K-1 Fiance(e) Visa Process & ProceduresAfter NOA2

Since the visa process varies by country, you should ask Sydney-specific questions in the Australia/NZ forum. Other consulates have a very different procedure.

that is the second best piece of advice you will get    the first best piece of advice you could get would be... if i had said it

*UPDATE*
On Thursday of last week, I received and email from USCIS that they had received the service request (four days after my local office put it in on Monday). That was all, there was nothing else included in the email.

I'm very bummed. It looks like I will be forced down a long road....

there is a good chance you will hear something within the next couple of weeks now... hopefully

Yes, but it is at home and I am at work today. My petition wouldn't pick up the phone when I called my house to speak to it, so I called the attorney for verification.

have you tried connecting your phone to your petition using a "phone to petition adapter cable"???

Not often. NVC is not a "stage" at all. It is a processing hub for the Department of State and it is PART of the consulate stage.

Petitions can also be sent back from the consulate, even after a visa is approved and in one case here the visa was issued and the beneficiary was told to come back and the visa was taken away! There was also a case where a person was tunred away at the point of entry due to erros in the processing of the visa. All of these are rare and nothing to worry about really. You are far more likely to be killed in a car accident driving to the airport

OMG i thought driving to the airport was the easy part... now im worried im gonna die in a car accident :(

K-1 Fiance(e) Visa Process & Proceduresdoes this happen?

The NVC automated phone system doesn't work for K-1. Press 1 for English, then 5 and you will be able to speak to an operator. Have your Receipt number (on your NOA1/2, beginning by WAC or EAC) ready, they will ask name and date of birth of the petitioner/beneficiary, verify your phone number and email address, and then you can ask them if they receive your case. If they did, ask for your case number, and also ask when is it going to be sent to the embassy. :)

you could just fill them out now and then sign and date them just before you send them to the embassy. just make sure they are still the most recent version of the form when it comes time to do it. obviously if anything changes between now and then you will have to redo them

K-1 Fiance(e) Visa Process & ProceduresAm I worrying for nothing?

Hello,

On 1-19-2012 I received email confirmation of receipt, a number for tracking on the USCIS website, and I was told my application was transferred to the CSC.
On 1-23-2012 I received a 'touch' on the website
On 1-24-2012 I received my I-797C NOA with receipt number for tracking

My question is, how do i know the CSC actually received my application? I have had no touches since what I listed above and I worry that it was mailed and not received.

if your case was transferred to CSC on the 1-19-2012 and then it was touched on the 1-23-2012 then it is probably safe to say that the 1-23-2012 was the date CSC received it.

my case was touched two days after my NOA1 and then it wasnt touched again until the day i received my NOA2 which was just over 4 month later.

K-1 Fiance(e) Visa Process & ProceduresK1 Medical Interview and AOS

I think it's going to be easier for us to just start this at her medical interview. It seems like we can just kill two birds with one stone. Plus, I know that the vaccinations are only $25 each. So, it may only be about $100 (I think she only needs 2 or 3 immunizations for immigration purposes).

that is what i did too. i had my medical yesterday and i had 3 vaccinations done at the same time...
MMR, shot 1 of a 2 part series. the nurse told me that the second part can be done when i want but it isnt needed for AOS. the DS-3025 will have a tick in the "not time appropriate box"
TD or TDaP.
Flu.
tell them you had chicken pox and Varicella isnt needed. the DS-3025 will be marked "VH". the rest where marked as "not age appropriate".
it cost me £85 (just over $100) on top of the medical fee but knowing that all i have to do now to satisfy AOS requirements is to provide a copy of my DS-3025 makes it well worth the cost :)

K-1 Fiance(e) Visa Process & ProceduresK1 Medical Interview and AOS

Start then today. Finish them later, whenever. As long as they are started you can file for and get AOS. And you don't need a civil surgeon. Is there something more complicated about this than I understand?

they do not have to be "finished" to get AOS, only started.

  MMR is a perfect example of this... it is a 2 part vaccination but only the first part is needed to be ok for AOS

If you are not referring to the space within the oath but the line that goes clear across the page, that is a dividing line, nothing goes there. Just sign the form where it ask for your signature, your printed name is already at the top of the form.

K-1 Fiance(e) Visa Process & ProceduresWe can't stay in one country!

She is a U.K citizen, if we do not finish this entire process and get her in the United States by the time I get back (highly unlikely, it seems!) Will it impact our petition if she randomly came here on a holiday? As a U.K. citizen, she can come for up to 90 days without a visa.

it isnt normally a problem for a UK citizen to visit the US while an application is being processed but she will need to take proof of ties to the UK with her just in case she gets questioned at the airport. even if she gets denied entry though it shouldnt have any effect on your petition.

if you are in the military then you should look in to getting your case expedited. i dont if it will be possible but it is always worth asking about

K-1 Fiance(e) Visa Process & ProceduresQuestion concerning filing location
it doesnt matter where you live... there is only 1 filing location for the I-129F and it tells you where this is in the instructions. the only difference filing now will make is that you will have to file a change of address when you move to San Francisco. it wont mess things up and you wont have to redo the process

K-1 Fiance(e) Visa Process & Procedureswaiting 3 months after filing I-129

Hello,
I live in the US and my fiance lives in the Philippines. I filed the I-129F form along with the 325G and all requested items about 3 months ago. Soon after filing, I did receive the 797 form, which seemed like basically a receipt. Since then, I have heard nothing. I realize that I am anxious for my girl to get here, but this seems like a long time. Is this normal? Is there some way for me to check on the status?
thanks

it is perfectly normal and you might not hear anything for another 2 month or so yet

K-1 Fiance(e) Visa Process & ProceduresSkype Log - how many is too many?

