How do I get to check it out?

First thing is, get your receipt number (or case number). You can find it online on the back of the check you used to pay for the filing of the application when it's been cashed. If you can't do that, wait for the NOA1 in the mail. It'll be there.

There are 3 ways to check for updates.

1. By searching online: https://egov.uscis.g.../jsps/index.jsp - you'll just need the receipt number.

2. By logging into your account. To register on the USCIS site: https://egov.uscis.g...ntextType=CU_EN

3. By e-mail (once you have registered and clicked on the "E-mail on" button.

Options 1 and 3 are good if you only wish to check for status update. Option number 2 shows the mysterious touches (somebody worked on your case but we can't be sure what has been done).

Option 2 in detail:

Log into your account: https://egov.uscis.g.../jsps/login.jsp

It'll show a table:

Receipt Number | E-mail | Last Updated | (mm/dd/yyyy) | Form # |Form Title

Take a look at the date in the "last updated" box. Then go to "Receipt Number" and check the message. Is it different from the last update you got?

Yes: smile.gif Great! You got an update that changes the status of your case.
No: sad.gif Aw. They have just worked on your case...

Please note that the date on the update notices don't change. For example, if you got a message saying your petition was approved on JUNE 20, 2006, that date will never change. The ones that might change are the ones you get to see at the chart when you log into the account.

Do I really need to check the mysterious touches?
Not at all. Only obsessive people like me, for example, will do it. I find it comforting to know that someone's been working on my case smile.gif

Also, you only get to check the status before your petition is fowarded to the NVC...

The civil surgeon should give you an I-693A documenting the fact that your vaccinations are complete (either they were completed when you had your medical or you had them completed stateside). You should submit this with your AOS package.

im sorry i dont have what i sent, but it was VERY short.. maybe 3 sentences just explaining to them our dilemma, giving case numbers, dates etc. and asking for assistance.

 

My senator sent me a letter stating that the embassy has no timeframe for AP and that he was assured it would be completed in a timely manner HOWEVER a few days later I received word from embassy to have my stepson bring his passport in to get the visa issued.. 

so it may seem like it wont help, but it will get somebody moving if your case has just been forgotten like i believe mine was

I can't make a guarantee, but that's all we had to do. Our's was about to expire in a month too. I was worried just like you are now, so I called and told them it was about to expire and their reply was pretty much, "okay, we'll extend it." It really was that easy. Just from what I've seen, the biggest issue to be concerned about in Manila is finances.  If the finances are in order then people usually do okay.  The interview isn't usually that bad.  I wasn't there either and this is what my fiancee (now wife) experienced.

 

The questions asked were:
Who is the petitioner?
How did you meet?
When did you first meet?
When did you meet in person?
When was the last time you saw him?

Then she looked at our pictures and said we're approved.

That's what I'm worried about the paperwork.
At least point we can only try and hope for the best. Worst case we get stuck in AP but even then if all is on the table what else can be said or done but to wait. This whole visa journey is all a wait. When we initially filed the paperwork I knew about his baby momma cause that's the one he told me about. His daughter is listed on the i129f She lives with him.
I would figure if he wanted to hide something the daughter would have been more of a reasonable situation versus the previous marriage

 

All I have to add is that being stuck in AP is definitely not the worst case.  This could get a lot worse in the future.  Just be very sure of what you're doing.

Yes. That is why I am excited to go and visit her for 3 weeks maybe more if Immigration lets me. 

 

Getting your visa extended past 21 days will be really easy.  You can probably get it taken care of at the airport, if I remember correctly.

 

ETA:  As others have said, take pictures of you and your fiancee together.  And keep receipts.  You'll want these later.

I've a casual friend that I was chatting with at a site other than VJ and I commented that the couple appeared very nice together.

 

I was surprised to hear: "Yes, we are waiting for a decision by USCIS, as we forgot to file some papers, it's been over two years now..."

