US Citizenship General DiscussionMinor child and citizenship
Hi, I'm married to a USC and will be eligible to file for citizenship by August 22 this year (3 years). I have a 10 yr. old daughter from a previous marriage. When I apply for citizenship does she become eligible also? Also when exactly can I send to paperwork? Is it 90 days prior to my AOS approval anniversary date?

Age does not matter, you are not adjusting status, you are petitioning to remove conditions.

Thanks for the quick response! Filing all these papers gets me so nervous but I'm sure I'm not the only one though.

Removing Conditions on Residency General DiscussionI-751 help
My eldest daughter is turning 18 on July 30. Our conditional resident status expires on Aug. 22, 2008. Does her age matter when we file I-751 and I put her under part 5?

Removing Conditions on Residency General DiscussionFees for I-751 help
Hi everyone, we are within the 90 day period for filing our I-751. My 2 daughters (from a previous marriage) and I received our conditonal green card together here in the U.S. when I married my wife. My question is, when we file I-751 how much would the fees be? Would it be $465 + $240 ($80 biometrics x 3) or would we have to pay $465 each plus $80 each? The wordings on the USCIS site is a little confusing.

Removing Conditions on Residency General DiscussionPetitioner name change
Hi everyone, when my wife petitioned me and I received my green card, she was still using her maiden name. As a surprise to me for my birthday last year, she changed her name and legally took on my family name. We will be sending in our I-751 next week. Will there be a problem since her name is different now from when we filed my AOS?

Removing Conditions on Residency General DiscussionNOA received, what about children's extension
QUOTE (Kathryn41 @ Jun 18 2008, 01:56 PM) <{POST_SNAPBACK}>
There are instructions for getting the stamp for those who do not have a valid passport - I will see if I can locate them for you and post them here. If someone else finds them first, they are welcome to post them too (VBG). I would get the stamp for the other children as well - I don't know if there are issues at school requiring proof of residency or not but if so, you would be prepared.

Thanks but I just received two extension letters for both my daughters! The wierd thing is that it's just on plain paper stating that

"This is to verify that you are included as a dependent in the request for removal of conditions . . . etc. This verification extends the validity of your alien registration receipt card . . . etc."

Then it's not even signed or anything. I would think that they would print it on a paper with a letterehad or something. I wonder if this will be acceptable for the DMV.

Removing Conditions on Residency General DiscussionNOA received, what about children's extension
QUOTE (Kathryn41 @ Jun 18 2008, 05:39 AM) <{POST_SNAPBACK}>
It sounds like they are prepared to give extension documents with the I-551 stamp. Those are the instructions given for individuals who do not have a valid passport to receive an I-551 stamp. If your children do have passports bring them along as well . Your 17 year old should definitely go with you to the appointment.

My daughter does have a passport but it expired last year and we failed to renew it. How do they give the I-551 stamp when individuals don't have valid passports? Also should I get a stamp for my other daughter who is 9yrs old.? Would she need one? Thanks for your replies!

I have heard of others here with children getting separate NOA extension receipts for their children's derivative status. I don't believe they have arrived at the same time. I am sure you will hear from one of them about what to expect.

I called the service center and was able to talk to someone. They said that I should make an infopass appointment and bring 3 passport photos of my daughter and all the paperwork including the NOA. Has anyone had any experience like this?

Removing Conditions on Residency General DiscussionNOA received, what about children's extension
Hi everyone! We sent our I-751 package Monday, 6/9/08 to the California service center. They cashed the cash on Friday, 6/13/08. We received the NOA Monday, 6/16/08. I was surprised it was pretty fast!

The NOA states my name and A# so I probably won't have any trouble extending my driver's license and etc. for another year while our petition is under process but my childrens names aren't on it. I have a 17 yr. old daughter (will turn 18 next month) that needs to renew her driver's license also and I'm not sure how she can. Anyone know or have had the same experience with their children?

Removing Conditions on Residency General DiscussionPlain letter NOA?
Hi, we received the NOA to extend status for 1 year while our I-751 is processed. My daughters names were not on them but my eldest one needs it to get her license renewed. After a couple of days, we received 2 more notices (for my daughters) but it was written on plain paper and wasn't even signed! It said that the letter was to verify that my daughter has been included as a dependent in the request (I-751) and etc. The other letter even misspelled my daughter's last name.

The letter also says that "You may travel outside the U.S. during this 1 year upon presentation of both your alien registration receipt card and THIS VERIFICATION." But the letter looks so plain that anyone could have typed it up!

Has anyone ever experienced receiving notices like this? And would this be acceptable for the DMV and etc.?

Hi, my 2 daughters appointment for Biometrics is on July 11, 2008 and I just received my appointment date today in the mail and it is on July 10, 2008. Is it normal that we get separate appointment dates? I filed I-751 and my 2 daughters were under that petition. I wonder if they will allow us to go together. Anyone have any experience like this?

Thanks for the replies! I'm sorry russian_armenian for the confusion, my local office is Las Vegas and not Chicago. I guess I made a mistake on my thingy of the left saying something about Chicago, I'll try to fix that . . . anyway, I guess we'll do that - go together on the 10th and take it from there. Thanks again!

