Hello, everyone! I have been reading your posts for some time now... I am sharing your situation: applied for I-130 in October ( my "lawyer" did), received NOA 1 in January. I am desperate since I am not only without my husband, but also without my two boys(16 and 2 y.o.), since without my husband I can't really work and take care of them in Amerika. So, I miss everyone so much!.....
Anyway, not too many people dealing with the Rep. of Georgia. But I want to thank you all for all the help and support I got from you, and very usefull information as well.
Why I decided to post --- I spoke to an oficcer last Tuesday, complained ( in a nice way) that it's been 6 months and etc.. she pulled my case out , and said that my case is being reviewed by another officer. And I should expect the answer withing 10 days! I was so happy that day! So I am hoping , that when the automated system says now: more evidence /papers required( it happened with me as well on Tuesday), it means - they are working on the case. Just felt like cheering you up a bit, because I know what it feels like... yes.gif

woww thanks for posting this.. thank you sso much.. see SHREDIE u have somethin to look forward to!! anyways i hope u get ur approval soon.. welcome to this thread!

I hope thats what it means!
but i have also heard that its an automated response and that since you prompted that number about "we requested more info" then it just automacitally says that..but hyde..you didnt get that did you?
weird. who even knows

nope i dint get that.. i just pushed prompts that led me to somethin abt if u received a letter from uscis requiring additional doc please pre.. then entered my recpeit number. and then someone pikum up sayin good mornin vermont service center..

mine said nothin abt rfe?

I just want to know something soon.
I am tired of trying to figure this out. the stress is affecting our marriage since we have enough stresses with it anyway.
I am probably going to try again after work to day adn see if I can actually get thru to VSC

Good luck shrew ........I called them yesterday ...They told me same old " 6" months ####### and " BACKLOG"....nothing changed...If you keep calling after your 6 months time line they tell you "Give us a month more from the date you called lol"

It looks like they donot know other numbers first " 6 " then " 1 " more ....they need to go to Kindergarten to learn other better numbers lol rofl.gif rofl.gif it looks like i am getting ISD lol (Immigration Stress Disorder " ) unsure.gif mad.gif crying.gif wacko.gif

I know. wonder if the USCIS pays for counseling after this! haha
did you talk to someone from VSC or just a USCIS rep?

If I don't see something in the next 2 weeks I am going to do as I suggested above. Since we can't call to get attention, resubmitting the paperwork with the NOA1 and a letter asking if somehow they misplaced the original documents or filed them incorrectly or god knows what and that the received date was to be honored, not the NOA1 date and therefore could they please ensure that the application is put in the proper order for review, seems all we can do. If we use their processing times, we'll have to wait for several months to be able to even talk to them (legally) on the phone.

If they lost (misplaced) files, would they admit it? And would they be forthcoming or would we have to ask and then, what constitutes a legal time to ask? (And if they find a December 2006 application sitting under a file nobody has looked at for a long time, will they change the date back to December 2006?? jest.gif )

well guys, I tried to call and get someone to talk ot me about my case and the automated system said that I needed to "submit the documents they requested"
which WAS NONE.
when I finally talked to someone they sent me back to the USCIS person (the computer did) and they didnt even see that on my file but then put me on hold and said that they would mail me the letter by may 18 telling what I needed.
I WANT TO DIE. I have waited for 6 months just to see that I might have an RFE. BULL SH*T
I am so mad.
I have heard of this happening to people and they didnt really need any info..so we will see.
I think I may call back and try to get someone from VSC.

Hey Shrewdie, that message on the line is an automated one. It confused me too. Had me goin crazy thinking they needed an official marriage certificate or something. But when i talked to the operator she said she did not see any RFE on my case, so it could very well mean no RFE for you. And the My date is problably your completion date so it sounds like you are getting close.

What I'm thinking is that VSC pulled adjucators off I-130 to process I-129F's for the K1 folks. That is why its taking so long for you guys to get approval.

