SECURITY NAME CHECKS
AND ADMINISTRATIVE REVIEW*

I. SECURITY NAME CHECKS (ALSO CALLED BACKGROUND CHECKS)
For public safety & welfare and national security reasons, all visa petitions under current regulation and procedure are placed through security name checks at three (3) locations: 1. USCIS office, 2. National Visa Center (NVC) and 3. the U.S. Consulate where the visa is ultimately issued. There can be not one but several levels of security checking: There is an initial security name check done rountinely on all in-coming petitions. If the results produce a "lookout hit" or "red flag hit", the petition is placed in line for additional more intensive customized security screening, which could include a request for full fingerprints and which obviously has the undesirable effect of extending processing time for adjudication. While security checking is widely focused on the visa beneficiary, petitioners and even attorneys and consultants involved in a case are subject to security screening.

A Lookout Hit or Red Flag Hit can be generated on a visa petition, among other reasons, for any the following:
*Past arrest record
*Past criminal conviction record
*Past firearms record
*Past record of domestic violence or sexual offenses
*Past fingerprint record with any law enforcement agency
*Past visa or immigration history
*Watch List or Pending Charges "Hit": Petitioner or Beneficiary is currently on watch list or wanted on pending charges with any law enforcement or other government agency, (local, state, federal, FBI, INTERPOL, Homeland Security, State Department designated terrorist group list)
*Common or Similar Last Name with others in the database who have
past arrest or conviction records (sometimes called a "False Hit")

Under post 09-11 legislation such as USA Patriot Act, Border Security Act and Intelligence Reform Act, our Immigration Service, the Consulates, and Customs and Border Protection, have worked to significantly upgrade their technological capabilites, increase inter-agency data-sharing and coordinate investigative activities. The current policy directive is "zero tolerance" policy for security issues. The on-going U.S.Visit program is one example. Another important example is the implementation of a critical software upgrade which effectively links up Immigration and Consular databases with many local law enforcement data bases and the FBI criminal database.

Obviously, any security name check is only as good as the accuracy and completeness of the database upon which the check the done. Here is a sample of the principal databases upon which an immigration and consular security check can be done currently:
*NCIC (National Crime Information Center)(also called FBI criminal database)
*IBIS (Interagency Border Inspection System)
[Click Here for More Information on Security Checks with IBIS.]
*NIIS (Non-Immigrant Information System)
*CLASS (Consular Lookout and Support System)(This name-check database
in particular has been greatly expanded, now storing up to 18 million records.)
*CCD ( Consular Consolidated Date Base)(Stores 75 million records of past visa applications and outcomes)
*TIPOFF (Classified DOS Bureau of Intelligence database)
*NAILS (National Automated Immigration Lookout System)
*TECS II (Treasury Enforcement and Communucation System)
*TSC and TTIC databases (DOS Terrorist Screening system)

At USCIS (Homeland Security Department) stage, currently, NCIC, IBIS and NIIS database checks are done, with the option, if warranted, to do additional database checks.

At National Visa Center (State Department) stage, a separate independent NCIC database check is done by in-house FBI staff in connection with information supplied in the DS-230. Based on results, NVC has the option to request full fingerprints to be taken at post. NVC checks can usually be completed in 24 hours. In some limited cases involving high-risk visa applicants meeting certain specific criteria, NVC also does Security Advisory Opinions (SOAs) before sending the file to Consular Post.

At Consular stage, there are three (3) Visa Security name checks done: CONDOR, MANTIS AND MORE ANOTHER NCIC (via CLASS)
[Consulate has option, if warranted, to run full gamut of checks, such as CCD (past visa applications & results), TIPOFF (DOS Bureau of Intelligence), NAILS (Nat'l Automated Immigration Lookout System), TECS II (Treasury Dept. database), TSC & TTIC (DOS Terrorist screening)].

CONDOR refers to a check done mostly of information supplied on Form DS-157, and focuses on visa applicants with a potential terrorist, firearms or weapons background. CONDOR in most cases should be completed in 90 days or less. If not, contact the VO Public Inquiry line at Tel: 202-663-1225 or usvisa@state.gov

MANTIS refers to when potentially sensitive technologies might be used by the visa applicant in her visit to the U.S. If the visa applicant might employ a "critical-fields" technology in the U.S. which could have a "dual-use" such military or national security application, this check will be done to screen out a high-risk applicant. Most MANTIS checks can be done in 30 days. If not, contact the SAO Problem Resolution Unit at saoinquiries@state.gov.

