In July we were also advised by the kind and experienced people on VJ that after we had our NVC letter that included our case # then 1) pay our K1 application fee at BPI,  2) wait 24 hours and make Interview appointment which I did by phone since I had a problem with the US Embassy online interview webpages, and 3) go and get the Medical exam at St Lukes.

Also, I had my fiancée get all the additional vaccines she need before going to St Lukes which save her a  lot of time.

 

My fiancée was just approved last Monday, August 13....so now the wait for the Visa....and of course the CFO seminar and interview a Philippine government requirement.

Yes,  I don't think it is a packet per se.   You will receive a 1 page hardcopy letter in the mail from the US Embassy repeating your Case Number.  You will or have received the Interview confirmation by email.   For some reason I received the mailed letter (after 2 weeks) in California and my fiancée received the email confirmation.

Take copes of the Confirmation with you and all the other things they list.

 

All the vaccines you will get at St Lukes is included in the fee you will pay them in Pesos.

I forgot to mention the I-134 which is Evidence of Financial support for your fiancée when in the USA.  That needs to be signed and sent to your fiancée in Canada it cannot be a copy or fax I believe.  Please check instructions on that also.  They Embassy staff will ask for and take your last years IRS Tax forms, W2, and letter of employment. 

Again, I will say this is our experience.  Always use the list from the Embassy and ask them directly for all requirements.

CanadaFollowing up on NOA2, and scheduling interview...

I assume the forms for Canadians is same for Philippines. But be sure to look at the list on the US Embassy website in Vancouver.   You will probably NOT receive a packet, only a hardcopy letter which does not say much more than your NOAA 2 with Case Number.

The forms are probably the same everywhere: I-156, I-156K, and I-157,  Please look at the Embassy website.  You can download those forms from the website or US State Dept website. 

 

If you ever have a question about requirements DO NOT HESITATE TO CONTACT EMBASSY BY PHONE.  They are very helpful.  They will tell you which are the correct documents and how to complete the forms.  There are instructions that can be downloaded also, read those carefully. 

 

I was born in Victoria, BC, Canada, 1953!!!!, became US Citizen age 7.  Now I am waiting for my Filipina fiancée to arrive in California tomorrow night, Monday.  Wow finally together.

As was mentioned by others the I-130 takes a lot longer because once you are in USA you will get your green card in about 1 week.  My ex-wife's I-130 took 14 months total until visa in hand, she was from Colombia so I guess they wanted to be sure her family wasn't part of a drug cartel rofl.gif

 

That marriage did not work out due to her alcoholism that she hid from me and she was also bipolar devil.gif

 

So now I am in K1 process with Filipina who is normal and does not drink good.gif

 

When I filed our I-129F in October 2012 the processing time to NOAA2 was 5 months then in March 2013 I observed on the USCIS processing times were changed to 7 1/2 months.  They have processing time graph you can look at for every type of visa petition and you will observe the number of visa petitions processed each month changes a lot over the course of 1 year.  Sometimes it appears over 1,000 are processed in 1 month and other times a couple hundred.  I am still confused why some couples that applied for their K1 4 months after we applied already had interview and visa in hand and we will have interview in 2 weeks.

PS I am also British citizen as my parents were from Lancaster and were naturalized in USA in 1960 and I was born in Canada on their way to America.

14 months seem very long.  I checked the USCIS processing times and it says the National Average for I-130 is now 13 .5 months!!!!    But Vermont Service Center is 7 months for average processing times.  

One person suggested contacting congressman.  But on their websites the congressman say they cannot help with immigration so I never tried that, but you need to try anything.

Hi Jayann & Jay, 

 

My Filipina fiancée just had her K1 interview yesterday, August 13, and passed and was out of the embassy in 2 hours.  She was asked 3 questions:  1) have you ever been outside Philippines, 2) when is your wedding date, 3) when do you plan to travel to USA.

I could not be with my fiancée either due to cost and my vacation time that I wan to use when she arrives in California.

