This is a very heated, controversial topic that often ends up in a locked thread. As others have said a couple with a large age disparity will be scrutinized more than a couple without one... you may believe this is age discrimination but it's reality. With that being said many couples with significant age differences have been successful in getting a visa, so it's absolutely feasible.

K-1s are not eligible for expedite except military personnel about to be deployed to combat areas. It costs a minimum 4 year commitment to the military and service in a combat area, I think combat deployments are running 13 months now, maybe more.

There are Vj members who have received expedites for medical reasons as well as USCIS error.

Doesn't necessarily have to be related to a deployment, but usually is. Also the standard BOG (boots on the ground) is 12 months now. As for the 4 year commitment I don't believe that's relevant... USCIS looks at the merits of the case (they wouldn't even know what the service member's contractual obligation or time in service is).

That option has been there as long as I have been around here (since 2005), it's nothing new. But unless you qualify (and unless you are an ACTIVE duty military person, then you don't), then you can't use the option.

I don't know but I also wasn't aware there that you have to pay a fee for an appeal as well. I know what's done is done but IMO the better course of action would have been to start over with a new petition & ask for an expedite (based on USCIS error/ losing your RFE documents) after the petition is assigned a case number.

You seem a lot calmer about the situation than I would be... petition denied due to USCIS error, resulting in lost money & more importantly lost time. Now your appeal is in limbo as well (adding more lost money & lost time). Perhaps you can make an InfoPass appt & see what's going on? I know from experience calling USCIS will get nowhere, as the customer service reps don't know any more than you do about the status of the appeal.

If the OP sent the RFE documents by certified mail or got some sort of tracking number via the post office that might suffice as proof that USCIS lost the documents & thus the denial is their fault. Were you denied? Or you received an RFE? Was the divorce final BEFORE you filed the petition initially. Also you are very vague in your description. "Last March" when is this? Exactly. March 2009? march 2008? And what does "last September" mean? 2009? 2008? And what does "accomplished all the requirements" mean. It sounds to me like you did NOT accomplish all the requirements. I also do not belive you waited for 5 months to receive the NOA1. Do you mean the NOA2? Was the PETITION denied or was the visa denied? Did you have an interview?

And please state exactly the date the peition was filed and exactly the reason it was denied.


Yes the petition was denied but we were given option. yes the divorce was final before we filed the petition.
We filed the Petition last march 27, 2009. Received RFE last August. Submitted all the requirements first week of sept .
on the third week of september received notice of denial.


OK, I tried to read your timeline and it has not been updated. So you did not receive an NOA1 last August, you received an RFE. You did not satisfactorily respond to the RFE. So you have failed TWICE to submit the divorce decree? I mean you say that he submitted it with the peition, but you got an RFE for it. Maybe they lost it...once. So he responded to the RFE and sent it again. And what? They lost it again?

It would help us, now that we know what is going on, if you could give us the exact wording of the RFE and the exact wording of the denial.

And have you appealed the denial? Appeals can take many many months. If you are at that stage, it will be faster and cheaper to withdraw the petition and start over, OR have your fiancee come to the PIs and marry you, then file for a CR-1

If I were in this situation I would withdraw the petition & start over. When resubmitting I would ask for an expedite based on USCIS error (which is one of the valid choices listed by USCIS). Of course you would need proof that USCIS screwed the pooch by losing the RFE documents (e.g. a tracking receipt from the post office).

The part of the advice given that I would question is submitting the expedite request with the I129F. I successfully expedited our petition based on national interest/ military reasons but was informed that I could not submit an expedite request until we got our case number back from USCIS. Like others have said submit deployment orders (if you have them) with your expedite request and/or a signed letter from the unit commander (on unit letterhead). My expedite was approved in like 3 days & the petition was approved in something like 45 days. Good luck!

Gary is being rather abrasive & somewhat defensive, but his point is valid... if you have a "normal" case you don't need an attorney to file the paperwork & if you hire one you are essentially throwing your money away. If your case is more complicated than average and a subject matter expert is necessary then hire a good attorney.

Keep in mind that you are sending it express to China. When I send things via the USPS to Thailand it goes quickly but when the Thai postal service takes over it might be another 3 weeks. Someone has to translate the English address into Thai so the rural postal person can deliver it. Remember, not every one in Thailand or China speaks/reads English. They also might open it and inspect the documents to see if there is gift tax to be paid. I'm not sure if this is what happened in your case but I can tell you that delays in delivery are probably not the fault of usps. I am NOT a fan of the USPS but I think other countries screw up the delivery times with processing and not the USPS. My wife is here now and in the naturalization process so when we send documents to her family or photos we do the English address to help the folks here and beside it we do the address in Thai. I think it speeds up the process a bit.

