I know the wait is hard, but 99 days is not past the deadline. Just be patient, it'll happen. I don't know if sending an e-mail does any good.
You mention that you're flying to the US for 3 months soon. Be aware they might question you heavily, as you have an immigration petition underway. They might think you want to immigrate now. I was flying to Philly for Christmas during my K1, and they questioned (hell, almost interrogated) me as if I was Al-Quaida. Have evidence with you that you intent to come back to UK.

Don't even bother calling USCIS. Getting through the recorder system is a pain enough. And even if you get to talk to a person, they are gonna tell you that they don't have any other info other than your NOA1. They can't look into your file. If you call USICS you're only gonna waste 45 minutes of your life. Just wait. The processing times vary depending on application. You can get it within 20 days or 150 days. It all depends. You have to be patient.

Plz do not hesitate and move for a while to Gdansk believe me you won't regret. There is so many positives in experiencing different culture also you will better understand your future spouse. My husband, boyfriend back then, move to Poland for over a year and it was blessed time for both of us. He was able to find job here so you may consider this option, although it’s not so easy (EU members are preferred). Ask your fiancée to do research on available positions in your field.
As for I-129 F find co- sponsor or AFTER 6 months or more marry her in Poland and file directly at embassy. She will have GC after 3 - 6 months. No AOS in USA. Make sure she will register you in her apartment it will proof your six months residency here.

1-800-375-5283, 1,2,2,4,2,1, then enter your receipt number and press 1 to verify that is correct, press 1 again and wait for representative.
I think the trick is universal the receipt number is the one what taking you to the proper center. Not sure though. Using skype teleconf. we were able together talk to the officer. We've been honest, we have not received rfe, however we worry if ours papers are ok because...(give the reason) or simply I'm worrying. (in our case we were -Jakub submitted only 2 g-325, not 4)
Oh and we called 15.20/ 15.45 EST and always speak to someone. They're living office at 16.00. Good luck.

Usually beside love, the COMUNICATION between two people is the key, and it has just a little to do with language barrier. Clearly your fiance is not able to communicate with you because he DOESN'T listening. He choices not to.

Hi, I'm new here and already packed with info thanks to this site. Thank you everyone for your expertise and willingness to share your knowledge.

I do have a few questions as there are still a few things that are a bit hazy to me about this process.

1. My husband and I got married civilly in the USA when I was there visiting for Thanksgiving. I came home (to Poland) a few days later and from what I read here, we should be ok even though we did get married on a tourist visa. Am I correct? We have a big wedding planned in Poland (March 2011) but figured we could speed up the immigration process with this court wedding.

2. I was a student in the US and lived there for 3 years so I will need police reports from there as well as from my home country. Where do I go for that? I keep reading about FBI etc. I'm not quite sure how to go about obtaining such reports. I'll appreciate any ideas. Also, when are those reports needed? Is this something I bring to the interview or are they part of some forms sent back to us from the NVC during the process?

3. We are hoping to file our I-130 by the end of December (I sent mine to my husband last week, now all he needs to do is put everything together and mail it to the Chicago Lockbox). My passport is about to expire in June 2011 so I will have to get a new one with my name changed etc. I understand we'll have to let someone know about this but I'm not sure who that would be. Is it USCIS, NVC or American Embassy in Warsaw where my interview will be held? OR does that depend on where we are with the process at that time?

IR-1 / CR-1 Spouse Visa Process & Procedureswhen does one file AOS in the IR1/CR1 process?

The CR-1 visa is an immigrant visa. You get an I-551 stamp (equivalent to a GC) the instant you cross the border. An actual physical GC is mailed out to you a few weeks later.

The I-485 is used by people who are non-immigrants, to effectively become immigrants. It applies to K visa holders, and people who enter under any other non-immigrant status and marry a USC. Since you will be an intending immigrant all the way through the CR-1 process, you never fill out an I-485. Which saves you quite a bit of money - one of the major advantages of the CR-1 process.

So literally, the I-130 packet alone starts the CR-1 procedure and all we have to do is follow further steps and instructions as we get them?

I've been reading the guides and instructions over and over again for days now and I'm still confused about a few things. Help please?

We got married a month ago in November after which I flew back to Poland and my husband (USC) stayed home in Chicago. We want to get me there a) asap (obviously) and b) with a full set of docs, green card, work permit etc. I found out here that the K3 process is no longer used so we opted for IR1/CR1. My question is, when does one file all necessary forms to obtain the conditional green card right after landing in the US?

