IR-1 / CR-1 Spouse Visa Process & ProceduresRCMP Police Clearance

It can be from either the local police station or RCMP detachment as long as it meets the requirements listed. See the link below and scroll down to "Police Records."

Police Records

Thanks! I got nervous for a minute.
Mine states that a "Canada Wide Search of the following information has been processed" then it has my name, DOB, etc.. and that no criminal record was found. It does not use the words Canadian Police Information Centre (CPIC) or the national criminal records repository...but I'm assuming it's good as per the wording listed above.
I also got a vulnerable sector (children, elderly) completed as this check was for employment.

IR-1 / CR-1 Spouse Visa Process & ProceduresRCMP Police Clearance

RCMP police clearances are needed. It needs to be a CPIC check or a search of the national repository (Must have those on the police clearance)

They are good for 1 year after issuance - meaning, that Montreal will only accept it one year after it is issued

Good luck

I asked around the Canada forums and received a response saying that a local police office can do the PCC, and a RCMP check isn't required.
Mine, from my local office, indicates that a Canada wide search has been completed...as well as a search in my current city and my hometown.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan Canadian marry in US before application process?

I know someone who was married before she applied for her visa. It took almost 2 yrs for her process. She was finally able to come to the US at Thanksgiving last year.

I was married 4 months before applying for the Visa. The CR-1 visa is for couple's who are already married, as well as children and other relatives of US citizens.
We wil be married over a year before being able to live together.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan Canadian marry in US before application process?

My husband lives in Windsor and I live in Detroit. We got married in Detroit and then filed our I-130. We could not do a K-1 because he owns a business in Windsor and could not be away for more than a few days.

We had no problems getting a marriage license in the US and he when he crossed the border that day, he just said he was visiting his Fiance, which he was!

He crosses every weekend and some week nights to "visit" me while we are waiting for his interview in Montreal. Whenever he crosses, he brings his NOA2 along with ties to Canada such as bank account statements and paperwork from his job. He never has any problems.

I can't wait until he gets his Green Card and can come home every night!!

Sounds exactly the same as my husband and I, as we live so close to each other.

Your last statement is exactly what we say to each other all the time!

Great response HeatDeath

I would only add that when he visits you, he should bring strong ties to Canada, such as a lease/mortgage, job letter with an expected return date, utility bills, enrollment in school etc, that shows that he MUST return to Canada

Good luck

You should see the envelope I have with these things, I even included copies of our NOA1 and NOA2 after receiving them. I maybe get asked to give these documents every 6 months or if I provide them to a border guard that is giving me a hard time, which rarely happens.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan Canadian marry in US before application process?

Thanks for all the info everyone!

I hate the idea of being apart for even longer (we have been long-distance for almost a year now) .. but it seems like the CR-1 saves some extra steps in the whole process and wouldn't require him to be here without a job for several months while waiting for work authorization if we go the K-1 route?

Because my husband and I live so close (yet it seems so far at times), the CR-1 allows me to keep my job in Canada (self-employed Autism Therapist) and travel back and forth from Buffalo to Niagara everyday. With the K-1, that is not an option.
I have even had border guards ask if I was going to keep my job, so I'm glad I am able to do so with the CR-1.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan Canadian marry in US before application process?

Hi everyone .. I'm new to this site and so happy to have found it! :)

My boyfriend and I are not married yet but are planning to get engaged VERY soon ...

He's from Toronto and I'm a US citizen. Does anyone know if it would it be ok for us to get married while he is in NY visiting .. or will that affect his visa application in a negative way? I think I remember reading something a long time ago about it not being the "real" reason he told border officers he was entering the US for and would be a strike against him?

I'm just trying to figure out if I should go the K-1 or CR-1 route ...

Thanks!

I sent you a very long message about this...we went through very similar questions when deciding what was best.
Good luck! People on this site have been extremely helpful to us...so feel free to ask questions.

IR-1 / CR-1 Spouse Visa Process & ProceduresPersistance Pays

I wasn't really referring to the case number. I understand it is quicker to call than to wait for mail if they have already done the work. I'm really not convinced anybody works any faster if someone calls about work in progress though

I think the OP was specifically referring to the case number. I believe email is the best way to get info about your NVC process after the case number is received. From what I've read, people on VJ aren't really calling NVC to inquire about progress (at least for CR-1ers) of their cases as everything is mainly done online.

My NOA2 was issued on 10/02/2010. It's 10/07/2010 today and I haven't received the hardcopy. Should I be upset at USPS?

I doubt it, since the weekend is a write off (for sending mail) technically its only been 2-3 days...they may have sent it on Monday.

How does anyone know whether making these calls sped up the process or not? Has anyone actually said "If you had not called we would have taken longer"? Maybe it slowed down the process because they have to answer so many phone calls.