You need to fill out form I-134 ensuring that it exceeds 100% poverty line.
Mail it to your fiance in Pakistan. It is the most important doc along with the rest of the documentation that your fiance' must bring at the time of the interview.

I just realized that I made a mistake on the cover letter for I-129F when packet was sent. I put down that I am enclosing Birthday certificate instead of Naturalization certificate (Which I enclosed). Any idea if this will cause any kind of delay? Of course I-129F form was filed out correctly saying that I was naturalized.

Interview should be same or similar for everyone. I heard some good stories and some bad stories. The key is to bring all documents required and more. If you think it may be needed bring them. You can't never be prepared. If you have all documents in order and you shouldn't have anything to worry about.

You can get notarized from many places and not just from the embassy. Depending on what you are trying to get translated and notarized, many law firms in Seoul can do them for you.
If you just want documents translated to English and have it notarized, it will cost you some money. You might want to shop around.
Also try to gather all the documents ready and have all of them translated at the same time so that you don't have to keep going back and forth. If each visit requires notarization it will hit your pocketbook.

I asked my employer for employment and salary information and I received a following information

It contains my job title, and how long I have been working, and current gross salary is USD hourly rate.

However, it does not contain if I am permanent or temporary. I am consider a non exempt, which eligible for overtime pay. Not sure why I am not give a year salary. Is this okay to have hourly rate for salary?
I am a full time employee. Do I need to request another letter from my employer about permanent or temporary ? Thanks. .

My take on this is that. If father wants to be part of child's life and he should be responsible raising the child, then he needs to do the right thing. I am not sure how things are done in other country, but here you list father's name in the birth certificate. It can be very difficult process to go thru get father's name on birth certificate even with DNA test. There may be alot of paper work and court involved.

Does he have to pay child support? something to consider.

Does he wants to bring child with him to USA? if so it might make since to stop and redo the paper work?
Child's mama will let him raise after raising for 4 years? that to me is very highly unlikely.

I wish you the best. I think that this news surprised you in many ways I can think of.

I have some questions regarding needed paper work for K1 interview at Seoul after receiving packet 3(needed paper) and packet 4(Interview schedule)

Packet 3 list all the required documents to be brought for interview.
However, at this forum for k1 guide, it lists documents that I should send to fiancee

I have done all the recommended guidelines

However, in packet3 it does not list that we need copy of i-129F, another original letter affirming desire to marry?
So I know it's safe to have these, but are these must?

Any advice on this topic is appreciate it.

My finacee(now wife) came over from Korea on K1 visa we filed 4/13/2011 and received visa 9/16/2011 with no RFE's
We were married on 10/1. We scheduled the wedding day for 10/1 from beginning, but didn't set firm date until VISA date was received.
I think it's okay to pre plan, but I would advise against setting a hard date and plan around it. Once you get NOA2, you will have better handle on interview date.
Also, we ordered wedding invitation card from Korea, she brought them over from Korea..

Did they just have the cheque and not the envelope? I guess it could be anything, theft or just a machine that ripped it up and so maybe you'll get the rest of the packet returned sometime too.

On the practical side, if you're really worried about getting the police certificate before the medical then I can tell you that the Premium service for the police certificate is very fast, like very very. (Except when the post office is striking lol.)
Also, I read a post recently of someone who'd gone to the medical before receiving their police certificate, and it went fine, just the doctors told them to fax the police certificate in and once they're received that they would forward the medical results to the Embassy. So slight delay there, but nothing monumental.


Thanks for the last part on the being able to fax the certificate. She's ready to cancel the appointment because she doesn't have it. Seems more "Socialist" to me that a clinic requires the police certificate when they're supposed to be contracted and non-government. Hmmmmm? Cheque (check, chek) was fine. Called & found it was just a machine error because the BC got there just fine. So they're holding the app until sends another cheque. Thanks!!!!

To be honest, I doubt that it has arrived at ACRO - I accidentally sent my request with the cheque but forgot to sign the latter and they rang me up around the time they said it would take to process to let me know that the cheque wasn't signed and that they would void it and for me to send another cheque, so I'm sure they would have been in touch with her before now about the application without payment :(