NCIC (via CLASS) refers to the name check procedure done by the Consulate with the NCIC criminal database at FBI. This procedure screens visa applicants by name to see if there is a "hit" with the criminal database: that is, a person in the criminal database has the same or very similar name to the visa applicant.

"False Hits" Problem: Consular posts however have recently been inundated with "false hits" from 7 million new names added to the NCIC database, including persons with convictions for minor offenses such as simple DUIs and shoplifting. Many visa applicants with common names with those in the database get a "false hit": the refers to when a visa applicant's name matches a name in the datebase but is NOT actually that same person in the database, just a person with a common or very similar name. This places the case into what is called "Administrative Review". Under current rules, the Consulate is required in this circumstance to receive full clearance from FBI (via the NVC) before Consulate can issue the visa. It may require a full fingerprint check and customized investigation. Full clearance from FBI (via the NVC) in most cases can take 4 to 6 weeks, but in some cases much longer and even months.

"False hits" have become a major problem for some visa applicants. There are reportedly an alarming number of false hits caused by similar or identical or very similar names, or errors, inconsistencies or discrepencies in listed names in official documents. This is true especially in countries, such as the Latin countries, where there are only a few surnames and name-similarity is common, or record-keeping accuracy in official documents is dubious. Reportedly, approximately half of all names in the NCIC database are Latino, and this has resulted in a high number of false hits for individuals with common or very similar last names at Consulates in the Latin countries. Applicants presently are not allowed the opportunity to prove that they are not the same person as that on the database, nor is there a way to initiate security checking in advance of the visa application.

Thus, the best protection for visa applicants to avoid name check problems and delays resulting from Administrative Review at the Consulates and USCIS is: providing full, accurate and truthful name information (first, last, middle, and other) in all forms and documents, timely submission of local police clearance reports and promptly complying with any request for full fingerprints.

*SPECIAL NOTE ON EFFORTS TO AVOID OR CIRCUMVENT "FALSE HIT" BACKGROUND SECURITY CHECK*: Except in the most extra-ordinary circumstances, advance efforts to avoid or circumvent "false hit" before it happens, or complete a background security check in advance, such early submission to the Consulate of the DS-156 and DS-157 or police, arrest or fingerprint records, will probably not be fruitful. As stated by AILA: "Although attorneys have attempted to be pro-active and expedite the process by submitting copies of arrest records, final court-dispositions and attorney-initiated FBI results [and DS-156 and 157], at the initial visa application, consular officers are required to obtain fingerprints in a NCIC name check "hit". Once a post has received a response from the FBI via the National Visa Center (NVC), it may at the consular officer's discretion accept documentation from the applicant that matches the extract provided by the FBI. However, consular posts will not accept submission of all related documents in lieu of initiating required security checks and fingerprinting." See 22 CFR Section 41.105((2), and "DOS Answers to AILA's Questions" (Oct. 02, 2002), published on AILA InfoNet at Doc. No. 02100340 (posted Oct. 03, 2002).
*SPECIAL NOTE ON NEW SOFTWARE TO EXPEDITE "FALSE HIT" CLEARANCES*: Department of State (DOS) has initiated worldwide deployment of new computer software that is expected to greatly reduced the clearance time for applicants who have been the subject of "false hits" in the visa security check process. The new software will allow posts to capture the applicant's digital fingerprints and check them electronically with the FBI's NCIC database within 24 hours. DOS has launched this new software through a pilot program at consular posts in Mexico City, and reports that the pilot program has been able to clear "false hits" in as little as same day (sometimes in one or two hours). Worldwide deployment of the new software to expected to be finalized once the Technical Communications Security Office approves the program. See "DOS Answers to AILA'S Questions" (March 23, 2006), published on AILA InfoNet at Doc. No. 06041060 (posted Apr. 10, 2006).
II. ADMINISTRATIVE REVIEW
"Administrative Review" refers to a Consular Official placing the case "on hold" because the Visa Petitioner or Beneficiary FAILED TO PASS the security name check or background check, or because the Consulate or State Department or Homeland Security NEEDS TO INVESTIGATE some issue or matter in the case more closely. Cases placed into Administrative Review can ADD WEEKS OR EVEN MONTHS to processing time and final decision on visa issuance, typically in most cases AT LEAST 4 to 8 weeks additional time. Under current regulation, there is no right of appeal within State Department or Homeland Security for administrative review status. It is suggested that visa petitioners and beneficiaries keep track of the status of their case as best as possible, and secure, if possible, the reason or reasons their case has been placed into administrative review, which at least helps to relieve some anxiety during the waiting time. **STATUS CHECK OF CASES IN ADMINISTRATIVE REVIEW: Status Checks of cases in administrative review should first be addressed to the Consulate in question. Click Here for List of Consulates. The State Department's Office of Visa Services can also assist in status checking of cases which are unusually delayed. Tel: 202-663-1225 (Punch 1, Then 0, Avg. Wait Time Approx. 15 minutes to Speak with a Live "Visa Specialist", ET 8:30 AM to 5:00PM). E-Mail: usvisa@state.gov Click Here for More Information. For people who want to be active during the painful waiting period, especially if it becomes protracted, here are two suggestions: 1. Request in Writing Information from Immigration Service and the State Department under the Freedom of Information Act (FOIA) regarding the reason for the Administrative Delay. See: USCIS Freedom of Information Act Request. and State Department Freedom of Information Request. 2. Order the Visa Applicant's FBI record directly from the FBI and have it ready in case the Embassy requests same. See: FBI Criminal History Record.

