Version 1.2 !!!

LOTO,

DO THE DOCUMENTS LIKE THE PHOTOCOPY OF PASSPORT'S BIOGRAPHIC DATA PAGE OF THE BENEFICIARY AND THE BIRTH CERTIFICATE OF THE BENEFICIARY HAVE TO BE TRANSLATED?

ALSO, I LIVE IN FLORIDA SINCE JAN 2007, BEFORE THIS DATE I LIVED IN PUERTO RICO. IN PUERTO RICO WE DO NOT FILE FEDERAL INCOME TAX, ONLY STATE INCOME TAX. I HAVE THESE RETURNS WITH ME... DO I HAVE TO TRANSLATE THESE RETURNS ALSO?

I APPRECIATE ALL YOUR HELP TO ALL OF US....

THANKS IN ADVANCE

kelvin_omar25, Passport copy will be in English, right ? If birth certificate is not in English, you need to translate it. Here is the link for more info:
http://travel.state..../info_3176.html

If you have only state tax copies for the remaining 2 years, you need to submit last 3 years W-2/1099 with tax return documents and write a letter as attachment stating Federal return was not needed during those years. For more info, please refer the instructions in this link:
http://www.uscis.gov.../form/I-864.pdf

Thank you very much for taking the time to answer my post.

I have one more question. When we send the DS-230 form... do I have to submit these documents for the beneficiary only or also for the US citizen?

Thanks,

Kelvin

HI EVERYONE!!!

I MADE AN ERROR ON MY G-325A. USCIS RECEIVED MY APPLICATION ON 05/08/08 AND I RECEIVED MY NOA-1 ON 05/12/08. LAST NIGHT I WAS LOOKING AT THE COPIES I SUBMITTED TO USCIS AND SAW THAT ON MY WIFES G-325A I PUT THAT SHE HAD WORKED IN VENEZUELA FOR 5 MONTHS... WHICH IS TRUE... BUT I HONESTLY FORGOT TO PUT THAT IN THE LAST 5 YEARS SHE LIVED THOSE 5 MONTHS IN VENEZUELA...

MY WIFE LIVES IN COLMBIA NOW....

WHAT SHOULD I DO?
SHOULD I CALL USCIS?
WILL THIS RESULT IN A RFE?
HAS ANYBODY MADE THIS MISTAKE?
WILL THIS DELAY MY APPROVAL?

PLEASEEEEEEEE HELPPPPPPPP!!!

She came here legally, so she is ok. The only issue will be the overstay of her visa if she does not leave before it expires. As of now, once the I-130 is approved, she can adjust status in the US. If she overstays, she will have to file an I-601 for illegal presence in the US. It makes the case a little more difficult. I hope this helps a little

CAN SHE BY ANY CHANCE DO ANYTHING TO EXTEND HER WORK VISA?

Hello everyone this is a photo of us dancing at our wedding, we got married on July 19, 2007, we married in the office of a mosque, in El Jadida, Morocco,

This is the party we had the week after to celebrate the wedding, we had to give the family time to travel, so we waited the week for the party, but got married as soon as we had all the paperwork complete, the paperwork alone just to get married took three weeks,

and we thought we waited then, here is where the real wait happens

I hope everyone is doing well and is not driving themselves crazy like I am , checking and re-checking the mail. email. USCIS website, Visa Journey, and anywhere else you might get your info from, hey yeah is there anything I haven't mentioned that someone else may know of, like another website.

well lots of luck to everyone,

oh by the way I wish I was wearing flip flops and jeans, this was the second dress I had to have for the wedding the first was for the henna ceremony,
maybe i will send a pic of that,

the purple dress is wedding ceremony, and the green dress is from the Henna ceremony,

Have any of you written to your Congressman for assistance? Are you calling USCIS regularly? We called USCIS for the first time this week and was essentially told to go away, as ive read here many time before, and told to expect to wait at least another 4 months unsure.gif

We are looking to know we are not the only 2007 filers out there still waiting crying.gif and if you have any tips at all on how we can improve our chances of approval (I know there probably aren't any, but its worth asking we hope)

Thanks

We applied October 29, 2007, sad thing is I have applied for the I 129 F two years ago, it was approved and my husband had his interview, everything went well except for the fact the petition expired in CSC, why it went to california, I don't know, I live in Orlando, Florida and at that time, i was to send info to Texas Service center, so actually we have been waiting three years
not on this petion just in general

well good luck to everyone

I am so sorry. SOmething is wrong there. Have you written to anyone concerning your case? If not, this would be the time to involve your Congressman.

