Hi and welcome to the Journey!

1. You can put your own address. Later you can send in an address change to USCIS. That’s what I did, and it worked out OK.

You can keep your fiancé’s address in Spanish, because it will probably only be used by the Consulate to mail Packet 3 & 4. Boss’ address is fine.

2. USCIS uses two holes at the top of the page and the little metal fastener thingys on it.

3. Contacting local senator is ONLY used as a last resort if you do not get approval for your petition beyond 6 months from filing. No need to contact anyone now!

PS Only official documents (birth certificate plus letter of intent etc.) need to be translated while sending in the I-129F. What I wrote was in reference to the interview at the foreign Embassy only. Actually the only proof that needs to be sent with the I-129F is meeting within 2 years, NOT any letters, chats, phone cards etc.

During the interview they may ask for the letters too, so they need to be translated. What I did was copy the letters, use black pen to cross out the very personal things, and translate the remaining words myself. (I am fluent in my fiance's languge.) Then I also sent a letter of translation that I wrote myself. (I, ---, certify that I am competent to translate from -- To English and that the translations of the following documents is a correct and true translation to the best of my knowledge and belief.")

Yes Vicki you are right, after it is returned back with intent to deny, looks like it is pretty hopeless. :crying: And since you were indeed approved at the US level and only denied in India, well even if you (or those in your position) started the process all over again, how likely is it that the Consulate will suddenly be happy to approve the same people?

All that time and all that money and all the heartache… it is so sad. :( Sometimes things just aren’t meant to be, but what can we do? At least hopefully we can get some strength out of the whole experience.

My interview is in only 3 days so I'm bracing myself for whatever the outcome… we are going through Chennai too, like you guys did. :unsure:

You will be fine, you don't have that much of age difference.

Men can be a LOT older and not cause red flags. The red flag as mentioned is if the USC fiancée is much older than the non-USC fiancé. However most cases are approved.

I am the USC fiancée age 41 and my fiancé is age 26 (15 years difference), but we got the visa fine (even though in India if the fiancée is aged even a year older it is frowned upon).

Her family should know that she probably will be sending back a lot more money than she is earning now there, that she will have plenty of people from her own country here as friends, and her daughter probably would be quite happy here! I have never heard of 120g denial. Maybe you mean 221g? You can read about it on the forum named "Waivers (I-601 and I-212) and Administrative Processes (221g)".

The 221g usually means some information needs to be verified (like a name check) or some information is missing (they might request certain paperwork) or they may have doubts that the relationship is bona fide. Hopefully your friend received some details to verify what the problem is. Good luck to them!

maya62 gives good advice, regardless of who you inform about the address change (and the most important is to make sure the Consulate has the address/PO Box), keep track of your timeline and when the time is right, have your fiance check with the Consulate direct (by phone/email/in person) to see if they tried to mail anything out.

I don't think the temp EAD stamp makes any difference in getting a SSN. Eeryone seems to get it equally easily, and we have the same "Valid for work only with DHS Authorization" printed on the SS card.

My husband went out of his way to get the JFK EAD. We paid $300 more, and had 17-hour wait in JFK just to get that stamp (then he had to take flight to LA and then to Fresno). Connection flights are hard, we chatted with an agent online to get it scheduled (makemytrip.com).

It was really hard to get a job, even temp agencies are slow to give work but finally after weeks of searching he got a job as cashier in a gas station (far cry from the auditing and accounting work he did in India!). Anyway, the over $2,000 he earned for that one month of work (before the 90-day work permission expired) made up for the trouble and expense of getting the temp EAD! yes.gif good.gif

Often they tell you of the interview date at least a month beforehand, often 1.5 - 2 months before, so I would not worry about it. Hopefully she will receive Packet 3 and return it before she leaves to USA for the visit. If not, she can always prepare Packet 3 before she leaves and have a relative send it in (or hand it over herself at the Consulate if she knows they received her case).

Our interview was scheduled over 2 months after our NOA2, and Chennai is typically the fastest Indian Consulate. I would make a wild guess that the interview might not be until January, but maybe Delhi applicants can offer more insight here.

Like Rob and Jin said, it is risky. The authorities at POE will know that she applied for a fiancee visa, they may deny entry thinking she will just stay on in USA. Is it a multiple entry tourist visa, because you said she used it once already? I think the tourist visa will be valid until the K1 visa is granted.

Since you just received the NOA2, the interview will probably not be scheduled until December or later; certainly not in November. so I would not worry about that.

If she decides to go ahead and make the visit in November, it might be good if she brings along paperwork to show at the POE in case she has a problem of questioning, paperwork showing that she has definite plans to return to India (letter from employer about vacation time and when she is returning to work, or anything showing that she has to return to pay bills, etc..

Many people try applying for tourist visas while their K1/K3 visa applications are pending, but they are usually denied. So we don't have much knowledge of what it is like visiting on a tourist visa while other visa applications are pending. I hope others with experience will answer!

It is no problem. We had a slight address difference too, and all the paperwork came fine. yes.gif

If you have any doubt (if the mail will arrive without the landmark included), you can always write an email to the Consulate giving the full address and requesting that Packet 4 be sent to you there. But only write after you know your case has arrived tat the Consulate, otherwise it will just confuse them

For my husband's Chennai Consulate interview, I sent in a copy of all pages of my passport, and also my original birth certificate. yes.gif

Welcome to the world of visa applications! Yep, as others suggested, have her print it up from Internet and mail to you after filling out and signing it. I had my fiance send like 10 signed copies, a few not filled out, in case I found mistakes or we changed things in filling it out before finally submitting the paperwork (which we did). My hubby used his village address on the I-129F too, for the same reasons. However on the G-325A we were honest and listed the addresses he was at for the last 5 years, which included Hyderabad where he resided for 2 years before coming here to USA. He tried but could not get a police certificate from Hyderabad because he had no proof of residence (bank account was in a town near his village, he had no lease agreement, voting card, ration card etc., all registered in the village). He just got the village Police certificate and the passport office one from Visakhapatnam. No one ever asked for the Hyderabad PCC, there wasn't a mention of it at all.

