I am assuming you already submitted the form.  If yes, then don't stress out too much over this oversight.  People often make errors when submitting the G-325A.

 

When your fiancé goes for the interview and if the IO asks her to confirm any info relating to the G-325A then it"s an opportunity to correct the oversight.  She can also walk with an updated form that includes the missing address.

 

If however you haven't yet sent in the form...please send it with the actual information with all the relevant addresses...don't fudge information.  Ask you fiancé to look for any old mail, past tax returns or school transcripts/correspondence info that may show the address that she can't remember.  That's how I found one of mine!

I have seen some posts where members have mentioned to send I-864 also along with this packet. Is that advisable as I have not seen in any of the guide.

 

 

 

No you wouldn't send the I-864 (AOS - Affidavit of Support) at the I-130 stage. 

 

Once your I-130 has been approved, your case will be sent to the NVC (National Visa Center). 

The NVC will contact you to pay the AOS fee and you can then submit the I-864 at that time.

The NVC will also ask you to pay the IV packet fee and submit the DS-230 form

 

Read up on what happens at the NVC stage and also look up your wife's embassy in India that you will designate for consular processing and read up on their info.

Hello all, its my first post and I am new to this website, joined today only.

 

I just got my citizenship 2 days ago and struggling to get the proper documentation in order to file for the Spouse Visa.

 

Hello, It seems to me like the form available as a guide on this link http://www.visajourn...-G-325A-aos.pdf is not filled in the right way. Please let me know if I am wrong.

 

The last block on the 1st page - Applicant: Print your name and Alien Registration Number in the box outlined by heavy border below

The last name should be Smith instead of Doally. Am I correct?

 

Also, i am confused, is this form is supposed to be filled by both of us. I meant, my wife is in India and one form is required to be filled by her with her information and she needs to sign it and then again, I need to fill the same form with her information and sign it and then send along with the I-130 packet.

 

Please also let me know if I can send any other documents beforehand to speed up the process.

To answer your question - yes the last name should have read Smith instead of Doally at the bottom of the first page.

 

You (petitioner) and your wife (beneficiary) must each complete a G-325A and both should be included when sending the I-130. 

Your G-325A is based on information relative to you and your wife's G-325A would indicate the proper information pertinent to her. 

Ensure you sign/date your G-325 and your wife will need to sign/date hers and have it sent back to you.

 

When my husband submitted the I-130 and our G-325A forms we checked the box OTHER(Specify) and put I-130 instead of what the sample VJ form has checked off.

 

I would highly suggest sending in all the required supporting documents together with I-130, at the same time, to minimize the need for an RFE (request for evidence).  Take your time when filling out the forms, review all the supporting evidence you need, and have a trusted friend or relative review everything before you mail the package. 

 

There are guides on VJ on how to complete the I-130 for a spouse so take a look at those and feel free to ask specific questions if you cannot find the answer on VJ.  Here is one that may be helpful for you:

To answer your questions:

 

The I-864 is required when your I-130 is approved and has been forwarded to the NVC for processing.  This is referred to as AOS package. 

Your USC husband is the one who will be required to complete the I-864 and submit the required supporting documents.

 

I-765 is not required for you as you will going the consular processing route like myself.

 

DS-230 has been replaced by the DS-260.  This is submitted online and you can only access the form once the NVC gives you a case number and an Invoice I.D. number.

 

DS-261 is the Choice of Address & Agent form which replaced the DS-3032.

 

Optin for EP - Electronic Processing which us Canucks will use since we will be processing via the Montreal US Consulate.

The problem is I can not travel overseas because of health reasons. And I don't know when I will be able to. It might be years. It is regrettable that we spent so much time and money on the process, but it is the least of my concerns now.

We haven't contacted the embassy yet, but my idea was to stop by with the passport and return the Visa and explain the situation.

 

I am sorry to hear this and I wish you a speedy recovery.  Health does come first no matter what.

Yes it's a good idea to go back to the embassy in person to explain and have the visa rescinded/voided.

