It's just too iffy. . .If I were you I would try to contact the agency named on the deportation papers to find out for certain. Since he is outside the country it doesn't really make that much of a difference, he has to go to the interview to find out for sure either way. . .hopefully he was just given an order to depart and ignored it, in which case he would be eligible for the waiver.

I'm afraid that he might have been given a notice to appear and ignored it resulting in the deportation order in absentia. . .that would make him ineligible for the waiver for five years.


I spoke to someone else that was deported for failure to attend a court date, but he said that his wife's deprtation papers stated deported for absentia. My fiance's deportation papers just state that he was deported due to Section 8 USCIS 1251 of the Immigration and Nationality Act....I am just so confused, nervous, and scared at the same time. My lawyer said that it would take a long time to receive anything from Immigration in regards to his deportation file so I am just going to have to wait and see what happens at the interview.

In 2005 he entered the US I suppose it was a catch and release and they gave him a letter saying something about leaving in 60 days or something like that. I never saw the letter. We met in 2006 and I was trying to help him get everything legalized, but I was very ignorant as to immigration laws . Well when he had an interview (May 30, 2007)for what he thought was a employment authorization they detained him and said he had an order for deportation for September 12, 2005. He was detained for 3 months then sent back to Brazil. I went there to attempt to get married but the Brazilian government was on strike at the federal building. When I came back to the states I retained a lawyer and started the I129f paperwork. Our interview is for November 4. I know they will tell him that he will not be able to get the visa, but what I am not sure of is if they will let him do the waivers. i212 and i601. I just want him home so we can get married and we can be a family again. His deportation papers that I have say that it was a warning for failure to depart. I am so confused, and so tired, and I am growing weary.

I am not sure if he was suppose to go to court or if he had a letter stating that he had to leave by a certain time. He does not remember and I am just so stressed right now. wacko.gif

I was just wondering if there was anyone here on the site that has been deported because they failed to previously depart? If so have you already been to your first interview and did they allow you to do the waivers?

Right at 6 months is what I've seen recently..I wish it were closer to 4, since I have one pending there for my husband.

He said tht they told him they would mail him something. He said that he never received anything. When we went to our interview in Miami, they detained him and said he had an order for deportation. When he was finally released and sent back to Brazil, he said that he never received any paperwork stating that he had a ban. I am so confused right now.

My fince came her in 2005. When he crossed the border through Mexico to Texas immigration officials took his passport, fingerprinted him, asked him for the address he would be staying in the US. Then let him enter the US. He never received anything from them. He never planned on staying here for long, but we met in April of 2006. I did not realize he was not legally here until after a few months of dating. Well in July 2006 we got pregnant. So we were trying to figure out how we could try and correct the problem of him being here illegally. We wanted to get married but he was afraid that people would think that we were getting married just so he could get some sort of status or just because we were going to have a baby. We went to this place in West Palm Beach where we thought that it was going to be legit, but we were both naive of the situation. It took all about 2 months before we had an interview in Miami and that was when they detained him stating that he had a previous order for deportation. I went to Brasil to try and get married and the Federal government was on some sort of strike at the time so we could not get married. I came back and retained a lawyer and started the I-129 process. We have the interview set for November 4, 2008. We will also be filing I-601 and I-212 waivers. We just wanted to try and file them all at the same time. We originally requested Brasilia for the interview but for some reason they sent it to Rio de Janeiro. My fiance is very upset because for financial reasons. He feels that we will be going to the interview for no reason, only to be denied. I told him that is the way things have to be done. But being aprt from me and the baby is hurting him so bad.

Our interview is November 4th. I scheduled my faince's medical to be done on October 31st which is a Friday and we will be able to pick up the results on Monday November 3rd. I was told the exam is R$200, blood test is R$120 and the chest x-ray is R$50 for a total of R$370. The dr is Dr. Alexandru Buesco (21) 2527-3477

Not sure how long it takes to get to the Ukraine, but you can take a look at my timeline. I filed the I129f through the VSC and once we got the approval it did not take long at all to get to Brazil and get an interview date

As far as I know the baby will have automatic dual citizenship. My fiance and I had our daughter 18 months ago. When I first visited Brazil she was 4 1/2 months old and I obtained a visa for her with her US passport, they only allotted her 3 months on her visa and said that I would have to get her a Brazilian passport because her father is Brazilian. You can always contact the US Consulate to ask questions regarding birth abroad

They may ask for more evidence for proof of meeting in the last two years or ongoing relationship. But do bear in mind, age can be a factor but very rarely is if you look at other VJ'ers age difference. It's essentially discrimination. Just do what they ask and deal. I mean hey it sucks. But what is an extra two-three weeks if you're going to get a lifetime together right?

There is almost a ten year age difference between my fiance and myself. We never received an RFE. I know things seem rough, but these are trying times. If the love is there you will do whatever it takes. My fiance was deported over a year ago and I have been raising our 18 month old daughter alone, working, paying the bills, going in debt paying for the immigration process, not to mention the phone bill. We all know how hard it is but stay strong and know GOD is listening. He knows your heart, but you have to remember everything happens for a reason and it is in his timing not ours.

We received our NOA1 May 2, 2008, we received our approval (NOA2) September 9, 2008. They say it is a 6 month processing, but you can receive it sooner. VSC website still says they are working on K!'s for Februaruy 2008.........just wanted to give you a heads up

Sorry to hear about your denial. But you cannot blame GOD for it. There may be a reason for the denial. All good things come to those who wait. When we have our interview I know we will be denied due to my fiance's previous deportation. They have already told me that it will be denied then a second interview will be scheduled. Keep the faith and always remeber that it is in GOD's timing, not ours. God Bless