**WRIT OF MANDAMUS: What is this Writ and How is it Obtained?
"Writ of Mandamus" refes to a federal court order signed by a federal district judge which directs the Consular Official in the State Department's U.S. Consulate abroad to decide whether to issue a visa or not within a short time. It is appropriate ONLY in a limited number of extra-ordinary cases, where the visa applicant's waiting time has been extremely long. It requires that the U.S. Citizen Visa Petitioner be prepared to spend the time, effort and money to file a federal court lawsuit, namely, an Action for Writ of Mandamus, in the District Court where the Petitioner resides. It is also generally required that reasonable documented efforts be made with Immigration Service or U.S. Consulate and State Department BEFORE filing suit in court. As explained by the U.S. Court of Appeals, 9th Circuit:
"Mandamus is an extraordinary remedy and is available to compel a federal official to perform a duty only if: (1) the individual's claim is clear and certain; (2) the official's duty is nondiscretionary, ministerial, and so plainly prescribed as to be free from doubt, and (3) no other adequate remedy is available. Azurin v. Von Raab, 803 F.2d 993, 995 (9th Cir.1986)."

A Writ of Mandamus is usually not appropriate for a Visa Petitioner and Applicant whose case has been placed into Administrative Review for only a few days, weeks or even months. However, it may be appropriate for a case which has been waiting for many, many months and even years. See: Patel v. Reno (U.S. Court of Appeals, 9th Cir., No. 96-55359a, Jan. 16, 1998)(Court issues Writ of Mandamus to Consular Officials at U.S. Consulate in Bombay, India because "consulate had a duty to act" when Petitioner's family visa applications were under administrative review for EIGHT (8) years without decision). For more general information, see: Writ of Mandamus Process Practice Advisory from AILF.

*INTERNATIONAL MARRIAGE BROKER REGULATION ACT ("IMBRA")*: Security Name Checks at USCIS and the Consulates have reportedly intensified due to the passage of IMBRA, which effectively requires more security checks of both Petitioner and Beneficiary, including check for Abuse Protections Orders, court-restraining or "no-contact" orders and past domestic violence history, and a check on the number of a past K Visa petitions a Petitioner has submitted.

Sometimes i feel like calling DOS is usefulness .Cause they really don't want to say so much and they just want to say still pending AP the hang up LOL .
In fact i feel that calling the embassy is so much better at this point .DOS get their info from the embassy '' The embassy update DOS with everything new they do on the case '' So at least the embassy can say more details than DOS and we can get the info from its sours LOL .

