IMBRA Special Topics	IMBRA- "International Marriage Broker Act"	In reality, whether you have perceived its impact or not, the International Marriage Broker Regulation Act (IMBRA), which went into effect in March 2006, affects ALL K visa petitioners and applicants. It [also] places a number of requirements on "marriage brokers" or web-based introduction services. Most significantly for K visa petitioners, IMBRA has introduced restrictions on the number of K visa petitions which may be filed both within a two year timeframe and a lifetime. There are also provisions designed to protect K visa recipients from domestic violence by distributing educational pamphlets through the Department of Homeland Security and providing information about any criminal convictions or previous petitions of the US citizen petitioner. This law came about not beacuse of the jealousy of American women, but because of some real abuses out there over the years, which even led to the deaths of foreign national spouses. Regardless, of the box you check or do not check, the larger issue is, that the USCIS, DOS, and the FBI, each conduct their aspects of the enhanced background check now performed on all American men who petition to immigrate a foreign spouse or fiancee to the U.S. For those of us who do not have any of these following outlined issues in our past, the path is generally clear; however, for those who do, the issue may come into play. While USCIS and/or DOS do not disclose reasons for denial of petitions, I have always suspected that [some] of these denials are likely due to IMBRA related issues in the petitioner's past history. The most significant provisions of the IMBRA include: (1) New I-129F Petition for Alien Fiancee Visa Form: The new I-129F form requires petitioners who were convicted of a violent crime (includes domestic violence) or a crime relating to a controlled substance on three or more separate occasions to submit certified copies of all court and police records--regardless to how you met her. The new I-129F petition also requires petitioners who met their fiancee through an international marriage broker to write the name and the address of the international marriage broker on the petition. (2) Restrictions on Visa Petitioners: A consular officer is prohibited from approving a visa petition before verifying that the visa petitioner has not (a) filed K visa petitions with regard to two or more aliens (b) filed a K visa petition within the last two years or © committed a violent crime. If a visa petitioner falls into one of these three categories a waiver must be granted by the Department of Homeland Security before a successful visa petition may be filed. (3) Database Tracking Multiple Visa Petitioners: The Department of Homeland Security will create a database to track multiple K visa petitions. After a second visa petition is approved, the petitioner's name and information will be included in the database. In cases where subsequent visa petitions are applied for both the petitioner and the beneficiary will receive notice about the previously approved number of fiancee and/or spouse visas of the beneficiary. (4) Domestic Violence Information: The Secretary of Homeland Security will develop an information pamphlet on legal rights and resources for immigrant victims of domestic violence. The pamphlet will be mailed to all K nonimmigrant visa applicants with the visa application information packet. The pamphlet will also be available on the websites of the Department of State and the Department of Homeland Security as well as at the consular office. (5) Criminal Convictions Disclosed During Consular Interview: During the Consular interview, the officer will provide the applicant with information regarding any protection orders or criminal convictions of the petitioner. The applicant will also be provided with an information pamphlet on the legal rights and resources for immigrant victims of domestic violence and an oral summary of the information included the pamphlet. All in all, there are no hassles and the US Officers, while stressed out from the mob scene, are very professional and fair. Recently I have had friends who were allowed to go through the foreign national line, along with their spouse; they were not separated. And yes, the Officer will take the envelope and open it upon entry. He will then stamp the entry date on the visa. Always be polite and courteous. These Officers have all the power at that moment. Although not common, they have the absolute authority to deny entry, even with the US Visa in hand. The biggest issue I see at the Tom Bradley International Terminal, is the large number of flights which are arriving one on top of the other, which makes this terminal a real zoo, with thousands of people and long lines, while trying to collect baggage and get through the various USCIS check points. I have tried to calm her, and have tried to ask her questions to get all of the proper information for the I-129F, G-325A, etc., but she just doesn't understand what I am asking her, and sometimes why I am asking her things. I keep telling her it is because the American government wants to know. She says, "But in China...." Then I remind her that we are trying to bring her and her son to America, not China, so we must do everything we are asked to do. So, with all of this in mind, I emailed Mr. Lin a few days ago to request a little more information about his services, but I have not received an answer. K-3 Spouse Visa Process & Procedures	K-3 Guide information	Hi, I am recently married (this month) to my woman in Guangzhou, China. I will start my I-130/I-129f K-3/4 Visa process very soon. I have closely reviewed the K-3 Visa Guide with respect to the I-129 Cover Letter and its contents as provided in this venue. I have also looked at the the similar K-1 Visa guidelines herein. My question is.....I perceive a nuance between the two types of visas in the guides ?? It appears that it is not necessary to show proof of visits to her e.g., airline ticket stubs etc. and (logically) intent to marry the foreign spouse ?? I have a close friend who is now in the final phase of the K-1 Fiancee Visa process for his Chinese Fiancee, and he says I must include proof of my visits to see her and written declaration of how we met and the status of the relationship etc. as attachments to the I-129f Cover