Something came up and we won't be able to leave to the US within a year or even longer.
My Visa application was approved and we were supposed to leave within a year.
How do I officially let the USCIS know about our situation and cancel the VISA and greencard? I don't just want to let it expire, that won't look good on our part.

I don't know where you are currently living but I wouldn't be so quick to give up an approved immigrant visa after all the time and money spent! huh.png

 

If you can, why don't just you travel to the US so that you complete the POE process and validate the visa?  You have six months from the date of issue of the visa to enter the US.

Ensure that you have a mailing address (maybe a family/good friend) so that your physical green card will be sent there and you can arrange to re-cuperate it.  Once you are ready to re-enter the US at least you'll have a valid green card. 

You may get some grief about having been outside of the US for an extended period of time (over 6 months) however usually with sufficient proof of your circumstances most border guards will let you re-enter.

I'm currently filling out the I-130. It asks "Address in the United States where your relative intends to live." 

We currently don't have a place to live. 
He lives with his parents, and when our Visa is approved we plan on moving some where else: To be decided. 

With that said, 
do I put his parents address ( where he lives) 
or put n/a


Any other suggestions?







 

My husband currently lives with his mom so we put that address on the I-130 and will maintain it throughout the process.  This way the green card and SSN card would go to a known address on file.  If you get another US address prior to your eventual POE then you could update it.

Hi Everyone, My husband and I were married in January 2013 in Ecuador.  We are planning to move to the US next year, in 2014. He has a multiple entry tourist visa (b1/b2 visa). We are trying to figure out if it will be better to go to the US on his tourist visa and then apply for residency or apply for residency while still living in Ecuador. Also, he lived in the US for 7 years legally on a student visa and then a work visa, but then he came back to Ecuador to work for his family's company. Thanks for your help! 

 

Here is my two cents:

 

As the previous poster said, if your husband enters the US on the B1/B2 visa as a visitor with the INTENT to immigrate at the time of entry, that is considered visa fraud.  People do this all the time and get away with it but it doesn't make it right or legal though.

 

If your spouse decides to file the AOS in the US and USCIS determines that your spouse committed visa fraud, the AOS would be denied and your husband would require a waiver of inadmissibility to overcome the denial - not the easiest thing to get.

 

The safer course of action would be for you to petition for your husband via consular processing. 

N.B. If you intend to remain in Ecuador with your spouse throughout the process, you need to prove domicile in the US - that you intend to live in the US with your spouse and prove that you will/have established domicile.

I don't see the lack of name change as an issue.  All my travel documents are in my maiden name even though I am married and in all my crossings to the US or elsewhere I have never been asked about that. 

 

Your wife should declare her marital status in relation to you if they ask her, otherwise she doesn't need to offer any info.

In 2011 my husband did not make enough money due to an injury he sustained and was unable to work. however he DID file his taxes.

 

Will my husband need a joint sponsor even though his income for 2013 and 2012, is over the 125% poverty guideline?

Your husband would not need a joint sponsor.  He is only required to prove that his current income is above the 125% poverty guideline. 

It's always a good idea to include copies of recent paystubs and/or a letter of employment confirming his position and salary. 

Don't forget to have your husband request the IRS transcrîpts for the past 3 tax filing years - you can do this online at

Ok I'm going to try to make this as clear as possible:

 

You will need to file three I-130 petitions:

 

Your wife.  You will submit a G-325A that is based on YOUR information and you'll sign it.  You will also need your wife to complete and sign a G-325A based on HER information. 

Your stepchildren will each need their own I-130.  Submit the required documentation based on the fact that you are their stepfather.

It is perfectly legal for your fiancé to enter the US, get married to you and then RETURN to her home country.  The fraud occurs when the person intentionally enters the US with the plan to get married, not return to their home country and instead file for AOS...

 

We had planned our wedding in NYC for months.  I entered the US as a visitor a couple of months prior to the wedding day and got married two days before Hurricane Sandy hit.  I was stuck in the US for two unplanned weeks due to flooding and cancelled flights.  But I made it a point to get on the first available flight back to Canada.  