 

I don't want to be the harbinger of bad news but I've seen men dupe Filipinas by saying that K-1's had been filed when clearly they had not been at all.  I wonder if this is such a case.

 

Once (a different occasion about a year ago) I simply said to a Filipina; "Have you made a letter that you signed that stated you intend to marry the US citizen (your fiancee) and sent that to your fiancee?"  The answer was "no."  But she had been told that the K1 had been started well over a year ago.  It was my sad duty to inform her that she was clearly being duped.  (And she was).

 

I wonder if this is a similar case.

 

Has anyone heard of a K-1 that took over two years?

 

I think your suspicions are probably correct.  If there had simply been missing papers; responding to the RFE would have taken care of that and I can't imagine it taking two years.

 

BTW, like you, this isn't the first time I've seen this happen.

Well I think it was a good question and the answers here are all based on conjecture of course. Mentioning someone's country is not an insult against that person personally, as it seems some are taking it. In my husband's case, he tried for a student visa to the U.S. and was told no way by the visa officer at the embassy (this was before we married and filed a petition). She told him he came from a country that was causing the U.S. too much trouble and there was no way she was going to give him a visa. So if you think that they don't have prejudice against certain countries while looking at your petition, think again.

Hello Everyone, I am getting ready to return to Russia in a few weeks, and when I return I will be filing the documentation for a K-1. I have 2 questions:

1) Should I include her Patronymic Name as her middle name on the forms?

2) I have an extensive criminal record. None of the crimes I committed are listed in the IMBRA Disclosure guidelines, nonetheless, I do have a record. Does anyone have any suggestions how I can defuse any problems with our petition because of these past convictions? The offenses are over 20 years old. They range from not-to-serious to pretty serious.

1) Enter her name exactly as it is shown on her Passport. If she has a middle name, it would be listed that way on her Passport.

Really!!!! I don't recall you being a consular looking over my evidence in Morocco and saying we cannot accept this as evidence, which they clearly DID. So yes, I do know what I am saying when it comes to calling cards and MOROCCO and others here to have had their calling card evidence accepted as well. Where do you think I got the idea from, looking at the UK consulate and seeing what others did for my case in Morocco.

So basically, you are advising every single person here that may read this, THAT PHONE CARDS are not permissible at their own consulate because UK consulate didn't accept your. THAT'S REALLY GOOD ADVICE

I have to agree with you, I used calling cards all the time with my cell phone and the calls registered on the itemized phone record. The Casa consulate does accept that as proof of communication to support a bonafide relationship. As anyone that went through Casa can attest :wacko: they are in a league of their own, you have to of gone through the process to get a true appreciation.

She can file for a K-1 visa as long as it has been over two years since the last approval. USCIS will send you a letter informing you that you are the second person she has petitioned to bring to the US. If it has not been more than two years then she will have to file a waiver. The question of what happened to the other gentleman may still arise as she agreed to marry him within 90 days and did not do so. A reminder to her every US citizen is only allowed two petitions in their lifetime for K-1 visas.

I just moved to California from Vermont so I can finish my final semester of university. I just went online to file my change of address on the USCIS website, and one of the sections has me stumped. The form asks whether I am filing the case for myself or someone else, and I'm not sure of the answer! Am I filing my case for my fiance or for myself?

Difference between NOID and NOIR, NOID you can reapply but NOIR you can no longer apply for a visa as stated above because of fraud. In the case of NOIR you are suppose to get an opportunity to provide further evidence to overcome the CO findings. I have seen both NOID and NOIR be overcome and case forwarded to NVC for a second interview. Get some legal counseling...

Casa average is 6-8 week notice before the interview, you will have a bit of time before the interview but under no circumstance buy return tickets for him until he has visa in hand.

