It all depends actually.  If you pass your interview, Administarative Processing can take anywhere from a few days to a few months.  In high risk countries it can sometimes take years.  For my wife, it took 2 weeks of administrative processing after her interview.

Knowledge of a date is NOT a requirement.  Stop making things up.

 

Although not a requirement, it is best to know the date she got engaged.  A CO can ask any question about their relationship and would cause a big red flag for not knowing the date of her engagement. In most countries, engagement is a big deal, often a formal ceremony. I would absolutely advise her to know the date of the engagement even if it isn't a requirement.

You can schedule your interview once you have your case number and paid your visa fee.  You should wait for your NOA2 clearance first, if you are concerned, but it's not necessary.

 

The medical appointment is first come first served at St. Luke's Medical Center in Manila, no appointments. Get there early like 4:00-5:00 AM.  If you are menstruating, they will not be able to examine you fully and will ask you to come back one week after the last day of your period.  It's best to go to St. Luke's  a few days after your period when you are no longer discharging.

Section 212(g)(2)(B) of the Immigration and Nationality Act provides for a waiver of otherwise required immunizations if the panel physician certifies that "such vaccination would not be medically appropriate." So, you should take this question up with the physician who conducts the medical examination, and he/she should be able to request an appropriate waiver.

You don't need to file your return to have a copy of your W-2. It should come to you in the mail or electronically if you set it up that way at your job.  :)

Yes, Administrative Processing is usually what delays a visa after approval.  It can happen for any number of reasons, but normally it's due to backlog.  For us it was because my fiancee's medical report was not forwarded to the Embassy until the day of the interview.  The CO told her "All looks good, you are approved, we just need to wait for your medical records, call us in 10 days if you do not get your visa in the mail."

 

Well 10 days passed and we really got worried, but the Embassy assured us that they were experiencing some backlog and apologized for the inconvenience. 9 more days later she got her visa and came to the USA on January 27th.

 

So have hope.  if the CO said you were approved, you are approved, and simply have to wait.  I know it's heartbreaking being away from the one you love, but soon you will be together!  Good luck!  Keep us posted!

Once you pay your fee, I advise you log on each day and look for openings.  Some people cancel and spots open.  If you see a good slot, grab it fast.

 

As per dwheels, the Philippines can be very booked.  Back in October 2013 I tried booking and I could not get an appointment for my fiancee until January 2014!  I can't imagine what the calendar looks like now.

I was in the same boat as Caryh, limited vacation time.  I say if you can be there, do it.  My wife gets very stressed and nervous when it comes to interviews.  I knew if I had been there she would have been much more relaxed and less stressed.  She did get awarded her visa though, but was sad we could not be there together to celebrate afterwards with a nice dinner and night out.

 

If I could do it all over again, I would have found a way to get the time off to accompany her in Manila.

Oh wow.  I saw recently that some people have gotten their NOA2 in 3-4 weeks and some have even completed their entire process, even getting their actual visas in their hands, in 3 months or less.

 

Yes, some have been Filipinos but I saw that a good number were from other countries as well.

 

I wish mine was that fast.

 

It all depends how backlogged they are.  I filed back in May 2013 and received my NOA1 in early July 2013 and NOA2 in late August 2013.  My fiance would have had her visa by September, but she wanted to spend Christmas and New Years at home. :)

Sometimes your visa can go through a process called administrative processing which can take 2-3 months.  It all depends what you gave them at the interview, if all your paperwork was in order, etc.  My fiance's interview was on the 6th of January but did not get her visa approval until 3 weeks later.  Not cool.

You do not need a round trip ticket to enter the USA.  However, if she needs to change flights (and depending on the layover times) do make sure she does not need a transit visa while in a connecting airport, some countries require them.  That said, my fiancee is from the Philippines and I bought her a one way ticket to New Jersey, USA.  She had a stop over in Japan, but did not require a transit visa as her layover was less than 4 hours.