Oh God that nightmare journey sucks .I hope that we all will wake up and that crazy horror nightmare will end up soon .

now i'm really confused :( i understood that during administrative processing, the file is literally sent from the embassy to the DOS in Washington, where they perform perfunctory name checks. when i contacted the embassy they told me they have no control over this, that it's with the DOS and it's the DOS who update the embassy. i call weekly, but no news. on day 73 of AP in Washington. but your post indicates that the DOS get their information from the embassy?

I have not heard back from my congressman since I just emailed them. Im guessing maybe I wont hear back from them until sometime later this week. Did they write you back to let you know that they had contacted the embassy and were waiting for their response or has the congressman not written back to you all? If the congress has contacted them and not received a response back yet that could mean that the embassy is waiting to respond to them with good news about your visa. As soon as I hear back from my congressman, I will let you know whether they require me to fill out a form or not. Isa this will be a good week for us since its the beginning of a new month.

My congressman required me to just fill out a form giving them permission to look into my case, it's an information privacy thing. Congressman don't have any authority to change a case, just to make a 'congressional inquiry on your behalf' - they typically have contacts at other government agencies who are more likely to respond to them quickly. Be forewarned, mine gets confused and gave me the wrong information (that we were out of AP and we're not). So be sure to explain in full detail what you want them to do and who (what agency) you want them to contact.

I'm not filing in Egypt, hope you don't mind me joining the thread. We're going through exactly what you are - we are apparently out of AP since some time last week according to the Congressman, but have no news from the Embassy, nor will they respond to my emails. What happens after AP? I thought we just receive the visa in the mail a few days later?

K-1 Fiance(e) Visa Process & ProceduresI have a K1 paperwork question, but also need advice - My fiance is giving up hope that we will ever be together :'(
You only need the police certificates for the countries you've lived in, not towns. And they are easy to obtain. The process is long, but if you believe in each other, it's certainly worth it! Good luck.

VISA IN HAND! Of course they sent it to our old address and after the second day of waiting, I called them for the tracking number...and Brahim went to pick it up at the post office. Can't wait to actually see it in person, I might sleep with it under my pillow tonight. Here's to happy dreams!

Yep, it's true! Email from immigration visa unit chief at the embassy first thing this morning:

"I'm not sure if we told you on Friday, but your husband's visa is being issued. And he might actually have it today or tomorrow. Good Luck."

Now that calls for three happy dances (   ). Next post will be the one we all wait for...stay tuned!

If it were me ... I would call and ask if there was a visa number assigned yet (thats just cuz thats the way I am) .... remember the Algerian consulate isnt the fastest moving so if you are planning on coming home next week you're really going to have to push them!!

My fiance's visa was issued on April 17th but he did not have it in his hands until the 27th (the embassy did not call him until the end of the week before)... AND that was with me pushing.

Keeping my fingers crossed ... keep on them until he receives the call to come and pick it up!!!

Malarie

Yeah, I think I'll call back on Monday to get the number. We're actually at the Paris embassy, and they've been waiting for our case to get approved so they tell me. I'll give them til Monday too, then follow-up.

Thanks again, all for your kind wishes. I'm walking around our apartment to figure out what we can pack now (with six days to go). So happy! But will be ecstatic when we have the visa in hand!

Thanks everyone! We're so excited! I have a flight home on Friday morning and reserved the seat next to mine for Brahim. I'm 90% sure we get to use it :)

She didn't say a visa number had been assigned actually (should I call back and get the number???) After my conversation yesterday with the immigration chief at the embassy, who said she'd follow-up, I'm assuming she's going to have her team issue it 'toute de suite' when they go back to work on Monday.

God, the relief as we have so much happening - flying home on Friday, closing on our new house next Friday, visiting family for a reunion the following week! Not having to find other living arrangements when our lease expires on the 19th. I've been dropping things since we heard the news - it's like the strength and coordination have gone out of my limbs, but we're not jumping up and down, just quasi-excited and waiting.

It's been a great few weeks and I know that they're working on those of you who are still waiting. Have faith.

