IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting US with US citizen child board abroad
QUOTE (missing*him @ Sep 17 2009, 03:20 PM) <{POST_SNAPBACK}>
Hi guys,

Im not sure where to put this really, so thought Id throw it in here. In January Im going to be giving birth to our little girl up here in Canada. My fiance lives in the US. Instead of me moving down there, in the spring he will be moving up here since my exhusband wont allow my children to move to the U.S. We will be starting the paperwork process in late October or November.
My question is, after I give birth to our daughter I want to be able to bring her to the US to visit my fiance's family at some point shortly after. I went to the Toronto consulate website and it states:

QUOTE
U.S. and Canadian children under the age of 16 will be able to present a birth certificate or other proof of citizenship.

It takes about 4 months to get the birth certificate up here in Canada. So Im wondering if anyone here knows what the other proof of citizenship is? Im wondering if a copy of the statement of live birth is enough? Im hoping that I can fly down with her a couple of weeks after I give birth for approximately 4-6 weeks. Has anyone gone through this, or know what other proof of citizenship you can bring other than a birth certificate or passport for her since she wont have one yet?

I would call the border and ask them.

QUOTE (Varba @ Sep 18 2009, 09:11 AM) <{POST_SNAPBACK}>
Americana, you'll get there. The waiting game just really sucks, and noone wins really.

At least we have a support group full of people who completely understand - whereas family and friends can't even fathom what we go through during this process.

Without these wonderful people and a sense of humor, I'm not sure what I would have done.

With that said, I shall add my smilie to the mix of win.

Well, it doesnt look like IR-1's are getting October interview. Shall I keep my fingers crossed for Dec....2015(kidding) wacko.gif

I am also waiting for an interview and its driving me nuts. crying.gif but I shall try my best to keep sane wacko.gif
just wanted to say thanks everyone

Welcome to VJ, Americana. smile.gif

I am a IR-1. I married my Canadian husband almost 15 years ago and we have 2 beautiful girls 8 and 10. They are both dual.
This has got to be the most trying experience I have ever encountered. We feel like we are in a neverending state of limbo. Thank goodness for VJ because until I found VJ I thought I was the only one in the whole world going through the pain of not knowing and waiting. I will say so far everyone we have encountered at the Consulate and at the medical were extremely pleasant. And my husband passed. kicking.gif

I also filed DCF at the Toronto Consulate. Im not very good at this posting stuff so with my luck I probably put something in where it did not belong. Under the DCF, yes virginia you can topic I have my timeline written out it is probably more clear. helpsmilie.gif

CanadaCongrats, Americana2009!!
When I got home I checked my emails and nothing. But I am not to fret because the lady at DOS stated they mailed the letter yesturday.

I guess after the last interview issue I won't be feeling assured until I have something in writing.

Mind you I'm still as excited as a person can get. lol

And... I will definitely post my experience when we get out of the appt.

Thanks again

CanadaMontreal Consulate Interview Review
I am so happy it went well for you!!!!

Sitting at Gare Centrale waiting for my train -- did NOT think we'd be done so early so....
Thought I would write up my review for you all.

It is VERY long...
I will post it here and in the other spot too...
Thanks everyone for your well wishes on this -- I do not think we would have had this much ease of process if it were not for VJ.
Good luck to all of you, please PM me if you want to know anything else.
Here you go:

Okay all, so here’s my indepth review of our Interview/Montreal experience.... it’s probably gonna be long so... bear with me...

We got into Montreal a day and a half early and on the second day, we took a stroll by the consulate -- you would NOT believe how many people we saw with the ExpressPost envelope and xray envelope -- pretty crazy, actually. We took that time to actually speak to a very nice security guard who happened to be outside -- I told him that were just casing out the place for our interview tomorrow and he told us, “get here as early as you possibly can -- the line up forms fast and long...” he also told us about bringing our stuff in a bag and all the other things we already knew -- he was a super nice guy.

