Waivers (I-601 and I-212) and Administrative Processes (221g)restraining order

hi ya david
hows things going...have you got an interview date yet...

if the Australian Police have advised you that it won't be placed on your certficate I wouldn't worry about it...

its not recorded as a criminal offense and no time was spent in jail ....

take care
kath

Thanks for the reply. No I haven't got my interview date yet. Apparently its only a offense if you break it, I know I shouldn't worry I just want everything to go right! Im in Victoria but according to legal aid in Perth (its the only place I could find this info) restraining orders are not placed on records.Im just paranoid! But thanks for the reply.

Waivers (I-601 and I-212) and Administrative Processes (221g)restraining order
Hi guys just a quick question. I havent got my police checks yet but im worried about the above topic. When I was 19 ( im now 26) a friend inherited (or so he thought) his house that he was living in (his father died when he was 3 and on his 18th birthday the house was his) So a couple of friends and I set about moving his mothers junk (the house was a pig sty) to one of her other houses. Turns out she got the inheritence overturned when he was 6 (he found this out through his lawyer) and had life interest. So she got restraining orders on her son and 2 of his friends. Should I be worried? The australian police have said that they don't consider it an offence only if you break it which I didn't but I don't know about the americans. Any advice?

Good luck you will go fine. My interview was really painless! I had to sit around for a bit but no dramas and the only questions I got were "so you were married last year?" and "is your wife in Australia?" apart from that they looked at all my paperwork and said yes and I have my visa in my hand! But good luck once again, enjoy the snow and hopefully the flight goes by quick! All the best, david good.gif

A December interview would be ok but January is next year and seems so much further away! I have no police record, medical was fine have the affidavit of support and have packed away the house. Give me the interview, pleeease! Its good to know that I am not the only one in this situation.

Having the interview later does mean that I can get all the mundane "things" out of the way, but Its still little annoying as I have all my paper work ready to go! Bloody APEC I suppose that it means I can save more money but miss our first wedding anniversary and my wifes birthday. Apparently patience is a virtue.

Hi I have just sent my ds 2001 to the sydney consulate. I emailed them and they told me that they were scheduling interviews for the month of january 2008! and that they shall let me know when my interview will be. I thought sydney was faster! So It looks like several months without the wife! Has anybody else had this with sydney or put in their ds 2001 recently and have been scheduled a interview sooner? Thanks

Hello everyone, I am at the final step of my journey, but I have a question. I am doing dcf through Sydney. I am in Melbourne but was born in Tassie. I got my police check through victoria police. I had the national fingerprint and name check. Was this the right one? I am assuming it is but just want to make sure. This check is for the whole of Australia. I contacted tassie police and they said that this is the only check I can get for tassie as I am residing interstate and the National police check is for the whole country and the victorian police knew I was doing this for an us visa. Am I worrying for nothing?

Hello just a question. i-134 do I need this form. In the documents in packet 3 from Sydney in the checklist with the ds 2001 it mentions this form. Now looking at Sydneys website it seems that this affidavit is only for K visas , is this right? I am doing the spouse visa so I have the i-864 filled out but no i-134 I have never seen this form!

US Embassy and Consulate Discussioni-134 do I need this form?
hello thanks for the reply. I had a look again at the Sydney website and they only mention it in regards to K visas. With spouse visas they only mention the i-864. When we filed we had to submit the i-130, g325a biographic form. They approved that stage and then we received packet 3 not long after with the medical form, affidavits of support, police record requirements and ds-230 1&2 and ds 2001 form no i-134.

US Embassy and Consulate Discussioni-134 do I need this form?
Hello everyone I am currently doing DCF through Sydney. I was just going through my packet 3, I have my police records, my medical is on Monday, and the affidavit of support form from my wifes father (my wife was a student so no income, although she is about to start work in the states) Now looking through the checklist it mentions i-134 and that "it may be in your file or otherwise attached" Well mine isn't and I don't know what this form is! It does not mention this on the us embassy in sydney website or on the list of instructions I got when first starting this process. It would be great if someone could shed some light on this form.