I'm still praying for you all. At least the NVC is pulling out this online payment system so you will likely cathc up withthe rest of us soon enough.

marlita thanks for ur info.. it realyhelped.. mine and shrwedies timeline is very similar.. i hope we dont have RFEs and i hope so by may they complete our process. and i heard abt the NVC online payment that is so cool....

i hope we do catch up ... keep pray in for us.. and hope ur reunited with ur spouse sooooonnn

thanks Lita
the more I think about it the less I think I have an RFE
I hope we all hear something SOON!!!!!

She told you that you actually had an RFE? The automated system gives that canned message whether you have an RFE or not if you aren't actually in as having an RFE (as I understand it -- need to search on that.) So unless she confirmed that it says you have one, she might have been giving you a kiss off response and not an actual response.

well she was all like..getting my address and everything..so obviously she wasnt looking in my file or she would have known that already. and she put me on hold and was like.."I am making note that it needs to be mailed to you and blah blah..with an adjucator by may 18" and when I asked what it was she said "they need to mail you the letter because it is personal information"
she didnt even know my name
she took my receipt number first and then my zip code..then my name and then my address
if she looked up my file then shouldnt she have known all that already?
so what do you guys think?
do I have an RFE or no?

the more I think about it I think she has no clue. she just gave me a date that is 30 days beyond today.
I keep trying to call and get thru to VSC but "there is noone to take your call"
I bet they leave at 5... even though it says six!

First of all calling USCIS front desk officers (though they say they are officers with their badge#) are waste of time. They are bunch of school boys/girls who can read the computer screen star_smile.gif Instead of we calling them, it is always better idea to involve a congressman/senator though it may not speed up the case ! Just a thought...

I have been in contact with my congressman a gazillion times. useless

That's not true ! Once you file any application with USCIS, it is entered into their computer system, so that they can sort it out. It is not paper based system. You get the receipt notice of any application from their computer system. Sometimes, date goes back due to the reason (one guy got RFE and he/she sent the docs back to the USCIS and when they posted the date on the web site periodically, it was that bad guy's priority date), not because of one file sitting inside a drawer.

Why some people is getting approvals faster than others could be for many reasons:
1) Which officer handles the case
2) If the application is clean (with all required docs and completely filled forms)
3) If it is expedited case
4) And so many other unknown factors...

But personally, I don't like USCIS the way they work. Recently, they have made tremendous improvements such as speeding up FBI name check, adding additional staff (of course, with our money) etc. I know couple of my friends who are stuck in FBI name check for more than 2 year !!! FBI has to clear 300,000+ cases from the name check.

there is no way that all of us in october have the same "unknown factors" that we are all waiting 6 or more months to leave Vermont. seriously. they have just tossed us aside for other cases it seems.

Its strange how people who filed in Dec and beyond are getting approvals before people who filed long before. Makes me wonder if it is because in Dec they told everyone to send the applications to the lockbox, at the same time the service centers were sending their applications to the lockbox fo data entry. Maybe they had a system in place when they asked that all pettitions be sent to the lockbox in Dec. and all of the applications before that ended up in one big mess. Last month we saw the the processing dates go back for reasons not yet known to us. Sure they can say they sent out RFE letters and now they have the responses back , but they also said that it was because of applications being sent from CSC to VSC, I tend to think that all that shifting has left some applications in some strange black hole. I believe that they moved the dates back because the applications were sent to the wrong service center, VSC got some of CSC and CSC got some of VSC. They had no system really set up before Dec, they only knew they had more than they could handle and started packing up boxes and mailed everything to the lockbox to cash our checks.

ya totally.. what the heck is that? i mean only ppl wo suffered so far were july aug sept and oct filers. every one else had it easy.. they got their notices within 1 weeks time ( iwaited 91 days for mine) and then their files did not get transferred all over.. it stayed at one service center.. its not fair sad.gif now they got their approvals.. im sure their spouses will be together even before us.. aug sep oct ppl r stil hangin but ppl from dec jan feb and march r approved? wheres the decency..

i wish i could work for uscis and straighten out their operations..

