You have to put them in a .pdf format. It is the only format NVC accepts.

1. Download the free Adobe
2. Scan your documents as a .pdf, or after they are scanned, turn them into a .pdf file. (If you scan everything at one time it will make them one big .pdf file. If you scan individually, then you have to merge them.)
3. use Foxy ->>Foxy utilities to merge into one document.
4. use PDF escape ->> PDF escape to fill out the forms and put them in the order you want.

Both are foxy and pdf escape are free and will not harm your computer. Make sure your packages are under 8mb or NVC servers will reject them.


you can zip files together. just use your shift key highlight the documents you want to include, right mouse click,send to> compressed zip folder. that should work for you. good luck. I'm not at that stage yet -hopefully a few weeks :)

The intending immigrants income will not count towards the I-864 income requirement unless that income source will continue after the immigration. BUT his assets do count.

It all depends on what state you are in. Some states have the illegal immigration laws that make it impossible to get someone that doesn't have a valid visa on things, some states take the patriot act as the bible.

I live in Tennessee, it was no problem to change the deed of trust to my home to my married name and add him. He was added to the utility bills with a copy of the marriage certificate. I added him to my 401k and life insurance with just a phone call. Geico had no issues putting him on the car insurance policy, they used his Canadian driver's license number (he also raised my premiums because he'd had a wreck in the past five years :angry:) Since none of my cars have liens, I had his name put on the titles with no issues, and we bought a car jointly last summer with both our names.
About the only thing he could not get is a Tennessee driver's license, he has to take his I-94 or green card in to get one.

The joint bank account is problematic. What we ended up doing was opening a joint account in Canada at the Royal Bank. I did have to be there in person and show my passport.

In Alabama a person can not get their foreign spouse on anything until they have the green card in hand.

After he receives a visa, it must be activated with in six months. Then the visa expires. Once he activates the visa and has a green card in hand he can travel back and forth as much as he wants, but the burden of proof lies with him to prove he is indeed a US permanent resident, living in the US. If a CBP officer deems he is spending too much time outside of the US they can, and will, take his green card.

Speaking of the Montreal Consulate, I read on their site that they only allow interpreters if you don't speak English, or a parent if you are under a certain age to accompany the applicant. Are you sure spouses can attend the interviews with their wives/husbands? I want to take my wife and just want to be sure I can. 

yes, Montreal allows the US citizen spouse to accompany them. They don't allow attorneys or interpreters.

If you both attend, they will ask you both questions. When we went to our interview there were lots of people there with out their spouses. 

We were asked a total of five questions: How did you meet? How long have you been together? When and where did you get married? How well does he get along with my children? Are there really 11 Final Fantasy games?

Social Security and VA benefits are tax exempt. If a person has other retirement income other than these two, then they file a US tax return on the amount of the other benefits, only if those benefits exceed $25,000.00 a year (including Social Security and VA)

The answer to your question is:
A) if all your co-sponsor makes is from Social Security Benefits, she does not have to file an IRS tax return and her statement of benefits from the Social Security Administration is enough.
B) I your co-sponsor has another form of income, (retirement savings etc) other than VA benefits, then he/she should have been filing an IRS tax return. Period.
C)if your co-sponsor receives Social Security and VA benefits, they do not have to file with the IRS no matter what the amount is.

Yes, all I put was the Chicago Lock Box address. Everything was fine.

Make sure you write US dept. of Homeland Security. They will not cash it if it says USHS or any other kind of abbreviation.

He has a job. The economy sucks, people are losing their jobs and getting hours cut all over the place. He needs a little help and he's allowed to get said help. He is a tax payer, and paid into the system. The OP has even said he's looking for another job. Ease up a little. Some need to remember the saying "Walk a mile in my shoes"


People seem to be confusing temporary benefits as welfare. Welfare is a totally different ball game all together.

We have substantial savings, but yaaa, no where near that. Maybe if one includes the equity in our house.
FYI, I'm a poor college student living on student loans and grant money, and since yesterday, a part time job at a pharmacy. I have a co-sponsor that makes well above the 125% rule, so it's all good.
As said before, as long as you make above that line for your household size you needn't worry.
Some countries require savings for both petitioner and beneficiary, and have more loops of red tape that have to be jumped through precisely as told.
Canada is not one of those countries.

