my fiance arrived in the United States last Tuesday so I decided I would look at the k1 visa flow chart.I noticed it showed that I should get a Social Security card for her as soon as possible but people are telling me that the Social Security Department wont even talk to us until we get a green card. I guess I'm just wondering what the process is now if the flowchart is incorrect.

which people are these?

Going forward - for USCIS stuff (as others have mentioned) - there is no deadline to file the AOS stuff - the only deadline you two had was to get married within 90 days of POE.  That's it.   There's other rules about SSN issuance for a K-1 visa holder, but it smells like you two either have the card or the card is coming.  If your SSA office visit was recent, please go back there and check the status on the application - if all was good then the clerk can give you a printout of the SSN (no, not the card) or you will learn of other problems.  Either way, best to go, nowish.

if you file the I-129F petition Now, in October 2014-ish, I doubt you will have her here on K-1 visa in the USA for a March 2015 wedding.   A K-1 visa holder 'loses status' if they leave the USA before having a green card in hand, and green card issuance can occur 4 to 15 months after filing for the green card.

 

If you marry in Canada in March 2015 and file I-130, chasing a CR-1 visa, expect a wait of about 11 to 15 months before the visa is granted, plus other work inbetween first filing and interview scheduling.  Can leave USA the same day the CR-1 visa is activated at a POE, travel around outside the USA, no worries there - the CR-1 visa gets a stamp at the POE that endorses the VISA to be utilized as a temporary, 1 year duration, I-551 document (a temporary green card).

 

So, with those 'hard calendar spans' you might want to rethink your plans, a bit.  Regardless, Canadien folk are allowed to cross into the border and come to USA, but sometimes get denied (rare, but happens) if the USA CBP folk see any pending petitions or pending visa applications in their system...

My fiancé came here in April using a k1 visa . We got married, he received his work permit but the green card is in process. We didn't go to an interview yet. I want to divorce him and make sure he goes back to his native country. How can I do that? Any advice? I was thinking abt calling immigration to come get him, but he is not illegal

ok - some steps for you - do in this order:

 

1.  prepare a letter formally withdrawing your I-864, affidavit of support. 

2.  get the letter into all of these:

__a.  address on NOA-1, receipt notice.

__b.  lockbox address that you submitted the adjustment paperwork to

__c.  walk-in at an infopass appointment, talking with the shift supervisor, telling said shift supervisor to log it and give you a hand receipt, signed by him/her.

3.  file petition for divorce with county courthouse

 

as to deportation - you have no control over that.  the most you can do, without much extra effort, is to withdraw the I-864, affidavit of support; then he has no basis on which to receive a green card. 

 

If you have documented evidence of marriage fraud and/or visa fraud, that's a different matter - you'd have to get into an infopass appointment, ask for the FDNS officer, then present all evidence to the FDNS officer, along with your written letters of attestation that reference said documented evidence.  If the FDNS officer thinks there are grounds for fraud, he/she will tell you (and that's really all you can rely on, not expect further info).  If the FDNS officer investigates, proves up the fraud, then a note is put into the A-File and electronic record.  IF he is every 'checked' anywhere by law enforcement, they will do an immigration 'hold', waiting for ICE to verify/confirm/deny his legal presence.  IF ICE then wants him, then (and only then) will they come to get him. 

 

You not mention AP, him holding AP - I say do the stuff I've written here, then invite him to a holiday in Saltillo, Mexico.  He'll be stuck at border, trying to get back into the USA, if you have already accomplished the stuff in my list.  It's still on ICE to deport him, but that depends on what that FDNS officer actually put in the A-File. 

 

1 and 2 is mostly instant, gets you off the hook, need to do 3 regardless, but for deportation , actual deportation - it's a long slog and your chance of success on it is minimal. Doable, but minimal.  I not want to give you false hopes about it, either.

first - details are only listed in the postal mail, so make certain your postal mail address not have any forwarding order whilst yer gone.  a hold older is ok, but a forwarding order?  the USCIS postal mail piece will bounce back to them, part of the USPS nix'ing process.

 

second - you will be given a duration of time in which to respond, usually 45 to 67 to 90 days, depending on what it is.  I think you'll be ok to review the postal mail after you arrive back in the USA.

They will require minimally these for the K1 visa processing.

So you have to investigate which name(s) she can get this documents in.

1,2 and 3 not exist at the moment.

 

They exist, only after presenting hukuo book to the office that generates these 3 documents.

