If the OP does have a C or D visa, then they might want to consider getting married and going through the K3 or CR1/IR1 route. Since she is free to travel in and out of the US, they can get married on one of her trips down to the US. When she returns, they can file the K3 or CR1/CR2. While that is being processed, she can continue to travel on her C or D visa as part of her work.

No you don't have to have that much in your bank account. That is crazy... You will need a police report from where you are living now, and maybe from where you used to live. This is only for information regarding you have not been in any trouble with the law. It could take awhile depending on immigration. Since you got your NOA notice, that is the first step...then when you go to the Embassy for your interview, make sure they understand how much you really want to be with your fiance. My husband is from Morocco which is different than your embassy. They did not believe him about our relationship and was going to send papers back to USCIS. So beware you could get papers stating you are not approved, but do everything you can if this happens to reassure them of the love between you two. Make every effort if this does happen to stop it from going back to USCIS. I did, I called the embassy, my senator over here and had people write letters of our relationship. He is now here as of 2 years ago and we are happily married. GOOD LUCK!!!!

I am the lucky guy who is getting sponsored by his fiance to move to the US. We sent in the I-129F approx 17th of Feb, received NOA1 on 30 March. Our application was just approved on 15th June. So now we wait for the next part.

Now for the questions =)

I have seen posts regarding how much it costs, is it true you have to have $5k in your bank at the interview? Is this in my account or my fiance's?

What does the Police Certificate actually mean? Also I have not been at my current address very long, only this year, will that matter?

How long does the process take once the NOA2 is sent out? We have seen on the letter it is 2-4 weeks for the new case number then the interview times/dates?? Very confusing this process.

How flexible is the Embassy with the interview process? Reason is in my current job I am constantly travelling for work & I need to be working for the money.

The last & biggest question is, I am from New Zealand, however I have been in the UK for 6 years now. Will this affet our application? Esp as I have had a typical London life with moving flats every year.

I don't know of any other way of doing it.

No one is allowed to live in the US on a tourist visa. So you've got some more info gathering to do before you start so that you are aware of any potential bans to US entry that may be in place.

How long was she living in the US? At what age did she enter? What age did she leave the US?

I beleive that the first time I entered the US was when I was 1 year old
I enteres the US several times and stayed for years
the last time I entered was in 2004 I beleive and left on 2009

In june of this year I met a wonderful woman on a on-line dating site. even though it was not for international dating, she lives in mexico.
I think she is perfect, she is everything I also knew I wanted in a wife.
I have now traveled to mexico and meet her in person and we are ready to get started! I would like to thank you for your help and advise in advance.
She wants to hire an attorney to handle this for us, I think we can do it ourselves. I know an attorney may be the best solution but the ones I have contacted want $1500 to start the case. If I need to pay this much it will delay us by about 2 months.
We have several things we are worried about before we get started.

A few details for your information at this time.
I went to mexico 9\19-9/22, I have receipts and pics, and of course my pass port stamps.
I earn about 38,000 a year, I have 2 kids, the oldest will be 18 in 7 months and no longer considered my dependent.
She has two kids who will be our dependents, they are US born and live with her in mexico at this time.
Neither of us has a criminal record that would effect this, I do have charges from over 20 years ago, but nothing major, and nothing listed as a problem.

She lived in the US on a tourist visa until it expired and moved back to mexico.
when her mom applied for her original tourist visa she was a minor, her last name on that visa was Cedillo Almanza, her moms name because her dad did not live with them.
After some time her dad added his name to her birth certificate but her mom never changed her name on the visa. she entered the US as Alejandra Cedillo Almanza, now she uses the name Alejandra Andrade Cedillo.
while living in the US she applied for and received a South Carolina drivers license, she thinks she didn't have the right to have one because she was only on a tourist visa, not a resident.
In 2004 her visa was stolen, she never reported it to the embassy but did file police report.
lastly, her mom is in the US illegally now, she does not want her to have problems with immigration because of us.
Will any of this be problems or cause us not be able to get her here?