YESSSS I was very nervous and she was also nervous, that is perfectly normal.  If you feel confident about having all your documents and they are up-to-date and you have all the information the embassy requested then She will not have any problems. 

My fiancée found all the people at the US Embassy very nice and smiling and helpful. 

Your fiancée will do great and yes you will both feel nervous.  But when she calls you to say she passed and will get her visa you will feel GREAT!!!

My fiancée in Zamboanga City, Mindanao had the following experience:

 

USEM Interview Tuesday, August 13: 7:30 am.  Finished interview at 9:40 am and they told her she passed and to go home and wait for Visa to arrive

CEAC showed "ISSUED" on Wednesday, August 14 end of the day

Fiancee received text message on Saturday morning about 9am, August 17 saying her Passport and Visa documents at 2GO in Zamboanga City.   She picked up the Passport and Visa 2 hours later

 

Now we are worried about the CFO seminar and interview to get sticker to allow her to leave the country.  Lately many Filipinas not getting approved there even after having US Visa in hand

I agree with the other responses.  We even received an RFE on the I-129f but I still did not send WU or bank transfer statements.  Showing the strength of the relationship such as being together in person and having evidence of that is most important.

For the Embassy interview take everything you have.  Like the others said, our WUs and records of emails etc were never requested.  They did want and keep  my letter from my company stating I had a job. 

We were also Approved after my fiancée in Embassy for 2 hours and Visa Released the next day.

Also, I had my fiancée go to a private doctor for some vaccines and then also the local Medical center which are less money.  but it is City Health Office that gives the health certificates listing all the vaccines and medical history. At least for Zamboanga City that is how it worked for us.

the health certificate is the official medical document listing all your vaccines that you already had say as a child or recently.  City Health in your area should give you that.  You need an official certificate showing what vaccines you have had not just a written list.  I highly recommend getting all the vaccines before you go to St Lukes you have enough time before your appointment.

Do not forget the Health Certificate with previous vaccinations.  Philippine City Health is a good place to get updated certificate that is accepted by ST Lukes.  Also, try to get all the vaccines before you go to St Lukes to really save time and not have to return to St Lukes since they will only give a few vaccines at one time.  Look at the US Embassy site for the Long list of vaccinations, Ouch.

Hi all,  Just for clarification from those that have gone through this and just were posting here.  My fiancée just passed her Interview yesterday, but the CFO website says she needs here visa so they can put in a stamp directly into the visa which is required before leaving the airport.  Second point, I wanted to buy my fiancée a plane ticket on Philippine airlines but they required her Visa number in order to purchase the ticket. 

From what I just read in some of your posts you went to CFO seminar without Visa and passport and you also bought plane tickets.

Can you please confirm that.

Congratulations and as the other replies said this is your APPROVAL for the Petition of K1 Visa.  As they said, you should receive a 1 page letter stating it is forwarded to the National Visa Center (NVC) to determine which consulate will process your visa application.   It is in NVC for just a couple weeks then you get a letter saying "shortly the information with be sent to the appropriate embassy" and it will indicate "MANILA" in the letter.  But then you will have a CASE NUMBER and you can have your fiancé(e) go online and pay the visa application fee at the bank, go to the St Lukes for 2 days of medical exams.  You can even go online or call the embassy to set up your interview date about 24 hours after you pay the fee at the bank.  I am sue you know this from reading other posts. 

I do recommend fiancé(e) getting the vaccines that they do not have at the local PhilHealth and get the updated certificate there to save a lot of time at St Lukes. 

My fiancée has her Interview next week August 13.  We are really excited now as it will only be a few weeks until she comes to California.

This may be related to IMBRA limits on K1 applications.  Apparently under IMBRA which regulates US Immigration of people using marriage brokers including dating websites there is a limit of K1 applications an individual can have in a certain time period.  When I applied for my current K1, USCIS informed me about this because they assumed my prior marriage to a Colombian woman was a K1 and through a dating site when, in fact, it was an I-130 spouse and met through mutual acquaintance.

