It seems like you all say not to worry, which is great.  They really just care about recent income.  However, I just wanted to point out that on the form i-864, on the 6th page, it does require entry of the 3 most recent years of tax information. We don't need to provide proof like a 1040 unless asked, but we still have to write it down for them to review nevertheless.

 

It seems though, from what you guys are saying, that even though they want the 3rd year information, that a low income that year isn't significant. I just wonder why they ask for information that they won't use for making a decision?

Hi! I'm getting married to a Filipina and this is my first post here!  We met earlier this month in Cebu, Phillipines.  I am from Wisconsin, United States.

 

Question regarding the Affidavide of Support.  I understand that I need to make over 125% of the Federal Poverty line.  For two people that's about $19,387.  I understand that while I only need to submit last year's tax return, I still need to state my last 3 years of income.

 

My Gross income via my filed taxes are:

 

2012: $29,200

2011: $32,900

2010: $16,700  sad.png

 

I'm concerned because in 2010 I made about 91% of the Federal Poverty line as it was defined that year.  Far less than the 125% requred.

 

That's because I didn't work the first half of 2010.  The reason was because I quit my job late in the year before to go back to school full-time to finish my pre-reqs for nursing school. 

 

I've already made over $20k this year, and actually I just got my LPN degree and job and just started making $22/hr last week. (with the same employer I've been working for since March).  By this time next year, I'll have my RN and my current employer starts new RN's out at $32/hr. 

 

At any rate, I'll make about 30k this year.

 

So, it is safe to start the process of starting the K1 visa and the affiidavide of support now, which would consider my low 2010 income?

 

Or, should I wait until Febuary when I'll have new taxes, and then the lowlely income I made in 2010 will never be revealed (as I would just submit 2013, 2012 and 2011 numbers).

I'm writting the letter declaring how we met.  In the first paragraph, I wrote that we initially met on cebuanas.com before meeting in person.  Then I started thinking about IMBRA, and the fact that I wasn't background checked by this site.  Yet, IMBRA should not apply because this isn't a technically marriage broker website, right?  It's free for woman to do anything.  For men, it's free to sign up, make a profile, send smiles and such.  However, you do have to pay to actually have a conversation with someone.

 

So, is it okay to mention that we intially met on Cebuanas.com?  Or should I avoid it and just say we met online?  Then again, if I declare it right away and they accept it, then that can't be reason for disqualifying the K1 visa down the road right?

Hi!  I've been gathing documents and am almost ready to mail the initial documents to get the visa process rolling!  I am hoping to have everything in order by tonight.

 

I received my fiancee's passport photos.  They meet all of the requirments in the i-129 instructions, however, there is potentially one issue.  US passport photos are 2" by 2", however, what she sent me is something more like about 1.5" x 1.75."  From the top of her head to the bottom of her just is barely over 1". 

 

They i-129 instructions don't actually state that the picture must be 2" x 2", but it is a USA passport standard.  Will this be okay?  Am I at risk for a RFE?

My Fiancee is from Sta. Elena, Sta Rita, Samar.   She was house sitting in Tacloban for her cousin when the cyclone hit.  As I understand, her hometown was destroyed (I hear over 15 ft in water) by the cyclone Haiyun / Yolanda.  In Tacloban, she hid under a small part of roof that reminaed in the house, and survived on the stored food and water for 3 or 4 days until rescue teams   We all can see how devasted Tacloban is from all of the images they've shown on the media.  She texts me now and then when she can, but there is not always a signal and her cell phone loses battery life quickly.  Rescue forces have taken her to Ormoc, where she has access to food water and sometimes to charge her cell. Last night she stated that Tacloban is 18 ft high in water.
 
First, despite this tragedy, I'm happy that she survived!  She was lucky to be in Tacloban house sitting instead staying in her hometown, which seems far worse off. 
 
Second, unforuntely, despite her best efforts, she has yet to make contact with anybody that she knows except myself here in the states.  (I keep a cell phone with a Phils sim card in it to make texting me super easy).  We hope that her entire family survived and are simply unable to contact, but fear that... well you know.  She now has no home, no known surviving family members, only myself. 
 
She is searching for her family members for one more day, then heading to Cebu.  She asked me if I would support her, and of course I will.  Otherwise, due to the cyclone she has nothing.  I will support her until she joins me in the USA once the K1 Visa is finished. 





 

Where we are on the Visa process: the I-129F was recently confirmed as received two weeks ago on November 1st.

