Hi everyone,

Just a quick message to say "good luck" to everyone who are having an interview next week. I too have my K1 scheduled on Thursday in London, and I'm sure that I am not alone to say that I'm pretty nervous about it :wacko:

I have a few more reasons to be than others though, as I have two previous convictions and whilst I am sure they don't constitute CIMT and where more than 10 years ago, the interview could go either way!! which is a very nerve-racking thing to deal with (I have a waiver prepared)

That leads me on nicely to say that I just want to thank everyone on this forum for all the help and advice over the last few months, including pax, nigel, munchkins and Liam. Forums such as these are sooo useful and everyone is so incredibly helpful and considerate, I wouldn't have gotten this far without VJ!!

anyway guys, I'll keep my fingers crossed for all of you (I'm heading down to the capital tomorrow to spend a few nights with friends), please keep your fingers crossed for me too!!! as I really need "lady luck" to be shining on me

surely if you are denied a K1 visa after the interview you have the option to submit a waiver?

and many (if not most, as London has a very good approval rate) are approved...... as long as you submit a good well thought out hardship letter with good evidence.

even if the waivers are denied I have heard of appeals etc., and getting in touch with congressmen in the states.....

I've heard of very few instances that someone was denied and that was the end of things!

It depends what your previous convictions are. I had two previous ones that I didn't declare on a B1/B2 (down to misreading the form), got the tourist visa, but as a previous poster mentioned the K1 is a completely different ball game.

Your police certificate (which you didn't need for the B1) will list everything that happened in the past, and basically if you have more than 1 conviction or if any of them constitute CIMT, you will need a waiver prepared for the K1 (speaking from experience).

I haven't been able to find much information on this topic. I have had a Thai girlfriend for a while now. I haven't applied for a fiance visa yet. She applied for a travel visa and she got approved. She said it is good for 10 years. So she can go back and forth within the 10 years. We are not sure what the maximum stay is each time. She came and visited me for 1 week. This was last month. Now I want her to come back and stay for 6 months. Who determines how long she can stay? From what I read it is the immigration officials at the port of entry? But if she bought a plane ticket that arrives in March and departs 6 months later, will this be a problem? Also, is there any way to get around the time constraints? I know an American citizen that was living in thailand, but he could only stay in the country a certain amount of time, so to get around it, he would fly to Hong Kong every 3 months or whatever it was. I am hoping that she can come and stay for the 6 months, and I will also apply for the Fiance visa while she is here. Does anybody know anything more about this?


I also have a B1/B2 tourist visa. I don't think there would be a problem with booking a flight with a return date close to six months (obviously not over it!), that's what I did. HOWEVER, your girlfriend will have to convinve the POE officer that she has a good reason to stay for six months.

Apparently the DHS USED to stamp you passport for a six month stay..... mandatory (whether you were staying for two weeks or longer), but now if you are only staying for a two week period they will only stamp you for that..... so it is up to your girlfriend to convince them that she wants to stay longer.

I told them that I had a few friends in the states that I wanted to visit and travel around for a while for perhaps 5-6 months, they're normally ok with that type of thing, and then they stamped me for six months (that should work).

Then if you are not killing each other after the six month period! :P then you can start to file for the K1 visa whilst already in the states. This is how we did it, and it helps shorten the time period that you will be away from each other while the visa is being processed.

Just thought I would let you all know that I read that thread yesterday, and was also surprised to hear that you needed the DS 3025 form ( I didn't know about this one either!) for the AOS filing in the USA.

so I phoned the Birmingham Nuffield centre where I had my examination 2 months ago, and the woman was very helpful there and she said that she would send out the form to me in the post.

so if you need the form, ring your centre and they should send it to you!!

Medical for K1 visa = $170

now I find out that the I-485 form AND biometrics are gonna cost $ 250 (or thereabouts)

So it's looking at nearly $1000 so far, that's a heck of a lot of money for the US DHS eh??? Somone's living in the lap of luxury over there! :yes:

There are a few VJers here who are/have adjusted from VWP and from reading their posts, I definately would not consider that they have had a stress free journey as you have implied Paul C. I think they face more worry and concern going into the AOS interview than many of us.

I stressed and worried about our K1 interview, but can honestly say that I am not one bit worried about our AOS. This is not the case with many of our VJers adjusting from the VWP...so give them a break and walk a mile in their shoes.