According to the NOA2 hard copy, it says to wait 6-8 weeks to receive the case number. This is by far longer than the 13 days I had to wait to get mine by calling them. <_<

Very helpful advice - I am counting down the days when I should check back with the NVC. Already made the first call and got the feedback that they received the case but it was not in their system. Thanks to you I know to wait 14 days and see if I can get the same results that you got. Loving VJ Members!!

We JUST received our case number by calling them...the 13th day from our NOA2. Without the help of all the knowledgeable VJers, we wouldn't have just waited like the NOA2 hard copy said. This site has been more than helpful to us...its really great to talk to people who are going through the same thing, as of course, most of our friends and family has no clue about the stress of this process. IR-1 / CR-1 Spouse Visa Process & ProceduresPersistance Pays

@BrokenFamily - I hear where you are coming from and am not the type of person who wishes to cause any further backlogs in the system.
Regarding your comment "you can check your bank to see if check was cashed to make sure they got paperwork"... we can't send a payment until we are invoiced for it, which hasn't happened yet. So, perhaps you thought we are in a different part of the process than we really are. The reason I was calling the NVC was to find out if they had assigned a case number and then to inform them that we wish to use email. Had I listened to the operator I spoke with yesterday and waited several weeks before calling again, we would have received an invoice via snail mail, which could add weeks to our process. Since we have already been apart for 15 months (due to some circumstances beyond our control that I won't go into right now), any amount of time I can shave off of the process by making a one minute (to the operator) phone call is very much worth "the dime" to us. My advice: This is supposed to be a supportive community. Let's be empathetic and supportive of each other rather than critical/quick to judge and attack, we are all in the same boat!

I agree. If a couple of phone calls speeds up the process but weeks maybe months, then dial away. We live in such a techonoligical world, waiting for snail mail is just silly when the option to email is there.

Thanks Loto, I know the USCIS was particular as to what was allowed/not allowed, so I was just concerned about if NVC was similar...

Our cover letter is similar, but not exactly the same.

Again, does the package have to be stapled all together or are paperclips acceptable?

If you include transcripts, you don't need to include actual copies of tax returns. If you do include the tax return, you have to include all the W2's and 1099INT, 1099DIV, documents if applicable. Keep this in mind.

Noted..thanks :)

We used the I-864EZ and just submitted the previous three years of tax transcripts. Had no issues at all. Good luck!

Good to hear, thanks!

 Same with us! But we submitted a letter from his employer indicating salary and start dates

Good luck

He got that done as well. So just submitting the letter and the 3 years of tax transcripts is good? Just wondering if we should include 6 months of pay stubs and W-2s as well....

My husband (petitioner) meets all the requirements for the I-864EZ (AOS) form. I haven't seen much information on this around VJ. Does anyone have experience with using this form?
Also, for the 2009 tax year my husband filed married jointly (stating that I am a nonresident alien), should we include a copy of my ITIN along with the last 3 years of W-2s/IRS tax transcipts?

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion about NVC stage
You send the originals and a photocopy with the DS-230. You only have to send the pacakge to the National Visa Center in the USA. Once it is approved, the NVC forwards the orignals on to the beneficiary's Consultate. You do not need duplicates, as they are only sent to one place then forwarded on. The form is available at the immigration visa website..

I am also a college student but I have a job and we have a cosponsor just to be on the safe side...the money has to come from the US to show that your fiance is not going to become a pubic charge. The medical and interview processing times vary by country. Some things you would bring to the interview include passport pictures, proof of ongoing relationship, police certificate, birth certificate, I-134 forms (Financal forms), tax transcripts, non-impediment, among other things I know I must be forgeting some things  hope this helps

K-1 Fiance(e) Visa Process & Proceduresk1 expiration date
It depends on the consulate and the reason behind the extention. They have automatic extentions when the consulate does not have an interview date within the 4 months of the NOA2. You should post something in the regional form or email/call the embassy and ask them about it and see what their policy is.

Copy of your passport stamps are solid proof that you were there. Many airlines do not put the year on the boarding pass so they are going to be useless because USCIS is not going to know what year they traveled and they need proof you have met in person in the past two years.

K-1 Fiance(e) Visa Process & ProceduresTax returns?
yep bring them to the interview. Once the petition is at Kingston and they have sent her packet 3 all you need to send back to get an interview date is DS-230 part 1. From what ive seen it takes about a month after they recieve it to the interview. Also make sure you send more than just the current year for taxes. We are going to take from 2007 to present. If you go to the Jamaican portal and look at the reviews, many people were blueslipped and asked to bring more information in regards to their taxes.

K-1 Fiance(e) Visa Process & ProceduresTax returns?
If you are sending the 1040 tax forms you will also need a copy of your W-2. You can always request tax transripts from the IRS and you would not need copies of your W-2. Bank statements and a letter from your employer are also good to have with it. Its better to be safe than sorry.