It was really warm THAT day but the morning we had to actually wait was quite a lot colder. we were up at 6 am and out the door by about 20 to 7, I went and staked my place in line while my husband went and got us some coffee and timbits... we shared those with the family next in line behind us -- they had two little kids and you CANNOT eat timbits while two little kids watch you -- not cool.

So at about 7:45 the doors finally opened and the guard let us in and put us through security. As we were first, we got the coveted letter A.

We were then taken to a small room until a guard came about 5 minutes later and took us up the elevator (we already knew which way to face!) We sat there for about 5 minutes until my name was called and we went into a booth where a very nice lady said hello and asked me for my passport, medical results and Expresspost envelope... she asked me to verify that the data on my ds 230 was correct and had me sign the second page. She did NOT ask me for any of the other passport photos I had or anything else. We sat down for another 5 minutes until she called us back and proceeded to take my fingerprints. That was cool. She said I had very good fingerprinting fingers (note to self: do NOT commit crimes without gloves! J/K). She was done with us and sent us back out to the waiting room and said that we would be called by name. We sat there for probably about 30 minute or a titch more -- in that time husband thought it was awesome to read all about the US in french so I had him every 2 seconds going, “what’s this word in english?...” fun times as I’m not nervous or anything! ;)

So, at that point, the waiting room was really full of people -- like jam-packed. Finally they called my name to come to room 7 and we both went -- it was show time! When we walked in, it was an enclosed booth in a room... behind the glass was a really nice woman -- early middle age, long straight hair and very nice. She had us swear, right hands raised, that everything we had/were going to say was the truth and that we were under oath. She then asked me how we had met, when was the first time we met in person (we had met on a travel website quite by accident, FYI) and when I answered she asked my husband to confirm my answers. She asked me what my husband did for a living and then she asked him if had medical insurance in the US and he answered that he did. She asked me if I’d ever had any trouble at the border, “no” , If I had ever been arrested anywhere in the world, “no”. Then she said, “you must really like hats”... I said “oh yeah, i sure do” I realized it was because in the wedding photos we had sent in to the USCIS waaaaay back when, I had sent some wedding pictures of us and in them, I am wearing a vintage hat from the 1940s... so... in my books that was our ‘trip up’ question? not sure, but it was good on her part -- i think she really knew what she was doing. But, I do like hats and I was wearing one and... we’re a bonefide couple so... no worries but maybe if we weren’t legit? Anyway, it was one of those questions that made me think, oooh, trying to trip me up, are you?

Anyway, she then asked my husband, “when did you ask LGG to marry you...” we both laughed as he and I always talked about marriage and what we should do about us and how and everything like that but in the end, I asked him (told?) to marry me when we were in the bahamas. he got the locale right but he said a year early. I corrected him and he was like oh yeah! I had a minute of panic but it didn’t seem to mar us at all. She then asked us to confirm the date that we got married. My husband has the WORST memory of anyone alive -- he really is a scatterbrained/genius scientist type. But, all in all it went well. after that last question of when we got married she said, well, that satisfies me, and this all looks good, I’d like to welcome you to the United States! And we were both really happy, I clapped my hands and was Like thank you SO much and my husband, true to fashion goes, “right on! we’re early enough that we can still go get breakfast!”

all in all? Everyone in Montreal was super nice, super friendly and very efficient. I have zero complaints about anything -- they are doing their job and they are doing it well. We had a really nice experience and really enjoyed our time in Montreal, our time together and the whole interview experience.

My husband bought me a montreal canadienes shirt so I could have it with me in the US. They are my team and Montreal, my city FYI... .

So, enough rambling. My words of advice? Be early. As early as you can. dress warm for the weather -- we were lucky, it was pretty warm. If you were prepared for all the other steps, you will be fine for this one. What I suspect? Is that even before you get in there, they pretty much already know that you are approved or not -- I doubt very much there is too much one could do to screw it up...

