Sympathy is not part of the USCIS job description but your friends here and friends and family elsewhere can be sympathetic. Filing to approval is commonly the most stressful and lonely part of the process.

I miss my wife dearly and my friends here and on this site are helping but it still does not take all the hurting away I am hanging on though because of Susie and the fact we can talk everyday and at least see each other on camara some people cant do that the time drags and I know each day that passes is another day to the visa I hope my time will be short here and I can be reunited with my wife very soon Hang tough sweety there are more friends here to vent and bend their ears

Our lawyer told us 14 months ago that at the interview, the fact of her cancelled visa would be the hot topic. Even after all this time we did NOT know how pivotal this would be even after countless chats with our lawyer. In the end, Dora arrived with a truck load of documentation supporting our marriage, he asked to see nothing.
All he did was pound her for (i came to know 2 hours) as to her original tourist visa application. It appears afterwards that his sole purpose was to ensure that my wife was not
a visa violator from the very instance that she desired to VISIT the USA. The interview was so brutal that at one point the interviewer feared Dora might pass out and she was escorted out for water and candy, then to resume the interview. Now, my fellow members, Dora is college educated and this process almost broke her. Even after he told her she was approved she was not certain as to her fate. SHE WAS BROKEN BY THE INTERVIEW.
The only reason she was approved was that our marriage was VALID. How i mean that is that the consul could NOT find any break in her story as to her intent to visit the USA.
So, for my fellow VJ'ers if your spouse has a prior visa problem, expect a very difficult interview at the least. But if your journey is true, they will never be able to break it. But if you are hiding, they will find it.
So, for those that may be hiding something, don't ever expect a happy ending. But for those that have nothing to hide, stand in the light for darkness can not overshadow it.

I have an email address from the letter I got from the police acknowledging my subject access request - I have emailed them asking for comment on this change.

For now, don't waste your £10 on the "old" method as it appears that the US consulate will no longer accept this kind of report for the purposes of visa applications.

If like me you are part-way through the I-130/visa process this is a bit of a nightmare, and it requires some clarification.

I will post back as I get more info.

Just wanted to share a bit of good news ...the first agency that I have spoken to that has a clue what is going on.

Back when I had not received my I-130 I-797C after a certain amount of time, I wrote to the Omsdmn office in Washington DC and they repsonded back with the form letter that USCIS has xxxx amount of time to respond.

Well just now, some really cool chick called from Washington DC, and said is this so and so, and I said yes and she said this is xxxx from Omsdmn office in Washington D.C. omg i about fainted and said "WAIT IM INNOCENT" - anyways we had a super great chat.

She said that even tho Vermont had not responded to their request, she was following up cause she did not see me in the system for the I-130 and I said correct, and she said further but your I-129f is there - she probably knew that I was eating oatmeal at the same time also.

She was great, she has another database and said I was not in that either and that she was placing a call to VSC to inquire as to what is going on since the person before me that she called had same date of I-797C and was not in. She actually said she would email and call me back as soon as she got an answer and for the researcher in me, I actually believed her.

Step one...... weeeeeeeeeeeeeeeeeeeeeeeeeee


p.s She was so informed and I told her that.....she was my first experience with this process that made me say "OK someone knows what is happening and has the authority to inquire about it.

Thank you all for your support it helped me not to lose faith.
Communication is the key, but sometimes the pain blinds us too much.
We have known each other for 5 years prior to marriage and have been married and apart for 11 months... I don't think wait was the problem, it was more the stress and pressure USCIS added on our relationship and the fact that no matter which door my husband would push, the only answer he would get was " be patient". It made him feel useless in the long run. Like all of us here, that is what USCIS does to us and our genuine marriages.
Only time will tell.

Big thanks to all...something interesting tho and any thoughts on this...

Spoke with lawyer, and she stated that the I129f should be approved within the next two weeks, and if so, she would like to move forward on that application instead of the I130.

I know there is alot of talk about the I129f being binned out of VSC, but she said NOOOOOO! She has been really good about everything and pretty spot on the averages of approvals so far.

