Thanks jamerican! I appreciate the info....We can get the long form at the Registrar General's Department, right? Do we need to specifially ask for the long form, or if we put it's for a visa, will they just automatically give it to us the way we need it? And is it really only 650J?


sorry to take so long to reply.....DO NOT ORDER THE BC ONLINE....have him go to the RGD office and order it locally...I had an awful experience by ordering it online rush service HA HA HA...and finally after 3 months and my husband going in daily to the local office he finally got it... There is only one BC now and it is the long one so no need to request it. I honestly don't remember how much we paid because of the "rush" and I ordered 6 copies by mistake...I think it was $55us and a lot of stress!!!

If the co-sponsor income was enough...it sounds like it may have not been complete?? I would suggest calling them directly or sending an email so you don't go all the way there (although you will still need to) without the proper info. Good luck. Oh and from what I have seen on previous blue slip interviews, you can request a particular day being that it is your presence that is what they want.

It is what it is....very simple...he went to the interview and for whatever reason they were not convinced that your relationship is valid thus they require you - the petitioner to come for a 2nd interview where they will ask you questions as the validity of your relationship.

Will this cause problems? It says you can have a co-sponsor, Has anyone gone through this? Is it a big hassle for that 3rd person?

It say's as well a passport is required for the interview process. Like I said I do not have one, and she as well does not have one right now. Will both of us HAVE to get one by the time we have our interview?

You should have passports. I don't think you can travel between the US and Canada by plane without one anymore.

I hope you are joking otherwise you will offend many if you say this (including me). Most here would love to have a spouse/fiance that close with travel that cheap.

Many here use a co-sponsor. I think it is pretty straightforward.

I second the CR-1 plan. good.gif

We filed for a K-1. We had the option a year ago to marry and do a CR-1, but at the time I didn't know the difference. We would much rather have gone the CR-1 route. It will save you lots of money and is a one step visa, rather than the 2 step of K-1/K-3 and AOS. A CR-1 holder has residency privileges immediately on entering the US. A K visa holder will have to wait months in 'limbo' for these.

You are close enough to make frequent visits easy and cheap (compared to travel outside of North America).

This is my opinion though. If your number one concern is living together, the K-1 usually gets a person to the US faster, though without residency status (for the first few months).

US consulate will do the police checks for the US and the country you are residing in. You may have to sign some kind of authorization form with packet 3 to allow them to get the UK records.

My file from USCIS went quickly through NVC after approval. I ended up receiving the NOA2 letter only 1-2 days before the NVC letter.

One could have just taken a faster route in the mail.

We had no luck with Infopass either. They told us nothing but the case was pending at our appointment. The next day the senator told me that our case was in background checks. Infopass wouldn't even tell us that the case was in background checks. Maybe they didn't even know, or they just don't care. I suspect the latter.

Can you marry in Canada and file at the consulate for an CR-1 visa. As long as your fiance/spouse has some sort of legal status in Canada, you should be able to. That is much better than the K-1 route. You need to marry and file before you (the USC) leaves Canada. Your spouse may have to wait a little while in Canada, but it is much much quicker than the K-1 route.

Visitor visa may be tough because of 1) the country you are from and 2) the fact that you have a spouse in the US proves you have immigrant intent (also shown if you file a K-3 or CR-1 application).

I would have her file a petition for you, as each day you wait is one more day later for you to get to the US.

Many people take over 6 months for NOA2 (look at us). Most of these people don't hear anything until the petition is approved. Have a look at the 6 months waiting thread. VSC is a little longer than CSC too.

Congressman and Senator inquiries are good to get info. However, I recommend, once you are able, do a service request. That will force VSC to pull your file and hopefully approve it. Sometimes you have to wait 30 days outside of the 6 months to do a service request.

In our case, the senator's inquiry gave us status about the case. Our case was approved the day after a service request was received by CSC. I don't think its coincidence.

FYI, The letters of intent are optional (just something VJ and some lawyers recommend). If the other forms are not correct, you will get an RFE.

She can't leave for years and years and expect to get back in. The general rule is no more than one year away (I think, but it varies, some say 6 months).

