When we filed our forms, we put a brief statement of how we met online (in our case it was within an online game, haha we're such nerds) and included a log of our online chats and whatnot to show our relationship. Basically just when we logged in and logged off on MSN. We also included details of our visits with one another within that statement. Don't be embarrassed about it, it's far more common now than ever.

I waited about 6 months last year before receiving a response and realistically you should expect 5 months - 6 months wait assuming you don't receive a RFE.

To further clarify, most Senators and Congressmen will only assist you on getting a response on your case after you are out of the normal processing times. They usually request you try to resolve the issue on your own. Just be patient, then if you are beyond your processing times and you get no where with USCIS, you are well within your rights to ask for assitance from their offices. You will have to fill out a form for them to speak to them on your behalf (see Privacy Act of 1974).

The form you attached is updated May 2012, so I will say that's probably the most updated and correct information. It does not state to go to the Embassy. It says you can visit their online site to schedule or call and make an appointment.

I would suggest you get all of the materials on that list together as well as getting your medical done before scheduling. I'm not sure how quick they are in Manila on scheduling appointments. You just want to make sure you aren't rushing to find information prior to the date. Good luck!

The problem is German consulate recently updated their procedures, however, their website still lists the old procedure. I agree with trying the regional forum. You could also try contacting the consulate directly at FrankfurtIV@state.gov. They were quick to respond to our inquiries during the process.

I think filing for the K-1 is super stressful...probably more stressful than even planning the wedding! You probably think that if you make one mistake on the form that you could be delayed, but honestly it's a straight forward process. I think it's just the fear of the unknown. I know when we filed we both were freaking out. We were afraid we'd mess up and he'd be banned or something (honestly, and my husband has 0 record at all, not even a parking ticket). My husband insisted on a lawyer much to my chagrin. All that stress and fear was really not warranted. Unless you have a special circumstance or are filing from a country on the US watch list, the process is straight forward.

The consulate officer asked my husband if we set a date for the wedding. We had not and he told them such since it would be difficult not knowing how long the wait would be for the visa. She stated she understood. I don't think you'd have a problem either way, but likely to come up during the interview. Best of luck!

Kal, I hope that you are able to obtain some additional evidence so you are able to proceed with your visa application. Further, if you have any other questions about the process please don't be discouraged to post them here for advice. You will get a far better answer from those with experience in that area than you will from a spritual leader, though he will be good to use for the emotional side of this (it's a long process that's sometimes hard on you).

I know sometimes it's hard to hear what others say and perceive. It may or may not be your situation, but just keep what they say in the back of your mind and trust your gut. We (afterall) have nothing to gain from giving you this advice. I hope it won't be a bad situation for your sake. A broken heart is hard to mend. Be careful on your trip and I wish you luck on your journey no matter where it takes you.

Hey fellow Germans! I have received package 3 already and now am preparing everything to send it back. After some research, I also got to know that they have changed the process and now you have to send everything back before the interview.
What I am trying to find out but cannot seem to verify is if we also have to send in the birth certificate and police cert of the UCS. He is still preparing what he will send to me, and we wanna make sure that everything is correct.
Also, is it true that the letter of intent has to be dated to at least one month before the interview? How can I do this if I don't know when my interview will take place? :blink:

I'm so confused right now. The consulate website still has the old forms saying not to send information in to them except the following:

Regarding the letter of intent: Just showing a new letter of intent affirms you still want to marry. I don't think the date is necessarily needing to be within 30 days, just that you still intent to get married (since your original letter is likely a few months old and boy does dealing with the US government test that resolve, haha).

Please let me know if you Packet 3 is different so I'll know not to give wrong information. The information contained above is from form dated 12/2010 (obtained from the consulate website). Thanks and best of luck to you!

That's actually good to know they changed the process. It could cut down on your wait time in the embassy. My husband spent a good portion of the day there (I think it was 5 hours before he finally got back to the interview). That's after driving 6 hours there from Berlin. I posted his experience in our timeline if you'd like a better idea of what happened.

