I'm a May filier...well unless my application is lost on the way to Texas. :) Sent yesterday, should be there by Wednesday.

 

I think May filiers will set new speed records...like the January filiers seem to be doing!

You say you husband but you are filing for a k1 visa for him? U would not file that if he's acutely your husband . and he was not legiley here and was deported 3 years ago? There is probly a ban to when he can come back in .have you checked on that as it can be up too 10 years

 

From what I've read it's a 10 year ban for the deportation and if a crime was committed that led to the deportation then it's a 20 year ban.

 

I'd check with an attorney.

Suggestions along with the other great ones already posted:

1) Establish she is the one you want to marry as in person can be much different then internet love.

2) Bring an extra lap top with you for her. Buying here is cheaper unless she already has one. Get her internet via Globe Tatoo USB or Smartbro etc. Trust me I waited to buy by fiancee one and we spent alot on internet cafes, plus convenience etc.

3) Take many pictures so you can sort later which ones show different dates etc. If you meet other foreigner there and befriend ask them to write a letter stating you and she are a couple etc. Not needed but the more proof the better.

4) Save all your receipts, boarding passes for airlines etc.

5) Take the time to get her Cenemor (certificate to marry she will need), NBI clearance and passport done unless she lives in Cebu or Manila where it is already convenient for her. If she lives elsewhere it will be a nice change of pace for you and she to travel domestic together. Airlines are cheap in the RP as is taking boats.

Like others said. print off the docs you need to her her sign. Letter of Intent of marriage etc and G325 Form.

Then when you get back you will be prepared to send the packet off with just a few additional items. Enjoy the RP. Drink a SML for me :)

I am a US citizen and I'm visiting my fiance' for the first time next month in the Philippines.

My question is what paperwork or tasks should we preform while we are together for the two weeks?

She is getting her passport and all documentation and we are also taking pictures together.

Like everyone I would like to speed up this process as fast as I can. :)

Does anyone have an idea which option below is faster? I would assume most people send their application in the fastest way, but could it be faster sending it in the slower way? Possibly they'd have less applications sent to the PO Box?

Within two years from the date of the filing you must have met in person and have proof to that effect as is detailed in the instructions.

 

If it is filed two years and ONE day after meeting...well then you've missed that window of opportunity.

I listed her names as it was listed on the birth certificate.

 

I also noted on my 129f coversheet that I had a page explaining the name. On that additional page I explained the reasons for the many names for my fiancee and the lack of a traditional middle name.

I've seen "miscommunication" first hand in my own relationship. I don't think it's a scam what she's asking; although it would be illegal as far as the US is concerned.

 

In my opinion this has more to do with emotion, than outright scamming...because it would be one of the worst scams ever attempted and would get her deported in the end. Nobody devises a scam like that.

 

I'd try calmly discussing this entire process with her using someone to interpret the conversation. I get the feeling that she's as scared as you are about now.

That sounds illegal. So you were not in a genuine relationship and the visa was contingent on her working for you?

 

Sounds like indentured servitude which is illegal almost everywhere, especially the US.

 

You could be charged if you've stated facts to the contrary in your K1 application.

It's hard to feel bad when it's obvious that the "within 2 years meeting in person" (not dating, just meeting) requirement was not met. Its a simple rule and a primary rule.

 

Waiting an entire year when you knew you had not met the basic criteria isn't the governments fault, but hey go ahead and blame them; that will not solve your problem.

 

I'd suggest meeting in person, then filing within two years, like the rest of us had to.

I filed in May and we used the old form...this new form looks easier to complete.

 

In my case anywhere I could type N/A or None I did. (Except for Alien Number, so they could add that to the form when it's provided by them)

 

I read that the adjudicators look for empty answers and that's why I added None or N/A to every blank answer.

 

We received our NOA2 in 76 days and had no RFE's. So in my experience it seemed to work.

My fiance though insists on taking his last name for ''sentimental reasons'' ( feel more like a family member etc), so a good solution is to add his last name in mine.

I was having the same thoughts but I guess any other country except the US, is less strict in letting people enter the country.

Plus the fact that you can tell your fiance/fiancee pack light and give them some of your stuff to take back to the US so you won't have to worry much, whether you'll be able to move all the things you want.
That's how I like thinking about it.

