There are many cases of denials or returns everyday, i had one returned in June that expired so we just married and refiled. There have been a few that got the denys overturned but not many each case being different, did you try to get yours stopped?



My Fiancee and were denied our K1 Visa becasue the consulate officer felt that we were already married becasue of our engagment dineer photos. We did show that we were not married with a certified letter from the US goverment ! Also with emails to the goverment office and Contacts of when and who we talked to in these offices. The Consulate officer told my fiancee that it did not matter what we had it was his belief that we were married and today he was denying our case !!!! Can you give us any advice !!! We are looking for rays of hope ! Where do we go from here !!

SO what are you guys doing next? The article said the court of appeals may take years? Why not get married and file an I-130? I know it isn't fare but man I would not wait years and still have a potential denial and have to do the I-130 anyway.

Our Congressman and Senator have filed a review for us as well as our attorney this happened within the last two weeks !!! The denial of Teresa's visa occured at the consulate level. The petition for the visa application was approved.

In Juarez they kept our pictures we sent with the I 129f and the photos we brought they gave back to us !!! We had pictures taken of our engagment party and our consulate officer gave us ####### about he thought they were wedding photos ! We was not standing by a cake or holding up a marriage license ! I was in Jeans and she was in a skirt ! I guess he thought we looked married ! So I would also pick some casual picks of you out on the town ! I dont think you are graded so much as intent to be married as you are being in each other presents !!! By the way you are a good looking couple and you will have no problems !!! Hello all good people !!! Soon I will have to Leave Juarez and we found it to be cheaper to fly from El Paso to Kansas City. Instead of Flying from Ciudad Juarez to kansas City... The difference is about $300 dollars or so !!! So here is my question !!! What is the Best way to get to the El Paso Airport with no car from Juarez !!! Anyone done this before any reconmendations !!! Also I was hoping to find out the distance between the border in Juarez to the El Paso Airport !!! We have about two weeks before we need to do something !!! We are Praying the consulate accepts our appeals and allow us to go together, if that happens we will rent a car and drive together !!! Please Pray for us that, that will happen !!! We still have some good people on our side fighting with us !!! But you know that whoever is faithful with little will given Much !!! I am told you have to sit on the street to wait to get in, and once in there is no food allowed, and you may wait inside almost a entire day. We have three children, one baby ten months old, and a 9 and 13 year old, if my wife needs to feed the baby, will she have to go out side? Will she lose her place in line if she goes outside? Should we even bring our children? We really have no one to watch them we are unsure of what situation we will encounter there with all the kids. My wifes neighbor said they were at your office getting some kind of visa and they were there untill 12 at night how late are you open? Also to pay doctors and visa fees may I use a credit card, as the 900# recommends you carry as little cash as possible.

I hope you can inform me on some of my concerns, hopefully tell me its all false!

You don’t need to be here one week early, if your appointment is on Thursday, you can be here taking the medical exams on Monday or Tuesday. If you take a taxi do not let them take you to any Hotel because they usually scam the people charging a lot for a dirty room, we recommend that you stay in a hotel that belong to a chain, like Holiday Inn, Holiday Inn Express, Lucerna or Fiesta Inn. You also don’t need to be in line at 3:00 or 4:00 in the morning, you should be here at 6:30 a.m.

You are in luck i dont know when you are going to Juarez but if you have to stay in juarez you might want to consider staying at this place it is called Danyels's Apartments !!! They have a Kitchen stove microwave refrigerator there own bathroom and bedroom they are about 45 dollars a night for a weekly rate. they are close to the consulates office the number is 011-52-656-613-6729. If you were to stay in Hoilday Inn or one of the chain hotels you are looking at about 80 to 90 dollars a night !!! With no aminites such as stove refridge or microwave !!! Hi Chuck and Teresa here. If you apply for the tourist visa before the I 129 you could be ok. But there is speculation on filing for a tourist visa after you apply for the 1 129 some times they take it is you are goung to "Marry" if that is the case on your tourist visa. As said before if you have strong family ties you could be ok. However the bottom line is you want reasonable doubt in your favor when you got get your I 129 visa. It is a ball game there and you never know what angle they will use to try to throw you off. Be storng love long and you will be great. I received a PINK slip,. then paid Delbros for visa delivery..