There is only one way to find out if he will be approved and that is to apply for the petition. The advice given here is very accurate but when a person is in love and determined they will do as they wish. Unfortunately, being confident and having money does not guarantee anything with this process when dealing with Casa consulate. I have seen countless of married couples be denied after having met all the requirements much less a K-1 visa. For those of us that have come before you all I can say is prepare him for what he will experience and much of the preparing only comes from the shared experiences from members of this site. Don't take anything personal just extract what you will need to set him up for success. As I have told my 20 and 22 year olds, sometimes we have no clue or are aware that we don't know something.

We wish everyone here luck, take what you really need from all this advice, even if you don't know.

I called USCIS to ask if my fiance and I are married in Puerto Rico through the K1 visa would a marriage certificate issued by Puerto Rico be valid. The answer was yes so long as its in English. My question is if you live in Puerto Rico, got married with a beneficiary via the K1 and have submitted the AOS, was the certificate issued from Puerto Rico accepted?

To me traveling to and from Puerto Rico is moot since persons livig in Puerto Rico can file petitions. This is just to bring some validity that marriage and travel to Puerto Rico is still within the perameters for this visa journey. Any comment are appreciated.

All documents issued in PR by the courts are done in Spanish, you would have to get it translated and yes it is accepted for the AOS now I cannot tell you how easy it will be to get your marriage certificate but everything I ever did with government agencies in PR was very slow. The recommendation to marry at home and honeymoon there is ideal.

You do not need a Lawyer a K-1,can go from NOA1 to the covsulate, it does stop at NVC momentarily to be processed and get a interview date assigned but if the interview date waiting list is too long they just forward it to the consulate and let them contact you with setting up an interview date this is not uncommon. Morocco is setting interview dates two months out. The first two weeks of March they will set April's dates.

You can always track the petition by the NOA1 tracking number.

You have to count the children if they are under 21 even if they do no live with you. Count your fiance, the children and you then look on the chart under to determine how much you have to make. If it is over $20,000 which I am sure it is then you need a co-sponsor.

We found that we couldn't just book online for Nigeria, without him having the credit card to show at the airport. I have heard a few that were able to, but I think they had to go in advance to the airport here and show the card there. We used AMR Travel out of Houston, their number is 713-952-4600. I know another lady on here used Adams Travel, they deal with Nigeria a lot too.

The RFE we received was for a Divorce decree that was absolutely in the original submission. I'm positive they lost the decree.

I think we were alot more careful to seperate everything with clear folders when we submitted our AOS than I was when I submitted the Original petition.

Good news was that the RFE really only set us back about 2 weeks.

As a forward I will note that although I know anyone is subject to a mistake, I am an EXTREMELY thorough person. I read every word of the guides here and went through my petition at least 5 times before sending it in. I was shocked to have received this RFE and thought for sure I must have missed something stupid but from what I can tell they are asking for something I have already provided...

Here is verbatim what the RFE says in its entirety:

REQUEST FOR EVIDENCE

REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON: It must be established that the petitioner and beneficiary have met and the circumstances of their meeting.

  • Circumstances of Meeting- Submit information regarding the circumstances under which the petitioner and beneficiary met to establish the relationship.

That's ALL. Here is what I submitted with my petition:

  • Paragraph in question 18 explaining that I was in Lebanon in December to visit my fiance and his family.
  • Every copied page of my passport showing my entry/exit stamps into his country at said times. (It is important to note that these were the ONLY stamps in my passport at the time and my fiance has never been to the US before so our pictures together could have ONLY been taken at this time as opposed to any time earlier)
  • Copies of all of my boarding passes to Lebanon from above mentioned trip.
  • Separate, signed letters from both my fiance and I stating that we were together in person at this time.
  • Copies of blood test results (very common in his country for a couple to get these prior to a formal engagement to eliminate incompatability for children, disease etc) with our full names, date, and address of facility showing we were in the same doctor's office at the same time.
  • Six photos of us together including one with us and his mother and one with me and his mother and sister (names of people, dates, and location written on the back of each).