You are approved, you are just in AP status. It could be for a number of reasons, for my fiancee it was because St.Lukes forgot to forward her medical exam results in a timely manner.  She had her interview around the 6th, but was in AP status for like 3 weeks, almost a month. 

 

Don't stress, you will get your visa in the mail soon!

A lawyer has no control over the speed of your process. Save yourself some money and just file yourself.

 

While an immigration lawyer may not be able to expedite, they can ensure the paperwork is filled out properly as well ensure that any supporting evidence that  is required, is also submitted.  In short, an immigration lawyer can significantly decrease your chances of any delays or requests for more evidence.  One simple mistake, like a missing signature, can delay your petition by 3 months or more. If you are in a hurry, why risk a delay?

YUP!! we were denied on k1 because we didnot meet the required income we did the k1 because we thought its mych easier and faster and he petitioned me when i was pregnant. . and ofcourse we have met each other not only for two years but more than two years. and were living together now.. and have one kid. thats why we want to do the spousal visa because he has only one year to stay here in the philippines and were planning to fly with him after that. and regarding the paternity. yeah were doing the CRBA thing this may.. thank you guys for the help.. i guess i would need to do some researches first if we can do it by ourselves or hire an attorney.. im confused... about the CO SPONSOR does anyone know what form they need to fill up? my fiance's dad will be the co sponsor--- paula

 

I believe the Philippines is one of a few countries that does not allow co-sponsorship.  There have been exceptions in the past, although I do not know what were the circumstances of such exceptions.

My bride to be and I submitted the following:

 

1. Photos of our trip to Singapore together.  *Make sure these are photos of you and her together.  Include a variety of shots of you two having fun togther.  It's also good to include pictures of your families, especially of either of you with each other's respective families.

 

2. Receipts, ATM slips, and boarding passes of our visit.

 

3. Gift receipts of anything I may have sent her and her family.

 

4. We backed up all our chats/texts.  We use data text/call services like LINE, Skype and Viber which you can back up all your chat histories for print out. *You dont need to give them every line of history from the past year, just a few pages for each month to show an ongoing relationship.  Try to grab chats where you talk about your future and wedding plans etc.

 

5. Phone bills with line details of calls and/or texts/data transfers (LINE Skype of Viber use data).

 

6. Emails, cards and letters

So for example, if you live in one of the 48 states (Alaska and Hawaii have different thresholds), the threshold for a family of 2 (just you and your fiance) will be $15,510.  If you or her have children, just add a family member(s) as per the chart.

Hi All,

         

My K1- 129F petition was denied on Jan 10, 2014. As per USCIS, they mailed a copy of denial letter. So far I have not received a hard copy of the denial letter and the reason is unknown to me. What can i do next? It took a year to get the final decision. Does anyone else have had the denial of k1-129F petition? . My Fiancée is in India, Can she get Visitor Visa to visit me?  She does not have lot of assets, money and do not have a job. I have been supporting her and her 2 children. Do you have advice or suggestions for me please?

    

 

There are lots of reasons a 129 can get denied.  Some of the more common ones are:

 

1. Form filled out incorrectly (The number one reason actually)

2. Lack of evidence of a relationship

3. Either party not free to marry

4. Not responding to a RFE in the time frame alloted.

5. You are not a USC but a permanent resident

6. You are not at least 18

You only need a few pages from each month you have contact.  Preferably try to show pages where you build your case and talk about your future, possible kids, wedding plans, etc.  Avoid talk about K-1 or tourist visas.  The same goes for phone bills, you only need a few pages from each month that shows contact.

 

But chats are not enough.  I would make a portfolio of evidence that includes gift receipts, boarding passes of your visits, photos of you and your fiance(e) together and with your families, Western Union transactions, emails, cards, letters and a love timeline.

If you are the beneficiary you do not have to earn any kind of income, the petitioner must prove they can afford to support you in the USA.  That said, your US petitioner must make over 125% of the national poverty level in annual income for their state of residence.
