Well, actually, I don't think they will delay a case based on that.
My advice is that you need to keep calling because the status of your case can change suddenly, and that will be a waste of time if you wait too long to call them.
I will tell you this for you to understand my point of view ...

We called on thrusday trying to get our case # they told us we should wait 6-8 weeks to get the case #

...and we call again the next day and we got our case number ... do you know what I mean?

...my husband called to nvc and they said that my case has never been closed,he told/explained to them everything about that email i receive , they said that usem manila is the one needed that docs not NVC because our docs are fully submitted to them.he also said that maybe,they are now reviewing my case right now ....its a big relief ..huh thanks God :) :) :) :) :dance: :dance: :dance: :dance:

so, they have not read your e-mail yet, but yes! they will answer you in 2-3 (8 days the most)

yes, I read something like you are telling me. They said it must be authorized by the County Court. I sent the DS-230 and there was requested the GC, and it would be like this:

CASTILLO DE SMITH, Blanqui. So, it seems no way, I have to wait about two years :S then... thanks again!

If you have already filed the paper work using the "Castillo de" then the GC will have that on it. When you file for ROC in about 2 years change your name then. You can file the I90 and pay the fee to change the name on the GC, but it will still take time and cost I think $485 or so. I would recommend you do the change the next time you have dealing with USCIS which will be for ROC to get the 10 year GC. Just put the name you want on the form and do not forget to list your current name as others used. Once the GC has been changed you can then change the name in the passport or you can change the name in the passport now that you are married. If that is too much of a PITA then wait after naturalization and apply for a US passport with the name like your GC.

I appreciate your time reading my post. My question is a little confuse, so I would like to give you more details.


...I filed out all forms and docs for USCIS /NVC as "Blanqui Castillo de Smith" as shown in my passport.
And I will travel using those names. (airline tickets CASTILLO DE SMITH, Blanqui).

But it has given issues to my husband. Let's say for credit card's forms, (they issue my credit card as BLANQUI SMITH);
insurances forms, etc. Because Americans seems to be confuse
Taking "Castillo" as my middle name.



Now, my question is if I can use at the US only a short way like this:
BLANQUI SMITH
(in my country it would be Blanqui de Smith)

I google my question, looking for some information and someone said that's possible, but must be authorized by the Court .
It seems I need to pay about $400 and present my marriage certificade.

But that was all I found :S so I would like to know what you have done according to your experience.




Everything from USCIS and NVC has been like this:
Last name: CASTILLO DE SMITH (Always both of them, not only one ).

You may know that in Central and South America we use the word "de"
before our husband's last name

1. Americans use only this way:

Blanqui Smith

2.But in our countries it would be:

Blanqui de Smith (short form)

I was married in my country so my name in passport, and all the legal documents have my father´s last name, the the word "de"
and then my husband's last name

So, my long name seems to be very complicated and for some other paperwork we have done, it seems to be confussed at the US

My question: I will travel with my passport (loooong name)... once I get to the US, is there one way to use simple as Blanqui Smith?

Hi there,

They told me the same about the Green Card, however, after 2 weeks, I got it in the mail. Regarding your SSN, if you don't get within 21 days you can go to a Social Security Office and they will start processing it for you. After 1 or 2 days, you can go to the office and they can give you the number while you wait for the card. It takes around 10 days to get it in the mail.
You can work without your Green Card, the stamp that you have in your passport works as a G.C. However, you need to get your SSN before you start working.. Thus, you will probably have your GC by that time..

hi! ... I am already at USA, since last week, when I asked the Immigration Official @ Houston, about the time to get my green card, he said it takes 6 months...
what about the Social Secc card?...how long does it takes?
...and on the other hand I would like to know if while I get the green card, can I work (using my passport only)?
...is the stamp on my passport like a validation that I am here legally to be able to work? or do I need to wait to get my green card?

...you need to wait because your case will be transferred to the NVC
to start the process there...(it takes about 15 days for the NVC receive your case)

then you need to start calling them trying to get your case #

(from the NOA2 to the interview takes about 4-5 months)

By mistake my husband did not filled out one of the items requested on that form. Today, we got a notification (Checklist)
to re-send the AOS form, completed filled out.

My question is: Do we need to send again the attachments? They refferred there only to the form.
Hopefully they have kept the attachments we send along with the AOS the first time.

case number on the subject line
name of petitioner and date of birth
name of beneficiary and date of birth

explain them the situation on the body of the e-mail

and then you can scan that part of the form and send to them

and/or
send them like a continuation sheet
stating it is a correction
including the item #
date and your signature

I did get an e-mail, and i am not in an electronic process... but as "A16!!24A" says, we need to be proactive... I got that e-mail in reply to my inquiry

and I think that's the reason we did not get a letter, because they already notified us.

you should receive an e-mail...saying something like this:
"The NVC completed its processing of XXXX XXXXvisa petition.

The petition is waiting for an appointment to be scheduled at the U.S. Embassy or Consulate in GUATEMALA CITY, GUATEMALA. When an interview appointment is scheduled, the petitioner, principal applicant, designated agent, and attorney of record (if applicable) will be notified.

you should send an email to: NVCInquiry@state.gov (they did replied to my e-mail, that is why I knew it)
or call them ...

if you send an e-mail send case # on the subject line
and on the body of your e-mail
Petitioner's name and date of birth
beneficiary's name and date of birth

You are free to travel anytime after you enter the USA but you must either maintain your permanent resident status in the USA or lose it. There is no finite limit of six months outside the USA or "IN" any other country.

Google "maintaining permanent resident status US" for the details.

Besides the ones already mentioned, I found here on Visa Journey some possible red flags
during interview:



  • · if they think that a marriage is not genuine (and not be in abonafide relationship)
  • · only visited once
  • · hesitant answers during interview
  • · If the foreigner wired money to the US citizen, it will usually damage the case a lot more thanit helps. It makes it look like a business transaction rather than a marriage.
  • · If a visa has beendenied previously to the marriage
  • · No proof of how you stay in touch
  • · red flags in your documents
  • · her/ his immigration records
  • · If that's the case, they would issue a letter that reads:

"TheRefusal Letter reads as follows:

(under section 221 (g) "You will undergo a fraudreview to ensure that your petition is not solely for immigration purposes. Youwill be contacted within 30 to 45 days with the status of your case.''

-------Its not a denial at this point, It seems those cases are submitted to review.------------------

The CO conducting the interview only has power to deny an immigrantvisa based on absolute facts such as a missing document, criminal activity or aproven misrepresentation of fact (lie). The consular officer cannot deny a visaon suspicion. However, suspicion is a viable reason for delay and investigation

The I-134 is used for the K1 fiance visa, not the spousal visa. Your husband will need to fill in the I-864.