OK let's get one thing sorted out, like I have already said, I am not sh*tting on anyone that took that chance and adjusted from say VWP OK?!! (in some ways I admire them taking the riskier option)

God read my posts for chr*sts sake, I said that the word HONEST was the wrong word to use.

MY POINT that I was trying to make was that I felt a little frustrated knowing this option was open at this stage of my journey..... and that's all

Aussie Wench I am not condoning it ok, I used the word MIGHT.

I wouldn't assume that a large percentage of those who adjust from other visas were dishonest. I'd like tho think that most of them truly decided to marry after they were already here. In any case, they are faced with much more scrutiny for their adjustment and must convince the adjudicator that they did not enter the U.S. for the purpose of immigrating. I would think that this path for adjustment must be much more stressful as the chances of denial are greater.



OK the word honest was the wrong word to use, and I certainly didn't imply that people that enter the states and then get married on a spur of the moment thing are dis-honest........ :no:

It's just that I think that if more people KNEW about the latter option they would take the risk and then plead that it was just "co-incidental and pure chance" that they got married, than rather sit it out for 6-12 months in their home country......... do you understand what I'm getting at? I just feel hard done by because I was not aware of this option when I fell in love with my fiancee, and maybe if I had I would have pursued it?!

It is allowed to adjust status directly from some non-immigrant visas if the decision to marry and adjust was made AFTER they were already in the U.S.

It is not legal to use a visitor visa for the purpose of coming to get married and adjust status.



Yes I realise it is not legal............ but let's face it lots of people do it!!! That's what I'm getting at!

I don't know about the rest of you guys but doesn't anyone feel a LITTLE pi##ed off that people can go in to the US, marry there and then appply for the AOS, while the rest of us HONEST people have to go through the worry and stress AND seperation from our loved ones (that can take up to a year) that is the K1/K3 visa process????

Jubjub, I would question whether the former situation is MORE stressful than the latter!

Hey guys,

This is just a general question in relation to the whole "applying for a visa to settle in America" issue.

I have applied for a K1 fiance visa, and we are going through the correct and legal channels, with the invaluable help of all the colleagues here on VJ...

however is it just me or are there other people on here that have heard of cases where a person has entered the US on a tourist visa and before the visa expired, they got married in the US. Then I learned thay they were allow to STAY in the USA, and then apply for the whole greencard thing etc... effectively "jumping" the whole stressful process of the K1/K3 visa by going straight to the AOS stage???

Is this correct or am I just getting this all wrong? I have heard of many cases like this!

Don't get me wrong, I am not advocating doing this, as far as I am concerned it's best to stick within the rules when it comes to the US immigration services................

however do people do this?

yeah my hubby said 6-8 months. but when we made an infopass appointment, we asked the USCIS and they said usually it takes 6-8 months because of the work log but usually it will take 2 months at the most.

My husband entered the US on December 4, 2008. We just got his social security card in the mail today December 15, 2008. But we didn't get a welcome letter yet. And my hubby was told at the POE that the green card will take 6-8 months to get here. But I know someone who got their green card in the mail in less than 3 weeks from entry.

I sent the RFE submittal with all the primary and secondary evidence to the wrong friggin' address. :bonk:

I used the same address I used when submitting the K-1 paperwork. Tonight, I looked through the file folder and saw a legal letter envelope with USCIS's RFE address ... a different address. It's on an envelope that no one would use because it couldn't possible fit all the evidence USCIS requested(!). :girlwerewolf2xn:

I have copies of everything and I still have time ... I'm going to re-send the RFE submittal to the correct address. It just doesn't end with this :ranting: petition application. I'm going to be six feet under before this stupid visa is issued !!!! :dead:

re: 2 months 'away' - i work remote anyway, so being 'gone' doesn't affect me at all - I take my work with me, have remote data center in Wuhan for my work, tied into the big data center elsewhere. VOIP phones, blah blah blah- I am reachable anywhere.



Wish i could do that.. I am a network engineer, so everything I do can be done remotely too. But for some odd reason they like to see our pretty faces :hehe: in the office.. I am going to print out the P3 and fill in where I can. Then have the wife fill in with Chinese letters - Hand written with blue ink to show "original" then bring it back and scan it in. I'll leave her a signed copy too. Only think missing now is the AOS Fee Bill and the new GZO number before I can do anything.. Now I wait.... Off to Guangzhou Tommorrow.. Only for a short trip and then I'll be headed back for the interview.. that will be a quick trip.. there for interview only then back home.. The wife said she will fly in herself.. You think she could ask to go to the US Citizen line?