Her words to me were, about six months after NOA2 for I130 to finsih - but only 2-3 months to finish for I129F. Told her not crazy about the I129F steps, and that is if it even gets off the ground at USCIS (of course it gets touched next day lol) but she said the I129f's fly thru NVC.

hmmm........


Glad to be out of there tho and I only wish God Speed to the rest of you on this journey and my many heartfelt thanks to VJ for such a great site. I would have been lost without you. And to all the people that I have met - we have and are sharing a common goal, and we are committed to finish it - but such an experience I would never wish on anyone! EVER!!!!! ALL OF YOU ROCK !!!

The reason it is posted this way because if K3 people want to stop the K3 and want to continue with IR1/CR1 if both get to the embassy at the same time.

If you back out of the maze far enough you'll realize we are in an IR-1/CR-1 Immigrant Visa forum as we speak...err..type! Your K-3 non-immigrant visa discussion is located one forum above our current location. smile.gif So by default, any thread that is labeled I-130 (or any thread for that matter) within this forum is assumed to be the immigrant visa or the IR/CR visas and not the K-3 non-immigrant visa forum. There are many forums within VisaJourney as evidenced by the plural usage of the word forumS. This forum that we are currently speaking in is the CR/IR (stand-alone I-130) Immigrant visa forum.


I am quite aware, as you request, of the mulitple forms K-3 filers complete. I almost went that route. But may I ask you to be aware of just what you are clicking on as you make your way to this forum...reading may help! smile.gif And I am not complaining...not yet...I'm just trying to educate to make people a little less confused...as we see has happened with you and susieK. smile.gif

Sky - just keep going mate, as there are alot of us appreciating what you are doing - also with Sunshine and Delicia timelines - it makes us a group of just wanting to contribute - correct me if I am wrong, but that I do not find confusing in the least. Whether we are July August September October November so forth, does not matter, the effort is appreciated. I spent three hours on the phone last night with a VJ who is further down the road and so informed, yet he is dumbfounded by some things that are going on. All we can do is support each other - we all have A COMMON GOAL - and that is having our SO's next to us soon.

WaitingForK3, no one told Sky to stop helping other folks here. This is the confusion I referenced susieK about. I'm glad to see that your comment is based on what she said rather than on anything I ever said. It also backs up my point that susieK (great attitude and all) misunderstood my words and purpose. I never told sky to stop helping other folks.

I'll say it again. I just think that K-3 visa petitioners should discuss their I-129F's in the K-3 forum. That's all I said. But I get a lot of flak for making the statement and then in order to justify words and actions, people start twisting the debate off the original issue. Perfectly done. Now I look like the bad guy who is trying to tell Sky to stop his quite extensive work. But I did no such thing. I can even praise Sky in previous post's and still my misson (to get K-3's in the K-3 forum) goes unnoticed.

Seems like out of all the commentators, Sky was the only one who understood what I was saying. He disagreed...and has the right to do so...but he didn't take the emotional tangent and change subjects...he stuck to the issue. I can't really say the same for the rest of you. smile.gif

Oh well, I had fun trying anyway. And I don't think anyone got too hurt.

Ok this is a 130 yes but if you look the k3 is attached to 130s so k3 is also a issue here as well but as you seem to think in only mono then please open other threads to deal with this issue but as some of us can clearly think outside the main issue then please leave us to openly help each other thank you

There are different forums for different visas. It is not posted that way, as you say, just in case K3's want to change to CR/IR. It's posted that way because they are different immigration paths that, although similar, have distinct differences. Ok stepkids heres the deal,

The applications are not being forwarded to Chicago in our timeframe that I know for sure, well at least my lawyer states that and he had better know since he has strong ties to HS issues.

Second yes there is this backlog, but the 18 month thing hopefully will not happen to us. Lawyer says maybe two to three months behind but if that is a crock then I am off to Washington DC with this #######. I should have just done the fiance Visa thing and not gotten married......he would have been here by now or at least ready to pack a bag.

Why are we on the backburner......oh sod it, no one knows, and for sure of one thing, USCIS does not care. BUT I DO and this item is going to my congressman as it defeats what USCIS preaches to us all, we shall process in order received. Bull ####### might as well take the website down and revamp it with some poker tables since we dont have our mates here, at least we can call their bluff there.