Canadian immigrants kind of fall under different rules. You can be broke as a joke, no money in the bank, but as long as the sponsor makes over the 125% rule, or have a co-sponsor it isn't an issue.

If you use a co-sponsor then the co-sponsor's household size becomes co-sponsor+ any dependents + the intended immigrant.

For example: mom is the co-sponsor, she files joint taxes with dad. So their household size becomes 3. mom+dad+immigrant=3 guide line is over $23,162.00

1.) put what you have in your savings, if you want to deposit more to make it look better, than by all means go for it. It can help. As long as you make 125% over poverty level, you're in the clear.
2.) This needs a little more clarification. Are you living at home with your parents? Do they claim you on their tax returns? If you file your own returns, do you claim anyone? Do you have children you pay child support for?
I'll attempt to answer this:
A) if you file your own returns and you live with your parents, your household size is 2, you and your SO
B) if you have any children that are paying or receiving child support for your household size would be X number of kids + you + your SO
C) if you claim anyone on your taxes, mother, father, grandparents, cousin, brother, sister, they are included in your household size

I'm a pharmacy tech, in my second year of pharmacy school...

You can not get Tylenol with Codine, or Robaxin from the pharmacy here, with out a prescription. Every state has different laws from their board of pharmacy of what they can stock and give as 'behind the counter'. You can ask a pharmacist at the corner drug store your issue and see if they can give you something.

America is full of the un/under insured. If you do go to a local hospital, many have 'charity care' or offer services at a steep discount for those not insured. You may also check with local churches in your area that have free medical clinics.

Like another poster said, there are lots of small clinics where you see a nurse practitioner and they can prescribe you drugs to help your situation. Keep in mind the majority of these clinics will not prescribe any controlled/scheduled drugs (narcotics, muscle relaxants/anti anxiety) There are some muscle relaxants that are not under control and you MIGHT get a prescription. Otherwise you will probably only a script for a prescription strength NSAID. Also a lot of these clinics do not have the capability to do lab work or take x-rays, and they will probably tell you to go the emergency room anyway.


Doctors in private practice are not required by law to see patients with out insurance. It's their choice. Some do, some don't and some will; if you pay them cash up front.

You may also want to check with a chiropractor or massage therapist.

In the mean time, if you wish to take any over the counter NSAIDs (non-steroidal anti-inflammatory drugs) Aspirin, Ibuprofen, Naproxen PLEASE please, please follow the directions on the packages.

We had kind of the same thing happen. Basically they haven't done anything with your petition except acknowledge it's at the service center.
Once someone opens up the envelope, they will process the check. When they notice it is over the amount you will receive an RFE that your application has been suspended and you need to send the correct filing fee in a certain amount of time, for us it was two weeks. The notice will have a number you can call to pay by credit card over the phone with an agent, or you can mail another check.
After the correct payment is made, they continue processing your petition. You will receive another NOA showing proper payment was received on X/X/X date and the process has continued. This little hiccup can add some additional time to the process.

We did the same thing as you, we had a cashier's check made out to me, drawn off my husband's account in Canada.
We filled out the form, they asked to see the check, asked us what it was for (to buy a new car and to pay my fall tuition) CBP said Ok, and let us go through. It was no big deal. You are doing your visa activation and I'm sure there will be absolutely no issues for you.

Montreal does K visas and CR-1/IR-1 visas (for spouses of US citizens). If people in Vancouver HAD to go to Montreal they were probably getting an IR/CR-1 Visa.

First time poster, so please excuse if this is posted in the wrong forum. The situation is ... well, complicated.

Me:
USC

Her:
A dual citizen of Taiwan and Canada, currently a full time medical student in Australia, in Australia on a student visa (not an Aus PR).

Us:
Engaged.

Goal:
to have her have a GC by March 2013 so that she can start a U.S. medical residency training in 2013 (and not have to be on a restrictive a J-1 or H1B visa)

Plans:
Her hospital rotations in Australia go till July 2012, and she has some US hospital rotations from July tilli Nov 2012. Her med school graduation in Dec 2012.

