K-1 Fiance(e) Visa Process & ProceduresWhat are some good examples of proof of engagement?
I'm there too - Proof of engagement to your fiance - I'm going to include receipts of my wedding dress and engagement ring (with pictures), and of our engagement announcement which we mailed, as well as email correspondence with a priest about marrying in his church. I believe, though, that it's *like* updated proof of a relationship information: updated letters of intent, new pictures of visits, boarding passes/passport stamps, and anything at all that shows one of you is leaving his/her country behind shortly and preparing to marry in the States.

Of course, I would also welcome any further suggestions! B-)

Simply try to keep smiling when people ask you, "So, when is the wedding?" and simply answer, "I don't know."

Hehe, I am practicing this too! Several well-intentioned (elderly) people have started with, "weren't you supposed to get married?" instead. At least I have a ring to prove to them I haven't been stranded.

K-1 Fiance(e) Visa Process & Proceduresquestion/ HELPFUL advice
Hi there,

Have you filed the I-129 petition yet (your timeline seems to indicate no) ? If you have not filed yet, I would say late October is cutting it very close - 8 months. My guy and I are coming up on our 7 month mark and our petition hasn't even reached our consulate yet (nevermind the backlog there). Once you get to the consular stage, it can go as fast as 5 weeks, but other folks with experience with Jamaica can give you a more accurate estimate.

In any case, I wouldn't put non-refundable deposits on anything for October...

I'm with JimVaPhuong on this one - it sounds like the OP's intention is to make it look like he is providing financial resources to his fiancee so that the consulate will believe their relationship is genuine when in fact, the OP is not providing financial resources.

We've established the money is not his, his relationship is the real deal, and that financially supporting our SOs abroad is perfectly legal and records of such support may or may not validate our relationship in the eyes of the consulate, depending on the interviewing country.

At this point, the examination of a sensitive conscience should alert you to the immorality of making things look different for your own purposes than what they are regardless of whether or not anyone has 'gotten away with it' in the past. The very use of this as an excuse suggests the very thing he US government calls fraud and your conscience knows as a lie.

Hmm, I'd copy every page in your passport and attach a note saying something to the effect of, "frequent crossings at Ambassador Bridge have not required passport stamps" ... I mean, they must know about the passport stamping procedures for Canadians getting into the States?

If you're going on the weekend, you could always try to bring your RFE and mention it to the agent at the border and see what they can do for you...

K-1 Fiance(e) Visa Process & ProceduresFiance Letter of Intent (another ?)
You should really send it to Texas - all the petitions should go there first and are distributed usually depending on where you live, but sometimes depending on the work load/staffing at the California/Vermont centers. You don't really get a say over where it goes, but do send it to Texas.

As for the letter of intent, my fiance and I wrote ours before we ever found VJ and we included quite a lot more about the sort of 'timeline' of our relationship starting with how/when we met, when we started dating, meeting each other's parents, and deciding to marry and we kept it to a page or less. I don't think it's all necessary - the point is, do you intend to marry and so one or two lines including "I, _____ am legally allowed and fully intend to marry _____".

K-1 Fiance(e) Visa Process & Procedureshelp please
Like previous posters have suggested, and you seem to be aware of, ignore the I129f approval (or rather, don't plan to make use of it). Obviously, USCIS is confused or mistaken or behind in their paperwork but since you've applied for the I130, it's important you pursue THAT petition and remind the USCIS again that you no longer wish to pursue the I129f because you are now married.

You don't *need* a lawyer to straighten this out, but you do need to send a few clearly worded letters indicating which path you are pursuing along with relevant file numbers.

K-1 Fiance(e) Visa Process & ProceduresFRUSTRATION and some questions
You may visit your fiance while waiting for your I129f petition to be reviewed but you are subject to whatever visa rules are in place for where you're going. You will visit Jamaica, I guess? I don't know what the 'tourist visa' rules are for Jamaica, but there is no rule against visiting each other.

As for sending your package, did you get a tracking number? This is the surest way to know what happened to it.

Hi there, and congrats on your approval! Now that you have a new case number, you can call the Department of State (here) and check what's happening with your application.

Once the NVC forwards your case to the consulate, they will send the beneficiary information about the paperwork needed for "Packet 3". Check this link out to see what's coming up, but I would read through the Mexico forums to see how things usually progress in terms of time or procedures, since some consulates only issue 'electronic' versions of Packet 3.

K-1 Fiance(e) Visa Process & ProceduresQuestion's on petition paperwork
Actually, photos together are not the most important proof and won't even be considered as evidence at all unless there are travel documents proving you were both in the same country at the same time.

You could try to print out the itinerary of the 2010 flight and include a note explaining that your passport was stolen (and include copies of the pages of your most recent passport) and hope for the best?

K-1 Fiance(e) Visa Process & ProceduresNOA2
It's a Notice of Action that allows the beneficiary to apply for the fiance visa, now that the petition to apply has been approved.

The USCIS will forward your petition to the National Visa Center where you will be issued a new case number, and the NVC will forward your case to the US consulate in the beneficiary's country. Eventually the beneficiary will receive "Packet 3" outlining the new set of forms required by the consulate in order to actually apply for the fiance visa.

This link outlines the process step-by-step: you've made it through step #4!

This link tells about how to get information about your case and whether anything new has been sent to you after the NVC assigns you your new case number.

Good luck with the rest of this process!

Are there any agencies that they are specifically looking for to translate?

It's my understanding you do not need a professional agency to do the translation for you - if you have a friend or relative who is fluent in both languages, they can do it, as long as they sign exactly as mentioned above, certifying that they are competent and that the translation is true and accurate. I've even seen people do their own translations.

