Some Embassies may have tougher requirements, in that they may want you to prove sustained current income by your past income history, but this isn't true of London.
You need to list the income from the past three tax years, but this isn't so much an income issue as a tax issue: they want to make sure you're a good tax-paying citizen ;) Someone whose current income is just above the requirement may find it helpful to prove that their past income was also just above the requirement, ie in that case it may help prove their current income is reasonably stated. (Or also in the case of someone whose most recent year was lower for a specific reason, and maybe if they're self-employed.) But for someone whose current income is substantially above the requirement (which your partner's is) the past is really irrelevant.
If you were having to prove income right now he would have to use pay stubs and maybe an employer letter, but by the time you guys make it to the stage of needing to prove income he should have his 2011 tax return showing >125% so may not even need to use those (though you probably will choose to include those as well).

Whichever visa you go for, your assets can also be listed.

You will be fine finance wise for both visas, so that need not figure into your decision-making :-)

I would go ahead and get him to book a trip over. He should arrange to have the medical before Christmas. He should have received his police certificate before he visits you, so he will be able to send off the next set of forms before he visits. He can note on there that he won't be available to interview until after January 10th. It's unlikely he'd get an interview before then anyway, but who knows maybe he will receive his police certificate tomorrow and be able to send off everything. I was in the US when I got notice that my interview was January 5th...obviously that's kind of an impossible time to fly back so I had to rearrange the interview :lol: Who knows, maybe he'll be able to interview as soon as he returns to the UK. Unlikely, but possible :-)

I understand the question because technically a K-1 visa is a non-immigrant visa. But like everyone else said, it doesn't matter what kind of ticket you have. Either one is fine. And although many of us have found the return tickets are cheaper, this isn't always the case.

I wouldn't worry overly much about missing the interview letter. I myself didn't receive the letter until after the interview. Of course you want to do what's possible to decrease the chances of that happening, but don't worry. That in itself is not an insurmountable obstacle.

Searching back through the forums it seems other people have at times over the years asked similar questions, and often not received answers. But one thread where someone did get an answer is here: http://www.visajourn...ysical-address/ I looked at their later posts and they were approved. Maybe you could message them and ask what exactly they ended up putting on the forms, as then you would know that there should be no problem with you using a mailing address in the same way they did.

On second thoughts, they do not seem to give you this option for the fiance visa although they do for the spousal visa.
It is hard to say exactly what you should do. Some people from other countries have had similar issues, but everyone's situation is slightly different so the solution varies. (Ie for some people, their vague physical address will get their mail delivered somewhere, even if it's somewhere they they have to go to to pick it up.) If your fiance does still maintain a residence at his father's house then that may be an option, otherwise I would not personally feel comfortable not providing his physical address.
Whatever you do, I would ensure your cover letter includes both the physical and mailing addresses.

Generally, you should be able to keep track of developments even if mail is mislaid. Even in normal cases mail is sometimes lost, and generally a phone call will resolve this issue.

Are you completing the I-129f? If so they are wanting the physical address of your fiance. There should an option later in the process to provide a mailing address for your fiance. Right now any mail relating to the petition will be sent to you.

Ok, well we're on our own now with no attorney, and to be honest they've been a waste of money so I'm glad on that. The reason for my post is I'm filling out all the forms at the moment and the DS-230 is asking for address history since I was 16. Given I'm 37 now that's a lot of years. Is there anywhere I can check my address history or get a report as my memory is shot.

I didn't have record of my second MMR shot because I received it in school and I guess the NHS never put that in with my other records. So I had to have a *third* shot at the medical. (I did have a very lightly pencilled in "MR" in my handwritten record :unsure: )

If you've never experienced negative effects from vaccinations then I don't think receiving the MMR again will be harmful; however you're right that it's completely medically unnecessary. You could therefore look into blood titres, although with your medical on Monday you may decide it's not worth the delay. According to Wiki the second shot is aimed at the 2-5% of people who don't develop measles immunity after the first shot...

You can reschedule the interview via email. Seems sometimes they reply and other times they only reply when there is a code given in the subject line. Not sure exactly what they're doing now, but back when I was interviewing one person told me to email and then when I phoned again after not receiving a reply I was told to email with a code, and they denied that anyone could ever have told me to email without a code :huh: So you may want to phone again just to check, and if possible to get a code. The sooner you can contact them the sooner the rescheduled interview will be.

The most recent tax return requirement is not simply about helping to prove income, but is also required to prove that you're a good person who files taxes. Given that it is now November 2011 you will be required to either show your 2010 tax return or provide a good explanation as to why you do not have it. Prior to October proof of an extension might have sufficed, I don't know. But at this point I don't see an alternative to providing the return. Of course with immigration anything is possible: they might get confused and forget to ask you for it. That's not impossible. But unlikely. Generally, they would give you a chance to provide it after the interview, and generally that would not require another interview. (But just as it's possible for them to do something stupid in your favour, it's also possible for them to demand a second appearance by your fiancée rather than just asking for the missing document. I don't know how Moscow tends to be. In the UK I would feel confident telling someone that they would just have to send the document to the Embassy when they got it.)

Anyway, right now about all you can do is bombard your accountant with emails and phone calls. Maybe even ask a friend if they can talk to him in person.

I visited my boyfriend/fiance/husband in the US frequently in the months prior to getting my (spousal) visa and moving here. One time I visited my husband for 87 days. So what you're asking is perfectly possible. But just remember that there is never a guarantee that he will be allowed to enter.
Also remember he will need somewhere in the UK to stay/live once he returns for a few months. There will be a gap between the medical and interview.