I understand the IR1/CR1 process begins with sending the I-130 packet which includes I-130, I-325A for both of us plus the optional G-1145. However, I do see some posts where people also include I-485 form in this first mailing to USCIS. Should we do the same? Or is the AOS packet included in some correspondence we will receive from NVC/Consulate later on?

Include as much as you feel comfortable with. Some have included affidavitts, others - like us didnt unclude very much at all. We sent very little to be honest, few scans of wedding photos, marriage licence, a blank check from our joint account. I wouldnt advice sending a tiny amount - as I was worried for the duration until we were approved. if you have anything with both of your names on, and more recent photos, but the applicants whom are married to the beneficiaries from the so called 'high immigration fraud' countries are generally advised to load the evidence in with their petition.

As you have a beneficiary from the UK - rightly or wrongly, you dont need to pile on the evidence as thickly.

If you feel more comfortable, you can inclde an affidavitt from a parent for instance.



Would you have any knowledge on how Poland is viewed nowadays? High immigration fraud? No? I doubt it would be, there aren't that many petitioners from Poland recently. But I just don't know.

Dont really understand all these terms here.......
Do I need all 3 of these things?



US Citizen:
I-130 Processing at USCIS aprox 5 months.
NVC processing 2 months or so
Consulate processing 1-2 months


In a nutshell, when you file your I-130 (for CR-1, spouse visa) it first goes to USCIS, then upon approval it is moved to NVC, after which it is moved to her consulate in Jordan. So yes, you will need all 3 of these things. Therefore, the process for getting your wife here after you get married in Jordan is appoximately 8-10 months AFTER FILING THE PAPERWORK. From my experience I can tell you gathering all necessary documentation will probably take you about a month after your wedding day. (Translating marriage cert to English, etc plus all other things you will find in the guide - you got the link from Canadian_Wife)

So the question you need to ask yourselves is: what is your priority? Be with her asap (because for this the fiancee visa seems to be faster but then you end up getting married in the US) or have a wedding in Jordan which I am sure she may want, have her family there etc. Then you take the CR-1 route and prepare yourselves for the wait.

Another option which me and my husband chose is if she flies over for a visit, you get married in the US, she leaves (this is a bit tricky, we weren't sure if that would be considered immigration fraud or not but since I didn't fly there to immigrate just for a week-long visit over Thanksgiving and we happened to get married in the meantime, we figured we should be ok. Plus the great VJ members here assured me this shouldn't create a problem so I'm not really worried). Then you start your CR-1 process as soon as you obtain your marriage cert.

But since you mentioned she won't be able to visit until April, I'm guessing this is is no option for you guys. Hmmm, it does sound like marriage in Jordan and CR-1 after that is the best route for you.

I would be very cautious about her coming over for visits after your CR-1 process has started, though. I've heard some opinions that DHS officers at POE are often extremely suspicous and sometimes deport people just out of fear someone might try to overstay and immigrate. I'm certainly not an expert here, someone else might have a different opinion. I personally deicded $1000 per ticket plus 9hrs on the plane and a very possible deportation scenario is too much for me to take that risk. So my husband will be visiting me until I receive my visa. I'm not going anywhere for the next 8 or so months.

Keep in mind, in the US you can buy a handgun even as a Lawful Permanent Resident, and if you then have an episode of paranoia where you feel somebody is going to get you and you load your gun and . . .

Just sayin' you should try to deal with your paranoia with the help of a mental health professional . . .



Not sure what you're getting at, Just Bob. Are you trying to insult me or someone else or was that supposed to be a light-hearted joke? Because if it was, it definitely didn't come out this way. I do not, I assure you, have paranoia. Just trying to get an idea, based on other people's experiences, just how worth it may be for me to blow $1000 on ticket and spend 10hrs on a plane to try to go and visit my husband while our petition is pending.

It may be easier for you to judge us, beginners and look down on our silly questions. This process is far behind you. We are just starting and everything is new and strange and suspicious and raising all kinds of doubts. So I personally would appreciate a bit of tolerance and open-mindedness.

PS. I'm a Psychology graduate. Trust me, you don't need to explain to me what is and what is not a mental illness.

Poland is not in VWP. I do carry a 10-year visitor's visa. Never had a problem so far but the last time I traveled we weren't married yet. I was a student there and visited a gazillion times back and forth. I do have some ties in Poland. Can't provide them with a serious looking employer letter since I run a small family business with my mom. But I do own a flat here in Warsaw and a car (with insurance paid for the whole 2011, etc) My two dogs are here...

I wonder if that would help me get through... What do you think?