When i got back to the hotel i texted my Chris and he called me,. I cried over the phone and told him about my unpleasant interview experience.. he's very supportive and wished he was here with me...
I hope that the document verification stuffs will be over soon so i could have my visa already before my flight (May 16th)

I am unsure about all of this I am new to this site and this forum ! What are the blue slips and pink slips and green slips for that i have been reading about ! Also I am unsure did they approve you or deny you ! My Fiancee had our K1 visa last week and it was hell we got denied because the CO said by our pictures he believe that we were married. We did get a marriage license but did not use when my fiancee was on a Tourist visa but did not use because we hear that it can be consider fraudlent. So my fiancee returned to her home country and waited for seven months for us to be married on a K1 visa ! Now we are devastated because the officer denyed what we did legal to do ! So we are working with an attorney to help appeal and also we have contacted or congressman ! So do you have any advice for us !!!! Good Morning my name is Chuck and my Fiancee name is Teresa ! We are right now in Ciudad Juarez waiting for an appeal for our K1 Visa ! We had an open appointment and went to that on April 16th. After waiting for about 7 months to get to this point we were denied of our Visa becasue the Consulate officer stated he believe that my fiancee and I were already married ! The consulate officer did invite us back a second time and asked that we provide him proof that we was not married and we did that with a certified letter form our goverments office ! After showing him the certified letter and providing him with emails and contacts of the person we talked to in the goverments office. THe consulate officer then stated the letter was worded wrong and that he was not going to review any other eveidence we had. The consulate officer said it was his job to approve or deny our visa and we were denied becasue he continues to believe we are married despite our evidence ! The consulate officer has no prrof to back up resaon for denial because there is no proof. Do you know how long an appeal can take ? Do you have any suggestions where we can go for help ! Our Attorney has made an appeal for us and we are waitng to hear what the next step is ! So what would you suggest is a good step for us ! What can we lookarward too ! Thanks for the reply let me clearifly a few things that seem to be foggy ! One thing is that we had the original documents Fed Ex to Juarez. The document was issued with the States rasied seal and was Notarized. The Letter stated that on this date a Marriage License was purchased and not used. The Marriage License had numbers on there that matched the Certified letters conformation. This is the document that the Consulate Officer requested and then denied stated that he wanted our state to say that we was not Married. That is why I brought additional copys of the emails and contacts as well as the US Governmet website so they can see that no Marriage has taking place between me and my Fiancee. The reason we brought the Unused Marriage License in the first place was we were under the direction of our attorney to show true intent of wanting to be married and to follow the laws to get married under the right visa ! He stated this is to show the consulate officer to that we were clear and free to be married and that an unused marriage would show that. I am new to this whole process and Now it is turning in to a Living Nightmare and not like a Wedding we had dreamed of !!!! I really do apperciate all the advice and insight it is what is keeping me grounded from going crazy through this whole process. However it continues to be my belief that we did do exactly what the consulate officer asked of us !!! I think denial is what he had in mind and there was no document we used to statisfiy him. I would love to be wrong and so the Journey continues !!! By the way as we believe our file is still in Juraez for review and as of this afternoon our Congressman has recieved a Fax from the Consulate General stating that he is reviewing our case. Also as stated before the Consulate officer did recieve the original certified document signed and notarized stating that we were not married. So we could only hope that this whole process can be over soon ! We welcome anyones thoughts on this together we are strong !

I was hoping that the CO would look online to see that we were not married per the website i provided him. It is a government website. it was just to back up the others papers i printed off for him. I did not want hime to think that what i was providing was fraudulaent.

The CO officer did state that with the Certified Letter/Statement we had sent via Fed Ex that it stated the marriage License was not used. He wanted it to say that we were not Married. He did not like the word "Unused" that is why it was important to review that emails to that office and also see the website we had for him. SO what are your thoughts.

I know that at this point, "could haves" are good for nothing! BUT I have to say this, because it seems your lawyer did not give you the best advice. You guys could have gotten married, even if she was on a tourist visa, if you were at the point where you already had the marriage license and everything ready, you could have gotten married, then your fiance could have gone back to México and filed for K-3. Did your lawyer ever mentioned that possibility?