I have contacted VSC and asked for an expedite, they said I don't need my case to be expedited on the grounds of lack of income, they said i have raised my three kids this long withouth the help of my husband I can continue to do so until he gets here, but there is nothing they will do right now for me
right now I am in the process of writing to John Kerry , he's not the senator of my state but I figured that in 2004 I helped with his campaign here in kissimmee, I have spoken to someone at his office and i have the fax number and all I am just getting things together for it

There has been so many things that have happened to me in the past years, and its really putting a strain on me, and I work in a hotel and because of the recession, hours are just 40 per week, which i can just skim by on
It is getting tougher everyday, and lord only knows when i will be able to see my husband again, the tickets are so expensive,
argh
I am beyond frustrated,
good luck to all

I had wondered whether it was possible to make a class action lawsuit, for all those stuck in long delays? There has to be a financial amount in dispute of at least $5,000,000 however for this to be possible and someone has to be the lead plaintiff. I guess one could include the filing fee in that if there were at least 5000 VJ petitioners with extended delays? Those whose cases never get processed within the published processing time ought to be entitled to having their petition fee refunded, wouldn't you agree? At least this way there would be an incentive for them not to delay cases without very good reason.

they shouldn't get paid until the job is done, hell why should they work if they already have the money, they are like scam artists

IR-1 / CR-1 Spouse Visa Process & ProceduresThis really pissed me off!!!
Hello fellow lurker, i hardly write anything here either, but you brought up something that has bugged me for a long time, I work in a hotel in Orlando, a very well known hotel, we have many J1's , they are from all over, Argentina, Romania, Peru, and the biggest influx that is there now is from the Phillpines

I can't tell you how many times that these people have come to me and friends of mine and are looking for husbands and wives, its incredible, I can't begin to tell you how many people have married american citizens already too, and quickly got the girl pregnant,

one such case I thought of the guy as quiet and nice before I knew what trick he had up his sleeve, I knew him from the time he got to the hotel, he had a fiance back in his country, all of sudden he is married to an american and now she is pregnant

Not only this, I here from the Mexicans who are working at the hotel, telling how they crossed the dessert and some point and were picked up by an american labor company

I am all for people coming to this country, hell my grandparents were brought over to Ellis Island way back in the day, the late 1800's and early 1900's, I understand people want a better life, but we suffer because we are doing the legal thing.

I have a lot of venting to do, this is just the beginning, I have waited for four years now to be with my husband, because our original case which was an I129 F was approved but later it expired while it was in the hands of immigration, and then I was unable to travel to see him because of airfares being so high

So here we wait together, for a long long time,

Good Luck to everyone,
Kathleen

I am applying for CR-1 Visa for my wife. We were married in September 2007 in Casablanca. I just sent in the DS-230 to the NVC and they sent back letter stating that the marriage certificate is not a valid original. All other documents are ok.

It is the certificate that I was given from the Adoul (judge) that performed our marriage. I had him make two originals one for me and one for my wife. We use it to travel in Morocco because it is required for stays in certain hotels. It is valid in Morocco.

The person I spoke at NVC said its been reviewed twice and they still said it is not valid. I told him the story and asked what do I do to send valid certificate and he could not answer me. I asked to speake t a supervisor and he put me on hold and came back to me with same answer. Its not valid but they dont have answer as to what I should do and I can't talk to person would reviewed document.

As anyone experineced this problem. Any help appreciated
Thank you

Ernie

Hello sir, I was married in El Jadida, and i am pretty sure there was the paper from the adoul , then we had to take that to the court, they had to make another paper, with a stamp on the back of it, or maybe i am confused, maybe the one with the stamp is from the adoul
I have another that is on a long green sheet of paper, with stamps ,
I will send this message to you to get you to understand
i will look into my papers in a little while to see if what i am writing is correct

My husband phoned CSC and requested expedition of the I-130, but the online status doesn't show any touches after that, is this normal?

If you have requested expedition before, can you share with me whether there is any touch generated after the expedite request?