HI all,
As we wait for our application to be processed, I am trying to plan and prepare for the interview in juarez mexico. Alejandra will be flying from Mexico city and I plan to drive in from the US with my adult son.
Because she will be leaving her two small children with family we don't want to have her away any longer than we must. Can any one tell me how long we need to plan on her being there, what happens if the results of Medical exam are not back before the interview? If it a bad idea to buy round trip plane tickets?
I can for see her interview being early in the week and her not wanting leave the kids on a thursday to fly in to juarez, to stay almost a week. I understand the medical must be done there. is this true?
I will only be able to stay 3 or 4 days before i need to return home myself.
We plan on her coming to the us a month after she has visa in hand, in order to give her time to say her good bye's and get everything arranged for her move, so a small delay in being told she is approved and receiving the visa is not a concern.
Can you tell me the what to expect in the process, the medical, and what happens when the exam is not back before the interview. Any information, advise or suggestions will help.

Almost all embassies require 125%, because that is what you will need for AOS a few months later.

Usually they only require the 125% to be current and ongoing; so as long as you can show the job you CURRENTLY have is permanenet and stable, and have a few paystubs to show, you should be fine. Some embassies will be picky if the last tax return doesn't show enough income.

Yes, non taxable income counts.

I have read and searched but have only confused myself! Do they require you to have met the poverty guidelines for the past 3 years? in Nov I changed jobs (same field i have worked in for years, different company), the last 2 years I would not have meet the 125%, really the year before last. This year I will met it with some extra. the 1st year they will be looking at I was far below the bar.
The things that are changed from the last two years and this year are 1, I make $400 more a week since nov. 2, This year I will not claim my ex wife or kids on my taxes, therefor she will not be count as a dependant, 3, on child turns 18 before we will file the affdavit. 4, part of my pay is "per diem", i do not get taxed on it and it only shows on my paystub but not my w-2(I am useing the W-2 amount to calculate the poverty requirement)
My questions are,
Am I needing 100% or 125% to met the requirments
will my pay stubs showing my income from this year prove I make enough
will my 18yr old count against me even though I dont pay child support on him
will they look at my past income and denie me?
I will have tax transcprit from 10,11,@12 plus my pay stubs.
Is there anyway to count my non taxed income? and will they understand why my paychecks are written for more than I'm taxed on?

They say its not required to show a police certificate (which indeed they didn't ask for) BUT same thing they said about vaccines, (Not required for K-1) and they still applied TWO vaccines. (Another total of $2,000 pesos for the vaccines! :angry: ) so I rather be safe than sorry, anything you don't have that they ask for will cause delays, which I doubt you want.
Do what you think is best, we barely had our interview a couple of days ago and this is just our personal experience. We took anything and everything we thought would be useful even though they didn't ask for them at the end.

I used the I-134, with 3 years of tax transcript, 2 recent pay stubs, an employer letter, bank account info, and property value and they accepted.
It's important to fill out the I-134, they usually and most likely ask for this form and proof so don't skip it.

They didn't ask my fiancé for a police record, he has a clean record but they didn't even ask him if he's ever been convicted.
I'm not sure about this, they say its not required but we went on the safe side and took a police record (clean obviously) just in case they asked for it.
They didn't but it was all good.

I plan on 3 years of tax transcipts, my last four pay stubs plus one per month for the year (to show my pay is constant and within the same range every week, i letter from my employer. I dont plan on useing bank info or property value because my payroll this year should be more than enough, I dont want to use my property because it is paid for free and clear, and i dont want to risk it, how ever if needed i will. My personl bank acount would not help, except to prove I have them and have weekly payroll depostits, the cash value of my personal account is very little. Do I need to reconsider any of these? Ill fill out the form and give it to my fiance incase they do ask. And have her get a police record just in case. I dont want any mistakes or delays that I can prevent

I have read the instuctions from CD JUAREZ's web site, it says an The Affidavit of Support I-864 is not required. it says nothing about form I-134, does this office need an affidavit or do they just look at tax trans, paystubs ect?
also I have read conflicty info about the need for a police record, does my fiance need one if there is not charges or arrest to list?
can someone who has been through Juarez, please tell me their experiance and what they were required to have.

On a more serious note, if you're going to learn Visayan and you want to be completely correct you've got a long, long road ahead of you. If we want to be critical, as some might be in relating to English grammar, well then, there really is no Visayan--now some might say that there is Cebuano but consider that how could this even be since before the Spaniards came the predominant Philippine alphabet's whose name was Baybayin, had neither a "v" nor a "c."