So, if anyone has any questions or wants to k now anything, please PM or whatever, I am truly happy to help. We had a really good experience and I hope our POE goes just as well.

I am very much looking forward to my getting my passport back with my visa in it.

Talk to you all later...
xoxo
LGG

Canadaanother Canada/US tax question. pls help im confused!!!

ok ok i am more confused with the taxes now that i went on CRA and reading a publication for emigrants of canada 2009 and spoke to IRS and the person i was talking to was grumpy.

please tell me if i'm right.

1. i file my canadian taxes w/ section 217 as i collected EI & earned canadian income for 2009???
2. i file my us taxes w/ form 1116???

i really dont want to take this to H&R block as i live in a small town and there aren't a lot of immigrants here. Im afraid H&R block will just screw up.

can someone post the thread about US/Canada tax??? i cant seem to find it.

There is a tax place in Niagara falls, Canada that is excellent in doing can/us taxes. They have been doing mine for the past 7 yr. This year we are moving to the u.s.(I am an American Citizen currently living in Canada for the past 15 so I've been doing taxes for both countries for that amt of time) Anyway I talked to them about moving and they said they will do everything through Parcel mail. If you are interested I can give you the Name and number. When we move that is the way I am going to do it because doing taxes in both countries can get sticky.

CanadaIR1 / CR1 - Montreal Timeline to Interview

Hi all! Got back from Montreal last night and now finally have a chance to sit down and post our review after all the celebrations have died down. We got our "welcome to the United States" speech! Overall the toughest part was waiting in that below freezing weather for 1 hour before they opened the doors but when your inside the building, its a cool summer breeze. By the way Americana, you were not the only VJ poster there that day!

The whole process is very similar to what LGG and Americana have already stated. Got there around 6:40ish, which made us the first in line (beating another couple by a mere 5 seconds) and the doors opened around 7:45am. The interview was no more than 10 minutes. The officer basically had all our papers that we submitted and we never had to even open up our folder. The bulk of the interview time was spent on the officer examining and re-examining our docs, especially domicile. The basic questions were asked like how did you guys meet, where you met, when you met, how your families know each other, what we both do for a living. A whole 1 year process done in 10 minutes!

We asked the officer if we could get the visa same or next day but he would hear none of it and kept stating "it has to be mailed out". By the experiences of other VJers, it looks like the approximate wait time is 3-4 business days after interview.

Thanks for all your help guys!! Will post when we get our visa in the mail!

Hey congrats!! We must of been talking in line then, glad everything went well for you.

DFC'ers!!!
Domicile is the one thing you really need to pay attention too. I thought I had plenty but as you can see I had just enough.

Make sure you have a deposit on a lease, not just a lease agreement, make sure you take a copy of the bank statement that the check goes through on. I almost didn't take that. Got it in the mail just a few days before interview

If at all possible enroll your kids ahead of time (before you move)

These are two really important things.

Montreal is pretty strick on DFC. So make sure you get as many ties as you can.
Hope this helps

Here is our review:
6:25 am left hotel (LeTour and no bugs!!) It was too cold to walk farther than that.
Went to Timmies on corner and got coffee. Went back to Consulate and 2 couples were there. We all chatted and everyone knew about VJ but no posters except myself.

7:30 doors opened officer looked at passports

officer gave us a list of stuff to have out, went through our things, and sent us downstairs

sat for about 5 minutes and then we got sent upstairs in an elevator.

My husband was second to get called to window 9 the guy was really nice and took our passport pictures, our originals, and AOS, and our envelope.

He then sent us to pay. Computer was down so we had to wait in the meantime the same guy called my husband back to window 9 and took his fingerprints and sent him to wait til the computers were up so we could pay.

10 minutes later the computer was back up, we paid and within 10 minutes we were called to room 7

The lady came in and and swore us in. This is where it gets exciting...
She asked my husband why he wanted to move to the U.S. and he told her

As soon as we were sworn in she stated she couldnt issue us a visa at this time...(I was panicking!)
She said I had no info that indicates that I am moving.. I stated yes I do but no one has asked for it..

