K-1 Fiance(e) Visa Case Filing and Progress ReportsReceived 221(g). What now??

Agree with Eabbas, Also there have been some incidences that some people have been refused to file with co-sponcer on K1 visa. Generally the interviewing agent will see this as a liabiliy, perhaps after immigration the beneficiary may become a public charge. So if you have to go the route of Co-sponcer use someone who is a very close relative. Best cosponcers are your parents and siblings, someone with a blood connection.  Hopefully they have high income and can portray they will support you during the K1 process financially if needed.

PM me if you need some help putting the packet together.

K-1 Fiance(e) Visa Case Filing and Progress ReportsVaccinations

You have to get a medical done before your interview and at that time they will give you most of all the vacinations you will need....(sort of) see they give you what they think you need and create a file by a civil surgeon in pakistan.

Long story short without getting too in depth of the issues of the system, this is what you can do.

1. Print this form out and take it to your medical examination make 2 copies if you have to.

http://www.uscis.gov.../form/i-693.pdf

2. Familiarise yourself with this form.

3. Take any existing vaccination record you have with you to the medical examination.

4. Have the Doctor who is doing the examination complete this form. (yes they will probably not know what it is becasue it just got updated 15 days ago) so know the form have them fill it out sign it showing that you have all the vacinations completed and that the doctor went over the whole form.

If you get this done in Pakistan you will save yourself about $200 to $250 Dollars.  or you can come here and just get it done. I suggest getting it done there. having a form that shows all of the things listed on page 5 vacination completed.

if you have more questions PM i dont always look back at posts.

Ask yourself if you will feel more confident going to the interview with this information and will you regret not having it if in case you need it.

I think you should be able to answer the question and overcome the difficulty for this items if you really want to, rest is up to you.

I think with the posts above and I also agree with everyone.

1. DO NOT FALSIY Documentation!.... Very very BAD IDEA! If you have already done it to minipulate the system.... well be prepared to have more questions ASKED! too bad you dident ask VJ before you sent off the docs.

2. Honesty is the best policy! seriously! The USCIS are not heartless individuals if you honestly explain to them what happend and how it happend they will at the minimum give you the opportunity to explain yourself.... kind of like they already did in the RFE.

IR-1 / CR-1 Spouse Visa Process & ProceduresPlease Help Me with My I-130
What type of proof did you send in? Did you provide a marriage certificate? This is the gray area that's quite a bit of confusion it really all depends on if all the stars line up in your luck. But realistically there are a few things required to get married in the perspective of US standard meaning you have to be together physically in the same place to sign the marriage certificate! This raises another question how do they know who signed the certificate? You obviously were not there neither were any of the witnesses able to confirm it was you. Anyways you could try your luck at writing an explanation with additional proof of marriage with pictures and an amendment to your original application Nothing changes but the dates. But you never know might be easier for them to deny the application then you can refile pay again for application! Good luck let us know how it turns out.

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit Of Support Problem
If your cosponsor has money in the bank i think there is a 1 to 3 ratio of earned income, meaning if he/she has 3 times the minimum required in liquid assests that should satisfiy the afidavit of support. Also if they happend to approve you and that is the only thing pending for approval then your cosponsor could fill out the tax forms based on what he/she intends to file.

Mohsin I don't know if you have read the boards reviews of using a lawyer most of the time they slow things down. All correspondance goes to them and they charge money for something you can simply do yourself unfortunately there is such a big disconnect from the processing of the visa to the applicants a lawyer has no additional say so or insight.Unless you have magically found a lawyer who actually does have some connections.Anyways good luck. And yes I have heard its taking over a month to get a notice of action .

IR-1 / CR-1 Spouse Visa Process & ProceduresSample of Explanation Letter why not to required to file taxes

My joint sponsor used her husband's income to meet the requirement. Since they also files taxes jointly. Therefore, her husband filled out 1-864a. the total income will be 45k usd for 5 household including me. I ask her to provide me paystubs or employment letter. I told her which of the two she could provide easily. Then she provide the employment letter.

To her husband, what can I ask from him except for 1-864a?