However, the USCIS indicated it is possible to get a waiver for this.  See the US State Department link below.  May be someone that has gone through this will see your post and provide more details.

Best of luck.  I know the waiting for everyone is the Big trial we face to be with our love one.  But after the Interview it all goes pretty fast.  August 13 my fiancée had her interview in Manila, took 2 hours, then a Philippine government seminar and interview after waiting 4 days for passport with visa.   Tomorrow, Monday in USA she will arrive at night in California.  So 13 days after the interview she will be here!

 

I think late night TV must have been developed for those of us just waiting.

Congratulations!!!  My fiancée is flying to Los Angeles, California from Manila on Monday, August 26.   She was fortunate with her visa,  Interview August 13, she received it August 17 in Zamboanga City no less. 

I put her on a Philippines Airline direct flight so she doesn't have to change planes, sorry she cannot fly with you but I cannot wait any longer for us to be together.

I think you will like Arizona.  I lived in Tucson, Arizona for 2 years.  It is hot in summer, but not hot and humid like Philippines.

Congratulations....very soon you will be together.  As you may have seen on my other post my fiancée arrived from Manila at Los Angeles, California airport last night, August 25.  WOW finally and now we are so happy.

She was fortunate to get her Visa 4 days after interview even though she lived in Zamboanga City, Mindanao.  She received a text from 2Go saying the Visa was at the office for pickup.  She was in line at CFO for seminar during the storms and the people standing in line in the rain starting at 1am in the morning.

Yes the key difference is what is called a Civil Marriage in USA and there is an equivalent in many other countries and then the "traditional" or say a religious marriage.  the civil marriage is the one that is registered with the government.  I was married (I-130 14 months process time) in Catholic wedding in Colombia, South America, but that was also registered as a civil marriage and it was the civil marriage that was recognized by the USA Immigration. 

Now, after a divorce and annulment long story hehehe), I am in process for an I-129F fiancée visa.  Our intent is to have my Filipina fiancée come to California and we will have  civil marriage here in USA, then return to Philippines for a formal Church Catholic wedding for her family to see.  It takes care of all the requirements Immigration and family/cultural.

Hi and welcome to the forum.  A god question.  I can only provide some input on the free to marry issue.  I was previously married to a Catholic Colombian woman.  At least in my case our Catholic marriage there and also in Philippines and probably other countries there are two parts: 1) the civil or government recognized marriage and 2) the religious ie Catholic marriage.  My ex and I had a Catholic church marriage which was then registered with the government as the civil part.  Follow a very brief marriage I then asked for  a divorce.  I did not even ask my ex I just got a lawyer and processed it, a fast process in Colombia.  However, I was still married in the eyes of the Catholic church.  So now I am getting an annulment which while be completed in a total of 8-9 months.  The point is I am free to marry NOW because I have divorce papers.  BUT I cannot have a Catholic marriage until I have the annulment. 

I do intend to have another Catholic marriage with my Catholic fiancée in the Philippines and she, her family, and the local legal vicar are aware I am in the process of getting the annulment but this is not preventing us from getting the K1 Fiancee visa before the annulment.  We will, in fact, have a civil marriage in California in October 2013, then after the annulment and fiancée has her green card we will return to Philippines for our Catholic church marriage.  I should point out the circumstances of my request were very compelling to the church for the annulment due to things associated with my ex prior to marriage and which I was unaware at the time.

The issue of letter is not so much parental consent as it is support which is evidence of a relationship.  Also, what DRafael is referring to is in Philippines and other Asian and some Latin countries there is a High Risk for super young brides 16-18 years old. with fiancés 60-80 years old, seriously.   In Canada, Europe and USA this is not considered an issue.  The letter of parental support would need to be shown at the Interview stage not in the K1 application I 1-29f.

I do not think any of those require notarizations but do not hesitate to contact the USCIS California Service Center to get the official information.  I believe what you mean is letter of Intent for K1 visa.  This is a letter with original signature for both you  and separate letter from your fiancée stating you Intend to marry within 90 days of her arrival in  USA. 