I wanted to throw up when I looked at the thread NOA1 to NOA2 above..
do you see how many dec. filers are in front of us now?
something weird is going on.

I dont understand USCIS at all, but on the other hand congrats to the Dec. filer, they only had to wait 4 months. I wish that was the case for all of us. And USCIS says backlog, well i fyou have so much backlog where did you get the Dec file from headbonk.gif . Atleast some people dont suffer as much as others. This process can be very detrimental to the people going through it. In fact it is one of the hardest things I have had to do and I have had some tough things to deal with before.

Well besides that how is everyone today? Anyone else have this strange attraction to their email, VJ.com, and USCIS and by attraction I mean addiction? wacko.gif

hahah I do. I am totally addicted. and it doesnt feel good.. If I am addicted at least I wish it could be an addiction that makes you FEEL good. smile.gif

To be honest I dont know what to tell you, Its strange how they have their filing system. Maybe thats why the FIFO system isnt working, who knows. I have been told by an officer that the in date shows the 24th of January but the date they use for processing is Nov. 19th. If that is what they told your congressman though who knows whats going on. Very frustrating indeed. Dont get to worked up over it though. The one thing that they are consistent about is inconsistency. But it would be very difficult to make the leap to them using the in date as the process date. Some people are just luckier than others. Maybe when you hit that 6 month mark you can send in your NOA1 to your congressman and show that they accepted your pettition in Oct. At the same time perhaps send them a printed page from the USCIS website saying that they will use the accepted at date VS the NOA1 date. While we can not do anything to assist ourselves in this situation sometimes its better to think that we are doing something. Besides it doesnt hurt to try again with your congressman making sure to show that you are at the 6 month mark. Yesterday you asked a question "how do you guys do it?", you already know the answer because your right here with us doing it. Your stronger than you think and we are here to help you become stronger in knowing your not alone. And if your going to cry dont curl up and cry , have one of those good walking around the house cries, you know the one where you cry so much your still doing the dishes, laundry, taxes, and making a birthday cake for a relative because you know it will be a couple of hours before you stop crying star_smile.gif . Might even feel a bit better good.gif

thank you. I needed that.
and I didnt even think of mailing my receipt (that I think they have already) WITH the printoff from the website about accepting the first date!
Thanks. thats a great idea!
I was really praying today was our day

hey shrewdie.. dont be sad or depressed... try callin urself and explain us situation to them... i think they dont know what theyre sayin.. so we r all going thru the same thing.. its ok ur not alone... but i was hopin today would be our day also... sad.gif

Shrewdy.. I aggree with Jason.. u need to fax a copy of your NOA1 to ur congressperson. This will show them the "received date" which is the date u filed back in October and this is the date that USCIS is honoring too. I dont know why or if its not reflecting on the system or simply they just passed the buck and gave the january date. But u know when u filed and u will show your evidence. Also I want to point out another thing... Your filing date is Oct 30.. technically you have not passed the 180 days (6 months) yet. They might get technical on u, as there is 12 more days to go. Maybe u might wait a few more days b4 faxing ur noa1. I am on my 181th day.. so im getting ready to do something here... whistling.gif
Don't forget about your dream... something might just be around the corner yes.gif

I will def. do that! Thanks for the great suggestions you guys. I know...my dream seems a distant memory now sad.gif hahahahahaha

I would like to start this thread for those who filed I-130 in October and November. We sent our I-130 on October 1st still didn't get NOA. With all this processing time delays published by USCIS it seems like it is going to take a long long very long time for us to get NOA.

Don't be hopeless.. Check out my timeline..

I sent my I-130 on 5-19-07 to the Vermont Office
Notice of Receipt was on 5-21-07
Notice of Approval was on 6-7-07

I didn't request no Expedite service.. I also I sent my application via Priority Mail only..

