Waivers (I-601 and I-212) and Administrative Processes (221g)illegal entry and fiancee visa?
I have a question... has he ever been caught or been deported? Is there any record of him coming into the USA? If ther is not then you do not need a waiver. You just simply have him leave the country and carry on with the normal process of the Fiance visa.

US Embassy and Consulate DiscussionInterview Evidence
I have a couple of questions. i am putting together the package i need to send to my fiancee so she could have all the supporting documentation for her interview. We have already received our NOA2 and i found out that all the documents got forwarded to Ecuador Consulate, But i have a couple of questions regarding them:

1. I don't know when her interview will be but if i'm guestimating that it would happen within the next 2 months, therefore is it going to be a problem that all my evidence only goes up to the end of February on the dates or do they understand that this takes time collecting and therefore there will be a gap in the dates?

2. I am sending all original documents that were submitted as evidence and new documents to serve as evidence of our ongoing relationship. Should the new orignal documents also be submited to the min the interview or is copy of those documents ok as long as my fiancee has the originals with her?

3. My last question is more of a concern. For new evidence we really don't have any letters or emails to provide as evidence since we speak on the phone every day practically. i do have as evidence a list of my call history with my calling card but that is as far as it goes for evidence other than photos from when she visited me here and when i went over there and our passports and airline tickets. Is this enough evidence?

US Embassy and Consulate DiscussionWhat Is In Packet 3?
Hi All,

i was wondering what forms are the ones that are included in the Packet 3 that my fiancee will received from the Consulate in Guayaquil, Ecuador. I want to go ahead and start practicing filling out whatever form with her so we make sure everything is filled out properly.

Also as for what she needs to collect on her side is her birth certificate, her police record, and a medical exam.... does she need these before she received packet 4?

QUOTE (thegreatgate @ Feb 27 2008, 02:07 PM) <{POST_SNAPBACK}>
That type of annual income with a tax return to back it up is proof enough. I just got my I-134 notarized and the bank teller did not even look at any of the numbers. I could have had 100 million dollars for my annual income and she still would have notarized it!

Well the Notary only serves as a witness that it was actually you the person who signed that form. It's like making a sworn statement but really they don't care anything about the amount of money. Anyways, all i have to show is my income evidence so that is all they are going to get.

US Embassy and Consulate DiscussionI have no Bank Statement For Affidavitt
Hi All,

i have a checking account which serves for me as a revolving account which means i really do not have much of a balance in there most of the time. Because of this i do not want to include any of my bank statements. As far as my income i make close to 46k a year. Will that be enough? I already have my employer letter and my 4 last pay stubs and i have my tax transcripts for the last 4 years.

I also do have a savings account but i only have about 1500 not more than that for now. So will all this be enough? Could someone from Ecuador who has gone through this process write to me please. As well as anyone else! :-)

Hi all again!

I was wonder, does the statement from your employer have to be original or can i copy it?
Yes it is signed and has a company heading.

I'm pretty sure that is has to be an original since they require that it is on a company letter head sheet. As long as it is on an original Company letter head with an original signature you should have no problems with it.

Well the thing that helps me not get so nervous is simply reminding myself that God is for me. Even if there is any thing that might have slipped from me God could still cover. So just remember that... Either way the interview always seems to be subjective so just pray that whoever is the interviewer is a fair and kind person and maybe even just pray for the interviewer that God takes care of them. I hope this helps!

She might need them before K1 is issued...it seems more and more common, especially in Central & South American US Embassies, that they are asking for the vaccinations to be done before the interview (at the examen fisico).

I am having my interview in Costa Rica (I'm Australian but live there) on Friday this week, and had to have my vaccinations FIRST! It is the embassy's right to ask this. At least them you don't need anything at AOS whistling.gif
Also a good idea to do them before she comes to the US anyhow - as it's way cheaper in most other countries for those vaccines!

I had to get only three, even though I wasn't able to supply my vax records from Australia:

Varicella
Hepatitis B
Tetanus

Hope that helps smile.gif

As RicNV posted, Ecaudor does not require vaccinations for the K1 visa but we do want to get them done there since like you said they are way cheaper over there. But i wonder if there is a list of vaccinations needed somewhere. It would make it so much easier. I guess she could just call the doctor and find out.

Unless the U.S. government has a waiver, I do know that "immigration papers" are subject to Customs duties when sent to Ecuador (for example, by DHL). Ecuador is rather strict about their surprisingly long list of dutiable items, which include photographs! Therefore, Customs could be holding or processing packages, and the consulate could experience delays in receiving the packages and is perhaps getting many at once. This is speculation on the basis of known information and educated guessing.