So even if you include her schooling address, I would not worry about it.

Others have had some problem with this, because it is a red flag for immigrating only for a green card (which in your case is ridiculous, as you broke it off, not the USC). One case I can think of had delays both at the NVC level and at the Consulate level. However such cases have been approved, so all you can do is make a strong case and send in the application!

Hopefully others with direct experience or more info, will share their comments. whistling.gif

I understand the off-shore storage facility is a sunken barge in the middle of the Atlantic ocean. Every couple of months they send divers down to retrieve documents they may need. Some of the documents are hard to find because it is so dark down there.

It is actually better to get the documents near to the interview, like a month or so before the interview, but due to your plan to go to India and be with your fiancee, I say yes, go ahead and prepare all the paperwork now. However remember that things can get delayed so it might be the interview won't be scheduled till after your four month trip! Timings are tricky when it comes to this Visa Journey!! unsure.gif

The I-134 is the only thing you need notarized I think. Since you will be in India four months they might think you will not be earning enough money, I would suggest getting a co-sponsor just in case. Make sure you have the W2s and 1099s for your tax years, they are always picky about that. Free tax transcripts from the IRS are the best. If you order now and they don't come before your trip, your father can always send them to India once they come. Get the statement from the bank and have your father write up a statement too. Below is an example of the employment letter.

The documents dated before the NOA2 is not a big deal but as I said, generally they like dates closer to the interview. Anyway they will understand as you will be living in India. You can always print up current bank statements from India itself, if you have your account online.

I would think the official name in the passport might be a problem, as it is different than the other paperwork. If you can manage to change it that would be best. For now, on the paperwork hopefully you put the alternate spelling on the line that asks for other names you are known by.

I agree that the address is not a big deal. My husband was living in Hyderabad for two years, including during the entire visa process, and his passport showed his home village address. He listed the Hyd address as most recent and his passport with visa stamp was also sent there. No one said anything about the address on passport being different. no0pb.gif

One note, better confirm that you will be issued the new passport (with correct name) fast before sending it in. You don't want that passport not ready when your interview rolls around!! (It took my hubby eight months to change the name in his passport, in Visakhapatnam.)

The others are right about India, there have been a LOT more problems for the people with engagement ceremonies. Many people file for K1 visa who have no solid evidence whatsoever that they are engaged, and they get approved fine. yes.gif (Same with my hubby and me, we just decided ourselves to get married and there was no engagement ceremony, rings or anything no0pb.gif) Sometimes if there are pictures of rings and a ceremony, the Consulates in India demand a guest list with everyone's name, address and phone numbers, and names and addresses of vendors who provided catering, the rings, etc. What a headache! Where there was no engagement ceremony, they can't ask all that and they can't be suspicious it was really a wedding instead of engagement.

Hi Kym, what a NIGHTMARE! The fact is, I have heard of several cases being "lost". At least now you have a new petition in, and a NOA1 for it. Hopefully you will get the approval in normal processing time (within the next one month, hopefully). Personally, I don't see much help in further pursuing the injustice of the last case.

Because most people with NOA1 from certain dates get approved, while a few are left hanging sooo long. I always imagined a stack of files on a slow pokes desk...

Yes address changes are always tricky because they reply saying they noted the address change then we get mails to the old address. Best is to both email and call the Consulate and give them the new address. Certainly DON'T try changing the address with the USCIS or NVC because that would be useless. wacko.gif

Hopefully you will know someone at the old address so they can either redirect the package or let you know it has arrived, just in case. yes.gif

Printing out the e-tickets is a good idea, also the letter from the employer is excellent. good.gif Re-send copies of the stamps in your passport and photos of you two together. Send the bank statements from Colombia. Then write a cover letter detailing what dates you were in Columbia and how you met at work and spent time together. I feel your pain! The SAME thing happened to me. yes.gif I was living in India for years and that's how I met my fiance. Then I got the same RFE to submit evidence of meeting! I mean, how ridiculous is that!

What they want is proof that you were in the same country at the same time as he was. You don't need to prove it with both names on paperwork, just that you were there when he was. So dig through any paperwork you have that proves you were in Bogata Jan - July 2008.

1. Don't send copies of the tickets for your first trip together, they are out of the timeframe asked for. At this point, they are only interested in Jan-July 2008. (Proof of ongoing relationship is needed at the Consulate interview.)

2. Yes, have the employer write a letter verifying that you were working there at the same dates.

3. Yes, definitely submit flight info for your trip arriving Jan 2008 to July 2008. THAT IS THE MAIN THING THEY WANT!

I sent in flight details of me leaving India (didn't have entering due to it being YEARS previously!), visa extensions, a hotel receipt with my name and hotel address in India, and a few encashment certificates of traveller's checks (if you have a bank account there and can prove you were there to withdraw money, or used your ATM card during Jan-July in Botaga, send in that proof). Remember, his name doesn't have to be there, just your name and address in Bogata and dated between Jan-July 2008. I also sent a statement giving dates I was living in India and dates of us meeting.

After sending in all the evidence, I was approved two weeks later. GOOD LUCK to you both for a speedy approval!! good.gif