My future hubby and I plan on getting married in April of the upcoming year (obviously) and does the expiration for the VISA count from the time issued from the embassy or, from the time he steps foot in the US? Reason I as he is a practicing pharmacist in the UK but is doing a specialty program for Oncology( cancer) and will finish in January but will need to see patients up until April, hence the reason we chose an April date. So, lets say if our process finishes by January, he gets his VISA in hand, will the opportunity to get his SSN expire from the time the embassy issues his VISA (lets say January) or, from the time he sets foot on US soil? The VISA is good for 4 or six months meaning, you have 4-6 months to use after issuance? thanks in advance

K-1 visa usage - has up to 6 months duration in which to enter the USA, one time. once done, K-1 visa invalidated at the POE.  This 6 months validity of duration is usually tied to medical exam date but some IV units have other variances... Will not know anything until he/she can review the visa foil attached inside of the passport, after the visa packet is in his/her hand.

 

Once inside USA, legal presence governed by I-94 document, and usually is 90 day span, POE date forward.

Is best to get SSN soon after POE date, and (if female) apply in passport name.

ya, uscitizens are required to file it.   study irs form f2555 or f2555EZ.  [you are studying the form I-864, not the I-134, for a CR-1 visa application]

 

when filing to USCIS Guangzhou - file ONLY the I-130 set.  I-864 comes in later, for the DS-260/IV application group, for the VISA Application.

 

and yes, assume you need a co-sponser/joint sponser, who will file an additional I-864.

It is simple, K-1 if CSC could be 2-3 months, TSC 5-6 months.,.,.,.,.,then the """stuff""" I mentioned.

 

I-130 can be 12 to 16 months.,.,.some are 9 months.,.,..but this visa is always double or triple the I-130 time!

as to your time out of china - sorta depends - if you were out of china due to vacation, for example, then maybe time out of country not count.    as to your 2.5 years of continuous residency in China, prior - maybe that will be the trick for you ?  

 

note it'll take 3 to 4 months from submittal to interview date.  if sooner, burn some joss.  adjust your actions/calendar appropriately.

another option would be DCF - Direct Consular Filing.

 

Caveats:

1.  must marry

2.  must have 6 months in country prior to filing

3.  most DCF-folk have USA-earned-income problems, needing a co-sponser / joint sponser for the I-864.

 

so if you want her to jump with you on your jump date - suggest you look hard at CR-1 visa, filing I-130 petition via DCF into USCIS office in Beijing or Guangzhou. IMO - it's a better deal for her - as she has instant status in the USA after arrival.  A K-1 visa holder has to do other stuff to secure this status.

why you write like this? no need to fight - OP is the beneficiary, is p|ssed off at the petitioner and will not marry him.  Since the OP is Australian and participates in the VWP, she wants to be certain not to have problems travelling in the future because of this person's inability to withdraw a I-129F petition with USCIS.

I think the Beneficiary can cancel it also.

 

I canceled a K1 last year after NOA2, and when I got a letter back from the Embassy in Manila it was a form letter and it said Visa was withdrawn by Petitioner and or Beneficiary, and they had circled the Petitioner  with a pen.  I was Petitioner

 

For the OP

 

I would send a letter to USCIS, DOS, NVC and US embassy in your country and wait for feedback, it took me about 3 months to get withdrawl letter.

Petitioner only, can cancel the I-129F Petition. 

The VISA application is filed by the Beneficiary, not the petitioner.  The VISA application _IS NOT_ the I-129F petition. ViSA Application, DS-160, once filed, can be cancelled by the Beneficiary.   VISA Application not filed yet, no basis for it (IE - an approved I-129F petition) 

 

If the OP was the petitioner, your advice would be meaningful.  Sorry. 

 

For the OP, somehow the petitioner must cancel the I-129F.  There is a process for that, usually the petitioner sends in a written request to the address listed in I-797 formletter, the receipt letter, asking for withdrawal. Nothing occurs fast after submittal, either, as the request has to catch up with the casefile. 


This is a very interesting information. Most of times I have read on VJ that beneficiaries couldn't cancel the petition and the embassy told the beneficiary to ask the petitioner have cancelled the petition. This is a very first time I read that beneficiary also can cancel it as well.

Is also wrong info.  Sorry.

in the signature block, can write:

this has worked in the past, I assume it still works. 

 

I did this on my wife's G-325A, as well, submitted with an I-130 for IR-1 visa, but I got the advice from reading one of Pushbrk's posts about it from 5 years ago on the I-129F stuff.

2. the shows producers were soliciting here last year.

4. none of the heart-wrenching land-mass separations were discussed on the tv show. 

5. '90 day fiance' as a title is a misnomer, as the person was a fiance prior to filing the I-129F, ages past.  sure, the couple has 90 days in which to get married, but the allusion here (illusion?) is that one has 90 days to decide about actually saying yes to be married.  bollocks. 

and finally.. 

6.  it's a canadien production company - they should have their rights to be on usa soil revoked for creating such a tasteless show.  They have other shows, should be yanked for the same reason.