I've been thinking for the past five months how I would write this post. I just got back from a trip to London and to cheer up my honey who was feeling kinda low, we called the DOS. I got the nice Asian-sounding woman this time. She told me that as of today, May 7th, the case was given its final approval and early next week the embassy will be issuing the visa!!

I couldn't believe it. We hugged and cried - the sense of relief is enormous. But I'm skeptical. About two minutes later, my mother called me from the States to tell me she'd had a dream last night that Brahim got his visa. Weird! So I called back 5 minutes later and confirmed with the same woman who giggled a little and said, yes, that's right, your case has been approved as of today. Congratulations!!!

So, I'm going to save the dance for the visa in hand. But we are going to have a little champagne tonight!

Best wishes for the rest of you, will keep you updated on what happens in the next few days.

It's so hard, this process! I think we need to make a stand and lobby Obama for new immigration processes. If you look at his website (he's a marketing-saavy guy!) It's one of the top things he plans to change. Now's the time!

I have to say 'looking back' (I was in the same boat til yesterday), that somehow getting contact with a higher up at the embassy will help you through the process. But I also have to say, get ready to wait a few months before they'll really look into it for you.

Hot Guy - quit talking to the guy who answers the phone, he's got no authority - you need to use your charm and get him to put you on with the immigration visa chief (his boss) - and charm them with your proof, that's what will get you out. I realize this may be a very American approach to insist on going over someone's head, but you're dealing with Americans in the end. My two cents.

Best wishes to you all - it does get resolved in the end. Though I'm not with everyone else who says that the anger melts away once you have the visa. I'm still angry on missing out on my family's life and going through all the emotions of being stuck, and spending lots of money to maintain two households. But the anticipation of everyone we're going to is thrilling!

Sorry if this is obnoxious to write in the same post, but you can update the list: Visa in Hand 5/12/10.

Oh my god! How frustrating! Can you get access to the CO directly? That really seemed to help me.

Another thing you could try is the office of Consular Affairs in Washington - they actually answer the phone and you speak to a real person who is responsible for all embassies around the world. The office of Janice Jacobs: +1 202 647 9576. If the embassy is sitting on it this long, there's clearly a problem with the embassy and you'd have good cause to escalate it.

Star, that is so exciting! Congratulations to you!

Today, we crossed the threshold - we've been waiting for 5 months. Yesterday I called the embassy immigration chief (bet she's sorry she gave me her number once) as it's been three weeks since she inquired about our case with the USA. She said that there's been no change but that she'd call again to 'see what's up' and she actually apologized to me for the long wait! I have no response from her today, but hope that she made a connection to someone. Once DOS comes on line I'll make my usual Friday morning phone call.

It's been a slow visa week so far...here's hoping there's some movement today!

I involved my congressman as soon as I heard AP. And you're right, all they can do is call DOS like the rest of us and get the same answer as the rest of us. If it makes you feel better, go ahead and involve them, but neither they nor the embassy have any authority to move it forward.

You know, others say that when the visa comes after this extended AP wait, the frustration melts away because you're so happy you have received the visa. I don't know about that - I'm pretty pissed off right now, I think I'm going to feel the sting of this for a long time and am planning to raise a campaign for reform once we're settled in the States.

Ahh, thanks for the humor (humour to our brit friends!). Needed very much today. Brahim and I just had a long and emotional conversation. Though I know in my heart our visa will come this month, I'm scared to death to leave him. Less than two weeks from now, I'll have all the comforts of home and my good support network, but my poor honey will be left here with just a few friends and the endless struggle to find a job (hasn't been able to in months!). It's not an easy situation and I feel very selfish for leaving, but our new home and my job is beckoning me back. Tough tough tough stuff.

Here's hoping they continue working on those of us long-termers next week!

I just called the DOS too!!! However, unlike you, I got the most unhelpful specialist. I gave her my details, she kept me waiting a while, which I thought was a good sign, then all she could say was 'You're still pending'. When I asked her what the latest date-stamp was, she said 'well, you had your interview 22nd February'...I said 'No, I mean when was the last time it was looked at?' She answered that they're not obliged to date-stamp the case every time it's looked at, and whoever told me that was mistaken...I replied, 'That's strange every Friday when I call and ask they tell me that it was looked at last week etc'...'It's still pending'. GRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRR.