My fiancée is 21 years old and though not required, I had her parents each prepare letters which were then translated into English and submitted along with the I -129f petition.  So if your fiancée is young then I would recommend the letters just to cover all the bases. 

My fiancée just passed her US Embassy Interview yesterday and she will be here in California, just up the road from you in Suisun City in early September and we are very happy.

But for Evidence of Financial Support when your fiancée arrives in USA the Instructions for the I-134 give a list of those documents.

I sent my fiancée the following for her interview which she passed last Monday at the US Embassy in Manila, Philippines:

 

Taxes for 2012, 2011, 2010.  The embassy kept 2012

W2 forms associated with 2012 taxes as evidence of income

Scanned copies of my 2013 pay receipts for January through July

Original and signed letter from the Vice President of my company stating I am current employee and how long I have been with the company and what my job is, this is an original with signature and needs to be mailed and not sent as a  copy

I-134 and original Signed document with all boxes filled in.  In Philippines we were informed if there is no information needed or does not apply fill in "None", but check with US Embassy in China for that specifically

I also supplied information on a house I part own with my sister which further shows financial evidence.

Be sure your Birth certificate information is all correct on the I-134 forms. 

I also sent 6 months of my bank statements showing current available cash in my bank accounts.

 

Again, look at the Instructions on I - 134 for other types of evidence.

I recommend he send you an original with signature and with the colored official stamps etc.  I had to get my registered copy from Colombia South America and it was on Legal size paper 8 1/2 x 14 inches so not easy to scan and copy.

Always be Honest and complete with your answers on all documents.  I agree with your view that you include time as a student and also identify when not employed.  Always include everything and be consistent with all your documents.  If they see differences in the documents they will ask you and cause delays or even deny. 

I am sure you are doing it all correctly.  Evidence of a relationship is what they really want of course.

Some years ago when I was already applying for a K3 for my Colombian wife we tried to apply for a Tourist Visa but it was denied, but again this was after we had applied for K3.  Now the Embassy and USCIS will say that the two visas are "independent."  However, the K3 shows intent to emigrate to the USA, so the Tourist visa "appears" to them as an attempt to take a short cut which is not permitted no matter how much you state they will return and continue with the K3 process even if you have work, family including children in their home country.  Also, by-the-way, if they believe you have obtained a Tourist Visa and then you apply for K1 or other visa leading to immigration, they could potentially see that as a fraudulent action and one or both of you could be given a very hard time including a fine or prison sentence and of course no chance in the future for the K1, so please be very careful about this.  Talk with a lawyer maybe. I asked a lawyer about our case and they told me the Tourist Visa would be denied and he was right.

I received an RFE for additional evidence specifically regarding my last visit to spend time with my fiancée. 

The materials I sent originally included:

1) Photos of together including our engagement party (no date stamps on photos)

2) Letters of intent to marry within 90 days

3) Listing of our schedule of meeting and my 2 visits to be with fiancée

4) all the required documents and check.

 

They wanted and I gave them the following:

1) Photos with date stamps - I only had 1 of these

2) Airline e-tickets of local flights which had both our names as well as my e-ticket RT USA/Philippines and boarding passes.

3) hotel and resort receipts, and restaurants

4) Letter signed and translated from her father

5) We had a letter from Catholic priest supporting our fiancee visa application and stating we met with him in her city

 

That all seemed to be sufficient and they processed the approval 5 days after receipt.

I have also notice this as a trend, but from what I have read most of the denial seem to come from Delhi, and I have read that the consulate actually wants USC at the interview. All you can do is just make sure  you have plenty of evidence, address all the red flags, and pray!!!! Which is pretty much what we are doing and we have lots of red flags cray5ol.gif  Wish you luck!!!!

 

Mel&Lal, if you don't mind my asking, how are you preparing to address the red flags? I am assuming your red flags are maybe similar to mine (age/religious/cultural differences).

Hello, not sure if this thread is still alive, we are just starting the K-1 process as a mixed-race couple with a bunch of so-called red flags. Just wanted to put myself out there in case anyone else is going through a similar process.

