anything. I am not a Lawyer. it says , if you have ever been convicted, submit certified copies of all court and police records showing the charges and dispositions for every such conviction. well, i have been convicted of 3 alcohol related in 88(dwi), 90 (public intox), and 99 (boating dwi). now, i have to provide certified copies of my criminal record. is www.cir-ncrec.com an acceptable source? are these certified copies? if not, who do i contact for these certified copies? has anyone had to do this? and, yes i have been behaving myself since the turn of the century. thank you I would suggest for court records you will want to go to the court house and get certified copies from them. They wiil actually notarize and stamp them with the court seal. As far as certified copy of your police record you might want to start with you state police website. IMBRA Special Topics	Handling IMBRA convictions at Interview	Interview at Bangkok, Thailand I went alone for the interview. the consular officer and I discussed about the past convictions of Robert. The problem is that he has 2 convictions that is what I was informed by the Consular officer, so our case might be pending……when I heard the word of Pending I started to explain everything between I and Robert. I talked alots I couldn’t remember, but all is about I strongly insisted that I have known everything about him and I will accept him anyway. Finally I got visa. Before we sent RFE to USCIS, Robert sent me his past convictions then I sent them to translate into Thai, after that I sent the translated convictions along with my Letter to confirm that I will still marry Robert, 60 days later our case was approved (Sept 7’ 06) Thanks to everyone for your help I and Robert appreciate very much. Unless you have no possible relations with your sister it is likely to come up at some future family gathering. So, you are right about biting the bullet now. If you are honest with her and she truly loves you, she will understand. Tell her about it and see what happens. I think you are going to be pleasantly surprised. I think consulting an attorney would be a good idea, but maybe you should wait to see what happens first. Yes, consulting an attorney might be a good idea, but you don't need to ask them to do for you all, some parts you can do by yourself. we paid for immigration attorney for about 200 USD only for IMBRA law as there were some points that we couldn't translate clearly. you can PM me for more information. you should disclose even it is sealed. I had one previous petition MORE than 2 years ago. If I read that right I don't think I need the wavier. Right? Gary Im not official but it seems very clear on the RFE what they require....... If you have filed two or more K-1 petitions at any time in the past or previously had a K-1 petition approved within two years prior to the filing of this petition, you must apply for a waiver. You say you had a previous petition more then 2 years ago. That would mean the above DOES NOT apply in your case as you have only had ONE previous petition. Being outside of the two years, the second part does not apply either. Yahoo Personals.......NO WAY and I will bet my life on that. I and my Fiance' met on Match.com. So could he tell you the exact whereabouts of your petition and what would happen if it was sent directly to the embassy - would that create any problem for you? Can you get confirmation from the embassy that it is indeed there? Both the NVC and the USCIS said there is no way to know where my petition is. It could be sitting at the CSC, sitting at the NVC, somewhere in between or on it's way to Manila. My lawyer is sending an inquiry to Manila to see if it made there. My only hope is that it's still at the CSC or on it's way to the NVC. Without a MNL case number it's unlikely that the Manila embassy will do anything with it. AARRRGGG!!!!!