Wish I could stay there for two months... not rich so i have to work... :angry: But what else can a guy do. Still no AOS Fee Bill, Called twice today and asked again. So they know about me and they told me that they requested the AOS Bill to get generated and then emailed to me.. Now I will just get everything ready for the next documents to be sent out. ALL I-864 documents done and ready... DS-230 just needs a signature and so does the Packet 3 Supplement form, which I believe i will send with the DS-230... Correct?

Got the form.. thanks and from my readings, this form will also need to be sent along with the DS-230 AFTER we get the new GZO number. I spoke with the NVC and they said they are processing emails from the first week of april now.. So if that is true then it will be about 10 days before I can start sending in everything else... It's ok Need to have the wife sign the DS-230 Part I. And the Packet 3 Supplement form.

I'll keep posting my experience under this topic,, ok ??

Sorry if my postings are confusing... As I reread it myself I am confuse too. Sorry about that. Yes I found all documents correctly and I am clicking on the links you provided. (thank you) As far as DS-230 goes, I wrote it back wards, Yes She will sign Part I only now.

Also here is an updated list of my events so far:

  • Received our NOA2 email and text message notification one day after the I-130 petition was actually approved at the USCIS
  • 6 Days after the I-130 was approved, the National Visa Center received the case.
  • 7 Days after the I-130 was approved; one day after NVC received case, I called and received our GUZ case number.
  • 2 Days after I-130 was received at the NVC, I received an email. “EPOPT ACL COVER LETTER STD” was the heading of the email along with our new GUZ case number. Email contained information on filling in the attached DS-3032. I printed out this DS-3032, cut out the barcode on the DS-3032 then taped it on to the DS-3032 my wife signed. Scanned it in, saved as a PDF file. Then I email this form to NVCElectronic@state.gov with the OPTIN GUZ{CASE NUMBER} in the subject line. I also included all information as outlined in the Wiki about the OPTIN email.
  • I received an email, automated response from NVCElectronic@state.gov indicating that the NVC has received our email request.
  • 3 Days after the I-130 was received at NVC, I still did not have my Affidavit of Support processing fee. So I called NVC and requested that a AOS Invoice be generated, I was informed that this will be done. Oh, I also asked (again) if the OPTIN email can come from either my wife’s email address or my email address. I was told (again) that it can come from either email address. I honestly hope there are no issues.
  • Now waiting for the AOS Fee Bill, and then for the OPTIN acceptance email so I can send in our I-864 form and all supporting document and all other forms.

I only listed what happened to me hoping it may help someone else. I hope it was ok to do this? I have the list of documents for the DS-230 that she needs, and I have all of those already both in print form. I have copies and she has the originals. I have also scanned and converted all to PDF format ready to go. I hope I have not missed anyting.

Greetings--------- Again;

I will research the wiki more today for the information. But I have also found the website that you gave me. Going to call the NVC today to see if they can send me a Affidavit of Support Processing fee email. Sure would be nice to get that out of the way before I go to see the wife. I am still a bit nervous about the emails I sent yesterday. A lot of information about sending the OPTIN emails from the wife's email address. But yet three people at the NVC say it can be sent from either email address. I will confirm with them once again about this too. Going to organize my thoughts and lists today.. Feel like I am loosing the grasp on reality here all of a sudden. While dealing with USCIS there is nothing but waiting, but then all of sudden things speed up. I'll be sure that the wife signs a few copies of DS-230 for me when I am with her, but only page 2 and not the rest of it.

I followed the template from wiki, exactly with the OPTIN GUZXXXXXXXX case number in the subject line just like it shows to do.. Now time to wait.. then what? I'll get an email saying we have a new case number with GZO now..?? Still no Invoice ID Number.. Just called and forgot that it is three hours later on the east coast so I will need to call tomorrow again.. I hope I did this thing right.. Sure makes you nervous about this entire process....

After reading the DOS website and the WIKI again, I believe I have it right.. All except where the email came from. Three people at the NVC said either or email address. That it was not necessary for the OPTIN email to come from my wife's email address. But everything here says different.. Arguh...... I hope I didn't mess up.. I will call again tomorrow to verify..

OK ... Just got off of the phone with NVC, they told me that the OPTIN can be sent from either my email address or hers.

So, before I send this, out.. I Will be sending the DS-3032 to the NVCElectronic@state.gov email address along with the DS-3032, Correct?

