It will be impossible for him to enter the United States while you are petitioning him for any visa. The only way he would be in the United States is if he was already here, you met him, you decided to get married to each other. But that is not the case for you.


Im a touch confused by the line above "It will be impossible for him to enter the United States while you are petitioning him for any visa."
i was under the impression that theres nothing to stop someone entering under the VWP while there are petitioning for a Visa (admittedly you are not guaranteed entry)but i was still under the impression that there was nothing written to say you cant and many people have ?

We are looking at going the CR-1 route, marrying in the US, i return home to the UK. File papers and go through the process.

Question is, we will be living together in my wife's parents house until i get settled and w can afford our own place, will this be a problem? I read the following on the guides here and was a touch confused if the above was ok?

Note: Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full nameand address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.

Basically its a formality. I am sire before the internet age. And since now this is a Immigrant Visa its the NVC asking who is your agent you, the petitioner , or whoever. Some who are abroad use their parents. In the chance snail mail has to ve sent they have someone to talk to thats all.

You are thinking too mush into this.

No you are still confusing it. Unless a person has a lawyer most everyone has the petitioner residing in US as agent. Just like the whole petitioning of this process is thee USC not the beneficiary. You would want NVC, USCIS , Embassy to contact the citizen. Well the DS-3032 really is a moot point because you both are notified. At this stage you both get email about DS-3032. both get AOS info IV Bill info and interview notification. So it really doesn't matter.


ok, still a touch confused, so are you saying that there's a point in the process where the petitioner is not longer normally sent correspondence and its sent to the beneficiary unless the beneficiary completes the D-3032 ? and that there's a reason to keep the correspondence being sent to the petitioner ?

Thanks for the info, i'm just a touch confused why i would want paperwork sent to someone else instead of myself, or is it that there's less chance of paperwork to get lost? Surely if i choose to get paperwork sent to my wife in the US who will petition for me she has to then mail it on to me ?

Ive read the CR-1 guide on here and there's nothing at all mentioned about the DS-3032 and no example form.

There's a left side, and a right side..

The left side is for Adjustment of status, the right side is for interviewing at a Embassy for a Visa.

Correct but technically not right as they both fall under the "if im in the USA" heading :)

Im the beneficiary, in the UK, It says:

"Complete the information below if your relative is in the United States"
"Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in":
[city] [state]
"It then says, if your relative is not eligible for adjustment of status he or she will apply for a Visa abroad at the American Consular post in":
[city] [country]


If im not in the USA then i presume my wife fills in the city and country i want to apply for my visa at ? ie London, England ?
Only reason im asking is both these sentences are under the:
"Complete the information below if your relative is in the United States"

UK is a perfectly appropriate answer for country when you are from England. England is fine too but UK is more correct. To say you are a "British" citizen is also OK but UK is a perfect answer for country of residence or citizenship.

Heres one ive been pondering about postting on the subject of Abbreviations.

While filling our i-130 in i noticed the United Kingdom doesn't fit in most of the boxes on the form, however it asks for the country on most of the questions and as such the United Kingdom i NOT a country! The actual country i'm from is England. English passports say the United Kingdom on them though, one of the first questions asking what country i am from has the space to put "United Kingdom (UK)" in, after that i was thinking of putting just the UK in all the other boxes. Would this be acceptable ? or should i just put England in all the boxes ?

1. If instead of the father, and her household size isn't too big, yes. Keep in mind that you do not file the I-864 until NVC stage, which is 5+ months after you get petitioned, so there is still time for your wife to find a better paying job too.

2. Not at all. You do need to have the marriage cert though, which, depending on where you get married, can take a couple of weeks to get.

My wife's (US citizen) father will be co sponsoring myself (UK citizen) as she doesn't earn enough to sponsor me on her own t the moment.
For the I-864 form is this classed as two joint sponsors ? or just one (her father)

What does she and her father check out of the following:

1. "I am the petitioner.I filed or am filing for the immigration of my relative"

or

2. "I am the only joint sponsor"

or

3."i am the 1st/ 2nd of two joint sponsors"

Im guessing she checks number 1 on her form and her father number 2 on his form ?

Although it's not a requirement anymore, include a copy of the beneficiary's birth certificate also. Some field offices are sending out RFEs and/or NOIDs for it, so it's a good idea to include it in the packet from the beginning.

Yup timelines correct, if anyone's not noticed we're getting married tomorrow :)
You mean pressing it for picking the certificate up? Its a civil ceremony and we are going over to the courthouse on Monday to get a copy of the marriage certificate, the do copies of the certificate while we wait as we are taking over the signed documents from the civil service. All we have to do is put the certificate in the package and mail it off, everything else is done.

dont forget to write your names and date of birth on the back of the passport photos. if the petitioner is not natural born USC then you need to send in proof of citizenship. did you make copies your international passport showing stamps etc?


Yup, did that on the passport pics, thanks. Also have copy of her US birth certificate.
I didn't copy my passport but i have included 4 pages with over 50 boarding passes from my 20 flights over to the US to see her over the last 2 years plus her 5 flights to see me!

I also bought extra certified copies of our marriage certificate HOWEVER each one has as different number on it. So I sent a photocopy of one, so that the original I present has the same number on it. Not sure what yours looks like but that's my additional two cents.

4. Certified copy of marriage certificate (1 page)
5. An original court cetified copy of the beneficiary?s divorce decree (1 page)
6. Form G-325A (petitioner) (1 page)
7. Passport style photo (petitioner) (1 page)
8. Form G-325A (beneficiary) (1 page)
9. Passport style photo (beneficiary) (1 page)

Evidence of petitioner and beneficiary?s relationship.
1. Letter detailing evolution of relationship (1 page)
2. Photographs of petitioner and beneficiary (7 pages)

Can we order my wife's tax transcripts now from the IRS and also her sisters ?

I know I'm way ahead time wise but I'd rather have them in hand, i wasn't sure if ordering them this far in advance makes any difference ?

Stop confusing yourself. If you are to get through NVC and get case complete you must submit originals or certified copies of originals.
Your police certificate has nothing to do with your medical. I believe London EmbaSsy folk can have medicals done before they get interview letter.
Be sure when you see peoples post and what they are saying you look to the left under their name and see what they are filing for.

Thanks, i think you'll find a police certificate HAS to be taken to the medical in London which happens before the interview and you dont get an interview letter until you've had the medical, i've just been advised that a photocopy is accepted at the medical though, so yes it does have something to do with it.

sorry, those folk in that topic are either K-1 or DCF'd IV. Both of those visa types require a packet 3 and packet 4 to be handled at the Embassy.

I see on the step by step guide it says

"Forms that may be either sent back (or requested to be gathered and kept for the interview) to the NVC or the consulate abroad (depending upon which consulate you are going through) before an interview date with a consulate abroad can be scheduled are as follows:"

Im months away from this so gonna read the link you sent and relax and try take it all in an have another look in a couple of months:)

Thanks, that clarifies things a little, so when i get the request from the NVC for documents, am i correct that they may not ask for BC, MC and PC and just request that these are sent to the London embassy ?

Thank for the info, i have read all the guides and post 1 and 2 in that thread, many, MANY times over. I'm still a little confused about originals or copies to mail in the DS30 package. I was under the impression that the only place i would have to either send or show original BC and Marriage Cert` was at the embassy when i went for the interview, is this not correct ? i have my original birth certificate and if i mail it with the DS230 package does it then get forwarded to the London embassy or do i have to get another original one to take there?