I was going to answer you other questions for you but my husband looked at me like :blink: when I asked him if he mailed off his forms before he got the request from Frankfurt, then said "that was years ago". Men. (it was last year, btw)

So if you then list a secondary school, as an example, do you also have to then present the certificate to the CO? My beneficiary didn't believe in record keeping (we'll have to work on that) so my fear is taht if I list something then I have to back i tup. But I also don't want to omit anything so it doesn't look like mirepresentation.

I wished that we have copies of the high school certificates, not sure if they give out primary school certificates.

I don't think you need those for the CO. You might want the secondary school and university though for job opportunities here in the states, but for the interview, they probably won't ask for that. I would go ahead and gather them (if you can) for when you (or your significant other) moves to the states. There are certain requirements for applying for certain jobs.

Well, we had to file for an ITIN, which actually was our only course of action because his K-1 was expired and we weren't eligible for a SSN based on that (at the time I was unaware that checking the box on the form didn't assign us a SSN like it said...stupid forms...hey I didn't know about Visa Journey at the time!). Since we have to file taxes and by that time it was already the end of March, we had to apply for an ITIN. They had no problem assigning one with proof. This allowed us to file 2011 as married and now this year we will not have to file by paper. Woot!

What do I do when I am assigned a social security number (SSN)?
Once you receive a SSN, you must use that number for tax purposes and discontinue using your ITIN. It is improper to use both the ITIN and the SSN assigned to the same person to file tax returns. It is your responsibility to notify the IRS so we can combine all of your tax records under one identification number. If you do not notify the IRS when you are assigned a SSN, you may not receive credit for all wages paid and taxes withheld which could reduce the amount of any refund due. You can visit a local IRS office or write a letter explaining that you have now been assigned a SSN and want your tax records combined. Include your complete name, mailing address, and ITIN along with a copy of your social security card and a copy of the CP 565, Notice of ITIN Assignment, if available. The IRS will void the ITIN and associate all prior tax information filed under the ITIN with the SSN.

Hello again! I am on the cusp of submitting my I-129F (Fingers and toes crossed) and as I was looking everything over, I noticed question 10 on the I-129F form. It asks for a certificate number and location where it was filed. I had previously left it blank as I was born in the US, but do they want the certificate number from my Birth Certificate. I'm looking at it now, and I don't see any number labelled "certificate number" or a filing location. Is this information only in the event of naturalization?

Have you looked at the Sample form? If you were born in the US, you don't put a number there.

I posted earlier on this forum about the fact that I am on SSDI of $1000/month and Disability insurance Income of almost $4000 (Total $5000/month), and I was told by someone here that this income would be ok. I am undergoing Lymphoma treatment and will have a bone marrow transplant next month. Hopefully, if I come thru well, I plan on getting back to work in my field again. Do I need to attached my degrees, certifications, and resume with the paperwork my fiance takes to the interview so they are satisfied that I can take care of her after my disability is over, which will last at least one more year if not two or three?


I would think that because your regular income was enough to support your fiance (based on your SSDI income you are receiving and I'm assuming an IDI policy?), I would think that would be fine. It certainly couldn't hurt to send that to your fiance for the interview so he/she will be able to show it to the CO if they have concerns, though I don't know if it will come up during an interview or not. I'll be interested to see how that turns out though so keep me informed! Best of luck on your transplant!

Hi there, disability specialist here (private disability and not government, but we tend to work together from time to time).

I want to point out that SSDI is not considered permanent income. It is only as long as the person is unable to work. The Social Security Administration periodically reviews all cases to make sure recipients continue to qualify for benefits. It is possible they would not consider his SSDI income as a stable income, unless he can get Social Security to say they will pay him benefits forever. It's not about being able to pay for the process, it's about being able to support the person when they are here and waiting for a job. They want to make sure they person does not become a public charge and that you are capable of providing a living for them (especially in these hard economic times). She may have a job waiting for her, but unless she's approved to work in the US, you could be waiting for months before she can legally start that job.