My first question is, how much does it cost to support a single Filipina in Cebu?  I understand that it will vary depending on various factors, but I serioiusly need some numbers to calculate my finances.  While I have a good job (nurse, LPN), I only work part time as I'm going to school full time so I can have even a better job in May (getting my RN).
 
One the one had, I hear that a family of 5 can be supported for $180 (a factoid from cebuanas.com, where we met).  "An average Filipino family that has five members needs a monthly income of Php7,600 ($180.95) to breach poverty line, according to National Statistical Coordination Board (NSCB). " On the other had, I hear that a single person living in the Phils needs at leat $500 a month just for the basics.  There is a big difference between supporting five for $180, and supporting one for $500. What's the real likely cost for rent, utlities, food, etc.? I was looking at http://www.rent.ph/ to get some ideas but this is all making my head spin. 
 
The goal is to support her until she get her K1 visa and live with me happily ever after.  Also, is Cebu the best city for this?
 
My second question, is there any sort of way she can come to the U.S. earlier than the K-1 visa processes related to otherwise being homeless related to her entire town being destroyed, submerged and unlivable (no power, no electricity, thousands of diseased dead bodies everywhere, etc.) as a result of a Natural Disaster with no known surviing family members to take her in?  Any kind of U.S.A. or International Refugee program (or something like that, not sure what it would be called)  that could likely help bring her to the U.S. now while she waits for the K1 visa?

Regarding number "you're not supposed to send cell phones via the postal service," it is perfeectly acceptable to ship lithium batteries "that are properly installed in the equipment they are intended to operate may be sent internationally."  So, if the battery is in the cell phone it's okay, but outside of the cell phone it is not okay. I like the idea of not declaring the iPhone, however, I'm worried that since registered mail is insured then if I don't claim it and it's lost then I would get anything really back.

 

 

 

 

Number 1, you're not supposed to send cell phones via the postal service as they have lithium batteries and postal regulations say thats a no no. 

Number 2, declaring the phone will probably result in custom duties above the value of the phone.

Number 3, US postal guarantees end as soon as they hand the package off to FilPost in Manila.

Number 4, all the delivery companies, including the postal service have had trouble with theft and or extorted fees.

 

Given all that, we just sent a small package to my sister in law via the postal service. We declared the vitamins, shirts, and other small items. We did not declare the unlocked iPhone 4S we sent. That is just asking for it never to arrive, or a huge customs fee and likely an extortion fee on top of that. We've been at this game for a while now. My sister in law was charged like 200P duty on the items we shipped. Packages through the postal service always make it to the recipient for us, although customs fees and extortion fees are common where my wife's family lives in Davao City. Cards sent to that same location stand only about a 50% chance of making it, as they're grabbed up looking for inserted cash. 

All shippers into the Philippines are supposed to be collecting custom duties on the items being shipped. So don't think that just changing shippers exempts you from duties. The problem comes in when the local delivery people take a 500P duty and turn it into 1000P or 5000P duty. Or a duty free item and turn it into a big duty. Like when I time I mistakenly wrote immigration documents on the customs for and my now wife was charged 5000P to get them. There is no duty on documents, but when they saw immigration, they saw many pisos to be made.

If you want your package to arrive, what I suggest is list a few things they can charge a duty on, even maybe a little over charging to, if its the custom in the area. But leave off those big ticket items that flag the package for theft and/or extortion fees. Yes there's a chance it may never arrive, and different shippers have differing levels of reliability to get it there depending on location.

I never heard of LBC, but I just looked them up.  Their two nearest locations are both an hour away.  Also, their cost calculator on their homepage is only for Phils to Phils, not international.

Hi!  I want to mail my Fiancee a cell phone (iPhone 4S), some pictures of us, and some vitamins.  She didn't ask for these things (excep the vitamins since I am sending the other things), I just want to send them to her.

 

At any rate, what is the best way to mail these?  She is now living in Mactan Lapu-Lapu City if it matters.

 

I see that USPS has the cheapest rates, but I also hear that there is a good chance that the package would never make it  to her, or that she may be extorted for extra money when trying to pick it up fro the Post Office.  Is this true?

 

I priced out USPS, UPS, FedEx and DHL.  I can ship via USPS Priority Mail International® Small Flat Rate Box for  $24.99 (vitamins won't likely fit but that's okay, the cell phone and pictures will), while the others all have the price 4 times and much, at about $100.