 

So you can either get married in the US or Columbia and then file for the I-130 and go through the consular process.  Her ability to get a tourist visa while the process is pending is definitely not guaranteed so be prepared to have your wife wait out the entire process in Columbia.

Hello!

 

My wife and I recently sent the I-130 petition for relative form to Chicago for processing. We received the receipt number a few days ago and I can see that it is currently at the "Initial Review" stage. Very excited!

 

Only problem is though, I have been reading up the info here and under the "Minuses" section it reads: "The applicant will most likely not be able to enter the US while their IR1-CR-1 Visa is being processed."

 

This is slightly worrying, as we are both due to fly to the USA for Christmas to spend the week with her family and now i'm worried that I may not be allowed into the country because we have already started the process.

 

Can anyone clarify this for me please or advise what has happened to them in the past? Should I even be worried? Is there anything I can do to make sure that I dont have a problem at immigration?

Hi there,

 

 

We filed the I-130 in late June 2013 and I travelled to the US in August to visit and had no issues.  I have a flight planned to the US in a couple of weeks to visit for two weeks during the holidays. 

 

We know that it is completely at the discretion of the office you get at the POE whether to let you in or not.  Don't offer information if not asked but answer all questions honestly and concisely. 

 

I travel with a solid packet of proof that I reside in Canada and that I have solid ties/reasons to return to Canada.  So far I have never been asked for any documentation but it is important to have it on you just in case.  Things like paystubs for the past few months, recent bills in your name with your current country address, bank/credit card statements, proof of ongoing employment/studies/residence etc...

 

I also carry with me an entire copy of our I-130 petition to show that we chose to go the route of consular processing.

Still trying to be patient... but it bothers me that there's no rhyme or reason to this process.  People who have professed of 'potential hiccups' in their petitions are seemingly getting approved on the fast track.  It starts wearing on you after 4 or so months - especially with approval flying around after your NOA1 date!
 
 
That's what I thought, too.  Most of my friends and relatives can't believe its taking this long to 'check us out'.  They know who I am since I cross so often, and know everything about my fiance - he is government employed!  What's the hold up?!?!  But I guess no preferential treatment for any one country (except those in countries with imminent danger) is probably the best way to keep things fair.  I just choose not to like it :P lol...







So what you're saying is we all need to move to third world crisis Countries? Lmao I'm in! I want to know why some people get expedited. Can "I miss him Enough to kill someone" be a good reason? I want mine expedited, I'll pay lol

This I can handle. It's the not knowing, not being able to plan, not knowing when I need to start getting my stuff together. It's impossible when you don't have an answer. My apartment lease is due in October, I don't want to resign it and then have to sublet in november or something silly. it's too much. Is that for a Tier 2/ISO call back? Don't let them schedule the call back for 3-5 days. Ask him to call them, and when they make that offer he should just say that he'll hold. Once they transfer him the system there has a call back function that takes a few hours or so, depending on wait time. No reason to wait 3-5 days.

 

Thanks, we really don't know I thank god for places like visa journey because i'd go off the deepend if it weren't for all of yous!! :D I let my Fiance know and he's going to try calling back again today. 

I would suggest to make an appointment using the InfoPass and talk to someone at your local USCIS office. Its passed their average 5 month processing time, they "SHOULD" be able to help you out or at least give you some clues where you at. Usually when you call them or ask them about your status and if you have been waiting less then 5 months they will tell you to wait 5 months. If you call ask to speak with tier 2 representative, they will give you more information. Good luck smile.png

I'm with all of you guys.  So frustrating.  The part that makes me the angriest is that they require so much "intent of proof to marry," but yet you can't even plan the wedding because you never know when you will get approved.
 
I was assured by so many people that since my fiancé is European things would move faster.  After looking at the processing times when I filed in January (NOA1 Feb 1), I thought September 27 would be adequate time for the wedding.  My parents have planned a black-tie event in Texas, and many of my fiancé's friends and family have booked flights.  Now it looks as though we won't make it on time for the visa...I guess he can fly in anyway on a tourist visa and we can hoodwink the guests into thinking the judge married us privately?  So frustrating.... Try to follow the rules, for someone I've been with for 3 years, seen in person a good 12+ times, only to get slapped in the face.  I honestly feel ripped off by my own country if that makes any sense.    
 