I as well called and asked if they can look at my case, they said everything is ok, they asked would you like to expedite your case I said sure, they told me what I had to do, later that day i got an email that denied my case

I called again yesterday and the same thing, denied again
and never a touch to my case

and this afternoon I received a letter in the mail with the same denial, and still no touches,
I am at my wits end, I am raising three teenagers by myself , never had child support, argh I can go on and on but I will spare you,
I don't know what else to do , but wait, and wait and so on and so on and so on, like the old faberge organic hair shampoo commercials, all i can say is argh

IR-1 / CR-1 Spouse Visa Process & ProceduresAnyone waiting for NOA2 from VSC who filed in DEC/JAN ?
I'm an October 2007 filer and still nothing,

this is our second run through

in 2005 we applied for I 129 F , it was approved, but it expired in there hands, in California

Its been a long time to be without each other, and I have only been able to see him every two years,

Our first wedding anniversary is comine up 7/19 and for sure we won't be together, i will be here and he will be in morocco, as usual, they haven't even looked at my case

I asked for an expedite due to financial hardship, I have three children and no child support and they refused my expedite
they told me I live in Orlando, Orlando is expensive, but I have worked in Orlando for the past 10 years for the same company

I have lived here for 15 years, I don't know how I am supposed to be able to move, I don't understand how the woman in VSC could have told me this, it seems ridiculous to me

any way , just to let you know you are not alone and some of us have been going through this for an un-necessary severly long time
its not fair ,
I hope your case goes well

All of us are waiting, I understand its hard, but some of us like myself are waiting much longer than what you have waited, I haven't seen my husband since August 9th, we were married on July 19th after waiting for all of the paperwork to be completed to allow us to marry while I was there in Morocco,

while I was in Morocco I was away from my three kids, which was so difficult but it was the only way to get married, i wasn't able to afford taking all of us to Morocco,

So anyway a lot of us go through many things to be with the one we love, I see on here where people congratulate others and tell them how they have had such a hard journey where in fact they are able to be with there spouse at any given time, where as some of us don't have that luxury

Maybe I am just venting but really you just got married, I am about to spend our first wedding anniversary WITHOUT my husband, but I will wait,

I have tried to expedite, but I have been told many things by the people in VSC who seem to think that I should move out of Orlando, which is where I live and work for the past ten years, because Orlando is expensive, they told me that I have struggled raising my three kids alone for the past 17 years so I can continue to do what I have been doing and all they can say is for me to wait for my husband to get here, they will not expedite my case

So you know maybe think about others on here that have been waiting much longer than you, and way much longer than others who are already approved and have also gotten an expedite by luck,

Its a long process and it svcks,

this is my second time around on this damn journey I filed two years ago, my case was approved it was an I 129F and my husband had his interview all was good, the only thing is he had his translated birth certificate, he was given a paper stating he needed to return to the consulate within a year to give the original birth certificate, he returned the next day , and you know what our case was delivered back to the US and it was sent to California where it expired,

I am a natural born American Citizen and I can't get my husband here, My parents were born in this country, my father fought in WWII for this country and I can't have my husband here,

Don't tell me about you have waited long, because buddy you just started waiting,

I am so aggravated its unreal,

USCIS Svcks
VSC Svcks MORE

Sorry for venting but you have to understand its disturbing to hear someone who just started this process have nerve to complain, You know I don't post much on this site I just read and congratulate here and there, but you know what, we are all going through this so stop whining
hate me if you will
but i am honest and probably saying what others are thinking

I am here if you want to talk and if you are frustrated as well , but its sad to see how you think you have waited so long

i will regret posting this because this maybe sounds terrible, but Its annoying already

IR-1 / CR-1 Spouse Visa Process & ProceduresI 130 petition sent on October 9
QUOTE (KIMF @ Jul 3 2008, 01:46 PM) <{POST_SNAPBACK}>
Hi

Has anyone had any updates. On July 9 it is going to be 9 months since I sent in my I 130 petition. I am an IR1 CR1 filer.

I dont know what to do. I am pregnant and things are really getting hard. Are they still processing petitions from July? Is this possible? Has there been any approvals from Vermont?

Kristy

I sent in the I-130 on September 29, 2007, they received it on October 4th, NOA1 January 8, 2008. Last touch February 24, 2008
that's all the info I have on my case

Kathleen

Good Luck to you and everyone else

IR-1 / CR-1 Spouse Visa Process & Proceduresoctober Filers CR1
I'm still waiting too, I get the same answers whether I call uscis or the vcs, they give the handy website and the oddly enough they give the number you just called to get to them in the first place, ODD

so here is my timeline, and let me start by saying this is my second time through this waiting ordeal, three years ago we filed for I 129F it was approved, but expired so here we are again, three years later , five years into the relationship and still nothing, we filed our I 130 and it was accepted, no touches, nothing

I 130 Sent September 29, 2007
received October 4, 2007
accepted January 8, 2008
put in system February 24, 2008

since then I haven't heard a thing, I have called VCS and one lady said they are about to move my case to another building, that was a few weeks ago, since then I have heard nothing. I asked for an expedite, being my income is low, and I am raising three children and it was denied

I don't understand this whole process

I don't understand why they are still accepting J1 visas in this country while we are in a recession, it makes no damn sense at all,
anywho thats all I have to add for now

take care and good luck,

I am the new Delicia, waiting for ever without approval, LOL

K-1 Fiance(e) Visa Process & ProceduresLetter from employer for affadavit of support
hi, does anyone know if a form letter generated from HR specifying a person's salary and length of time at the job will suffice for the affidavit of support? i mean, as opposed to my co-sponsor's boss putting one together.