I hand it to her and she looks through it and again stated that I havent proven domicile. She said it looks like I've done alot of research though...

I pointed out that I've actually filed all my childrens immunization records to sc to dept of health to make sure they are up to date

she said yes i see that but you haven't enrolled them in school

I agreed stating that It is a private school and they said not to enroll them because we have no move date and therefore they didnt know what the fees were.

I showed her the letter from my family stating we would be living with them until we found a house and the house rental agreement. She questioned why I had 2 addresses, I said I don't but originally we were staying with family but we found a house when we went to visit She again stated she didnt see enough domicile evidence. She then asked about our moving co. I said we were using u-haul or ABf and showed her the quotes. She asked why we haven't booked anything. I stated nicely that we didn't have approval from immigration or a date.

She again stated I haven't showed enough domicile. I said but i have a rental agreement and a deposit.

She stated that anyone can write an agreement and photocopy a check..It would be different if it was cashed.

I stated it was CASHED, and I showed her the bank statement.

By this time I was a wreck (my husband thought I was gonna loose it, meaning cry)

The next thing she said was "I feel you have showed me enough evidence of domicile" and she turned to my husband and said "WELCOME TO THE U.S.A."
The only thing I could do was say "thank you...but you scared me"

My husband asked how long it takes to get the visa and she said 2 weeks and handed us a letter.

We again thanked her and went on our way.

Hi americana,

That looks pretty good. You mention you found a place to rent, are you just waiting to get the visa before committing to it? Have you exchanged emails with the person who would lease it?

Lately Montreal has put a lot of emphasis on a 'proper' lease, even with relatives - so if you can get one before Monday it might be a good idea. (Doesn't have to be anything too fancy!)

I assume your children are U.S. citizens, did you have to document that with a report of birth abroad? If so that might be something to take as well. What about schools for your kiddies, have you looked at that or inquired about that, so you might have an email from one?

Anyway, not saying your proof will fly or not - in any way, just thought I would throw a few ideas out there.

We are commited to the rental the landlord is aware of what we are going through and made it an open lease til we go through immigration.
We have the info for the childrens school but they aren't enrolled yet because its a private school. We have actually had a tour and everything when we went down there. The admissions dept said to wait til we get down there because of the unknown move date( when we go to Montreal and sell our home)
Our children are U.S. citizens born abroad and they also have thier passports and SS cards so hopefully that will be enough.
The only reason we havent put our home for sale yet is because the last time we sold our home it sold in 4 hours with a 30 day closing and with not knowing when our appt was until 2 weeks ago we couldnt take that chance. We already have 2 people wanting to look at our home and its not listed yet. We are listing it as soon as we get the ok from Montreal. We also have pictures. Another thing I hope they consider is we have been together since 93' and married since 95'. I guess we will have to see...

ok guys and girls, I am all set I think, I hope. I will definitely post my review. as far as establishing domicile here is some stuff I am using:
Approximate insurance quote for our vehicles
our compliance letters for our vehicles
a letter from relatives stating we will be staying with them, mind you we did find a home to rent
I am using a letter I recieved from my employer after I told them my husbands interview was monday
they wrote me a letter stating they are aware that I am returning to the U.S. and will be giving me 2 letters of reference instead of the standard one.
The information I recieved from the SC dept of health for my childrens immunizations
Our rental agreement on the home we are going to rent
The ABF quote I got in August and the ABF quote I did yesturday
U-Haul quote (I don't know which one to use yet, we aren't sure)
Proof of u.s. bank account in area near where we are moving
experience letter from our insurance company
I PRAY THAT IS ENOUGH, I dont know what else to use...lol
...and yes, EXTREMELY NERVOUS My husband is ok though...lol     :crying: :crying:   :star:
