When Will These Obligations End?

Your obligations under a Form I-864 will end if the person who becomes a permanent resident based on a Form I-864 that you signed:

1.  Becomes a U.S. citizen;

2.Has worked, or can be credited with, 40 quarters of coverage under the Social Security Act;

3.No longer has lawful permanent resident status, and has departed the United States;

4.Becomes subject to removal, but applies for and obtains in removal proceedings a new grant of adjustment of status, based on a

new affidavit of support, if one is required; or

5. Dies.

 

Maybe some of them have worked 10 years by now?

Thank you everyone for your replies.  I will add my 134 form of my cosponser's to my own.  Apparently Ghana has the longest average wait time between second notice and actual embassy interview of any country, so I still have time to get a job.  I filed in Dec 2012 so I am expecting the second notice this summer and the interview in November.

Thank you for you reply.  Sorry, I am new to the site and will try to find out how to join the Ghanaian forum and fill out my timeline.  I was trying last night but unsuccessfully.  Somehow I also managed to lose my password and had to create this new account.  I am trying not to reask questions that already are answered, but I couldn't find info about whether the cases stayed in place if the american petitioner moved.  It is great to hear that my case will stay with the Vermont Service center.  (Are you sure about this?)  I was worried that moving would cause a delay and a reassignment to the CA center.  Knowing that it won't I will update my address immediately even though I am still jobless.  It seems that from the stats on this site Ghana actually has the slowest turnaround time from NOA2 to interview (four more long months).  So it does look like I will have some more time to get a job before she goes for her interview.

 

How do I know whether Ghana Embassy will accept a co-supporter?

Thank you everyone for you support, input, advice, etc.

 

Abby and I have decided that we are going to continue with the interview.  If she is approved and we are granted the Visa, then she will come to the US and we will get married in Dec.  Then, we will apply for AP and if it's granted in time she may return for her final semester.  If the AP doesn't arrive, then we will make the decision as to whether she should return or not.  Maybe it's best that she finishes school here anyway.

 

If the interview doesn't go as planned and she doesn't get the visa immediately, or the process goes into the common administrative processing line, then we will try to delay her arrival into the US until after her semester concludes.  I will update the thread with the results after the interview on December 5th.

With the Christmas holidays coming up, I seriously doubt that she would be able to get AP in time; they take time off for the holidays too.

 

I personally would post pone the interview until February so that she can leave by August because she is so close to getting her degree and a few months extra time to get a bachelor's degree stacked up against a 30 year marriage is completely worth it to me. But if it's not for you guys, then that's your choice.

 

Is she likely to be in Administrative Processing since she is from Ghana? I know most people from African countries go through this, but I don't know the specifics about Ghana. In that case, it might be months after the interview, rending the marriage plans in December moot anyway.

 

I just talked with Abby about the situation.  I agree with you that a few extra months doesn't matter that much compared to a 50smile.png year marriage!

 

I think that she should complete her degree in Ghana.  I personally lost time by transferring during undergrad schools and then again when I switched schools for graduate school.  She has completed a 3 year teachers trainer college program and got something similar to an associates degree.  Then she taught french in middle school for 4 years and saved money before starting afresh in a bachelor's degree program at University.  She is now in her fourth and final year at University and has just one semester there to finish.  Seven years of college is enough for a bachelor's degree.  If she transfers to a US school she will likely lose many of her credits and most school have a 60 credit (two-year) minimum residency requirement for granting degrees.  Then there is the huge amount of cost to study at US schools to consider.  To me this means that the best option is for her to complete in Ghana.

 

I have no idea whether she will be in administrative processing.  If we do get stuck in administrative processing and her x-mas break passes by then we could try to postpone things until August when she completes.  I think that after talking with Abby again that we should decide whether we either postpone the interview, OR, we go through with the interview have her come to the US to get married and run the risk of not getting the Advanced Parole in time.  Then we have to start the process over by applying for a CR-1 visa. 

 

To me the later option seems best simply because I have know her for four years and I want my friends and family to get to meet her!  Plus the idea of x-mas together with her in the US sounds great.  Her first time flying, first time seeing snow, first time sledding, and showing her my home, and finally being married and and and ...

Abby is a french education major and the requirement of the school is that she complete her schooling by teaching French during the spring term.  If she doesn't complete this spring she will have to wait a year and complete then.  Either way, I am 35 and she is about to turn 30.  We would like to begin our lives together.  Postponing for another year doesn't seem to be very helpful.

I just checked.  When we got approval status on August 6th, 2013 from USCIS for our 129F petition it said that the approval expires December 5th. 

 

Our interview is December 5th.  Does the USCIS expiration mean that if the visa interview cannot be postponed?

Why is this process so inflexible and inhumane? 

 

I spent three years going in and out of her country at will.  I served my country as a Peace Corps volunteer for over two years, have waited one year for my fiancee to be able to come over and marry me.  And it seems, that as my wife, she still won't be able to come visit me without first waiting for over another year.  Sometimes I really hate the US government!