Dream:
Marriage in July 2012, she does US hospital rotations till Nov 2012 as a student, she returns to Australia Dec 2012 for graduation, and return to US Dec 2012 and starts working (residency) July 2013 as a US PR.

Ideally, she wants to get married in her hometown in Canada. We were thinking of marriage in July 2012, after she finishes her Australian rotations and before she starts her US rotations. However, I'm discovering that once we're married in Canada, she won't be able to enter the US until her IR-1 visa is approved, which takes -- months? a year? This would obviously prevent her from doing her US hospital rotations (which, were she not involved with me, she would come to the US for her hospital rotations on a B-1).

Question: Can we get married in Canada and then can she enter the US as a STUDENT while the IR-1 visa is pending?
Question: If not, could we have a church ceremony in Canada but then have a civil ceremony in the US (she would enter on a K-1, thus)?
Question: If we get married in the US, can she travel back to Australia for final school exams and graduation as a STUDENT while the AOS is still pending (Dec 2012)?
Question: Is there any way we can use her dual citizenship to help our situation?
Question: Does anyone else have any other ideas to help out?

1. Maybe. They do a case by case basis. You would File for CR-1 since you have been married for less than two years. I doubt they would issue a Student Visa while an Immigration Visa is in process.

2. If you have a church wedding or civil ceremony in Canada, you are legally married in Canada, US, anywhere in the world. K-1 is fiance visa, and does not apply.

3. If you get married in the US, yes, she can go back to Australia for her finals and graduation. The CR-1 Visa takes about 9 months, give or take, from beginning to end. She will not do any adjustment of status as a CR-1 applicant.
Once you file the CR-1 she will have to have her interview in Montreal, Canada. If she has to be here by March 2013 for her residency, you guys need to get the ball rolling.

4. Dual Citizenship will not help or hinder your application. The plus side is that she will interview in Canada, instead of Taiwan (cheaper to travel)

5. Get married ASAP,
have her return to Australia to finish her schooling,
File the I-130 for her CR-1 Visa
During the wait she can be finishing up in Australia
Once the CR-1 Visa is issued you have up to a year before she has to move to the US for her permanent residency (green card)
By then everything should be ready for her to do her residency (medical)at a hospital in the US
She can travel to the US as much as she likes while her CR-1 is processing.Canadian Citizens can legally stay in US for six months with out any kind of Visa, but can not legally work, or have the benefits of an LPR. She has to prove she will not STAY PERMANENTLY until she receives her CR-1 visa.

I'm a CR-1, but I'm self employed independent contractor.
I'm using my written contract from the company I am contracted to. I also had the owner of the company write a letter stating, basically the same thing the contract does, that I'm an independent contractor and my pay is purely based per job and I average $x of dollars per month.
Because of this, I did have to line up a co-sponsor because my adjusted gross income on my taxes is below the poverty level rule for the household size. (6 including my husband)

You need the original signed forms. Make copies of them to keep for your records.

Fed-ex is the way to go. It's around $30 to over night paperwork. You really do get it the next day as long as it is sent from Canada before 1:00 pm.

When I sent in our I-130 I mailed it from Calgary, it was during the Canada Post strike over the summer, so I sent it from Staples through Purolator around noon. It got to Chicago the next day at 9:18am.

We used Canada Post to USPS ONE time and that's all it took. We spent $42 to have priority mail. It took it 12 days to arrive in the US.

Thanks sheeshkabelle for your reply . I just landed this jon on February 02 and thought was best to wait for 90 days because the General Consensus in U. S. is 90 day probation period even though this job is always actually probation period since is through a Staffing Agency BUT ...it is more or less permanant as long as this Agency has the contract with Virginia . In your opinion ...do I need to wait for that 90 days to LOOK BETTER for the filing of the K-1 Visa ? Thanks ...Terry


If you're working for a temp agency, even if you don't stay at VDOT you are still employed and the agency will send you somewhere else to work. As long as you have the income, USCIS doesn't care where it comes from. (As long as it's legal!)

You can file now and you'll be off the probation period by the time you hear anything from your application.