It's so unfair - I honestly believe that we have a right to some basic information about OUR application and OUR data. I've a good mind to call again and see if I get someone a little friendlier and more helpful within the confines of what they can say.

Oops, nearly forgot to say I hope you get a response to that email soon, as well of course as the all-important email telling you that the visa is ready!!!

Call back - nothing brightens your day like one who'll give you a little hint. I can't remember her name, had an N in it somewhere. Best of luck to ya! How's the weather in the UK? I'm headed over for a few days next week for business... It's been sunny in Paris for like two weeks straight (unheard of in early Spring!)

Weekly DOS Update Time!

Just now I got a very nice woman on the phone. I expressed my frustration at the 4 months, 3 weeks. SHe said she understood the hardship and frustration. SHe said that it's normal to see a case take several months for administrative processing, but she also said that she could see that it's being worked on. I confirmed that the 'being worked on' was not just the embassy's request two weeks ago and she said, 'Correct, it's being worked on.' So I said, I know you can't share details, but if you were me, would you be hopeful? And she exclaimed 'Yes!'. Doesn't give me anything concrete, but was sure nice to hear!!

My email to the kind embassy immigration chief yesterday reminded her that it's been two weeks since her request from the US agencies on our case and stated that I'd be much obliged for her continued follow-up. It has not yielded a response.

Here's hoping!!

Update :-

OK guys i just got an Email from the embassy .They asked me to provide them a new police record .I tried to call them several times to make sure but they did not answer the phone .I sent them an Email back and i asked them if they want me to send a new medical exam with the police record '' I told them its already expired '' .They sent me an Email back and they said '' Please provide us with the police certificate along with the medical examination '' if its already expired ''

So it sound like good news for me .At least i know that they are working on it and its not collecting dust on someone's desk .

Great news!!! So exciting!

OMG!! I got an email from the consulate stating that he will be hearing from them very soon. Yay!!

Oh! That's exciting! Yahoo! It's all coming together now!

I didn't realize that NVC had anything to do with AP. I thought it goes: petition to USCIS who passes to NVC who passes to consulate (where you do your interview and they make final decision) who passes to DOS/Secret Agencies for AP(FBI/CIA/Homeland Security). I haven't tried calling the NVC...that may be another step??

I agree .Cause he is going to move to USA not just visit .So he will have to go through immigrant line .

Good luck and my best wishes for you .

That's a good question and, what if as a USC, you're with your spouse - I was picturing going in the Immigrant line at POE with him. What are they gonna do, tell me to go somewhere else? I'm so worried about POE (and we don't even have a date of course). But my husband doesn't speak English (French or Arabic, a little Spanish)...they would have people who speak other languages, right??

It feels like they're clearing a backlog - I just looked back in this thread and see 4 this week    :

Malarie - Algeria after 2+ months
You (Pman) - Nigeria after 2.5 months
Zaheer - Pakistan after 5 months
Star - India after 4 months **on its way**
...and HotGuy (whose is coming asap)

Those of us long-termers left are: Wellmux (almost 8 months), Alen & Bridget (4.5 months), Meredith & Brahim (4.5 months), Whatznext (too complicated to list!!), and the odd white woman out, Treehugger (2+ months)! I'm sure I missed someone, very sorry if I did!

I'm tempted to call DOS even though I just called them on Friday. I'll try to wait another day. *sigh*

I've got great news! Pman had his second interview on yesterday and was APPROVED! He will pick up his visa on next Tuesday and come home soon thereafter. I was so on edge that I couldn't even post. Now I'm relieved. I am praying for a speedy and favorable end to every deserving couple's AP. Thanks for your prayers Bridget. I believe every prayer helps. Stay positive everyone!

Thanks for the helpful thread Whatsnext. Please update my status in the tracker.

Fantastic news! Congratulations! Another family off the list. Enjoy your reunion and your life together!