Sorry I just needed to get that off my chest.

I hear you... our NOA1 date is 5weeks after yours and I'm antsy already.  I kind of feel like... "damn... I'm right here in Canada!  The US is RIGHT THERE"  Maybe hoping that our case would be 'easy' because of the fact the government has scanned our passports together 40-50 times in the last 2.5yrs.  They know we travel together.  Gah.  Keep the faith, hun... it could be any day now for all of us.

I'm a January 3rd filer transferred to texas with a weird status showing on my case .... I called them and requested an inquiry two weeks ago. Upon calling them after two weeks, i was asked to call back in two more weeks again. Keep faith ... Many people haven't heard anything yet

I'm seeing people from march and april getting their approvals and i'm still waiting. this is starting to drive me bonkers. My fiance and I got our NOA1 in January on the 25. We were transferred to texas on June 21 and everyone in or around that time seem to be getting their RFE's or Approvals. My fiance isn't working today so he is calling to see whats up but REALLY? why are they processing so far ahead and theres still people from january waiting? I don't anticipate any problems seeing as how i've gone over our original package several times, and don't see anything we've missed or provided any less proof than others who have been approved. I just want to move and start my life already :( thank goodness I'm visiting next week for our birthdays because i'm going crazy by myself over here :/

Get the docs you need from him and GET HOME. I was in the same sitch as you, visiting my fiance in LA when the NOA2 came through. Before I knew it, things started happening REALLY fast, and I had my Packet 4 on a Thursday and there was an interview date available on the following Tuesday. Unfortunately, I was still in LA and no time to get back and have the medical in time. Luckily there was a spot a week later (and then not another one for a few weeks), so I booked the 1-week later slot, booked the medical for a couple days before and got a flight home. It was crazy rushed and stressful (especially with packing my stuff and selling my car etc., cuz I POEd 3 hours after receiving my passport back with visa), and in retrospect, I should have gone home as soon as I got my case number from NVC.

 

 

Well nothing's come yet for him or I, and I'll be heading home soon enough anyway. I have yet to receive anything from them. My parents check my mail for me, and I know it's all time sensitive, but at this point do I need to mail anything else in? Or does it all come with me?

Thanks to my last batch of helpers I have determined my petition has been and gone from Texas to the nvc and is  now enroute to Vancouver. My question is thus:

WHAT DO I DO??? Lol. I'm at my fiances place and we haven't received a noa2 hard copy I would like to start the paperwork now while I'm here with him so we have 2 minds set on ensuring all the l's are dotted and t's are crossed.  I have my new case number for Vancouver consulate and am not sure what to do..

 

Where do I start? Can I book medical and appointments yet? What paperwork from my fiance do I need to take home. I know I need the whole package from before, New intent to marry letters and affidavits of support. After that I am lost.

K-1 Fiance(e) Visa Case Filing and Progress Reportsinterview documents

Hello All!

 I booked my interview for October 9th, 2013 and I'm so excited!!! 

I need to know what order to put all my documents in. I have my copy of my first packet, and everything ready for the interview, I also need to know how to put it together. I know the initial petition was not allowed to be binded, stapled or anything else, what about this packet? 

 

Right now i have everything in a 3 ring binder in clear sleeves, all pages visible (front to back) for my benefit, but when i take it to the interview, how should it be presented?

Congratulations! I'll be doing the same later this month so thanks for the insight. I have been pretty spaztastic ever since getting the interview date so it's awesome to hear about the experience before hand.I hope you get your visa back right away!

Hello all!!

 

This morning I finally got my approval for our visa! I'm so happy and excited and I cannot wait to move home to be with my man! Now for any of you who are going through vancouver any time in the next little while, let me tell you how this happened!!

