K-3 Spouse Visa Process & Procedures1 year since I filed my I130 and no noa2
Hi bigchez,

We are in the same boat. We sent our application on Oct. 17th 2007, they didn't send NOA1 until Jan. 15th 2008 and we are still waiting for NOA2. It's just ridiculous. I've seen people on here who applied way after us and are ready to move to the States already. My husband has called USCIS numerous times and you can't squeeze out anything that resembles an answer. I feel for you having a son and not being able to be part of his life for so long! I feel we are getting time stolen from us also. If we could at least get an idea of WHEN, we could hold on to SOMETHING.

Thanks aba! I think it will be more than one month, still waiting on instructions for the medical and police clearance. But at least now, it's moving along!

We finally got the i-130 approval!!! Now we have to wait for instructions from NVC. The Congressman....Senator thing didn`t help a bit. USCIS deals with things the way they please....they told our congressman we were in FBI background check and that they couldn`t give him any information when in reality they didn`t like my husband`s birth certificate, which he's been using all his life, including to enroll for military service and had no problems before now. We waited over a year just to be told they needed another copy. Anyways...Hubby got another birth certificate from his hometown, sent it to them and all is fine. I hope NVC will be smoothe sailing.

Last time we got touched was Oct. 23rd, after calling them to let them know we were outside processing dates....since then, nothing. I think their online case status is useless and total BULL...it just serves a purpose of giving a false sense of customer service....the 1 800 # too for that matter.

suggestion call them up again (800-375-5283 then 1 for english then *1 to speak to operator) and tell them your case got transferred on what date and you are outside the processing window. Then say WHATS THE F****** HOLD UP
then say thank you for your time


LOL, thanks for adding some humor in this S***Y situation. We have to laugh a little, because this process just makes me want to cry.

Hi MsZ,

Yes he filled out the form although they said at the office the letter requesting him to look into the matter served the same purpose. His congressman is Bill Young, in Florida, he sent a letter of acknowledgement today already. Hopefuly he'll be able to get some answers for us.

My husband hand delivered a letter to his congressman yesterday. We'll see if anything moves. I keep checking our application status on USCIS and nothing is moving.... it makes me so angry! Thanks to everyone for your advice.

Mrs Z., I filled out my timeline...not that there is much to fill out, I`m still at the first stage after over a year. My husband did contact USCIS over 30 days ago and they opened a request but still no answer from them. He called 3 times last week and didn`t manage to talk to anyone helpful. All they say is to wait. I feel we are stuck in a rutt and this is never going to happen. I will mention to my husband about contacting his congressman.

I guess if the 90 day after being transferred thing is the standard....we should hear something in november.

It`s not like I have a bad life here in Canada, it`s actually pretty good. But, I did not get married to the one I love to keep being away from him. Between being able to get vacation time and high air travel prices, we really don`t see much of eachother. Talking on the phone is one thing, but we need more... I think we`ve been patient enough.

We got married on September 7th 2007 after dating for 5 years and sent in the paperwork for I-130 in October 2007. Vermont Service Center acknowledged receipt January 15th 2008. Our application was transferred to the California Service Center in August 2008, 26th I believe. To this day, still no answer. We are held in total darkness.

The processing dates for the California Service Center are now within 6 months according to their website. We are way behind in the process, way outside processing dates. I (Julie) am getting very discouraged, I can`t stand not knowing if I`m coming or going anymore. As far as I can read in the forums, people who filed after us are already approved and moving along. Anyone else in the same boat as we are? Any idea on what can cause such a delay?

If you have been married 2 years at the time of your POE, you will enter on a IR1 visa and receive a 10 year green card. You do not have to "Ask" for it. In addition when you are interviewing in Montreal you will most likely be asked when you were married (not that they don't have that information) but at that time they will note that you are eligible for a 10 year green card. So you will not have to remove conditions after 2 years and will not have to pay anymore $. You are definitely overdue for your visa, what a long wait you have had. Good luck. good.gif

I didn't know there was a difference between removing conditions and adjusting status....from what we understood it was going to cost us another 1000$ mininum in 2 years after entering the country. I'm glad to learn differently.

We got married September 7th 2007 and sent out our application in October, 2007. Were were stuck with USCIS for 1 and a half years until finallyl getting transferred to NVC in April, 2009. Well we are still waiting for an interview date and looks like it will be, at the earliest, in September. This is an application for a CR-1 yet we will have been married for over 2 years by the time the visa gets issued....if ever.

Does anyone know of a way to ask for a permanent residence instead of a conditional residence at this stage? NVC, USCIS or border patrol will not give a clear answer. After waiting all this time, we really would like to avoid having to run around and paying more exhorbitant fees after 2 years conditional residence to adjust status to permanent.

Any advice will be greatly appreciated.