 

Visa type: K-1
Consulate: New Delhi
Gender of beneficiary: Male
Religious difference? Yes
Religious background of beneficiary: Muslim
Age Difference? significant difference (I am 8 years older than him)




Race/Class/Education Difference: I am a white PhD student, he is a taxi driver with no college education (this doesn't bother me obviously); he spoke only a little english when we met but his english has greatly improved over the course of our relationship

Method of meeting (online, in person, etc): We met in person while I was doing research in India. He was my driver for 2.5 months.
Engagement Ceremony? None
Has beneficiary ever been to the US? No
Does beneficiary have relatives in the US? No
Family approval? Yes from his side, no from mine right now (but I will likely win their approval somehow)
Co-Sponsor required? I am not sure
How much time has petitioner spent with beneficiary in person? 1) 2.5 months first visit in Fall 2012, 2) 7 day visit in March 2013, upcoming 18-day visit in Sept 2013





Has the beneficiary or petitioner ever been married: No

Did the petitioner attend the interview: I plan to attend

 

I expect that the interviewer will be skeptical of our age, religious, and educational differences. I also expect that him being Muslim will result in increased scrutiny. Any advice would be appreciated!

Thanks for your concern, although I think there are a lot of pressing problems in the world more deserving of your attention than my unlikely love story, haha.

 

I do realize that there will likely be major incompatibility issues between my fiance and I, on many levels, which may or may not be reconcilable. However, despite being "ill-advised", our relationship is genuine. Qasim and I love each other. I am not being duped. Since that is exactly what a duped person would say, I know I can't convince you. But I think that your certainty about two people of whom you know very little is more absurd than my relationship choices :)

I think this may illustrate our contrasting cultural perspectives--why in your view I have fallen into a trap, whereas in mine I am pursuing happiness. I must attend my fiance's interview at the New Delhi Consulate (or risk likely denial due to red flags).

 

However, my teaching schedule will only allow me to travel to India after mid-March. Unfortunately, the I-797 form has a validity period ending March 5.

 

I've read that extending the validity period is no problem for K1 visas. But I just wanted to double-check...

 

My current plan is to wait to submit DS160 until late February (based on anecdotal reports that interviews are typically scheduled about a month after the DS160 is submitted). Then, hopefully, the interview will be scheduled at a time when I can attend it.

 

Any insights/advice would be appreciated!

Hello,

 

Most of the 'older women' that have posted here are >10 years older than their significant others. I am curious to know how big a red flag is an 8-year age difference? My fiance is a 21 year old Muslim Indian, I am 29. We'll be going through the New Delhi consulate. I know that these things are determined on a case-by-case basis-- I'm just looking to gauge the risk of denial at the interview stage.

 

Other factors that might be of interest: I am Christian; his parents have officially accepted me (my parents have not yet); I am a PhD student whereas he has no higher education; I have been told we "look like a handsome couple"; we will have spent >4 months together over the course of three visits by the interview date; I plan to attend the interview.

 

Any thoughts/bits of advice would be appreciated.

Anybody know how long the oath ceremony at USCIS office in Sacramento takes? I have my ceremony tomorrow (yay!!), and was curious.

Also, does anybody know whether my girlfriend can bring in a camera to capture this special moment on film?

First of all congrats!
It takes about 3 to 4 hours depending on how many people will be taking oath. First you get in line just to get in, then there is a few presentations/program, and finally the oath ceremony. After this, you get in line again to pick up your naturalization certificate. Once that is completed you have the option to get in another line to register for an updated social security card. You can bring camera in but best if you have zoom on it because people taking oath get seated on ground level and friends/family get seated in upper levels. Also good idea to both bring phone so you can find each other as there will be many people. It was this way about a year ago for me, dont know if anything has changed since then.

You mean the USCIS lets cameras in? Or are you referring to the federal courts where the oath ceremony used to happen? Every time I have gone to that USCIS building, for other reasons, they told me that I had to leave my Samsung outside because it had a camera.

That's why I asked...