Best thing is a current pay stub . Last years tax document are almost 8 months old for proof of income. Best proof of income is current income. Anything the supports current income is essentially what you should provide. It should be satisfactory however it is still up to the discretion of the reviewing agent.

IR-1 / CR-1 Spouse Visa Process & ProceduresSample of Explanation Letter why not to required to file taxes

Ok Thank you very much,

Another question, I have the employment letter which my joint sponsor sent to me. I have noticed that there is no salary indicated in the letter. Only the hours per week, the date she started in the job, and her title in the job. Is that alright? She started working since 2003.

Submit recent pay check stubs also there is information on prior year tax if cosponsor has been at position for a long term. If the income is more then the minimum required they don't really look to much further into it.

IR-1 / CR-1 Spouse Visa Process & ProceduresSample of Explanation Letter why not to required to file taxes
I think you would have to just write an explanation of why the requested tax was not filed in your case. But most common explanation is that the individual income for the year was below minimum requirement to file taxes.

Syeda is right. You should also provide your pastv3years info. Its not a requirement but shows you are being a good citizen and filing taxes. One of the things that comes up in a FBI record check is financial obligations something like a credit check . If your credit is good chances are they will not give you a difficult time.

If i wasent mistaken I would say this is borderline abusing power... actually it kind of is. The Hijab is a symbol of a devoted individual who practicies there religion and an observation of islamic believes. Lets have all the Seikh people take off there turbans when they apply also then :D in addition with facial hair its even more difficult to tell people apart.

Actually print this out and send it back to them;

http://travel.state....toreq_5333.html

have them read the section "Do not wear a hat or head covering that obscures the hair or hairline, unless worn daily for a religious purpose. Your full face must be visible, and the head covering must not cast any shadows on your face"

I am guessing perhaps the interviewer might have made a mistake or the picture you submitted did not show enough of the face.

1. DO NOT OPEN THAT PACKET! keep it as perfict as you can put it inside of another packet so it does not bend or get damaged.

2. BUY your ticket to USA. look on emirates i think they have some good rates, right now the prices went up but wait for another week or so they will probably come back down. (BWI) is the airport you should be going to unless you can find tickets cheaper somewhere else and its close enough.

3. Pack your bags! (your spouce should be more helfpull in this catagory)

and start counting down days to your departure.

That's right the visa gives you permission to enter The country at any POE since there us no designated POE assigned, and yes you can update the address also however its advised to maintain the original address because some documentation that is sent later might get misdirected so better to expect mail in one place unless its not possible.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat to take to the Interview?
I hope this helps organize a list maybe you can make one for everyone to use.

1. Original application copy
2. All notice of actions preferably original
3. Appointment letter
4. 4 passport pictures (just in case)
5. Valid passport
6. Medical report
7. Affidavit of support any recent pay check stubs proof of income etc.
8. Proof of ongoing relationship - pictures , letters addressed to each other the envelope is stamped showing time documentation of relationship.... Etc.
9. Good attitude and a smile always goes a long way.

You had questions about original and copy documents to best answer the question any forms you filled and sent to the immigration a photocopy is fine. The items they prefer to see originals of are items such as birth certificate , divorce docs, etc. basically anything someone would need as a legal document that people might try to forge for personal gains.

This is just to get you on the right path make us all a list we can follow.

1. 2 Passport size photos
2. Marriage Certificate
3. English Translation
4. Proof of marrage, ex. Pictures, Letters, Documentation of phone calls and any other exchange.

Many people on this bord will advice you against a immigration lawyer or consultant. The process is setup so anyone with a high school diploma can complete it if they follow directions. Note the link in the above post and you will do fine its a long process so dont waste time it can take nearly a year from time of application to complete.

Sometimes when the USC is not present, the intending-immigrant is treated more rudely or disrespectfully. Your presence there makes it a LOT less likely that your love will be treated roughly.

I'm at the crossroads of the same question, to go.....or not to go!

The presence of the petitioner with the beneficiary is dependent on interviewing agent at the embassy that you get. It's all a draw of luck, maybe you get one interested in asking your significant other questions perhaps you get one that does not care or maybe one that does not want to talk to the petitioner.