Today I just got my IV Fee Bill of $380.. After paying this, I am going to be on my last step which is the DS230..

ok guys..
my congressman called vermont and told them that I should expect 6 months from my petition date and they have my petition date as january 17 (my receipt date). now. we all know (and my receipt says) I petitioned in October. so. now what?
my congressman told me they cant take any more action until July when I have reached 6 months.... but really it will be nine?
do i just ignore what she said? or do I curl up in a ball and cry?

hey shrewdy... ur congressman prob called USCIS and not VERMONT service center.. we already hit our 6 months. and in their system at uscis they prob have u as OCT filer.. so u try callin vermont.. and askin wats up...? dont rtely on what ur congressman said.. ur 6 months started in oct not january...

well, she specifically said "kim at the vermont service center"

I will try to call again this afternoon
when I check my case online it does say "received" january 17
is that what yours said? your receipt date instead of the REAL date?

well guys.
I go to church with my local state senator and am best friends with his daughter. I work right down from my congressman's office and have had no success with the congressman and his workers are rude. So- the senator is going to contact the Congressman's office on behalf of me and this is the email I sent.

Hey P*
I need to send you my receipt number and I forgot the paper at home.
If you think it would be better (or no difference at all) I can call
Congressman B***** myself. Just let me know.
I dont know how much you know about my specific immigration process
(probably more than I do, haha) but I have been at Vermont since October
30. That is 164 days.
I do not want special treatment, that is not what this is about but I am
just so frustrated with this entire process. I understand that USCIS
received like 1 million more applications than last year and obviously
there will be a time delay.
Here is my struggle. All of us in that time window that are being delayed
had to pay the increased fee that was implemented so that processing times
could be cut (due to more employees I think).
The USCIS proudly boasts that they process cases in order as received, but
I am not sure where they received this information (maybe 3 years ago that
was true..but not from the patterns I have seen now). I know of a few
people that sent in their I-130 after Christmas and have already been
passed through Vermont and are now at NVC.
I am just really dissapointed. All my life I have heard how that the
honesty and honor of government is a lie and I refused to believe it. I
still do not believe it to that extent, but I do not understand why our
government officials all over the country (especially those in Vermont's
jurisdiction) are not protecting us.
I cannot explain to you how you have gained even more respect from me and
those I have told about you since you are so willing to at least CARE
about my case. It was very disheartening to speak to the rep. at Congressman B****
office and to get rude responses- AND incorrect advice. She told me to
file the I-129 (in conjunction with the I-130) and vermont is phasing out
those petitions and not even processing them anymore...
Anyway, thank you Phillip and I just want you to know that I have seen you
stand by your convictions and commitments and you truly care. THAT is what
government is supposed to be. I teach my students that we have a government
for the people by the people and all I can think is that when I call my
representatives to ask for help that I am seen as a nuisance. Your service
will not go unnoticed and God will bless you for that.
My other question - is there nothing we can do to change this process? It
isnt just about getting my husband home (although I want him home badly)
it is about getting the focus of our country back on the people and back
on the family.
K-1 petitions are for fiance's and those cases are being processed about 3
times faster than those of us that are married. Special work Visa's are
being processed almost immediately after petition. Those of us separated
from our husbands, wives, parents, and children..we are the ones getting
lost in the shuffle.

Okay, I am off my soapbox now but I just feel the need to make people
understand what I see, haha.

Thanks again Phillip.

hey thats cool, let us know if u have any luck.....

I totally will.

was true..but not from the patterns I have seen now).

IR-1 / CR-1 Spouse Visa Process & ProceduresOctober / November I-130 2007 Filers
I just really dont know what to do.
I have never felt this way before. so hopeless. and that is what I feel.
I agree, there would be some hope if we at least saw VSC processing in somewhat of an ORDER..but no..here we are...all lost in the dark.
I am so angry.
Do you think it would have mattered if we had all gotten lawyers? (like anyone could afford it with the VISA fees too!)
Maybe I just need to take a break from VJ because I have started checking it obsessively seeing if anyone has updated approvals.