Congratulations...best of luck on your new life together. Now when they gonna approve the rest of us.I have been so depressed lately.I miss Alen so much.He is scared to death in baghdad. He wants to leave Iraq. But we dont know what to do.sad

Just wondering if he could claim refugee status/political assylum? I have no idea how it works...but maybe it could speed along the process for you? I'm here in Paris worried about living arrangements for 3 weeks from now - trying to make a decision about leasing another apartment and shelling out significant cash for something we don't know if we'll need (i.e., if we get the visa before then). But reading your situation and Tara/Zaheer's and Wellmux make me feel silly. I know everyone has their own frame of reference, but our 'problems' pale in comparison to yours. We're not in danger or poor health or without support.

We both wholeheartedly wish you all a speedy and positive outcome from AP. I feel good news coming for all! With Zaheer and Malarie getting their visas this week and Starlight and HotGuy getting some good news from DOS, the rest of us are just a matter of time! I think collective positive thoughts are bound to have their effect.

Thank you thank you thank you so much everyone for all your well wishes and congratulatory comments. I am praying so much for Wellmux and HotGuy. I hope you hear something so soon. To all of you who are in AP, I will keep you in my prayers because I really do understand how hard this is. Insha'Allah, it will all be over soon. Zaheer is planning his trip for May 6th. So lets hope he has a very easy POE at JFK, NY. Its pretty warm here in South FL, so I am hoping to take him to the ocean so he can see it for the first time. I am not a beach person, but I would love to show him around. Well, thanks so much all of you who prayed for us and held out hope. May Allah Bless you and make all your dreams a reality.

So exciting! Congratulations! West Palm Beach is a great place, I'm sure you'll be very happy there together and he'll love the beach! Best wishes for your little one too, not easy to watch them have a cold at that age :(

The thing about AP is that I never knew anything about it until right before the interview when i started reading on visajourney. If I had known about it, perhaps we would have not tried to get pregnant when we did. I never wanted to be apart from him let alone travel while pregnant, all alone, give birth alone, recover from C-section, and take care of a newborn all alone with no income and only help from gov't in the form of foodstamps, wic, and medicaid. I wish they would tell you when you apply for immigration status that you will definitely have AP, even if it is just a few days. they should let us all know that it is a reality and we have to face it. It has been almost 6 months for my husband's AP and they have had his passport since the 12th of March. It only took Feisal 35 days to get his passport with visa back. So, let's see what happens. Zaheer calls AmEx office all the time to check and make sure if they have received it.. but they never say yes. =(
I pray for all of you to have a speedy AP especially HotGuy and Rana bhai.

It really is disheartening and your story is particularly touching. I do hope you have a strong network in the US that can help you through this. And you have a wonderful and healthy little person to take care of despite the hardships. I wish you comfort in your day to day life and a quick resolution for the visa. Think how much you will both appreciate being together and your life in the US (if you can get past the negativity I think we all feel toward the government process right now).

Update - unsatisfied with what the Embassy CO told me on the phone yesterday (that we stood out amongst the cases in AP, that nothing is wrong with our case, that all she could do was remind 'them' (the US, DOS, FBI?) that our case has been pending for a very long time, but that she would continue to follow-up) I called the DOS usual number today and got the most unhelpful person. She kept answering me that she did not have any information, she could not see details on when it was last touched, what agency it was with, etc. And when I complained that it's been 4 1/2 months now she said 'Well, I can see they are working on it, I can see it was updated just last week' So, the DOS certainly can see the details, but I believe are unable to share. I asked if the update was when the embassy reached out to check on our status and she said she did not have that information. Whatever.

wow Malarie! Congrats! That is such wonderful news. Mash'Allah! We hope to hear some positive news on our behalf soon too. Here's what happened with us...

Today I called DOS to ask if there was anything new since I had called last Tuesday or Wednesday. So, the lady was shocked at how long Zaheer was in AP.. (5 and a half months) and she was like "Wow.. he has been in AP a long time." and I said "Yeah" and she was looking at his file then said "They have his Passport, right?" and I said "Yes we sent it about a month and a week ago. And she kept looking and said "Yeah.. you know... you should...." then she kept pausing then she said "Why don't you call back by the end of the week..." and I didnt hear her well so i said "Im sorry, when should I call back, I didnt hear u" and she said "Call back by friday, we should hear something by then." And I was like "Ok, are there any notes on his file recently?" and she said "Only a congressional reply on March 31, but you know that, right?" and I said "Yes, I am sure that is when my senator's office replied to me." and she said "Yeah, it's still pending but why dont you call back by friday, hopefully we will know something by then." and I said ok and thanked her and then got off the phone. So, anyhow.. thats all that happened with us. I know it was finished with AP back on the 17th of March, and then put back on it around the 22nd.. so, let's see what happens. I am hoping the "Back on AP" is just because of his passport. Wish me luck. Allah Hafiz.