I understand that the St. Lukes Medical Exam is a two-day process.  When is the latest I can schedle the Medical Exam before the interview?

 

The reason why I'm asking is because I'll be flying my fiancee to Manila for the exam.  It would be great if she could do both the exam and the inteviews in one trip instead of two 

 

Like, fly in, Day 1 & Day 2 the Physical Exam, then Day 3 the visa interview... then fly out.... something like that.

Keep in mind that you are applying for Non-immigrant visa K1. you should not put there 10 years. coz it will referring to an immigrant visa. so just put there 3 months.

 

 

I'm a bit confused.  Even though the K1 visa is technically a non-immigrant visa, it seems as though this process is treating it like an immigrant visa.  In fact, the US Embassy in Manila's website talks about Fiancee Visas on their Immigrant Visa page, but not on their non-immigrant Visa page.  http://manila.usemba...v/wwwh3023.html

And she picked it up in Cebu, due to being displaced with Yolanda.

My Fiancee had her interview today and was approved! 

 

That's only  3 months and 2 weeks from when I first mailed the petition packet!

 

I just wanted to thank you guys and gals for your advice during this process.  Most questions I didn't even have to ask because someone else did.  smile.png

 

Something things that I learned: the small roughly 1.5" x 1.75" Philippines Passport photo is just fine for the I-129F.  No RFE with that.  Of course, for St. Lukes and for the Interview it was that standard U.S. Passport size--at that point they are strict.

 

Front loading the I-129F worked great.  Even though we were together only 3 days, I included pictures of us together on different days in different locations wearing different clothes.  I took screen-shots of email subject exchanges between us, and also phone records from whenever she called me.  Also, money that I have sent her for cell phone loads through Aryty or Western Union Money Transfers.  I lost all of my receipts from when we were together (can you believe it!).  So, I just printed a Bank Statement showing the transactions that I completed using my debit card (most of them) and wrote little notes about each line.  Of course, I sent more current proof of relationship for the final interview.

 

I planned for 3 days for her to be at St. Luke's, but she was completely done in one day and even arrived after they opened!

 

For the final interview, regarding my finances I just completed my taxes on Jan 30th 2014, so I sent my 2013 1040A and W-2's. Talk about current--I wonder if I'm the first one to submit their 2013 1040A.  smile.png According to the official website, only last years tax returns are required (no longer 3 years).  Nothing else is requested.  However, for good measure, I included a tax transcript for 2012 and my last 4 paychecks. 

 

I looked up every question I could think of for the interview and types out the answers just in case, and quizzed her to make sure she memorized.  smile.png   Ended up being totally unnecessary though. My fiancee was asked very few questions--it was a quick interview and fast approval.  Well, fast is relative.  They arrived at like 3 or 4 AM and (long before the Embassy opened) and were done "before lunch."  Oh, she also made a photo album of us together to bring to the interview.

 

We had no pauses, delays, and everything went super fast.  Perhaps it's faster than before related to Typhoon Yolanda?  I hear that as a result of that event, Visa processing has been accelerated.  I know every time I checked for potential interview dates, "tomorrow" was always an option online.   St. Luke's Fee is/was discounted related to the Typhoon. 

 

One of the best things for both our relationship in-itself and also to help prove our on-going relationship (by printing my cell phone call history between my Fiancee and I), is Smart's Talk-a-Lot 300.  "P1.50/min! Enjoy 200 IDD mins for 30 days for only P300."  Dudes, that's cell phone to cell phone from the Phils to the U.S. for 3.3 cents per minute.  That's less than $2 an hour.  Crystal Clear.  The quality of this to the Phils blows Skype, Google Voice, Yahoo Voice Chat, and the calling cards I've tried out of the water.  So, I would just send her loads and then tell her to call me via e-mail.  smile.png

 