So, hello.
My partner and I, had some rough patches the last months and now we're hoping to sort things out.

We are July filers (received NOA1 on July 9th, California Center)and from what I've been watching in the forum, there are a few cases close to our date, that have already been approved. So I am guessing that if everything goes well, we might have NOA2 in the next 2-3 weeks.

In order to figure things out in our relationship we thought it would be appropriate for me to fly there (US) to see him. We are thinking mid December to early January (19-20 days total).

My question is: if all goes well and we get approved sometime soon, wouldn't my interview be sometime around December (aprox. 2 months after approval?)
What if I manage to do the medical on time before the trip but then have them scheduled me for an interview the days that I will be gone?
Can in that case, ask them to transfer my interview?

I know that someone might think: why not wait a little more and have the visa on hand to move there instead of visiting, but first, we need to be together as soons as possible (distance is destroying us) and second, I have a window of six months to enter the country after the Visa, so I will take my time.

Yes, they gave me a hard time at POE, but I didn't lie and they let me in when back then I had much much fewer chances of being admitted.

So I think it's silly to have the laywers telling me now that my chances are only about 40%. Duh... what can you do...

1 to 2 months to receive Packet 2? Didn't expect that!

I've read the sticky post many times and so far, almost everyone's experiences had been pleasant.
So, if we say that I do visit for Christmas, since it's highly unlikely that I'll have a job by then (Greece, you know?), I was thinking about volunteering at the research lab I was when I was in university. This way, I might have my ''boss'' write me a letter saying that I indeed volunteer there and that he is expecting me to be back let's say January 8th or something.
I know it's not a paying job, but wouldn't be at least nice to have a letter from him? Doesn't that show something?
I will be having evidence with me (NOA, my laywers card in case they wanna ask something, blah blah blah), but other than that I do not own/rent a house to show them enough ties.

But honestly now, I'be going there in Christmas which is a hiliday season and only be stayin for about 18 days. What can go so terribly wrong? :/

I just read that they give you instructions about how to do the medical exams, only after you submit the Packet 3.
Is that correct? Does that mean that you can't actually have your medical before they receive all the documents needed?

So, we were informed that our petition has been approved yesterday. We have an attorney so I guess we will have to wait to be told about the next steps.
By the way, we would never hire an attorney if I had found this site earlier, but... :/

I have questions which I don't know how easily can be answered but I would appreciate any insight you guys might have because everyone here is super helpful.

First question: I want to spend Christmas with my fiance. Mid December to early January, more or less.
I am also thinking that if everything goes well, I might already have the visa by the end of December and be able to move there.

BUT, for now, I only want to visit him in Christmas and then come back to my country, prepare the documents, have my interview, say goodbyes and move there for real a couple of months after that.

So the main questions is: Do I get an interview date AFTER I have gathered all the needed documents (that is to say, I call the embassy and inform them and ask for a date), OR they give me a certain date and by that time, I have to have everything prepared?

I am asking because I don't want to risk traveling to the US in Decemeber and have to worry about whether I'll be able to make it on time with documents and interview and because we need to book tickets sometime soon.


If this message sounded kinda mixed up, I apologize. I hope you get what I wanted to say/ask.


PS: I would ask the laywers but you know them, they were always like: '' You only have 40% chances of getting in the US'' and all that, which I deeply don't believe. I trust this site better.

You could at anytime simply ask your fiance to scan a updated copy of both 134s to you. They would lack the wet signatures but still be acceptable.
I see what the embassy told you but if there is any question on interview day you will still have to get the updated info. I hope you realise the experianced members here have tried to advise you based on the total body of experiance gained over a long time period.
There are others that are simply responding out of pure ignorance and child like emotion. They dont even understand the situation let alone provide a helpful method to deal with your original question.

Since the whole filling process was done by attorneys, do you think my fiancé and his dad (as a co-sponsor) will still have these forms? It might be a silly question, but if they don't, they attorneys are going to tell me for another time that they cannot give me their I-134s since it is their clients' private financial information.

PS: I'd ask my fiance right now, but due to time difference, it is still morning there.

UPDATE: I just got a response from the US Embassy in Athens, and after explaining that we had already sent the I-134 with the I-129F petition back in July, I asked if they wanted a more recent and updated I-134.
Their response was: " documents provided with the I-129F are included in the case file. There is no need to provide a new I-134".