So best not to plan to move away from the US until after she gets a US passport (with citizenship after 3 years as a GC holder).

No one cares. I wouldn't bring it up.

However, if she is there illegally now, then the local US consulate may not process her, since you need to have lawful status in a country for the US consulate to process the visa.

It will be similar to a physical you may have had in the past.

It was not a painful or unpleasant experience for my fiance. They will take some blood and you may need a shot or two, depending on your childhood history (my fiance needed none). I think it took her about an hour, but that's including a lot of waiting time for the blood collection. She was actually with a doc for around 30 minutes.

To help yourself, bring any vaccine records you have.

I have heard of some stories in the past where a doc asks about any illegal drug use. Obviously if that is asked, answer safely.

I think the K-3 is a stupid visa (IMO). Either go K-1 or CR-1.
K-3 has no real benefit these days. It only made sense back when CR-1 visas were taking years.

Opps, thought this was the Embassy/Consulate forum, as pictures are usually a part of the consular process to show bona fide relationship. USCIS only cares that you meet once in the 2 years and I don't think pictures are solid proof of that.

About 50% of the time a Service Request will get an idle petition approved (stats from my lawyer - plus it happened to us).
We were approved the day after a service request was received by CSC.

Your son is a US citizen and does not need (or should not even be issued) a visa to enter the US. Register him with the Embassy and get his US passport.

Also, we know she is able to be in the US for up to 180 days, but we are wondering if it renews in the new year, Jan 2010? So if she comes down in June, can she stay until mid-November, go back home for a few weeks, come down for Christmas and stay in the country, and be able to stay until June? Or is it that you cannot come back until 6 months after you leave? Like is it a rolling year where when she comes down in June she couldnt come back until June 2010? We are curious as to how this part of the system works.

We tried a similar thing (my fiance entered by land without a return ticket - the logic being she entered by land, why does she need an airline ticket) and she had some personal possessions. She was honestly planning on leaving and just wanted to wait with me in the US during the process. She was going to leave a lot of personal items at my house.

PM me for the long story, but the short story is she did not get in. She was turned around and this has complicated the whole process. I would not recommend it. You have even more person items than my fiance tried to enter with and you will not likely make it.

I second the 'service request'. I think that helped get us moving at 6 1/2 months. Speak to a real person and do a service request...sometimes you have to wait until you are 30 days out of normal processing (meaning 7 months from NOA1).

A denied tourist visa won't matter. There are several here from high fraud countries (Philippines, Ukraine, etc) that were denied B visas and most have pleasant experiences with the K visa. They may or may not even bring it up at the interview.

You have been waiting about 4 months now, so keep your eye out for the NOA2, as I would expect it any time for you. Some unfortunate people (like me) take 6 months or longer, but the vast majority don't smile.gif

I would visit her in Russia But I will be starting a new job soon and cannot take off and we would really like to have more time together so that when her interview comes we have a strong proof of an ongoing relationship to the consul and we are also suffering by not being together.

Your fiance is from a high fraud country, she will not have a job or apartment either.

My fiance visited me without a job and apartment and she was turned around at a POE from Canada. She was from a friendly country too. She had bad luck with what we later learned was a bad POE.

I advise not visiting during the K-1 process, if there is any slight chance you could be turned around. Others will disagree. I advise this because being turned around at the border will most likely cause your NOA2 processing time from USCIS to be much longer because your case will likely be put in background checks. It will still be approved, but it will probably take months longer. I have about 1/2 dozen examples to prove this (I am a statistical person and don't make things up).

If you fiance had little chance of POE issues (say from a VWP country or had a job, etc), I would say no worries, but coming from a high fraud country, with no job or apartment or ties, I do not recommend it. Just wait for the K-1.

We used a lawyer and it wasn't necessary and I don't recommend them to most people.

However, in your case, you need to consult a lawyer. Call several immigration lawyers in your area and based on the initial impression from the phone calls, meet with a couple of them and them pick one to help you.

Expect the process to take a while. You may need to file waivers, which take time and money. Also, the border issue from Canada where they detained you will probably cause you to undergo more security checks with USCIS. Your NOA2 approval time will be long (most likely).