Sending my Fiancee a Smart Phone (iPhone) was such a great decision.  I pre-loaded it with all the apps she would need to view Microsoft Word, Excel, PowerPoint, .PDF's, and more.  So, it was a replacement computer basically--she could surf the web to look stuff up and read all of the docs she found or that I sent to her. Also, to watch YouTube videos that would do mock K1 Visa Interview sessions, etc. (plus yes she liked being able to Facebook and play Candy Crush whenever lol).   I also paid for her unlimited data ($27 / month).  I set up her iPhone to instantly notify her whenever I sent her an e-mail.  So, e-mail was basically just as fast as an Instant Messenger in getting each others attention fast.  Plus, having all text-based communications in one place (e-mail) vs. scattered (Yahoo!, Skype, WhatsApp, Viber, Text Messaging) made it so much easier print for Proof of Relationship.  Also, this system worked so much better than having her text my spare cell with a Phil's SIM Card here in the U.S. (costs her one Peso), then I text her back via Skype (I think that costs like 6 cents?).  (Though now that I no longer need to prove proof of relationship, I'm considering trying Apple's Face-time Voice (not video) as it's less data than Skype and therefore should be more stable with the Phils shaky internet.  If it works well consistently, since I already pay for unlimited data, then our Voice Calls would go from cheap to free.  smile.png  But Skype can be terrible even with just voice but it's also a bandwidth hog.)

 

The paperwork has been time-consuming but not difficult--especially with an awesome forum like this one to ask questions.

 

The next step is receiving the Visa stuff in the mail and scheduling the CFO Guidance and Counseling Session.  Just formalities.  Should all take less than 10 days, and then we can pick a date and buy a plane ticket!  No rush actually because we're planning for her to fly to the U.S. sometime in April.

It's possible that she could be positive for a skin test, and negative for the sputum.  That would suggest that she had TB before, but it's dormant and doesn't have an active infection.

For some reason, I thought that after she entered the USA, that there was nothing to do for the marriage processes until after marriage.  Now I see that we could have gotten a Social Security Card, and worked on updating her vaccinations.  We'll get on that right away.

 

So, she will be changing her family name to mine.

 

So, how should she sign the Marriage Certificate?  With her current family name or mine?

 

At this point, how exactly does the whole name-change thing work when we apply for the Social Security Card (since we will marry before applying for the card)?

My wife and I are getting ready to file for File for Adjustment of Status for K1 Visa.  I've been scratching my head trying to figure out exactly which vaccinations she still needs, or doesn't need. Especially since for many of the vaccinations that are technically required by US law ((Polio and Hepatitis B for example) are marked as "not Age Appropriate" by St. Lukes in the Philippines.  So, I'm not sure if we still need these.

 

I actually have a copy of the Vaccination Documentation Worksheet from St. Lukes attached to this e-mail (personally identifiable information removed, of course). 

 

Can someone take a look and let me know exactly which vaccinations we still need? (Besides the Tdap--I know we need that one).

she needs the NBI clearance and cenomar (certificate of no marriage)

since your petition is being sent to the Philippines you should get the required documents asap

nbi took me 3 weeks to get, cenomar took me 1 day. she only needs the police certificate if she lived/worked in another country for more than 6 mos after the age of 16.

BTW it does say on the link you included, under section D, that "Applicants aged 16 years and older must have a valid Record Clearance."  It doesn't say in that section that there are exceptions if she has not worked in a foreign country, etc.

 

And yes, I am curious to know where you got it in one day too!

We've received from the NVC approval and that the application is being forwarded to the Manila embassy (dated Dec 10th).  That same approval letter encouraged us in the meantime to fill out form DS-160 to apply for the K visa.  Wich I plan to soon (perhaps today).  Typhoon Yolonda resulted in a great delay and frustration regarding her gettting her passport, but she finally got it yesterday (great Christmas present!).  Now that her Passport is finally in hand after much delay, we feel comfortable moving forward again.

 

At any rate, I know there are time frames that are too early to gather certain types of information.  When should we start to get the Police Report and also proof of her eligiblity to marry?  Is now too soon?  How long does this stuff typically take to get?

I'm getting ready to send off the initial K-1 visa application (I-129f and such).  Should I sign and date everything?  Sign and date all copies of everything, including the copy of my birth certificatate, the passport photos (I wrote the full names on the back but didn't sign/date the back), phone call logs, screenshots of our email communications, printouts of my hotel reservations, the copies of my boarding passes... you know, everything?

Okay, let's say a a male sponsor, before ever meeting his fiancee, may have been sleeping with a married woman.  Let's also say that, even though it was over a year ago, as a response to a jealous husband strangely now sending threats of physical harm, the ordeal is made a little more visible via a court-ordered restraining order (protecting the sponsor from the angry husband--just in case).

 

Would this have any bearing in relation to Moral Turpitude?  Is this something both the beneficiary and the sponsor must meet?  

 

In short, could this affect the Interview for AOS for the fiancee obtaining a Green Card?