Removing Conditions on Residency General DiscussionGreen card in wallet
QUOTE (wannabe_texan @ Aug 1 2008, 10:28 AM) <{POST_SNAPBACK}>
Supposed to carry GC with us at all times. I'm carrying a copy of extension letter too when my GC expires.

From USCIS website:

Permanent Resident Card
The Permanent Resident Card, Form I-551, is issued to all Permanent Residents as evidence of alien registration and their permanent status in the US. The card must be in your possession at all times. This requirement means that you are not only required to have a currently valid Form I-551 at all times, but also that you must carry your currently valid Form I-551 on your person at all times. The Permanent Resident Card currently is issued with a 10-year validity. You status as a Permanent Resident does not expire with the 10-year validity. Only the card expires. The card is only valid up to the expiration date and must be renewed before it expires.

A Conditional Permanent Resident is issued a card valid for two years. In order to remain a Permanent Resident, the Conditional Permanent Resident must file a petition to remove the condition during the 90 days before the card expires. The conditional card cannot be renewed. The condition must be removed or you lose your permanent resident status. (See Form I-751 and Form I-829.)

I guess we'll haveto carry the extension letter too! I wonder if a copy would be ok? I don't like the idea of folding the original document to fit in my wallet.

Removing Conditions on Residency General DiscussionGreen card in wallet
Hi, I was wondering if there is a need to bring the extension letter along with your "expired" green card (under process) where ever you go. Also do permanent residents have to bring their green card wherever? Isn't having a driver's license in your wallet enough? I've been wondering about this since becoming a permanent resident 2 years ago. Isn't it better to keep your green card at home in case you lose your wallet?

Removing Conditions on Residency General DiscussionRenewing Driver's License with extension letter-
QUOTE (luzviminda @ Jun 26 2008, 02:59 PM) <{POST_SNAPBACK}>
I'm glad I found this topic because I am in the same situation. I am in Texas right now with an expired Nevada license. I tried to renew/reapply for a DL when I got here but they wouldn't not accept the NOA I received nor the biometrics letter, leaving me unable to drive. I was wondering, if I get an infopass appointment and I get the stamp, will they accept that (question to anyone who might know). Their list of accepted documents include "Resident Alien Card (I-551)" but I am not sure if they will honor a stamp on my foreign passport (after all, it's not a CARD). It would be really great if I can resolve this soon because Houston doesn't have the best public transport system. DMV frustrates me so much ranting33va.gif

Anyway, any info would be great!

Hi, me and my daughter just renewed our license at the Nevada DMV. It went like a breeze! My daughter didn't even have a formal NOA since she was under my I-751, they only sent her a plain paper letter saying that her green card is extended for a year and it wasn't even signed! Since you have a Nevada license, maybe it would be simpler to take a trip to Vegas and renew it there.

K-3 Spouse Visa Process & ProceduresUnemployment benefits used for support
No, they will not last 5 years but, they are guaranteed where a job is not. I know that if I dont find employment for the next 36 weeks, I have this income coming in, whereas with a job, you dont know if you will have it tomorrow, much less 36 weeks from now. Therefore, it would seem the guaranteed benefit would outway one that is not. Just my common sense opinion though. It would seem also that with the crisis across this Country, this information should be made available by the State Dept. which has been unresponsive to my request for information about this topic. But I do appreciate all the input from you guys and gals out there that have firsthand knowledge and experiences in sponsoring CR-1 or K-3 Visas and thank you for your feedback.

K-3 Spouse Visa Process & ProceduresUnemployment benefits used for support
My understanding is that by filing for a K-3, she can get here much faster (5-6 months) than by going the C-1 route. Maybe I am not understanding which way is the fastest. She graduates and takes her local Nursing Exam there in May and we don't want to wait any longer than we have to. So, which is the speediest to get my Wife home..the K-3 or C-1 route?

K-3 Spouse Visa Process & ProceduresUnemployment benefits used for support
My Wife and I were married last August and I want to start the I-130, K-3 process for my wife in the Philippines to come to Vegas and finish the process here. I have been layed off and now my only income is from Unemployment Insurance but the amount I receive is over the $18213, 125% above poverty for the two of us. Can I still file the I-129F using these funds since they do meet the income requirement per year.

PhilippinesShould I Be Concerned ?
Dude, Am I too late to tell you..WHAT IN HELL ARE YOU THINKING?? You can always call your carrier to get copies of any and all texts, deleted or not from her phone. New federal regs. that went into effect nearly 10 years ago made that possible. You may have to pay so much per page but if you really wanna know.....they can surely give it to you. From the looks of her prior pics back when you guys were kicking it in like 2007 and all, she has definitely become "AMERICANIZED". Her new friends are telling her she is an idiot for following the customs and traditions from back home now that she is here in the States which explains the empty plate when you get home. My wife is even shocked by your wife's change. She is even embarassed by how your wife is representing Filipinas because of the suspicious nature of her actions. Try getting her to sign an agreement, if someone cheats, they have to pay the offended spouse $1M USD and have it notarized and filed with the local family court system. Shouldn't be an issue if cheating is not in the cards. And if she does, then hey, a cool $mill will help with the healing for sure. Good Luck Dude.