What did the Certification issued by the County about the unused marriage license said? I believe that it did not exactly stated that the marriage license was not used, the CO must have had a reason for not taking it as valid. Which document did the CO had to look online? It is better to bring all your documents printed, do not expect that they will get online to review the information. Also, in this case I think certified original documents would have been much better than just online copies.

I'm so sorry, I understand your frustration and you have all the right to be upset. However, in all fairness, with all this new information that you wrote, it is my understanding that the CO is not trying to be above the law, unfortunately you gave him enough reasons for him to doubt that your fiance was eligible to get a K-1 when you presented the marriage license, and on the second interview the documents you presented (apparently... because I still do not understand what is it exactly what you submitted or what the documents said) that still, did not prove that you did not get married.

The CO decision may not be fair to you, but unfortunately he had basis to believe that your fiance did marry you in the U.S.

I'm sorry, but the best you can do is consult with a new lawyer, one who is specialized on this type of process and denials. Did the CO sent back your petiton to the U.S. already?

I'm really sorry, that you got into this terrible situation, at this point you really need to contact a good lawyer because you don't want to waste any more time with another mistake.

Thanks for the reply let me clearifly a few things that seem to be foggy ! One thing is that we had the original documents Fed Ex to Juarez. The document was issued with the States rasied seal and was Notarized. The Letter stated that on this date a Marriage License was purchased and not used. The Marriage License had numbers on there that matched the Certified letters conformation. This is the document that the Consulate Officer requested and then denied stated that he wanted our state to say that we was not Married. That is why I brought additional copys of the emails and contacts as well as the US Governmet website so they can see that no Marriage has taking place between me and my Fiancee. The reason we brought the Unused Marriage License in the first place was we were under the direction of our attorney to show true intent of wanting to be married and to follow the laws to get married under the right visa ! He stated this is to show the consulate officer to that we were clear and free to be married and that an unused marriage would show that. I am new to this whole process and Now it is turning in to a Living Nightmare and not like a Wedding we had dreamed of !!!! I really do apperciate all the advice and insight it is what is keeping me grounded from going crazy through this whole process. However it continues to be my belief that we did do exactly what the consulate officer asked of us !!! I think denial is what he had in mind and there was no document we used to statisfiy him. I would love to be wrong and so the Journey continues !!! By the way as we believe our file is still in Juraez for review and as of this afternoon our Congressman has recieved a Fax from the Consulate General stating that he is reviewing our case. Also as stated before the Consulate officer did recieve the original certified document signed and notarized stating that we were not married. So we could only hope that this whole process can be over soon ! We welcome anyones thoughts on this together we are strong !

Yes the BIG mistake was the unused marriage certificate. Too bad you didn't know about this website before your interview and then you could have followed the guidelines here.

We Did Provide a Original Certified letter from the county we got the Marriage license from. It even showed the License was unsed. We got our document from the same office we got the marriage license from it is also public record in our state. We had the document fed ex to Juarez and it took us two days to get it !!!