IR-1 / CR-1 Spouse Visa Process & ProceduresOctober / November I-130 2007 Filers
There are a huge amount of us that are about to reach our 180 days..If there are that many of us on VJ imagine how many of us there REALLY are.
They have to be aware of that. I predict we will get news very very soon. If not, I dont know what I will do. I guess i will call my congressman again.
and yes, hyd, It is VERY unfair to those of us that have been waiting forever.
Here is my thing - if they have SO MANY people with K-1 getting approved (a long time ago if they filed in october) and they are SO BACKED UP with 130s.....then lets use some common sense and move some employees around and equal times up...I mean seriously.
I just feel completely injusticed.
When I called my congressman the lady assigned to my case had the nerve to say to me "this isnt going to be approved in a few days, it does take some time" I almost hit the ceiling...I felt completely disrespected
I said "maam I am aware that this is a lengthy process and I am aware that you have plenty of work to do besides my case, but to respond to your statement I am the one that had to leave my husband as a newly wed to come home and fulfill a teaching contract, I am the one that at the end of a long day goes home to a house alone, I wake up every morning without my husband, I am painfully aware of exactly how long this process is infact taking"

guys- there has to be something we can do - right???
maybe a petition is a good idea??

ya kitty they posted their approval before.. the names are CHITTU AND PRIYA.. i saw this the moment they announced their approval...

goshh when will we get approved... we both filed the same date... i bet we should call on april 16 !!! lol and tell them our 6 months is up!

oh Hyd, I am doing the countdown! Yes, I plan to call them too once the 180 days and say where is my approval? mad.gif I feel like they have maybe 1 adjudicator on the I-130's! Cuz the approvals are just so sparce. Seriously we should start to consider a collection of signatures of those having met the timeline and not have their cases adjudicated yet!

I CANT DO THIS ANYMORE!!!
This is rediculous. I have talked to my congressman and it is useless pretty much. What are we going to do guys??? at this rate it could be this time NEXT YEAR that my husband comes home.
I am happy for people, but everytime I read abotu someone being approved that just petitioned in like MARCH. or the K-1 approvals it makes me lose even more hope. I just dont know.
I am about to go crazy over here!!!

hyd and kitty
I am right there with you! We have to be soon...right???
looking at this now..when do you guys think our spouses will actually be in the US?
I was praying for Sept..but now I think November at the EARLIEST??
what do you guys guesstimate??

hey kity and shrewdgal.. my first gues is also september... lets make avg at NCV about 80 days and then off to embassy// that is if everything goes smoothly and we do get out approval in beg of march.. hopefully this week...
god help us.. even i want my husband here so bad, i realy miss him.. im becomin impatient now.. dealing withuscis is very sad and u gota have a lot of patience to do this...

lets see what hapens

Hi Shrewdgal... welcome to the club.. we must be next, I feel it in my bones laughing.gif
lets all pray together that VSC keeps them approvals coming. IF we are approved early april.. i see that NVC is taking about 10 wks give or take a week.. then off to the embassy.. another 6 wks for interview.. then the Visa huh.gif .. im with your first guesstimate of September which makes it about 10 months process from start to finish if everything goes smoothly. yes.gif
What do you think Hyd? september or later? unsure.gif Omg, I am praying september!! I miss my husband.
Anybody out there.. what's your guesstimate for us??

Welcome to the Oct club Pecky.. if we all pray for our approvals it just might happen, the more the merrier. We are bound to be next whistling.gif This wait is driving me nuts blink.gif

I pray you are right about Sept. I am a teacher and I have to sign a contract for the entire year, starting in August. I will be with my husband all summer and will leave him the end of July. The thoughts that I may have to leave him and he wont be any closer to getting here drives me batty.
How mych is the AOS bill?
so let me get this right.
after we get approved we get sent to NVC. we have to do the ds-230 form and pay the AOS bill?
THEN we pay the IV bill?
what all do i need to be getting ready?
I feel like I am unprepared for whatever is next because I was so frustrated with the time it was taking that I had to just stop thinking about it!!!
Thanks guys!!