I just read this from one of the guides:

 

ball.gif The K-1 Visa Holder will need to apply for Advance Parole (AP) if they wish to travel outside of the US while their AOS application is being processed and not yet approved. Leaving without an approved (and in hand) AP will result in abandoning the pending AOS application and require filing for a new visa (either K-3 or IR-1/CR-1) to re-enter the US.

 

If she comes and we marry and she leaves without the AP, is it possible that she can get travel visas to come and visit me while she is completing her last semester of school?

How long would it take to get permission to travel while the adjustment of status processing? 

 

I plan to marry her immediately when she arrives.  She could probably stay 1 month and maybe slightly longer without missing the start of the spring semester.

 

Also, if she is only aloud to be gone for a certain amount of time, I could bring her back for short period during the semester.

Dear VJ friends,

 

A year ago my fiancee and I started this K-1 fiancee visa application process.  Finally, after 12 months we have received an interview (Dec 5th).  If she successfully gets her visa, the she will be able to come to the US this December so that we can get married. 

 

However, the big question for us will be how long she is able to stay.  She has only one semester of University remaining which begins in January and will end in August.    If she comes and we get married and then she goes back to after a month, will she be able to return to the United states easily or will we have to process a separate application for a spousal visa? 

 

I know how much this degree means to her, but at the same time the average amount of time to process a spousal visa is around 14 months and I don't want to have to go through this again!  Does anyone know if she come, marry me, go back and complete her degree, and the enter the US again when she is done???

When sending in my 129F.  I had to submit evidence for a previous divorce (10 years ago).  I went to the courthouse and obtained a CERTIFIED COURT COPY of the divorce decree and sent that in with my package.  HOWEVER, I still got a request for evidence because the CERTIFIED COPY did not state on it that it was the FINAL DIVORCE DECREE.   I got a RFE asking me to provide evidence that the marriage had been terminated.  I had to return to the courthouse and ask them to produce a CERTIFIED CERTIFICATE OF NO APPEALS which stated on it the the included divorce decree was therefore final.

 

Make sure that if you have to provide a divorce decree that it says that it is a FINAL DIVORCE DECREE, and if not then included a CERTIFICATE OF NO APPEALS which states that the divorce decree is final.

 

My case was approved by USCIS five days after they received this evidence.

I forgot to mention that I also did contact the national visa center (603.334.0700) and finally got through.  They told me that they couldn't assist me with the case because the case had already been sent to the embassy on August 26th, 2013.  So it seems that my fiancee was correct to go to the embassy on Wednesday two weeks ago.  Why did they send her away. 

 

What does she need to bring with her in order to get her package 3 and package 4 and the interview date?  Is the copy of the email I posted above sufficient or does she need something else?

Thank you for the helpful suggestions.  It is not that we were waiting we just didn't know what to do.  The letter we got told us the embassy would contact us.  Immediately after getting the email address, I sent an email to IVDVACCRA@state.gov and received the following response:

 

Re: ACC201373XXXX

 

Thank you for your e-mail inquiry.

 

If you have not received a call in letter, the applicant may come to the U.S. Embassy Accra on any business Wednesday morning at 7:30 am to pick up the appointment package. The package will have the instructions necessary to proceed further with the case. Please be aware that the applicant will drop off this letter in the morning and then return at 2:00 p.m. to receive the package and interview date.

 

Please also bring a copy of this email to be admitted to the Consular Section.

 

We hope this information is helpful to you.

I have instructed my fiancee to return to the embassy again this wednesday to try to get here package.  This is the same thing that she had done two weeks ago, but maybe a copy of the email will make the difference.  I will post an update wednesday night in case anyone else has had a similar issue.

The case status says that the case is ready for interview when scheduled at the consulate, but we have not received any instructions on how to schedule the interview and she is turned away when she goes to the embassy.

The letter on August 27th was from the NVC and it said that a package had been mailed to the embassy and to my fiancee.  It's been a month since that letter and we haven't received anything and the embassy hasn't been helpful.  I am going there in October and hoping the interview could take place while I am there.

Hi everyone, my fiancee and I filed for 129F Dec 8th, 2012.  We were happy because on August 6th while I was visiting here in Ghana we received our NOA#2 in which we were informed that our case had been approved by USCIS and that her packet would be sent to the embassy in Ghana. 

 

The arrival of the NOA #2 was 52 days ago and still we haven't heard anything from the embassy.  I also received a letter from the state department 1 month ago on August 27th saying a package has been sent but nothing has arrived. 

 

My fiancee has been to the embassy twice(it's a three hour journey) and both times they have sent her away without giving her any meaningful direction.  (She has been to the embassy twice in the past two weeks to inquire about her application and the first time they sent her away telling to her to look for an email address online which we haven't found any option for.  The second time they told her to send a letter of inquirey by mail, but they didn't give her any address to address it to and told her she could find one online.)    I have tried to find phone numbers for someone to contact at the embassy, but haven't had any luck. 

 

This seems like an unreasonable amount of time to me.  Do we just need to be patient or should we be persistent and proactive and try to get some answers.  What is a typical amount of time from NOA#2 until the embassy makes contact?