So you can tell your wife that really she is speaking Sugbuhanon but she will simply stare at you blankly or laugh because she will instantly understand the word Sugbuhanon, and so should you as most likely you've been to Sugbu. Once you've learned Sugbuhanon (commonly known as Cebuano) you've still a long way to go as Sugbuhanon aka Visayan will also require learning Hiligaynon also known as Ilongo, Waray-Waray, Porohanon and Boholano. I don't know about you but learning new languages gives me a headache and I'm so happy that Juliet and much of her family knows English.

Of course no one can tell you exactly how many denials happen, since we only see a sampling of those going through CDJ here on VJ, but I can tell you I have not seen many denials in the last few years. Of course this is only those that report back here on VJ about how their interviews went. At the moment I can only recall one. They admitted using drugs at the medical and it all went downhill from there. Most get approved, so the odds are on your side. Posted Image

We have met the all the requirments, and beside being close on the income part, and only have met once in person once (I will be there when she has the interview), we are well with in requirments. We know its a long wait but I'm looking for things to help her through this and keep her calm, or to see if we do need to be worried!

My fiance's 2 girls are US born citizens,  they live in Mexico with her.  Normaly one if not both of the girls come to stay with thier grand parents for summer vacation. We are talking about bringing them both here this summer, and letting them stay until after the interview, which we hope will be no later than this fall. If they are in mexico when she goes for the interview it will be hard for her to find someone to stay with them in Mexico city so she can be gone for a week for the interview. Also we would like them to start school here this fall.

My fiance is concerned that the CO will think that she is only wanting the visa so she can be with them in the US. She is worried that will cause her to be denied.  I think that since they were with her before we filed and only came to the US before the interview, that no questions would be asked. It seems to me that the CO will know that the girls were not needed at the interview and would not be concerned that they are in the US visiting family (and me). I will be in Mexico for  interview but doubt I will be allowed in, then travel home and wait with the girls for their mom and my wife to be.

No, it's not a certain. He can still travel as a tourist, but he may get more hassle at the border about it. He can do so, but he should travel with evidence of good ties back home, return travel info etc. to show he's not planning to stay illegally.

You can still visit him, but the same can apply (they make think you're planning to stay in Canada).

It's more of a warning than an absolute no-no.

The same advice is good even on K1 path. Border agents are often more likely to hassle anyone visiting their bf/gf/fiance/spouse.





Oh wow, I have read about ppl being hassled when they say they are visiting their fiance, and I still told the agents in mexico thats why i was there!  I need to be more careful,

You have to schedule your interview appointment to the embassy before you go to your medical examination. Also the medical will last for 3 months only and the embassy don't like that for long thats why they are requiring at least a week before the interview. And the ST. Lukes will ask the interview dates and appointment letter to her so better get that done first. As long as you have the case number you are ready to pay anyway.

 

And for the long wait, well its up to your fiance if she have suspicious Xray which is the number one enemy of applicant Hehehe. But if your fiance is clear only 2 days she will be release and ready to go on to interview.

"~ "  is not an English character, embassy requires ALL documents to be translated to English (I know... ), so the lack of "~" on the BC is actually following the requirement.  Like said before your visa will not have the "~" either.

 

Without special effort on my part there is no way I can put the "~" over the N when typing... won't happen. 

 

Relax.  You will be fine with the NSO BC not having the "~", I truly do not believe its a "deal killer".

I noticed while reading reviews that the Filipino consular encircle those wrong information (like wrong birthdate on CENOMAR) and they are ok to proceed. Well, I know that its very different in my case because its my surname.

 

I will have my interview soon so I'm completing my papers.

Being that the embassy requires all documents to be in English (or translated to English) they may be moot on the "n".  The visa will not have the Spanish spelling of your name regardless of what your passport or other documents show.   IMHO

 

Actually the embassy are all N. And I know also that once I get there in US I mean, I need to get rid of the ~N

 

Just had a panic thoughts about this.

Im having the same concern with that "tiny" line over the letter "N" on my last name. my passport and bc have it but my other government ID's don't. even when i went to NBI and told them to put a line over the letter "N", the guy said he can't do that or maybe he thought that that "tiny line" doesn't even matter. some of the forms from the I-129f packet have it too, but the other forms don't since that letter doesn't even exist in the English alphabet. im hoping that it won't really matter if the line over the letter is missing or not since everything or every letters are all correct anyway. i hope the CO won't even bother asking about that. any thoughts?