 

First, the medical with Dr. Cheema was a very pleasant appointment, and probably the most comfortable dr's appointment I've ever had. I'm no skinny mini (though not obese) so i get told to lose a little bit 90% of the time. Dr. Cheema, on the other hand, told me i was strong and healthy and had nothing to worry about. His nurse weighed me and checked my height, he took my blood pressure, checked my throat, asked me a bunch of personal questions (drugs history, medical history, std check and all that fun stuff), then he has to check the girly bits but don't be afraid, he brought in his nurse and its just the upper outer pelvic area, its not a full on gyno-related check. 

 

Then i was sent down the street to get my blood taken and xray done. I went upstairs first and got the blood work done which is a single vile and then downstairs to get the xray. they were very quick and efficient and i was out of there in 15 minutes (i messed up the first xray with a sneeze that made my innards fuzzy lmao!!)

 

For your medical make sure you bring your letter with the VAC number on it, your pictures, and vaccinations, you also need your health card (from whichever province you're from). 

 

 

Now for the interview. 

 

I was freaking out, literally, and I got there REALLY early despite my appointment being at 10. big mistake. They now longer allow you to wait in line that long, so you get sent away and are asked to come back 15-20 minutes ahead of your scheduled appointment. Do not arrive an hour and a half early or you will be sitting your butt in the starbucks like i did! 

 

So once in line they send you through security, and confiscate any and all electronic items and then send you up stairs to go through a metal detector. Do not being birthday cards that sing, they will make you gut them, my hoops and yoyo card is no longer a singing card. i had to rip out the voice box to be permitted into the building, and go through security a second time. 

 

After that they send you up to the 20th floor and over to window B, you flip a switch and a short time later they come with a piece of paper and ask you to take out your documents in order (passport, pictures, ds-156 x2, ds-156k, police certificates, marriage and divorce certs, ds-230 and medical) and they give you a number and send you back to the waiting room. 

 

when your number is called you head over to the window and the person there makes you sit down as they go over your file, and then call you up by name. When you finally get up there, it's not so scary.

they take your fingerprints and then start in on the questioning;

 

How did you meet your fiance?

How often do you see eachother?

what do you do for a living?

what does he do for a living?

Where does he live?

Do your parents like him?"

Does his parents like you?

 

Congratulations, I've approved this visa, please sign the oath stating everything you have written and said today is true and correct. Go back to window B

 

She explains about loomis and sends you on your way with another hearty congrats!

When I left Vancouver last time, a few years ago, I actually cleared US customs at the Vancouver Airport. Here is a list of airports that do 'pre clearances', and there is a phone number  you can call.
 
Winnipeg is at the bottom of the Canadian section.

 I hope you're not flying into O'Hare, LaGuardia , or JFK for your POE. POE is the first place you land in the US and with just a 45 minute layover that seems kinda risky especially considering you have to go through immigration and the lines..... Are you able to make changes to your ticket and maybe take a later flight from there that will for sure give you enough time? Hope everything turns out well in your travels.
 


So I don't go through it at customs in canada leaving then?

Okay, okay, okay So i'm reading about people who are going through their POE in between flights? I'm from Winnipeg, and I'm flying out of winnipeg into the states. Do I go through my POE when I leave winnipeg or do I go through it in the states when I land? I've booked my flight and I only have a 45 minute layover.

I am so happy for all the January filers that have been approved.

I'd like to ask for some advice on what to do at this point.Next week it will be 2 months since my RFE was sent. I still have not reveived it. I don't understand what is going on.

I have an info pass on the 3rd (a day after the date they told me to wait) . Can anyone tell me if I have any hope of receiving a hard copy there ?
We have started considering just getting married and starting a whole new process




I cannot believe it took that long jsut to get you an RFE! Glad it was easy to take care of, good luck in the rest of your process!

Congrats to everyone else who has made it this far, 

 

I have a question about the medical and interview for those who are going through that now.

 

I just received packet 3 finally and am getting ready to book my medical, how close should it be to my interview and how long does the medical take, is it a 1 visit thing? or do i have to go back the next day? do they send me home with results or forward them directly to the consulate?