Update on Abby and My Petition:   I am absolutely frustrated.  This morning at 730 AM she showed the embassy the email letter I mention letter and they admitted her this time.  She gave them the letter and they told her to return at 2:00pm.  At 2:00pm she went back and the Embassy said they didn't have the case!!!!!!!!!!  It was sent to them August 26th through DHL.  I am pretty sure it doesn't take that long to deliver a package!!!!!!!!!!!!!!!!!!!!!!

Dear VJ friends,

 

After NOA1, NOA2, NVC1&2,  the case is supposed to arrive at the Embassy and they are supposed to send a package with a call in letter to the beneficiary.

We cleared NVC2 on Aug 26th 2013, and I have our case number and sent an email to the embassy (IVDVACCRA@state.gov) and received the following response:

 

"the applicant may come to the U.S. Embassy Accra on any business Wednesday morning at 7:30 am to pick up the appointment package. The package will have the instructions necessary to proceed further with the case. Please be aware that the applicant will drop off this letter in the morning and then return at 2:00 p.m. to receive the package and interview date."

 

My questions are:

1.  Has anyone had this happen and have you gone to the embassy with a printed copy of the email to pick up your packages? 

 

2.  Will they schedule an interview for my fiancee when she goes to pick up the packages or does she need to do something else first? 

 

3.  What, if anything else, besides the printed copy of the email, and her Passport, does she need to take with her on Wednesday morning to get into the embassy and ? (she went to the embassy before with a printed copy of the letter from NVC stating the case had been forward and she was not admitted.)

 

4.  What happens next?  I know she needs a police report, and a medical exam(how dow we schedule this?), and that I have to send her documents showing financial support.  In other words what should we expect to have to do before the interview?

Yes, they have the case.  I contacted a supervisor from the NVC who called and confirmed that they had the case!  They received the case on August 30th so they have had it for over a month!

I am pulling out my hair.  I applied for a visa 129F visa for my fiancee (Abby) last December.  Here is how it has gone:

 

Dec 17th, 2012-  129F application received and in processing

Aug 6th,2012-   USCIS approved the application(NOA2) 

Aug 17th,2012-   the NVC received the package and on

August 26th,2012-   NVC said they sent the package to the embassy. 

August 30th,2012-   Embassy Received package**** (we received no notification.  Told this via phone by supervisor for NVC today Oct 2nd.)

 

NVC claims embassy has package and embassy claims it isn't there.

 

We have not received anything from the embassy acknowledging the receipt of the package.  Normally the embassy confirms the receipt of the package after about 5 days.  The embassy is supposed to forward a packet to Abby that tells us how to proceed.  It hasn't come.   Our case status when checked through the NVC says that it is ready for interview.  I have been warned by VJ members to hurry up and contact the embassy because it is even possible that we could miss our interview date. 

 

Abby went to the embassy in mid-Sept and they didn't allow her in because they only do visa consular visitors on Wednesdays  She went a second time two weeks ago on Wed and the didn't let her in because she only brought the letter from NVC saying it had been sent to the Embassy and she needed a letter from the Embassy.  I emailed the embassy with the case number last week and received an email back from the Embassy saying she could bring in the a printed copy of the email Wedensday morning and pick up the package in the afternoon received.  She went in this morning (Wed) and turned in the letter and was told to return at 2pm.  When she went back at 2pm they said they didn't have our application material! 

 

This is when I called the NVC spoke with the supervisor and learned it really is there (and has been since Aug 30th).  What do I do?  The NVC rep said to return to the embassy.  The embassy only allows consulate visits on Wed so it will have to wait a week. When I call the embassy and the consulate section never answers the phone (website says they answer between 3pm and 4pm-which is not true.)   The embassy is a three hour journey for my fiancee and she has to stop work (she is a teacher) in order to travel there.  I hate to send her back a forth time next week, but I don't know what else to do and I can't reach anyone at the embassy.  I have emailed them again. 

 

What else can I do?  Has anyone else had this problem with an Embassy?  I will be there in Ghana with her the month of Oct and I was hoping the interview would happen while I am there.

I filed in mid december and received the exact same notice?  Could this mean anything?  We were also being processed by Vermont.

 

I recently placed a change of address with the post office but haven't reported it yet to USCIS because I am not sure I will move permanently yet.  Has this happened to anyone else?

the embassy must have sent a letter to your partner's post office box, she has to check it, else it would just be sitting there. in case its not there when she checks, send an email to  IVDVACCRA@state.gov. and request for a pickup date for packet 3 and 4.

 

include in your correspondence/email the following:

* Your full name
* Your case number (should be a 10 digit number such as ACC2007123456)
* State whether you are the applicant or the petitioner
* Clearly state your question or concern in the subject line (such as Scheduling Question or DNA Question)

She went to the post office to ask if the letter had arrived.  They said that nothing had arrived at the post office(it's a little town) from the American Embassy.  I sent an email to IVDVACCRA@state.go and requested to pick the package up.  They responded with a (automated looked message containing our case number that we should print the email and then present it to pick up the packet.  She went and presented the email at the embassy and they told her to return in the afternoon to pick up the package.  When she returned they said that didn't have it.  Now what.  Wait a week and go back I guess.  I am really frustrated.