Ooh, that sounds positive! Lots of great news all around. Seems like somebody woke up in Washington and realized they're taking too long. Here's hoping for the answer you want on Friday - you know the next three days are going to be agony! Best wishes for you both!

OK - what do you all think about this....

My fiance had his interview on February 23,2010. After the interview he was given a paper that said "congrats blah blah blah - you will receive your visa withing 8 days via DHL".... two weeks later and still not passpport my fiance called the embassy and was told "oh -- you have to come in for an orientation and after you will receive your passport with visa" (this was on March 22,2010) .... Went to orientation and yep as you probably guessed still not visa stating still in AP.

It's just about 3.5 weeks later and we are going crazy not knowing if the file is in security clearance or some other type of processing .... because as I'm sure everyone on this forum knows calling the DOS is just a lovely experience and one that you dont get any real information from.

So last night I told my fiance that maybe he should try contacting the embassy from his side and ask for a status. Which he did and of course was told still in processing and they would call him when ready.

Not 10 minutes after I received this message from my fiance the embassy was calling me to ask me questions about myself as well as pretty much the same information that was asked of my fiance during the interview ---

A bit different than "oh you will have your visa within 8 days". Obviously they are looking for something more.

I asked the CO after all the questions what was to happen next and he said it looked very positive.

I'm having slight heart palpititions from the stress (JUSt KIDDING)... but really this is pure AGONY.

This not knowing is really really bad!!!

Malarie

You're right, it is AGONY! Sorry to hear about the AP, but it does seem rather inevitable for MENA males. Here's hoping your case will be short. At least you know they are working on it if they're calling you to ask questions. Best of luck and keep us posted on what happens next!

It's sad, but I have to confess that I come to this forum everyday, open the spreadsheet and look at all the blue colored cells of all of us journeyers who've received their visas...and it brings me a little comfort of being at the top of the list of those who haven't. Here's to good news coming soon - we're seeing a good trend with Mohammed after 13 months! Hope Zaheer, Dee, and Brahim are coming up soon - with 5 and 4 months respectively, can't be long now!

Maybe it would be helpful if we also tracked who is in AP at the embassy and who is in mandatory AP in 'Washington' (i.e., name checks)? SOrry to be a geek about this, but then we could really do some metrics on the average length of time....

Ok another thing that disturbs me is some men go to any country and marry females half their age, and they fly through the system even if they have been married a few times before. Where is justice in the system? What as being a female petitioner marrying a foreign man we have to suffer. I thought we are living in the modern world now, but it still seems like society has not changed.

Star

I completely agree and it makes me so angry that females from other cultures who obviously have arranged marriages for visa purposes are allowed to come to the States immediately. I know of two cases in my very small NJ town. We all have married for love and wait and worry that we'll get the visa. We spend countless hours, tears, and money on visits, living arrangements, etc.

I called the DOS on Monday, but I waited until Tuesday to email the embassy as we have a four day weekend for Easter here in the UK. To their credit, the embassy replied within 30 min  but they just confirmed I was in 'additional AP, which is mandatory and cannot be waived....Please be assured that as soon as the review is complete, you will be contacted'.

Who knows, you could still be right, but they're not encouraging are they? At least they replied quickly though, especially as their acknowledgement emails state that status checks for anything less than 90 days will not be answered. You just never know what to expect when dealing with officialdom anywhere!

It's terrible isn't it! And you don't fit the 'profile' for AP, so it's doubly terrible for you. The embassy tells me that it's in Washington and as soon as Washington responds they'll issue the visa. 'Washington' says it's not with the USCIS or the NVC, but at another agency that doesn't give updates (FBI? CIA?) who knows! Usually we get a few approvals by now - wonder what's happening this month?!