I called my fiance immediately and discussed with him whether they were asking for proof we were together in person within the last two years OR a statement regarding how we met (because both are kind of mentioned in the RFE but as far as I knew, the later was not a requirement of the petition itself, I've always read they just want to make sure you have been in each other's presence within 2 years prior to filing the petition). Since we couldn't make a definite determiniation I called the USCIS customer service number. The first customer service rep. said he had no idea and transferred me to an officer. 45 minutes on hold later I explained calmly and clearly what I received and what was my question. The officer insisted I was not telling her everything the RFE said because it was too vague and said that usually they list exactly what they are requestion. I replied that I agreed the statement was vague which is why I was calling. She continued to insist I was leaving something out and her final word was to make an info pass appointment so someone could see my RFE to know what was being requested (because again she insisted I was leaving something out). Her last words were "Ma'am, I can not help you".... Thanks a lot.. :angry:

Okay, sorry it was so long. I just wanted to answer any questions up front. Should I just resubmit everything I submitted already with a kind letter explaining how we met initially, when we were last together, please see the attached etc etc.. I am just unclear whether they are asking for evidence proving we have been together within the last two years or requesting an explanation of how we met for the first time.

As I know everyone else here would agree, I miss my fiance SO MUCH and just want this process over with so we can be together again...

Why is it that everytime I turn around I see someone bringing a person over to the states on a K1 visa and then decide not to get married. Although I am a US Citizen I hate the fact that this is happening. People you need to make up your mind before making this commitment and spending all this money. Must be nice to have money to play with. Even more playing with peoples emotions and dreams. I am well aware that everyone does not come over in all honesty, but those that do and left to believe they are loved by the person who petitions for them to only be left in a bad situation. I feel sorry for those that come here have no family or friends only to be told I DONT WANT TO GET MARRIED ANYMORE so I guess you will have to go back. Why could you not figure that out before going that far!! Some people come from really bad living situations and really dont want to go back. There was enough love to start the situation! Geesh I just dont know what to say. Just to clarify I am married to a wonderful man from another country. We have been married for more than a year. I am glad I did not file for him till 7 months later because it made me even more sure to want to be with him and to be with him more in his environment.

I'm glad my marriage and process has worked out, it's been the best deceision of my life! My wife is supportive, motivated, intelligent and just down right great to be with. That said she made her mind up to meet an American ahead of time. I made up my mind that I wanted a family, before we met! I don't feel the need to ask people on a website for their opinions. I'm also not afraid to put my life out there so people can learn from my successes and from my mistakes. I would hope that this could be a place where people who didn't have the "LUCK" (and I believe it is absolutely a matter of Luck to find someone abroad and communicate sufficiently to "KNOW" that it's going to work out.) we had can put themselves out there without reproach.

I say thanks to the people who post their drama, problems as well as their successes. If I was tired of reading something, I wouldn't read it.

Yes. So far eveveryone here that has Philippines as the country of origin are giving good feedback.

If you'll follow the feedback from the couples that worked this out through the Manila Embassy you won't have much problem. The package will ship very quickly and then be there before the earliest possible date you can get an appointment in Manila.

It's easy from here it just happens so fast after all that waiting. Then the money starts going out fast if you're on a budget.

There's several FB support groups too that are soully dedicated to FILAM couples.

Thanks very much for the post. I also just got notice that I'm in "Post-review-processing" status today and see this note when I look up my case on the uscis web site:
"On July 18, 2012, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.
For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."


So once I am able to get the MNL# (which I assume is a tracking number) and I find that the package is at the Manila embassy, then I can schedule the medical and embassy interview - is that right? And I heard you can schedule the medical 3 or 4 days before the embassy interview to avoid 2 flights to Manila - is that your experience also?

This was not my experience.

congratulations,on your noa-2 approval, you need to wait a while until in gets in the system 15 days or more then start calling nvc for your number use that number to have your medical done,