Are you saying that the petitioner MUST be present at the interview of the beneficiary? I'm not sure if I understood correctly.
I read a few times that they sometimes allow the petitioner to attend the interview - but it is not a requirement. Please elaborate - thanks

certain embassies like Ecuador, yes the petitioner must be present to stand a chance of approval... but there are other embassies that will not let any one else attend the interview... and then there are others like the UK where it really doesnt make a difference.

K-1 Fiance(e) Visa Process & ProceduresSkype Log - how many is too many?

Hello,

So I converted our Skype Log to a document and there are 331 pages from October last month alone.
Do I really need to print all that out and send it with my I-129F?

I must add that I have a lot of photos, proof of two visits, boarding passes, passport stamps, text message bills, and long distance bills.

Thank You for your help :)

you only have to prove that you have met when filing the I-129F but if you insist on sending skype logs then just include a couple of pages showing dates more recent than your visits. i included 1 page from the skype log and 1 screenshot of skype showing a date from the skype log... and i highlighted the matching dates

honestly though... i think even that was too much so concentrate on real proof of having met and forget about skype logs until your interview

2nd MMR shot? At the medical? Even if he's just gone and had a bunch of shots at the NHS? I don't know anything about that. :(

Thanks, I'll do all of that with the letter.

Nich-Nick will correct me here if im wrong but this is the way i understand it... MMR is a 2 shot vaccination and the 2nd shot has to be at least a month after the first. if the time from having the first shot to the medical is over 1 month then he will need that 2nd shot. if it is less than 1 month then he should be fine as it will be marked as "insufficient time interval" on the vaccination form. what shots did he have on the NHS and when??
Dan & JenniMaleEngland2012-02-21 14:10:00
K-1 Fiance(e) Visa Process & ProceduresDo I need to update the embassy on our case status?

Exactly! That's what I was told, but maybe I got it scrambled in my head a bit after and thought that we needed the vaccinations before his medical. In any case, getting your vaccinations at the medical is extortionately expensive as well.

I'm going to send off my notarized letter and hope for the best. I don't really know what information to include though? When I've sent letters of intent with other forms, like the I-129F and my I-134, they were always bundled with other information on our case, making it obvious who we were.

Do I need to include my USCIS receipt number?

i had mine done at the medical and it cost £85 for the 3 i needed but i consider it a small price to pay for peace of mind... plus getting an appointment at my GP is hard work lol. you know he will probably need the 2nd MMR shot right??

i would write a letter of intent just like the one you supplied originally but have it notarized... and then include a cover letter with you fiancés information on it, especially his case number which starts with "LND" and can be found on the letter from the embassy.

K-1 Fiance(e) Visa Process & ProceduresDo I need to update the embassy on our case status?

I made a thread here and someone said he could get his shots through the NHS (which we were under the impression he needed then-- even if you only need it for the AoS, it's probably better we got it done early, right?).

In any case, I sucked it up and spent $16 to call the US Embassy in London and the man told me all I need to do is send a notarized letter to the Immigrant Visa unit to get my case extended. I feel a little better.

yes it is a lot easier and cheaper to get the vaccinations done either on the NHS or at the medical as it saves a visit to a civil surgeon in the US who can charge whatever they want and even make you do a complete medical if they want.

He had 210 pounds with him for the interview, but had to get additional shots and didn't have the additional funds so they turned him away.

he didnt need the additional shots at the medical... he could of waited until he was in the US to have them. so long as he had the money to pay for the medical (£210) then they shouldnt of turned him away.

edit: Grrrr Nich-Nick beat me to it... i need to type faster :)

at my medical they even offered me a letter written by them to give to my GP listing the vaccinations i would require from them..

K-1 Fiance(e) Visa Process & ProceduresDo I need to update the embassy on our case status?

Most UK interviews do not require a new letter of intent from the USC. Your case is the exception because of his delay in moving forward. They will wonder if you had a break up or if one of you got cold feet. Do write a new letter of intent for him to take to the interview.

this is what the letter from the embassy (packet 3) says about this...

"The K1 petition is valid for four months from the date of action (priority date at the bottom of the letter) and must be valid to process your case to conclusion. To revalidate the petition, please request your fiancé(e) to make a notarized statement of intent to marry within ninety days of your arrival in the U.S. and present it on the day of your interview."

ok so what should i do if the space provided like the employers are or some address doesn't fit and can't type it in? what can i do with this, i have the same problem on the i-129f also.

2 choices...

1) any info you cant fit in by typing can be hand written afterwards.

2) write a supplement for each question where you cant fit the answer in the space provided... just make sure you correctly label the question and the supplement to correspond to each other.

i would go with #2 for the employers part but if its just a date or a few letters that you cant fit in then #1 just be fine