Is there a form I need to fill out with USCIS if I move before receiving my NOA2? My old address would be my parents so there is no issue in not receiving the NOA2 when it does arrive. The only address change form I saw on the USCIS was for an alien changing their address.

Thanks, I will try that. Since I am having a co-sponsor they will not really be focused on my assets anyway, don't you think?

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support - assets?
Hi, I was wondering if anyone had to get their letter for the I-134 from an online bank. The bank with all my savings is only an online bank, with no branches. Also, can I count value shares I have with the previous company I worked with? I don't exactly own the shares, but when I exercise them, they are worth a lot of money, depending on the current stock price. And could I include my 401k?

Two more questions, I'm seeing how several people have included tax information when they do their I-134. Does this mean its required even though the form says you need it only if self employed? Or does it vary for different situations? My father is my co-sponsor and his salary will be enough - we already have the letter from the employer.

Last one, when it says duplicate evidence, I assume that means two copies of each bit of evidence you are submitting, right?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresUSC Visitng Me, Surprising outcome
I have been to London 3 times this year and each time debated whether to mention I was visiting my boyfriend and then later fiance. Each time I end up saying I'm here for a vacation, which is entirely true as well. Plus, I always brought with me a copy of the NOA1, which is all I have right now, just in case they wanted proof that I was definitely going back home. Of course, my trip(s) was only for, at the most, one month. Sometimes they did want to see my return flight information. I hope to go and be in the country when he has his interview and bring him home, so there is likely to be another trip to the UK in the next few months.. hopefully soon!

But like someone else mentioned, I usually have more probing questions upon return to the states. Its easier going into the UK than to come home!

question 5, yes letters from people attending your wedding would be helpful. #6 airline tickets, copies of passport with stamps showing you have visited, pictures are very important, phone records, Copies of email or instant messages basically anything that proves you have an ongoing relationship. Good luck.

K-1 Fiance(e) Visa Process & ProceduresRomanian soulmate is in Italy
QUOTE (HeartPained @ May 17 2008, 01:41 AM) <{POST_SNAPBACK}>
Hi everybody! This is my first post and it is a messy situation, so please have patience with me!

I have had a life changing experience by meeting my soulmate! Unfortunately, it is a messy situation, but we cannot help how we feel about each other.

The details.....She is from Romania, married, with a 3 year old son. She is married to an abusive alcoholic that doesn't work. She left Romania 3 months ago and went to her sister's place in Sicily to get away from him. She got him to sign a release to leave Romania for their son to "visit" Sicily, but she plans to never return. Her goal is to get a divorce from Sicily.

(FYI, I have been to Romania and Sicily and spent considerable time with her and her wonderful family, and there is no question as to our feelings for each other!)

Here is where I can use some help or ideas! I have scoured the internet looking for answers, but this is an area that is just hard to find information about. Assuming she gets divorced.....there is serious doubt the father will ever agree to signing any custody over to her, or ever signing anything to allow the son to travel. Since she is in Italy, is it going to be impossible for me to get her and her son to the US? On Fiance Visa, marriage Visa, or even a Visitors Visa? I have found nothing in detail on this subject, so can I expect they will never let the son here without the fathers permission?

Let me be perfectly clear. I WILL go to wherever I need to spend my life with my 2 angels, so bad news is not a detrimate, just a roadblock!

Again, sorry for the mess I bring here! But short of going to an attorney, I would like to be a bit more informed of my options. Thank you all very much, and good luck to all of you too!

John

John, I just got back from Romania and my wife is in a very similar situation. Our attorney has informed us that if my stepdaughter has a passport and has not paid child support that he will not be able to stop her from coming here. She already has a passport that could be a problem. Both parents have to be there to get passport. If your future stepson does not have a passport now it could be a problem

If we asked him to help us speed up our case in any way, will he be able to? Anyone who might know anything about it, please reply. thank u.