If this is the case it sucks cause i sent about 65 pictures with my file. Anyways i called them up and they now gave me a different story once i told them i had a tracking number. They told me that the consulate also has to review my documents before they send anything out. Of course, i do not believe everything they say cause they have not given me a straight honest answer o far. Either way one thing that the customer rep did tell me was that i could go ahead and download the packet 4 documents and have my fiancee fill them out. As a way also to help speed up the process she could go ahead and collect the police report and have her medical exam done so that there is less of a wait. i hope this helps others.

Thanks

I don't believe it is a need for your manager to include his information. The letterhead sheet should include your company's general information which should be more than enough.

In Ecuador there is no Packet 3 so once you find out from the Consulate website that they have mailed your packet 4 you are able to make the appointment for the interview as long as you have completed all the instructions on Packet 4. Well we downloaded Packet 4 from the website and completed all the instruction but we have our interview on April 21 which is this monday and we still have not received anything in the mail from the consulate. Do we need to actually have the physical copy of the packet 4 with us for the interview or the one from the website ok? blink.gif

I know Mexico has everything you need on the website and that is what we did. We had everything ready before we ever received the packet from the consulate. The only thing you acttually need is the appointment letter. As long as you have all the documents required by the consulate it doesn't matter if you have the actual packet from the consulate.

Where do you get this appointment letter from? We do not have one. What we do have is an email indicating that we could make the appointment without ever having received the Packet 4. What does the appointment letter look like?

Wow.... i'm really sorry to hear that. There really is no guarranteed unfortunately but you have to take the risk in order to love and be loved. But once again i'm really really sorry to hear this. I will pray that God heals your heart cause He is the only one that could do so without leaving scars. Now as regards to informing the USCIS, if you are positive that she used you and only wanted to get his/her visa i would report it because you don't want him/her to do to someone else what he/she did to you. As a matter of fact you could even go further and call the embassy or consulate in the Philippines so they have a record of this also. I pray that you do well and please keep yourself contacted cause with situations like this one the best things to do is just to throw up on people or God regarding what you are going thru. Have a great day!

Honestly, I doubt your place of meeting has anything to do with your situation. The I-129f was adudicated and the ConOff is not suppose to re-adjudicate a petition. There has to have been some lack of evidence proving a bonafide relationship or other circumstance that prompted the ConOff to seek additional validation.

Right, they wouldn't be questioning the evidence of meeting requirement. It would be about the relationship bona fides. Maybe the fact you didn't visit during the process along with skimpy evidence would be the cause. You may never know but you know what to do now.

yes we hope its approved soon smile.gif

I am with you... i hope they keep coming. Although today I called them up and they defintely do not know what they are talking about. They told me that they are not working on anything past July yet and when i proposed that there are October filers already recieving an NOA2 the operator had nothing to say except some yiberish of an explanation of why this could occur. They said it all depended on the petitioners center and what type of background check they need to do and so on.... Apparently all they do is simply go into the same website which we could go into and simple repeat what is in there. What is the reason for this service if they could provide nothing else or at least provide updated information other than information whch has been posted since January 15th of 2008.

But anyways congratulations to those who are receiving their NOA2 and i'll tell you i am please we have VJ cause without it most of us would be clueless and we all would simply be tossed around by people who have less information than us... blush.gif good.gif

K-1 Fiance(e) Visa Process & ProceduresWhich One to Choose... K1 or K3 Visa

Are there risks to her visiting with a petition in process? Certainly. As with any attempt to enter a country... nobody can guarantee that she will be allowed, as that is an individual decision made by a CBP officer at the POE. They simply might assume she has an intent to immigrate and deny her entry or they will allow her to pass.... Nobody can tell you which way it will happen......

Ok maybe i should rephrase my question. Upon submmitting a K1 visa application does her current visitor's visa become null and void or is she allowed to keep it until K1 visa is approved?

If your fiancee has the ability to return to America on the visitor visa, why not use that until the application has been approved. Then return to his/her country, complete the remaining items, attend the embassy interview and return to America with the K-1 visa.

So are you telling me that despite us submitting a request for a K1 visa she could still come here on her current visitor's visa? That would be incredible and it would answer all our needs. She is from Ecuador.

K-1 Fiance(e) Visa Process & ProceduresWhich One to Choose... K1 or K3 Visa
Well, after searching through this site quite a bit i decided to submit my own topic. I am currently new to this site and i came here looking for some help and possibly some answers. I recently got engaged about 3 weeks ago while my current fiancee was visiting me for a 3 week stay. We have been a couple for almost 2 years and we figured it was time to move on to the next step.
My question is which visa we should go on. She currently has a visitor's visa and could come and go as she pleases. If we decide that she comes here with her visa and within two months we get married, is that going to cause us any headaches? and if we go with the fiancee visa is there any chance of the visa getting denied?
We really are not fond of the waiting period we have with the fiancee visa and would prefer to just have her come here on her visitor's visa and just get married within a 2 month period. What do you guys suggest? And what are the risks that we run if we decide to go without the fiancee visa? I really appreciate your help.
