Love isn't the only "legitimate" reason to get married, and love is not required for a bona fide relationship, per the USCIS definition.

I remember seeing something on several of the zillions of forms we filled out explaining the required documentation if the petitioner and beneficiary have not met (presumably because of an arranged marriage situation). That this is included in the forms suggests that it's not uncommon. It would be interesting to know the statistics.

I agree that this particular situation sounds tricky, but it's for the USCIS to sort out, if it even gets to that.

This topic piqued my interest, so I did a little bit of research. It sounds like what you're thinking of doing is close to what an immigrant consultant does. It appears that in the U.S. (as opposed to Canada), there is no certifying authority or professional association, and anyone can offer his or her services to people who need assistance with filling in immigration forms. However, it looks like they are not supposed to give legal advice of any sort, and how much they can charge varies from state to state.

Your business idea sounds like a very tricky proposition. Initially, you'd have only your experience and the anecdotal experiences of others on which to base your knowledge. There is a reason that immigration lawyers exist: it's a really complicated area! I'm not sure exactly what services you guys are considering offering, but also keep in mind that many charities and nonprofits exist (Catholic Charities, for example) that offer free or inexpensive immigration advice and employ lawyers and paralegals. I know that some of us feel like experts because of all we've been through with this lengthy process, but I wouldn't feel comfortable being paid to advise someone about immigration. The possibility of something going wrong would give me an ulcer!

I wonder if perhaps you could consider shifting focus. Instead of thinking in terms of assisting with highly complex immigration issues, which could be fraught with complications, you could concentrate on something practical for new arrivals from the Philippines, like resources for relocation issues, or where to get Filipino groceries, or how to deal with culture shock, etc. (This is just stuff off the top of my head.) I’m sure there are ways that you both can use your experiences as the basis for a good business idea, but I’d steer clear of anything that could be construed as legal advice. Assisting w/ document preparation definitely seems like it would fall into that category, no matter what disclaimer someone is willing to sign.

VJ is a free forum for people to relate their experiences; it’s entirely different from providing immigration advice as a paid service.

I was under the impression that drug testing is not part of the K1 medical unless the doctor suspects drug abuse. I know my husband was not tested for drug use.

Most illegal drugs, even weed, will not show up in standard drug tests after abstaining for a couple of weeks. Although THC metabolites can remain in the system for several weeks, in standard drug testing (e.g., the preemployment type), the concentration required for a test to show positive is pretty high.

If he doesn't smoke for a month (or do any other drugs), he'd certainly pass a drug test, but it is uncommon for a drug test to be performed as part of the medical. It does happen, but it's not the norm.

My husband was not asked about drug use in either of the interviews (K-1 & AOS).

I wasn't kidding...they did indeed buy an old ice cream truck and fixed it up. The trip was somewhat inspired by Nice Dreams (I wouldn't have remembered the title) and the book Elvis Presley Boulevard--"Give us this day our daily Elvis." The truck was their El Basurero but a bit more reliable because one of the guys was a mechanic.

Years later, of course, Borat found similar inspiration. And I'm sure there are other movies involving ice cream trucks.

If you look at that you will see it does require an affidavit of support, which means you need to have a job that can be verified as well as an income that is at least 125% above poverty for 2 people. If you don't not have a job you are going to have to have a co-sponsor because you have to be able to prove that you can support her and she will not need government assistance of any kind

Yes they want your maiden name listed here, because if they need any background information then they search by previous names, so if you have any other names, if you have filed for a name change at any time then that needs to be listed as well

Who is "they?" I've never heard of any such requirement.

My apologies, I looked through the instructions again and it doesn't say that, think its the canadian passport pictures i was thinking of. and "they" i was referring to the NVC but anyway i was wrong :) i don't know how they tell if they are more than 30 days old - and i thought it was 90 days but the instructions for the I-130 says 30

C. A passport-style color photo of yourself and a passport- style color photo of your husband or wife, taken within 30 days of the date of this petition. The photos must have a white background and be glossy unretouched and not mounted. The dimensions of the full frontal facial image should be about 1 inch from the chin to top of the hair. Using pencil or felt pen, lightly print the name (and Alien Registration Number, if known) on the back of each photograph.

They require that the photos are date stamped on the back and with the photographers name, 90 days is 90 days, 6.5 months is too long about 190

Your notice for what to send should tell you the photo requirements, USUALLY i believe it says that the photo has to be taken within the last 90 days I think.