On another note maybe you can ask yourself the question, "can you sleep better knowing you did everything in your ability to position the situation best way possible" meaning go and realize you did everything you could and accept the outcome as best possible effort. Then go with that response!

Let me know what you come up with I have been contemplating that question for over a month now.

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice reportt
Hello, You can fill out all the forms if you want in advance it does not appear anything will change.. unless your employment chages or address changes which most people avoid changing during this process.

In about a month you will hear that your case is approved, after that it will take 2 to 3 weeks for NVC center to get it then it will be processed takes another 3 weeks so about 7 Weeks total from NOA2.

Which means there is plenty of time to get the police report done also... the police report depends on were your husband lives, he will have to do research and find the local police station that issues the report. It took about 10 days for my fiance to get hers, however I heard other who got there police report same day.

Hang in there its a SLOW process... just takes time.

IR-1 / CR-1 Spouse Visa Process & ProceduresIRS QUESTIONS, I864

I am filing an I864 for my spouse that is in Pakistan the instructions on the I864 states that taxes have to be free of IRS.I owe from 2011 taxes and I am making payments months, do all the amount has to be sent in before I can file I864. Please help...

As good measure would suggest paying it off before the interview. There is nothing wrong with owing the IRS money for tax's, The IRS also does not report to the Credit companys unless an individual completly refuses to pay the amount owed. If you can pay it off then thats great do it.... if not then take proff that there has not been any delinquiceys in the payment plan. If the petitioner makes enough money the immigration hardly cares.

Looks like you have all the basis coverd just do a mock interview of questions that have been asked. It will help him get prepared for the interview and the type of questions that are asked, also reduces a little bit of nerviousness. Besides that dont lie about anything.. always tell the truth. Just be prepared for any sort of outcome.. I hope your visa gets approved, but dont be discouraged if they place it in AP... its usually very short time if the case is simple. Good luck!

I dont know how true this is, but one of the things that I have heard a few times is the immigration considers; education and career of the beneficiary an important aspect of the immigration process. Stick to the example forms that are provided do not experiment with adding additional information that could complicate your immigration process.

Many people who come to USA do not end up in the same line of work as they have education for or previous work experiance. I know a few engineers who drive Taxi's and work at Gas stations... now if you can find a title for that then go for it. But if you do not know what you will be doing here then dont put anything. Unless you are skilled with a special trait such as a Doctor or Lawyer and have committed to passing the required examination to become certified. That is the main purpose of this question, to determin if the qualifications abroad are accepted as licensed qualifications in USA. Majority of them are not.

There is no promiss that you will get your visa at any time. I dont know what others recommend but my experiance has been that lawyers will delay the process of your case so best thing to do is discontinue the use of a lawyer unless your case is complicated meaning Divorces and possible pending legal issues. The visa application system is designed so a 12th grade graduate can complete the process.

at the point you are at just wait for NOA2 and then the rest will go pretty quickly you should be hearing back very soon. Call DOS to check the status of yoru case if you have not heard anything for a while.

Good luck!

This could go either way to be honest too many variables.

1. Can you provide us background on your case... how did you get married and time frame, how did you meet a bit of information.

2. The interview: how did that go what was asked and provided .... provide a interview writeup so we can possibly see the concern of the interviewing agent and why he was refused .

3. Have you practiced a mock interview with your husband? .... the interview process is and can be very overwhelming and under pressure the beneficiary can under stress respond incorrectly so try asking him possible interview questions.

4. Gather addition proof to show that your case is genuine and gather addition documentation as secondary information.

The reason they ask for W2's and Tax return is to varifiy past income. Submitt most recent pay stub as proof also! That is one of the things they list. Income for past year can be varified by reviewing the "Year to Date" on last pay period of December Pay stub, in place of a W2 just so the last pay stub that you have recieved in 2012 or if you have the option to wait till W2's are issued which is in February.

Also if the necessary submit last pay stubs of various jobs which show year to date if there was multiple place of employments thought the year.