Letter ?? Good Luck to all. Overall, I agree with your assessment; however, I think we will see the the P-3 and P-4 times move a little faster, based on some other anecdotal info I have been observing. We both have almost identical I-130 and I-129F time frames and we both share the last 'touch' back in July. I, too, am still waiting for the NOA-2. If I had realized there would be this flood of filings to beat the fee increase deadline, I surely would have filed a month or six weeks earlier. I have no one but myself to blame for that factor. The bottom line is, that for those of us who filed in this May-June period we're at the start of the flood, and we will still stay ahead of the main larger wave as each step is reached !! Also, the bulk of our time has already passed by and what lies ahead will not be as great a time period, overall. I expect we will see the P-2's in this next week to ten days !!! Think positive !! I'm no expert but I think Embassies now come under Homeland Security...not State Department...at least not the Visa sections. In fact, some embassies have a USCIS oiffice within the Embassy. When I wrote the Moscow Embassy the reply was Homeland Security first address line, USCIS second address line. The Embassies and Consulates around the globe, have always been under the purview and one of the prime components of the US DOS. While they work in a partnership with USCIS a component of the DHS, they are distinctly separate Departments of the Federal Government organizational structure. Davejaz was "lucky" in that his petitions were not paired, and his I130 approval came so early that he chose to pursue it instead of wait for I129F. I read your time line here and yes, it was true about the computer delays in getting out the NOA-1's for the I-130's back in May and June. I got wind of this at the time I mailed my I-130 in early May, and when the NOA-1 did not show up when expected, I phoned the CSC and spoke a very nice female VIO who also advised there was a computer problem in generating the NOA-1 receipts in a timely manner. She told me she would order (2nd request) the NOA-1's again for me. But she added that it would take two weeks for them to arrive. I asked her if I could send in the photo copies of my canceled fee checks for the I-130's with the WAC #'s on the back, along with a copy of my USCIS Protfolio info from their webpage, as evidence in lieu of the receipt form. She told me this would be ok, and to try it. I did and I had my NOA-1 for my I-129F (for K-3) one week later !!! Therefore, I did not have to wait for the copy of the NOA-1 to arrive in the mail to attach to the I-129F. I was able to file sooner and stay ahead of the delays caused by the earlier computer issue; of course, until this lastest delay glitch over the NOA-2's.	My Lao Po	Male	China	2007-10-29 22:59:00

I called the NVC at 603 334 0700, and asked about the status of my case. I was told when it was sent to GZ, and given the GUZ number. Something to think about, if you are a K-3 and K-4 petitioner !!! My NOA-2 date for both I-130's and the I-129F, were each issued/approved on Nov. 6th. I checked with the NVC automated system today and discovered that my eleven year old daughter's I-130 was logged in at the NVC and a Consulate number (GUZ) was issued on Nov. 14th....only one week. My wife's I-130 and our joint wife/daughter I-129F, have not been logged in as received yet. I phoned the NVC and spoke to an agent; she advised me that each document (both I-130's and the combined I-129F) will receive separate Consulate numbers !! I had assumed that there would be one number for all of the files at the Consulate. This also indicates to me that with a minor child, the name check and any other FBI checks are minimal; however, maybe for the adults, both petitioner and beneficiary, it takes several days longer ??? Just my observation.....hope the I-129F Consultate number is generated soon and it is mailed to China !!!! The practice has been, for the VIO’s to ask for one or more of the past year’s tax forms, even though there is no basis for this on the I-134, for an employed individual. Moreover, while the taxes are not always asked for, I would not want to think about the consequence of not having them for her at the interview time. Of the ones I know of who have had recent interviews and were asked for the tax return, most were asked only for the previous year’s return. It is also my understanding, that if they ask for the tax return, they will not ask for the bank statement, usually only the employment verification letter. We finally get to his car after squeezing through a chain link fence, and sure enough he gets me to the domestic terminal with no problems. Turned out to be one of the nicer guys I met over there. I did wind up missing my flight anyway, but it wasn't because of him. You just can never tell what the reality of a place is until you get there. I mean, I don't think I need to go to Darfur to believe the stories, but I do think a lot of what we hear and what the State Department puts out is just a little too paranoid. I've talked to another guy who's been to Bogota and said the same thing--nice city, nice people, never felt threatened. Goog luck to you, hope your approval comes soon!! I have resisted calling, because I am not convinced it is productive unless most filers, in your respective time frame, have already been approved previous to you. Next, I figured today would be a slow 'news-day' due to the quasi-holiday and the preverbal office luncheons and parties and employees leaving work early to go to more parties and/or to prep the kids for tonight's festivities. Hey, people are people, be it in government or the private sector. Last, IMO, for those of you worrying about an RFE......don't worry a lot!!! Very few RFE's are issued this late in the process. Most come soon after the initial I-130 and/or I-129F is sent in and that important first content review and document scan takes place at the front door, so to speak. It is not common to see the RFE this close to NOA-2.......if there is to be a surprise, you will most likely get it during the interview at the Consulate or Embassy. This is also why the "approval" we all speak to at this stage, is really in name only. Remember, everyone of that 10 to 20 % who get blue or white slipped at the interview, were each approved at the NOA-2 stage.