They are not processing your petition because they have not yet reached it. They are currently processing other petitions that were filed before yours. Their goal is 5 months, and sometimes they are better sometimes worse. You have the right to call and enquire. They answered you and told you that, given the current pile of petitions in front of them, their best estimate is 6-14 days. The only way they could give you a better estimate is by looking at each and every petition and analysing how much time each one will take to process. Ie they will have to process every petition in order to tell you how much time it will take exactly ;)

They do not let you do a service inquiry before 5 months because they know that the answer will simply be "you are waiting in line, we have not reached you yet". After 5 months you can call...and the answer will either be "we have not reached you yet, here is an estimate of how much longer" OR "we should've reached you, hmm, we are working on your petition but there is some issue/we must have lost your petition". I don't see how you can expect anything more.

And yeah it is annoying when other people get approved before you due to them randomly processing a group of more-recent petitions. That is annoying. But ultimately there's nothing you or they can do about it now.

However, you can certainly prepare the paperwork for your mother co-sponsoring and give it to your fiance to take to the interview and hand over only if asked. Whatever happens with the K1, when it comes time to file the I-864 with your AOS you can file that alone and not involve your mother.

Just like the question about hospital stays doesn't mean there's going to be a problem just because you've ever had a hospital stay :-)

Personally, I bought my ticket after I had been approved at the interview but before I actually received the visa. Ignoring the possibility of AP, I was pretty sure I would receive my visa before my flight. (Based on how quickly other people received their visas, and what the IO had told me at the interview.)

If he does decide to book tickets in advance I would advise he gives it two weeks, and be aware that there is no guarantee he will have his visa. You just have to weigh up all the factors and make a decision. If he waits to receive his visa he can book a flight for the next day and be there sooner, potentially, you know?

As for cost, it all depends. At this time of year, even a last minute flight won't be too expensive. There might not be much money to be saved by booking sooner.

Medical will have to be in London. Once you have your case number you can phone up and make an appointment. If you wish, you could make the appointment for two months time, for as soon as you arrive back in the UK. When you send your forms into the Embassy you can include a note that you are having the medical on such-and-such a date. Sometimes this can help reduce the waiting time between medical and interview.

It is also true that some officials will be more willing to accept people from some countries than other countries. It's that idea that America is a very very attractive country to live in and try to stay in, but that, for example, people who get to hobnob with the Queen in London wouldn't be so likely to overstay.

Probably the best option would be to get married asap, file through London asap, and then he move in September and you follow as soon as you receive the visa. I wouldn't expect you to get your visa by September but you won't have to be apart for long. (And you could visit him.) By the time of your interview he will be in US employment and so have the required proof of financial support.

You will need to provide all the relevant documents. The Embassy will want to see for themselves all the information, so they can evaluate your character. If they decide it looks like you were found not guilty because you weren't guilty (rather than not guilty because they couldn't quite prove it) you should be fine.

Sounds like you should hopefully expect to get through the next stage of the visa process pretty quickly, so if that's true it's probably overall best to stay in SA. That way you won't slow the process down by being away when you need to do stuff, and hopefully pretty soon you will have your K-1 and be able to go join your fiance forever. Does he have family/friends who can help him over the next month or two? But if you and he really feel that it is most important for you to be with him right now, then by all means take a flight...personally I'd say you're more likely than not to be allowed in. *hugs*

You will need the I-134 at the interview for the visa. Then when you adjust status you will need the I-864 which is the legally binding one. Sounds like her grandparents should qualify. (Markie will also have to complete an I-134 and later an I-864.) Retirement income is fine. or assets. Just one co-sponsor so one grandparent will complete the forms and if necessary the other will include his/her money as a household member.

Hello all.

I became a citizen automatically because my mother became naturalized and acquired citizenship before I turned 18.
I do not have my own naturalization certificate. I just filed for a passport before I turned 18 by sending my mother's certificate, so I do have a US passport.

How should I answer question 10?
Does "naturalization" require me writing a certificate number? Should I check "parents"?

I do see in the instructions that as proof of citizenship I can just send copies of all pages in the passport if I do not have a naturalization certificate, but it does not say what to check on the form.


You check parents, and that "no" you haven't acquired your own certificate. Your passport should then be sufficient.

There is nothing wrong with maybe getting married and then applying for CR-1. NOTHING. What's fishy is the situation of entering on VWP with the intent to maybe adjust status. So personally I didn't and wouldn't do it. But marrying and applying for spousal visa, 100% ok.
Lol this is the one bad thing about being a good responsible person who researches everything online. Sometimes it is better not to know so much.

If you'll be visiting next week, personally I would choose to marry and apply for CR-1. In my opinion that is easier. You then skip the whole extra step of adjusting status after you arrive on the K-1 and marry. So there is overall less paperwork and it is also slightly cheaper. overall. Plus you will then be able to work etc as soon as you enter the US with your visa. The timelines vary slightly, sometimes one is quicker sometimes the other. Perhaps the K-1 is more often a little quicker.

If you marry you will present the I-864 at the interview. If you apply for the fiance visa you will present the I-134 at the interview, which is kind of to prove that you will be able to fulfil the requirements of the I-864 when time comes to adjust status, and then you present the I-864 then. It sounds like you will almost definitely need the co-sponsor. The exception would be if your girlfriend earns more than $12,000 in which case if you are married you would be able to use your savings to combine with her income to make the appropriate amount.

You don't have to do anything but you should inform USCIS so that everything is tidied up. You can most certainly file another petition, it shouldn't be a problem unless you file lots or if the interviewing officer decides to ask about it and then is suspicious of a suspicious response :-)

If it was an actual 7 months and 4 months, then that is only 11 months and so no. I suppose the confusing thing is that you could say you lived in Australia for 12 months, and just took a holiday to Thailand but were still living in Australia. So it depends if the length of physical presence is the important thing or not.