Removing Conditions on Residency General Discussionhow does this look
Hello, I arrived in the United States in October of 2007 so I am getting ready to apply for removal of conditions which I will do (if my math is correct) in July this year. I thought I would write a list of what info I will be sending at get everyone's thoughts on it.
2 lease agreements with both of our names on it.
Joint Credit card statements (6 months worth)
Joint bank account statements (6 months worth)
1 year of joint tax
Roth IRA with my wife's name/ my name as beneficiaries
Car/house insurance in both of our names
Time Warner bills with both of our names on it
Copies of other bills etc that were only in my name or my wife's to show that we do live in the same apartment
6 Affidavits
Membership cards of the gym we go to
Magazine subscriptions with our address on it
About 15 photos
Cards (Christmas etc) address us both (including some envelopes with both of our names on them)
Payslips with our address on it
Emails where people ask about us etc.
How does this sound? I really do not want to get a RFE so fingers crossed.
One more question. So I send in the I-751 with evidence and a cheque. What about Biometrics? Once I send in everything will USCIS arrange an appointment for me to get this done or do I. Do I then send in all that info to the VSC? I'm a bit confused on that part.
Thanks in advance for any reply's.

Yeah I did it online today. I tried to call but it is Presidents day. I have only moved twice but I have contacted them 3 times. I changed address the first time online, so I have a confirmation no. for that. The second move I just sent in the AR-11 but I didn't keep a copy (silly me) and I still haven't received any confirmation that USCIS has changed my details. But oh well, I am in contact with my last address and it seems that I'm not the only one who has either received no reply from immigration or tried to call only to get know where. What a journey! I wont worry I have done my part, but some official confirmation would be nice. Thank you to everyone for the reply's, good luck to all on their visa journey (pun intended!). smile.gif

hi davidaustralia, how or where you get the confirmation number. i dont know where to get it.

when I did it online a confirmation no. comes up on the screen and gives you an option to print it.

Hello I changed my address while ago with USCIS and I called them to see if it went through and was told that they couldn't tell me which I thought was weird. So I'm filing for removal of conditions in a few months and want to make sure they have the right address. What can I do? I changed my address by sending in the AR-11 from, should I just do it again online? I know I am being overly paranoid but Immigration does that to a person! No mail from USCIS has turned up at my last address though (not that I'm expecting any)Thanks in advance.

My husband and I moved this month as well, so I filed the AR-11 online. I figured it's safer than sending it by mail. A few days later I received a confirmation letter from USCIS by mail at our new address. If it's been longer than a week since you filed, I suggest you call them again and make sure they updated your information in the system.
Good luck with your immigration journey!

when I called them before they said they couldn't tell me, besides I moved over a year ago. I might just resubmit it online.

Removing Conditions on Residency General Discussionchange of address and sponsor paranoia
Hello everyone, I have filed the AR-11 each time we (my wife and I) have moved since coming over here. My sponsor is my father in-law. He has never filled out form I-865 because he hasn't moved however, (and I know I should have asked this before but the usual pre filing of I-751 paranoia is setting in!) should my wife have sent anything in? She isn't a co-sponsor. When I originally filed she had just finished a degree and wasn't working at the time (or the 4 years prior). Am I worrying over nothing?
Thanks guys!!

OK so thank you otto und karen for the info, I had a look through the I-751 instructions and notice that it states that the check/ money order "must be drawn on a bank or other financial institution located in the United States and must be payable in U.S. currency" I know it isn't a bank but is a money order from United States Postal Service (USPS) ok, or must it be a bank?

Hello I had a look myself. But its not what you said, I haven't had all my vaccines yet and need to have some it the states according to the USCIS website "Section 212(g)(2) of the Act authorizes waivers in certain instances. To implement the vaccination requirements and the corresponding waiver provisions" and (cool.gif looks like it means that the doctor who did my vaccines didn't think it was medically appropriate for me to have certain vaccines. that makes sense to me as looking back through my documents my doctor ticked a box which read something along the lines of "blanket waiver" I haven't got a police record and have never committed an act of moral turpitude or anything political.

Russia, Ukraine and BelarusGood luck to May interviewees
Good luck to everyone in their interviews at the Moscow embassy! Vadim had his interview on April 24th. Of course we were very excited and nervous about this final stage in our long process. I was so happy to hear the result. Vadim actually told me he enjoyed practicing English with the interviewer (I had to laugh). Some questions he was asked:

Where is the town located; is it near NYC or close to Canada?
What is the place like where you will live?
Does your fiancee have any pets?
What do her parents think of your impending marriage?
Has she visited you in Moscow?
How does your family feel about your plans?

Vadim also shared pictures of our trips together besides our Moscow visits, and also provided information of his relationship with my son, Ivan. There are probably more questions that were asked, but those are the ones that I can remember right now. The interviewer was a man who was very nice, and as Vadim was confident in our relationship, everything went smoothly. We are incredibly relieved that is behind us now, and wish everyone else the best of luck!