Really wish they would send me this Invoice ID Number. I will call and ask if they will send me the AOS Invoice. The people at NVC seem to me better than that of the USCIS.. Time will tell, and soon time for bed. I get up at 0330 for work everyday.. But one day and a wake up and I'll be heading to Beijing then to Guangzhou. I am flying Hainan Airlines.. Seattle Direct Beijing 9.5 hours later.. I'm there.. then 3 hours to Guangzhou.. Not bad on the price either 740 round trip. I'll get my frequent flyer miles here. Soon, I'll be going back for the wife's interview and then I'll need to buy her tickets.

With all that said, I will call now and see what they said. Also the last guy I spoke with said I can send the OTPIN email from my email address. Why should we send it from hers? Does it really matter?

Yay !!!


Really wish they would send me this Invoice ID Number. I will call and ask if they will send me the AOS Invoice. The people at NVC seem to me better than that of the USCIS.. Time will tell, and soon time for bed. I get up at 0330 for work everyday.. But one day and a wake up and I'll be heading to Beijing then to Guangzhou. I am flying Hainan Airlines.. Seattle Direct Beijing 9.5 hours later.. I'm there.. then 3 hours to Guangzhou.. Not bad on the price either 740 round trip. I'll get my frequent flyer miles here. Soon, I'll be going back for the wife's interview and then I'll need to buy her tickets.

With all that said, I will call now and see what they said. Also the last guy I spoke with said I can send the OTPIN email from my email address. Why should we send it from hers? Does it really matter?

Ya, LingChe's ShortCuts are chock full o info, and it's DENSE. I took a printout of it, and mapped out, on yet another hunk o greenbar paper (with blue crayon) the steps, in a flowchart format. I made 2 sets of the flowchart, one's on the wall, another is in my carry bag. Thank God for GreenBar paper !

I've had a nice refreshing shower, put on some clean clothes, and had an opportunity to think about this, run through the linkages. The reason the DS-3032 file is linked on the wiki page, is that it's ON the state.gov website for NVC Electronic Processing. The link is here - http://travel.state..../visa_4410.html The bit that's missing from that page, is that the DS-3032 HAS TO BE SIGNED by the foreign spouse.

The thing that bothers me, really, about BARCODE for the DS-3032, is that ITS NOT REQUIRED on this form, because the email address is the 'tracker' , along with the GUZ / GZO casefile number. Also, check the expiration date on the barcoded DS-3032 you got. If YOURS is following the pattern, it's LONG EXPIRED, as well.

Hang in there. NVC is open till 00:00 EST, so if you want to call, talk to a brain-dead operator, by all means bug them about the AOS Fee Bill :D


So it is better to use the new one then? I will use the new one then and if there are issues I am sure that they will let me know.. Yes it was expired back in 2006.

I just received an email about the "agent of choice" for the DS-3032. Now, I've read on the forum NOT to use the one that comes with the email But I called and I was told by the man at the NVC that I SHOULD use this one because it has a "bar code" on it. What do you think about this? Use or not to Use? I am thinking to go ahead and use it because he (the man at NVC) told me to. I think I'll call again and ask yet another person to confirm this. At the same time I will as them to send me a AOS Fee Bill.

FORGOT .....I asked about from "who's" email address should the OPTIN and DS-3032 should be sent from, I asked "from my wife's?" he said "it doesn't matter". So really confusing. But I am not going to temp faith at this point and just email the DS-3032 with the Subject line OPTIN GUZXXXXXXXXX from my wife's email address... to NVCElectronic@state.gov. This stuff will drive you nuts.... :wacko:

when you call back to NVC - ask a Human™ if they've sent you an AOS FEE BILL Via email yet, or not.
If they are clueless, ask them to send you an AOS FEE BILL via email.

The IIN will be inside of the AOS FEE BILL.

I am fan of foxit - the dl link is in the wiki page. You should be able to DL the installation set, then email it to her.

You prolly meant she had issues with OPENING the PDF file, not necessarily 'getting' the pdf, right?


You are correct, issues opening the file. My wife is not exactly a computer genius and I do not think a lot of people work with pdf's a lot. Myself I have adobe 9 pro on my Mac and use it daily. But for the wife........ :blush: I'll look for the "foxit" page. Anyway to get NVC to give me the Invoice ID Number over the phone? Sure are tight lipped about it..

She is having problems getting the pdf I sent her... Arugh !!! :blink: She will try again tomorrow, if not It will have to wait until Saturday when i am there... More delays...... Oh,.. she should be able to download adobe reader for Chinese, right ?
