I just want to ask this:

Does it OK to file US tourist visa here in the Philippines while waiting for the approval of my immigrant visa and K3? Does this not result any complication in the future? or does it has a big chance that the tourist visa will be approved? Provided that we have a pending visa application.

or it may just a waste of money and time filling tourist? :huh:

When it comes to PI, there is a 90% denial rate. Back then when they were issued tourist visas, most of them never came back home. US embassy is very strict this time around.

but i have seen cases in my country getting approval but my collegues had exams so they were given
in other cases 90 % visas are denied and denial has bad impact on the interview for sure
i did a lot of counselling with my visa counsellor for the visitor visa :)

at max if u get a tourist visa it will be off 6 weeks
i advice u not to leave your country unless very urgent like some exams or really important urgency
they give tourist visas only with firm basis and strong with the hanging petitions
and u must at any time come back on the time limit they provide if u take tourist visa
else
your immigration can be of trouble,
even if u get a rejection while applying for tourist visa it can affect your petition later at interview stage ,

If the interview for the K3 was first then that might be why you received the K3 visa. Hopefully the CR 1 visa is on its way, probably should contact them though and see what's going on just to make sure.



Hi thanks for your reply..I contact them right away and they told me what i gonna do. so right away i make a letter indicate there that im going to pursue my cr1 not the k3 and together with the copy of my k3 visa...You think is there gonna be a problem regarding on my visa? thank you again

It would be good to bring all the emails... that's what I did. Regarding the pictures, just put them in a 3R album... that would do... you could bring a lot if you want, but the consulate officer who did our interview just took a look at one album.... just be prepared. you don't need to bring the larger albums.... it wouldn't make a difference and they're a hassle to bring. hope this helps...

The AOS bill is usually generated a the same time they generate the DS-3032 Choice of Agent. 1-4 weeks is pretty much their standard speel.

NVC will not accept anything until it is generated. Wasting your time to send anything to them earlier.

Yes the barcodes and the e-mail of the choice of agent to the NVC will work. Just be sure to wait until the automated phone message at NVC tells you that the two documents have been generated. Do not send anything before that.

I am the petitioner... I am US citizen and my wife lives in Turkey...
I have received DS-230 form yesterday...

Who is going to fill DS-230 form and sign (Confused)?
As a petitioner should I fill the DS-230 and sign part I and fill part II (no signature) and send it to NVC?

One more question: It is not clear in the packet:

My wife (benificiary) is going to collect the documents, is she going to take them to interview or is going to mail to consulate?

as for turkey ,When part I & II of the DS-230 is required as in the case of Turkey according the the NVC site, both parts I & II are REQUIRED to be submitted to the NVC along with all the documentation requested by NVC. Part I should be completed and signed, Part II should be completed and not signed.

should i mention again that in germany you only have to go to the "ausländerbehörde" where they process the visa things, wait some time (depending on how many people are there that day) and then they put a visa sticker in the passport which allowes to live and work in germany for three years...

Yea, I've gotten two visas in Germany (one as a high school foreign exchange student and once as a college exchange student) and both times the process was very simple. The second time was a little more painful because I was doing it in Berlin and the stupid bureaucrats lost my file and then the one I was dealing with seemed to think none of my paperwork was good enough (telling me I had to have my parents' passport there so they could verify their signature on their letter of financial support was valid! And hten that the letter had to be in German because he didn't speak English...but my parents don't speak German!) But I got it anyway :)

If it takes a while to get this visa, I'll take a leave of absence from work and go live in Finland for a while. As i'm married to a Finn, I can get automatic permanent residency. All I have to do is go to the police where my husband lives and fill out a form and they'll set me up :) Only problem: I don't speak finnish and my degree isn't high enough to get me a job there :(

Our I130 petition has been with the CSC since Sept 2006 and our I129F has been there since Oct 2006.

Just pending-no touching, no nothing!

My husband phoned his senator as we are nearing the 180 day mark, but was told to call once we hit it!

Hopefully everybody who has been waiting so long will be approved soon. Or I'll be old and gray by the time I get to my husband! :blush:

Well I hope we've all learned the valuable lesson that you don't get anywhere calling VSC (if I weren't so nice I'd say I told you so LOL). PLEASE friends, as I had suggested a while ago, once you hit the 180 days mark go to your Senator. Don't call VSC, it's a waste of your time. Niagara, don't worry about what they told you-just contact the Senator and let them deal with it. To the rest of us-our day is coming in NO TIME! Get those privacy release forms filled out LOL!

What do you think if it 180 working days?

I applied for I-130 09/21/06 and received my NOA1 on the 9/27/06 for my wife.....so far there was few date changes in the web site. So I finally called them today the 1/31/07 and they said that, they need more info and they send a mail on 1/25/07 but I did not see anything on the web site about them needing any more information.......did anyone have to go through this situation. does that mean I have to wait another 3 more months for my approvals

Hello everyone!

I just read a very disturbing article today in the local paper. It discussed a family where the man and wife were married in Japan and then she traveled to America on a Fiancé visa. When they tried to get a permanent residency she was denied because they said she had committed fraud by coming to America on a Fiancé visa when she was already married.

My question is this:

My wife and I married in Japan this April and we have filed our I-130 just last week. She plans on traveling to visit me in June for about 70 days on a visitor’s visa. She is not entering to immigrate but to just visit. She has a return ticket and does not plan on staying.

Is this a problem? Since she will not stay in America can they say that she is committing fraud? Since the US government is so warped I am unsure.

SHARING SOME INFO REGARDING DELHI EMBASSY PACKET 4 CHECKLIST REGARDING TAX TRANSCRIPTS TO BE SUBMITTED TO VFS OFFICE ?