Ok, so i have a couple questions about the I-134 i guess.

My fiance is starting a new job next week, which is really good, but he really wants to go to school in november, he got approved for a respatory therapy program and now is having a really hard time deciding between starting this new job or staying with his job he has now and going to school in november which is what he really wants to do, its a hard decision, and i told him that if he went to school i'm not sure how good our chances are that we can prove he can support me, we dont have anyone to co sponsor and im just afraid that if i tell him to go to school (cause i want him to be able to do that) that we will get declined and i wont be able to get my visa.

anybody have any suggestions or know how it works if someone is in school how they can prove support? I just dont want to hold him back from doing that, but at the same time right now we just need to do whats best for the visa. sad.gif

I was able to find on the application for CRBA that you do need to still have the mexico birth certificate, so that will have to be completed before actually applying for the CRBA. but then the child is still listed on the fiance visa correct?

The child cannot get a visa if he is/ has a claim to US citizenship. They will delay mom's visa until the child gets CRBA (Consular Record of Birth Abroad).

The “old” Section 309(a) of the INA is applicable to individuals who were 18 on November 14, 1986 and to individuals whose paternity had been established by legitimation prior to that date. Individuals who were at least 15 on November 14, 1986, but under the age of 18, could opt to have their claim determined in accordance with the provisions of either the “old” or the “new” Section 309(a).

Thanks for this information, just have a couple questions about that now that I look at it all. reading http://www.uscis.gov...pAct_022701.pdf states a $160 filing fee and seems to state that since the child is living outside the US that he needs to file here and then the process is completed once the child is brought here as well, I dont see where we can actually do the registration in mexico. also, is it easier just to include the child on the fiance visa application and then register him as a US citizen once here, or is it better to do his citizenship separately?

thats what I'm not quite sure on, child is his and he is a us citizen born here, child was born in mexico and never registered here or anything so I'm not sure how that works.

Hello,

On 1-19-2012 I received email confirmation of receipt, a number for tracking on the USCIS website, and I was told my application was transferred to the CSC.
On 1-23-2012 I received a 'touch' on the website
On 1-24-2012 I received my I-797C NOA with receipt number for tracking

My question is, how do i know the CSC actually received my application? I have had no touches since what I listed above and I worry that it was mailed and not received.

The website does not update the tracking very good TBH. During my K-1 visa process it didn't update at all since receiving the packet and then when i received it in the mail THEN the site updated. I just went through my ROC and the site again never updated from the initial processing, it now says that my Green card has been approved and mailed out, but i already have it in hand lol so its pretty inaccurate and does not update very good

" We have always filed an I-130 petition with the I-485 application once the applicant for the K1 is inside the U.S, to provide a more thorough application. We have done this in every case, and have never received an I-130 returned as unnecessary. (Believe it or not, the USCIS will often reject and return filing fees when a petition is not needed). We have followed this procedure as a safety net."

Ok, time to follow the advise of the people here who have been through the process and helped others with the process 100's of times. I did the exact same process you are going through as have many others, you do NOT file I-130 with your I-485. the I-485 is for AOS which is what you need to do, the I-130 is the petition for an Alien Relative, which you will not be because you will already be here on a k-1 visa, no further petitioning is needed because they will have already approved for you to be here, you just need to file the I-485 to say "hey, i did was i was told and got married within 90 days and now i wanna adjust my status and get my conditional green card" now please fire your lawyer lol and we will all gladly go through the process with you because it is SOOOOOO easy to do on your own if you follow the instructions correctly, and if you have questions ask us :) :thumbs: (F)

You probably won't get a malpractice suit at all with this, technically she didn't do anything severely wrong, she has other cases that have been approved so they will look at that and be like nah she did everything fine, and you didn't actually file the I-130 so you can't use that (please note that i am not in any way taking her side cause i think she is seriously messed up in her information and should not be doing immigration applications for anyone or giving advice) I'm just looking at it realistically that you probably won't win any kind of suit or get any money back unless you flat out get denied, which isn't going to happen, at worst you will get the RFE which i know your not worried about at all. Does he have any friends or family that are not in that city that would be able to visit him and take the letter to be signed and then mail it to you for him, just thinking it might save you some money even if you had to provide a little money to make the trip, would it save you a good amount of money to do it that way?