Unfortunately, there is no way to work it out, even with a lawyer, so that you can use the K1 to enter the States now that you're married.

We heard the same - when we called at the end of December, we were told an RFE was issued to us December 20-something, but nothing had changed online or anything so we sent a service request etc, and a few days later, a new RFE was printed and issued dated January 5th. What a pain in the butt.

K-1 Fiance(e) Visa Process & ProceduresWhen to file
Well, to me it looks like you have the evidence you need to prove you've met within the past two years (the passport stamps/cruise information/flight information) and if you're looking forward to a spring wedding, I'd say file now. My guy and I filed in July 2010 and were hoping for a Christmas wedding, but at this rate, it'll be June or July again before we can finally be together.

Also, if you get an RFE, at least the longest wait is behind you and any information you send in will be looked at as if you're still next in line, so there's no harm in filing and then taking another trip for gathering more evidence in July.

I've nearly constantly had a tourist visa in my passport throughout this process and it hasn't influenced my application, as far as I know. I live pretty close to the border though so maybe my frequent crossings cause *less* questions because I do it so regularly?

K-1 Fiance(e) Visa Process & ProceduresK1 Interview relocation
Have you filed the K-1 yet? If you have, how long ago did you file?

Even if you marry in April, and apply for the IR1 visa instead, there is no "easy" (and definitely no "fast") way to get your wife to the States, even while waiting for the process to go through.

I'm going to go out on a limb and say all of us here are suffering through a much-too-long separation either by going the K1 or the IR1 route and there is simply no way around it if we want to live together in the States.

If you go the K1 route, you can have an engagement party but not a wedding party in Jordan - you must not marry until after she enters the States with the K1 visa. She may be able to get a tourist visa while the K1 is in process but you should check the Regional Forums to see the possibility of that.

If you do marry in Jordan in April, it is even more unlikely that she'd be allowed to visit you until she had the spouse visa (I thought it was never allowed for any spouse visa applicant, but I could be wrong).

The fastest way is a fiance or spouse visa (work visas take a very long time!). Both of these options could take between 8mo-1yr (give or take for "issues").

Take some time to read through the VJ Guides - they are a great source for information!

Well, technically your K1 expires when you leave the POE behind you and enter the USA. You do need to take measures to be allowed to stay, namely, apply to adjust your status before the I94 expires (90 days from your entry with a K1).

K-1 Fiance(e) Visa Process & ProceduresHELP PLEASE RFE Question*****
Not to the USCIS - they are really ONLY looking for proof you've been in the same country together in the last 2 years and they won't accept concert tickets as proof.

If the RFE specifically requests passport pages, colour copy every single page of your passport and send it back to them. If the RFE also makes other suggestions (boarding passes, credit card statements) send those too, but the other things you mentioned in the first post don't matter to the USCIS so much (though those items may come in handy at the consular stage later).

K-1 Fiance(e) Visa Process & ProceduresK1 or K3 ???
It's a tough decision to make, but you've come to a very informative place for answers!

In short, there is no "quick" way to be together :( My fiance and I decided to go the K1 route because when we applied, the whole year leading up to it, fiance visas were taking 5-7 months to be approved, and now we're into month 8 and probably have 2 more to go. Spouse visas typically take 10mo-a year. If you two are willing/able to travel and visit regularly, maybe go the K1 route because usually the spouse visa beneficiary isn't allowed to visit the US at all while waiting (I think?). If she can prove strong ties to Ireland, her traveling to the US (with proof you've applied properly etc.), entering on the VWP while waiting for the K1 is *usually* pretty straightforward.

Financially, the K1 visa is a like a spouse visa, PLUS a fiance visa so even after I get into the States and marry my guy, and $1000 has been spent on paperwork, medical, and interview, we'll have to apply to adjust my status which costs another $1000.

Being apart is the worst, but we're all getting through it. If you're determined to be together sooner, maybe look into what is required to do a Direct Consular Filing (DCR) from Ireland - you may have to live there a few years before you can apply, but you'd be together...

K-1 Fiance(e) Visa Process & ProceduresK-1 or CR-1?

thanks!
actually I don't oppose k-1 at all. the thing we are worrying about is how likely my fiancee will get her k-1, if we decide to choose k-1.....

The likelihood really is the same for K1 and CR1 - I don't think there's any reason the CR1 is more of a sure-thing than the K1 from everything I've read the last few months... For the K1 visa, at the USCIS stage, you only have to prove you've met in person the 2yrs before filing, and at the consular stage, "proof of a bona fide relationship" seems to be less of a concern than for the CR1 visa, in which case you have to provide more evidence that you're engaged in a real marriage relationship, which I personally think is more difficult when you're living apart...

I might be off base on this - if so, I'd be happily corrected!

K-1 Fiance(e) Visa Process & ProceduresTime stamps on photos??
No, it doesn't make a big difference. When you print the photos, a handwritten date and short explanation suffice.

Keep in mind the pictures themselves are not required, but can be helpful as supporting evidence for your passport copies and boarding passes which conclusively demonstrate your in-person meeting in the last 2 years.

K-1 Fiance(e) Visa Process & ProceduresInterview procedures
In some countries, (usually the high fraud countries) it's half-expected that both parties attend the interview, and in many of those cases, the presence of the USC helped "convince" the consulate that the relationship was bona fide. In other places, it makes no difference at all, and in some countries, the USC is not even allowed inside the consulate.

Hmm, that depends on which consulate you requested on the I129 form - you can be interviewed in either one, and you could even request a transfer (which can be a pain) but it will depend on the consulate you requested.