Also, the poverty guidelines are not $17500. They are $ 18912 for a household of 2, unless you are in Hawaii or Alaska. Please see the following: http://www.uscis.gov...form/i-864p.pdf

My fiancee is submitting our Packet 3 today. My employment letter that she is submitting (along with all the tax returns, K-1s, paychecks etc.) is dated July 20, 2012. I have been with the same firm since 1991, basically stayed with the same firm right out of law school. We reckon our interview will be in about 2 weeks time or so. Should she bring a more recent letter or is within the last month good enough? Thanks.


You should be fine. I believe mine was 3 months old by the time my husband had his K-1 interview and he had no issues.

Hi Everyone,

My German FI and I sent in our I-129F papers and filed for the K1 visa February 27th and I promise we sent everything AND MORE! Now I know, I made an EXTREMELY rookie mistake and didn't listen to my FI when se said "make 2 copies of everything!" I was going though other problems at that time and my mind was too occupied and I know that is no excuse. I still have all the proof; pictures, plane tickets, engagment ring and wedding band reciept, etc. And I have SOME of the written out papers such as my letter of intent and my G-325A...I guess my question is, if it is not EXACTLY identical to the first set of papers, will they deny us? I know this may just be me over worrying and I keep trying to convince myself that everything will work out because once he goes in for an interview, they will know that we really are in love and really planning on getting married in December.

If anybody can help me with this, that would be great!

Good luck! In our experience, the pictures and stuff they ask you to include when you receive the packet from the embassy were more important than the papers included with the I-129F when my husband went for the interview in Frankfurt.

I'm really worried about police check. I've got the police clearance letter which is just based name and birth from Canada when I was in Canada.
But I realized it I need a criminal record check which based fingerprinting.
currently I'm in US to visit my finace and I'm planning to go back to Korea in Oct.
I know it would take about 150 days to get police check. So I want to be prepared before I get NOA2 or an interview. (It has been 4 months so Im assuming I would get it at least in 2 months)

Is there any way to get fingerprints in New jersey, US??????

I would say you need to list any names you have been known by, regardless of whether you are still called that or not. That would mean to include your married name if you were ever legally called by that regardless of the nullification.

People seem to be very hung up on the requirement being for a "letter" of intent, but the I-129F official instructions from the USCIS (Page 2, 5B) indicate that you must:

"Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission..."

This is from the official instructions found here.

I'm not sure how nor where the whole "letter" thing came about, so the address is fairly meaningless either way.


I know my lawyer at the time made us do official letters, lol. Then again she was pretty useless so I wouldn't take her word for much. I suppose it is better to have and not need than to need and not have. When filing for a visa to have your loved one here, I think people don't want to chance it.

Off topic, but no. To clarify...the act is not to give them citizenship, only to put them into a deferred action status for 2 years (thus giving them a legal status from illegal status). Being legal does not equal being able to vote. It's a moot point to get their applications in and approved before election time. Some people however believe that the action was intended to sway the largely hispanic voting population (citizens) toward the Obama administration.

Back to topic...K-1s have been running behind for a couple of years now. I'm sure it's simply a matter of "do more with less" which seems to be a common practice here in the states with larger corporations to keep their eye on the bottom line.

I need some advice or any ideas from you guys coz until now i can't sleep and it keeps bothering me.. We got our NOA2 July 20, 2012, and we already have our MNL#..

My problem is when my fiancee filing K1 he send his 2008,2009,2010 W2 and ITR, and then we was now on disability leaved for a year and his 2011 W2 is below from the income they required but for the prev year he earned much above the required income.He has no savings he only have his house as an asset.

My question is:
1.) Is our petition will be affected?
2.) Would it be the reason that i will be denied?
3.) Should they'll ask the 2011 W2?
