K-3 Spouse Visa Process & ProceduresMaiden name versus married name
Hello,

For the past year and a half I have been living in Macedonia. I was also recently married here to a Macedonian citizen. I have citizenship here as well as in the US being that I was born in the US. I have an appointment this week in the US embassy in Skopje to file an immigrant visa petition (I-130). Back to the topic, I have legally changed my last name to my husbands name here in Macedonia but in my US documents (passport, drivers license, bank statements) I have nothing documented in my married name. How should I approach filling out the forms?... with my maiden name or my married name? I definetly do not want to be sent back for having forms improperly filled out.. Does anyone know what is the most accurate thing to do? Thanks for the help good.gif

K-3 Spouse Visa Process & ProceduresAffidavid of Support I-864 joint sponsor?

My mom is a joint sponsor because I have been living with my husband in his country for the past year and a half. My parents filled together and I was wondering if my father also has to fill out the affidavid of support I-864 form. My mom included his 1099 along with her W-2 for 2007 because they filled together. My dad is retired. If my dad has to fill out the form, it would pretty much be simular being that they share their assets .. is that correct?

I was also wondering if the full tax forms had to be included (the deductions, exemptions, etc.) or just the main front pages.

Also, being that I currently am unemployed and did not have an income for this year (only half of 2007) would that also pose a threat for my husband to come with me? Or is the fact that my parents have made well above the poverty level income and is sponsoring him make it okay? I have included the past 3 years of tax returns as well which has been over the poverty level. Any information would be helpful. Thanks!

Sorry for the confusion.. thanks for your help! smile.gif

First you posted this to the K-3 visa forum, yet your profile shows "DCF" which is CR-1 visa. You should have posted to "Direct Consular Filing (DCF) General Discussion", "The Foreign Embassy and Consulate General Discussion", OR "IR-1 / CR-1 Spouse Visa General Discussion". K-3 uses I-134 Affidavit of support.

To answer your question, one parent fills out I-864, and other fills out I-864A.

NOTE: You will need to show that you maintained US domicile, because you MUST provide an I-864 as primary sponsor, and I-864 REQUIRES US Domicile.