AFFIDAVIT OF SUPPORT:

Applicants should check with their sponsor to see if form I-864 has already been submitted to the National Visa Center (NVC). If so, it is not necessary to submit another I-864.



A) Immediate relative and family preference category

Each immigrant visa applicant needs to satisfy the consular officer that he/she will not become a public charge. In all immediate relative, family preference, and employment-based applications (in which a close family member owns 5% or more of the petitioning business), the petitioner must submit a completed Affidavit of Support (Form I-864), no matter what his/her financial circumstances are, to show that the sponsored applicant(s) will not become a public charge.


i) If form I-864 was not submitted to NVC the applicant must submit the following from the petitioner (sponsor):

a) Form I-864.
B) Evidence that the household member is a U.S.citizen /U.S. permanent resident if a form I-864A is submitted.
c) Federal tax return (form 1040) with all W2s and supporting schedules for the most recent taxable year.
d) If the petitioner did not file a tax return, then the petitioner must provide a written explanation of why he/she had no legal duty to file the return.
e) If the petitioner filed a late or amended tax return, he/she should submit evidence of it.
f) If the petitioner does not have copies of his/her tax returns, an Internal Revenue Service (IRS) summary should be submitted.

ii) If the petitioner's income or assets do not exceed 125% of the federal poverty guidelines, then an I-864 of an additional sponsor willing to assume financial responsibility for the sponsored immigrant(s) must be submitted. This additional form I-864 must include all the supporting documentation indicated in section (i) above, as well as evidence that the Joint Sponsor is an American citizen or Legal Permanent Resident.

iii) If the additional sponsor lives in the same household as the petitioner, he/she is considered a household member, and cannot fill out a separate I-864. The household member must execute an I-864A, as described below.

iv) If a sponsor wishes to qualify using the income or assets of a spouse or resident of his/her home, in addition to the above documents he/she should also submit form I-864A for each additional contributor. The additional contributor should sign the form I-864A as the household member. Each household member should submit a form I-864A along with all the required documents outlined in paragraph (ii). Please note sponsor must include household member income in part 4 of form I-864.

v) (a) Applicants are responsible for providing sufficient copies of the form I-864. Beneficiaries of immediate relative (IR) petitions must provide one original signed -864 and one complete set of original supporting documents. (B) Beneficiaries of family-preference (F) petitions must provide one original signed and notarized form I-864/I-864A for the principal applicant and one copy of I-864/I-864A for each family member, and one complete set of original supporting documents for the principal applicant. © If a dependent(s) will follow the principal alien to the United States at a later date each such dependent must submit an original signed I-864/ I-864A and a complete set of original supporting documents.

Mala,

You don't need to bring tax transcripts for the Embassy, as your husband has already submitted them to the NVC in USA. NVC will forard everything to the Embassy. However, it is a good idea to keep all copies with you and review them. Sometimes, consular offices asks questions from them to check, if the spouse is aware of all information. Plus, as YuandDan said, you can point them any spelling errors, if there is any. You also don't need to bring any IV Bill for the interview, as your husband must have paid it to the NVC in USA.

What happens next?


On receipt of the forms DS-230-Part I and DS-2001, the NVC will conduct any additional processing required and forward the applicant's file to the U.S. Immigrant Visa Unit in India that serves the applicant's current residence.

After an Immigrant Visa Unit receives the applicant’s file from the NVC it will inform the applicant by mail about their visa interview appointment.

The petitioner and Form I-864, Affidavit of Support

The person bringing the beneficiary (applicant) to live permanently in the U.S., the petitioner, must accept legal responsibility for financially supporting the beneficiary. The petitioner accepts this responsibility and becomes the beneficiary's sponsor by completing and signing a document called an affidavit of support. This legally enforceable responsibility lasts until the beneficiary becomes a U.S. citizen or can be credited with 40 quarters of work (usually 10 years).

After the petitioner has paid the Form I-864 processing fee the NVC will send a letter with instructions to the petitioner. The petitioner should return a completed Form I-864 to the NVC. When the NVC has reviewed and approved the petitioner's Form I-864 it will be forwarded, along with the petition, to the appropriate Immigrant Visa Unit in India.

Important Note: The applicant and petitioner/sponsor must not download and mail any forms to the NVC until they have received official notification that the NVC is ready to proceed with the application. Forms received before official notifications will be discarded.

2)my local embassy in india insists on bringing tax details , my husband already submitted the main tax returns sheet up to date with i-864
we dont have those sheets now

do we have to again submit these tax documents copy at the embassy or will the nvc forward it with my ds-230

any idea can we get those tax returns print outs again??

I called the NVC on tuesday morning the 29th and the operator told me that they had received my I-864 fee and had generated the I-864! She said it would be mailed this week and I should get it in 2-4 weeks (I am finding that this is a standard reply from NVC tho) I sent the I-864 package overnight as per James' shortcuts. I must say that I am a bit surprised that our IV fee bill hasnt arrived yet. it has been 10 very LONG days since I found out it was sent out. I am truly thankful to GOD and to all of you for the support, help and prayers that we have recieved so far. You are all in our prayers.

You can also call the NVC to find out if they received the payment for the IV bill, they won't close the case unless it is received. Once they close the case the embassy will know that everything is in order, including the fee payments.

Mala, they never ask the visa applicant to show them the proof of IV Fee Bill Payment. Embassy already knows that it was paid, since your hisband paid to NVC. But, if your husband still has the money order/cashier check copy, he can send it to you, though you don't need to worry about it at all, trust me.