I Charles Bennett filed for a K1 visa which is the I129F form. I filed for the fiancée visa with the assistance of my attorney Gregory Bryl. We filed this form on October 16, 2007 and on February 28, 2008 this application was approved and followed with open appointment letter for the US consulate in Ciudad Juarez. We attended this appointment on April 16, 2008. We ran into complications there because my fiancé and I was planning to marry in the US. We had went to the court house and got a marriage license on August 19, 2007 and planned to be married. At that time she was on a tourist visa. A friend of ours told us it was illegal to marry on a tourist visa and could be considered as fraud. At that point we hired our attorney and applied for the K1 visa.
My fiancée then returned to Mexico to wait for the K1 visa interview. For our interview we brought a photocopy of that unused marriage license to the visa appointment to show true intent to be married along with photos and emails to show we have been together with in the last two years, to meet the consulates requirements for the Fiancée visa.
On April 16, 2008 when we had our open appointment interview the Consulate Officer told my fiancée that was not good enough evidence and with the marriage license he believed that we were married, even though the license was unused. He sent her back to our hotel and told her to come back the next day so he could review the case. The next day when she returned he sent her away again and told her to get a certified letter from the office we got the license from with to state that the marriage license was not used.
On April 21, 2008 she went back to the consulate with the certified letter as well as some emails from the Jackson County Web Site -Marriage License to show correspondence about the unused marriage license. This was to prove we were not married. The officer then told her that it was his decision to approve or deny any visas and he believed despite the evidence that he still believed we were married. He sent her away without written reason for the denial.
Today April 22, 2008 we tried to appeal this decision at the US consulates office in Ciudad Juarez and they told us to contact our attorney and our congressman to help us. The guy at the window there said that we could talk with the chief officer to see if he can review our case but he was not available. He told us we could come tomorrow and stand in line again with the other 500 people there and maybe he would be available tomorrow but he could not give us an appointment or make us any guarantees to be seen. It is our hope that with the evidence that we are providing you that you can help us appeal this decision.
I am outraged that any U.S. Government office would refuse look up a document that is from another U.S. government web site ! Is this HOMELAND security ? Or are we denying our people the ability to find love regardless of race ,religion or geographic location. My Fiancée and I have been approved this Visa through the NVC and FBI backgrounds checks. Our case number is CDJ2008567315. However the person at the US consulates office in Ciudad Juarez thinks he must be above the law and polices that have put in to place.
My fiancée has had no infractions of the law and has never come to the U.S. illegally. She is free and clear to marry and has never had any children in fact her own parents reside in the U.S.. Now because of one mans opion My fiancée is denied the right to Marry in the US and to see her own Mother and Father. Please help us with this matter as we believe the decision is unfound and unjust. We have contacted our Congressman and our attorney as well as our Sentors !!! This is a complete injustice and should have never happened we got our apporal with the same documents we took to the consulate for our interview. There should have been no surprises reguarding our paper work... If it would have been an issue we should have been denied from the start... We are free and clear to be married and to much time has pasted already that I have been away from my future bride. This is negligent and irresposible on the consulate office.... It out rages that even though we were approved with same documents and went to the interview they made us get another certified document from my state saying we was not married which we had to have Fed Ex to Juarez and wait more days !!! They still denied us even with further proof !!! They refused even after we provoided them websites of there own goverment !!! They made us wait 7, 8 months to tell us it is not their job to look at these sites and our eveidence !!!! It was only their job to approve or deny any visa... They continue to say we are married and we have to file for I 130.... SO now they think we are going to take this lying down but WE ARE NOT !!! By the way I am still breathing !!!! I think they have gotten away with this in the past before and they may think it is even funny or cute for people to have to jump through all these hoops and be away from there loved ones !!! Well not this guy I am going to exhuast my resources and expolit them until they review our documents and see that we are not married and give us a fair reveiw !!! This is devasting to anyone !!!! Thanks for your advice !!! As of now our file is still in Juarez and our attorney has made an appeal for us !!! Who know how long that will take. Also our Congressman Cleaver has written a formal request for review. We Provided our congressman with all our documents and the consulates decision ! They are both full aware of our issue here !!!! I have also contacted my Senators. The thing that bothers me the most is that we had the burden of proof and the documents they asked for !!! But the denied us any way !!! I would think they would have to provide us with eveidence of their decision !!! To me it is like they are saying you are comitting fraud and go away or you will be punished... So we will continue to Wait and PRAY !!!! Also How is that for Homeland Security that US goverment will not look at its own websites before they make a desicion to allow anyone to go or stay in the US. Ok folks time does some strange things on a person mind !!!! So I was thinking since we were denied our K1 visa becasue the consulate offficer thought we were already (WHICH WE ARE NOT) He said for us to file for a I 130. What is that ? Also I was reading about a K3 visa !!!! Can some one help me out with that too !!!! Here is my big of an idea !!! What If we did get married here in Juarez and filed for one of thoes two visa types !!!! Remember I am new to all this and running at this blind. But that is what they say about love sometimes to it is blind so i think we are good !!!! LOL !!!! Does Juarez have DCF filling ??? What time frames would I be looking at then !!! Also if you have read my other posts you will see my postion here !!! Let me bring you to speed here if you havent, Please remember we do have our congressman and our attorney making an appeal for us !!! I have also since the last post contacted our Senator !!!