If I have a minor child and hold custody, do I need my son's father consent to get the greencard for my son? I am married to a US citizen and we are preparing documents for immigration for me and my son. Does anyone knows if the American authorities asks for father consent in case I have custody of the minor child?

As mentioned earlier you can attempt a visit but there is no guarantee of entry.You have to satisfy the officer at POE that you have intention of returning. I have visited my husband a number of times in US since we started this CR1 journey and thankfully I have had no problems.


May I ask how you managed to convince them? How did you prove your intention of returning?

Do gather whatever you can in the meantime. It won't hurt and in case they do send you RFE, you'll be prepared. I also didn't include much with our I-130. I'd only realized that stuff is important an hour before my hubby left home to mail it all. So I am sorta expecting an RFE. I'm currently going through our emails and chats and skype logs to save it all and send to him in case he needs it.

Also, you may want to look around the regional Turkish forum here. Every country has its portal here on VJ. Take a look there and ask around. DEFINITELY read LingChe's shortcut through NVC and start gathering papers for that. Your wife will have to send you a few completed and signed forms plus some other docs as well. It's better to do it now before you're approved (and yes, NOA2 is the USCIS's approval of your i-130) so you are ready for the NVC.

The reason I'm asking: we're not expecting to be approved before April/May but my husband will be visiting with me in March and I wanted to fill out and sign my - beneficiary's stash of forms and give them to him so he's got them handy for NVC. So if I do that and date them in March, do you think we might have a problem? Or should I just NOT date them and let my husband handwrite the date on them when the time comes?

Once you've found it, dig out yer crayon again, and start making copious notes.

Then, as you've made these copious notes, get a clean sheet of paper,
and make the diagram again.

Then make 2 copies.
Send one to yer spouse, send the 2nd one to yer favourite Uncle.

Keep yer original in your satchel, as you'll review it daily.

Then, when you have a spare moment, O Raj,
Change your user profile to reflect which country yer spouse is really in;
Change yer TimeLine to reflect the country yer spouse is really in;
and then ... (again, wait for it............)

click on the 'portal page'
and you'll see a wealth of information, in the form of clickable links,
that pertain to yer particular Embassy.

Study the Embassy info, Study the Timelines for yer country (of Spouse),
mark yer calendar,

To suggest otherwise is to say that your petition is more important than all others. Everyone is at risk from terrorist attacks, and if you do not believe that then you need to review the tapes from 9/11. The type of expedite you wish for, do not wish for it because sometimes you get what you wish for, and trust me, the conditions in which an expedite of this nature can occur, you do not want.

So, when I was sending them back via email my packet 3 (checklist), I asked if it was possible to make an appointment for the week when my fiance would be in Poland (I sent the checklist to them at the end of September and wanted to have an interview in the middle of November). And they agreed. Sent me the email back with the information about the date. This way we are going to be at the interview together. biggrin.gif

You did the right thing sending the form I-134 to your fiance. This is the form used for a fiance visa (K1). yes.gif And you do not need I-864 at the moment.

Answers above are correct - K1 visa is good only for 6 months and just for one entry. If your fiancee doesn't enter the US border within this 6 months the visa expires and you will have to start the process from the beginning.

USCIS tends to "forgive" things as a convenience to the USC, depending on the number of "negative factors".

Hi all,

I have a quick question regarding my employment history in US.
My fiancee is going to file in the I-129F packet soon and I am filling out the G-325A forms where I need to state previous employers.

In the past I have worked in US during my J-1 visa internship for one compony for 18 months. During this time I have found another employer and worked there too (carried 2 jobs). I paid taxes in both places and everything by law was done correctly. My concern is that according to J-1 visa instructions I was not eligible to work for second employer.

Does it matter if I put this second employer on G-325A form? Or maybe I should not list it there because they will dig it out as illegal employment or something?

I will appreciate your comments on this one and looking forward to hearing from you.

When filling out the applicant’s residence for the last five years, I have to include where I am living now, which is in poland. We dont have provinces nor states, but regions. Should I type N/A in this space, or the english translation of the region?

Also, My last address outside the states is my current address. Should I also list this below? I have lived here for more than a year.

And the dumbest question..........
The question “this form is submitted in connection wtih an application for....”
Naturalization, “other”, status as a permanent resident.
What do I put here?

I had a question for those people living in Poland. I currently live in Poland and earn polish currency. The payment for the K-1 VISA needs to be in American dollars. Does anybody have any suggestions how I can get a money order or something like this in American currency? Does anyone know if the government accepts other payments besides check or money order??
