Hello All,

I just got my passport picture for the G-325A and the top right corner has some of the screen in the image.

Here's an example of how the image looks.

The image from the bottom of the black screen to the bottom of the image is exactly 2 inches. Should I 1)cut the image to size, 2)just include the uncut image or 3)go get the photo taken again?

they wont mind a millimeter or two missing (coz the actual size used is really smaller than 2x2") so if i were you i'd cut that black part =) just so they wont have a reason to send you back to the photo shop

NO because K1 requires that YOU TWO HAVE MET IN PERSON in the last 2 years. K1 is assumed to be based on a genuine relationship which, although possible to develop through chats, they require a personal meeting of you the petitioner and her the beneficiary ( which you should be able to prove through evidence not only when she applies for the visa but when you apply to petition her)=)

Okay, so i am kind of unique in that I am a web developer and can do my job anywhere in the world as long as I have a steady connection to the internet. Even sometimes when it is spotty, i can do work locally on my laptop then upload it into the server online. So, the question is if it is better to stay in the states during my fiancees visa request, or if it would be okay to stay in her country during the process(Philippines). The other question is how long can I stay there legally with out a visa from her country.

Another slightly off topic question is, does anyone know a good place to get cheap tickets to the philippines. I did my first trip through travelocity, but think there probably is better places out there. Also, anyone that has come across this. How do you go about getting tickets for her return to the US. If i get a round trip ticket, then later when i get there purchase here round trip, how can I make sure that we are on the same flights/ seated together. Anyone who has experience with this please let me know as it is confusing me.

Maybe over thinking it a bit. Also when we get married, can we get refunded for the return ticket that we wont need? we have been in a relationship for 2 years so there is not a thought that things will not work out right.



it depends on a lot of things. for instnace, if you're confident that your fiancee can go through it w/out your help/moral support by being there, then you dont really need to be there. other factors are time and money if you have issues here.

as for visa, you can go visit her for 21 days w/out it\

as for her tickets, people here on vj will tell you it's always best to awit til she has her us visa on hand, just in case things happen and she doesn't get it on the date you plan on flying together. it will be a matter of timing/luck difficukt to book her on the same flight as you if you book your return way ahead depending on whether you book off/on season also prices of tickets, as dec. nears, prices increase, but are cheap during the rain months.

and you only need a one-way ticket if she gets her visa. good luck and god bles =)

if you think you presented enough evidence of a genuine relationship, the denial must have been caused by how exactly the interview went, what specific questions were asked and what his exact answers were. ask him about this.

in any case, you can still appeal/reapply w/out having to pay again...check out the same webpage. good luck =)

the sooner the better and also better if your account has been active for a long time and not only recently.

if you already have an interview date and one week is all you have to make the money appear, then that's fine, just have a good answer ready in case this is brought up during the interview.

if you don't have an official date set yet, transfer the money already, interview dates can take from weeks to months to get anyway.

i'm can only guess that you want to come on a tourist visa. you didn't indicate this on your profile

I am an american citizen, and have been living most of my life outside the U.S.A., including now. As i have to relocate back to the u.s.a. for job reasons we are applying for the k-1 visa. I was reading about the primary evidence proving our relationship and wanted to ask what kind of evidence should i submit in a situation in which me and my fiancée are living together and have not traveled any where outside of our foreign country (which means we do not have boarding passes, airline tickets or any other of these evidence. of course we do have evidence for our shared home. if any one has any tips on what is the best thing to show we would appreciate any info.

the primary requirement of the k1 petition is that you have met/seen each other personally w/in the last 2 yrs prior to application, so pictures are the main thing, and then as you said evidence of your shared home. maybe different forms of communication you two used (ex. birthday cards, texts) have these printed out. =)

I followed the K-1 process list and printed out the Letter of Intent and signed one and had him sign one...now I am thinking we were supposed to HAND write them?!? I'm four months into the K1 process. I just did my change of address online. It said it can take 45 days. This will put me over the 5 month mark. Will this cause my application to get delayed or cause anything negative at all? I won't be at my old address in two weeks from now.

there's always a possibility that communication from the uscis will be sent to your old address so you can do several things to avoid any problems. call the uscis hotline and inform them of your AR-11 to make sure it appears on your record. then keep track of your case by signing up for the online status update on the uscis website so that if they say they sent you something and you don't receive it at your new address, you can check it at your old one (will you save you time worrying if something was sent to it at a certain day)

Hi all,

Does anyone have any experience with being told they need a visa waiver? My fiance was denied entry a few weeks before we applied for the K1 and they accused him of lying to the border officer. The officer said that he may no longer use the visa waiver program, but he is still eligible to apply for a K1 visa. However, I heard there is a possibility that at the interview they will tell him he needs some kind of a waiver. Does anyone know how this works? Does it take a long time to apply for? Or is there just some sort of a fee you pay?

as far as i know, the vwp allows certain persons to enter the US w/out a visa. but if your fiance was told he can't use this anymore, chances are it's in his record too. so it's unlikely he will be told he needs it on the interview (it will be contradictory) and might even bring up the issue of his "lying" if he asks for it :)

Hi all, I am really new to this. I have a fiancee in the Philippines and we are doing the visa process on our own with no attorney (so far). Just received NOA2 on November 23, pretty excited!!! Now we are waiting for notification from Manila. I am wondering about what is required at this point such as paperwork needing to be gathered. Anyone have any experience in this and what things are important to keep in mind. Would like to get a conversation started in this, perhaps also help others in the same boat.



congratulations on you NOA2. there are several things from your end as well as from her end that you need to prepare. from you it's mostly proof of your income to go w/the affidavit of support which you will need to send to her for her interview. you need to read all the specific docs under "guides", it's all there, as well as what your fiancee needs to get, while waiting for the letter from the NVC/USEM. :)

the guide also tells you how to assemble your application, the fees needed etc

Hi guys. I just want to share the relief that we finally got our NOA2. :thumbs: It has been a long wait. So I am asking for any good advise and friendly suggestion as to what to do next after NOA2? Are there things that I can do to prepare earlier so that the rest of the process will be smoothn and quicker?

congratulations on the approval!
next thing to do is start preparing the docs that your fiancee will need to received from your end and your fiancee should do the same for the docs she will need to apply for her K1 visa . check out the "what to send" part here http://www.visajourney.com/content/k1guide

check out the NVC.gov website as well if for updates on forms/fees etc

in the meantime, your papers will be sent to the USEM in manila (about 2wks) after which they will send your fiancee a letter saying that she can already apply for a visa which will require doing two things, setting up an interview appt and having a medical done.

for the interview, she'll be paying fees and filling out forms (under "forms" on the homepage) and to go with the forms are required documents which she should also prepare now (i.e. NBI, police clearance, passport cenomar, etc)

if you think you'll have all th requirements ready at a certain date/time frame, you can call the USEM hotline and get a schedule for an interview. whatever date you get, your fiance should then go for her medical (there's also a guide here for that) at least two weeks before the interview so that the results can be forwarded to the embassy and evaluated during her actual interview.

I am trying to make sure I understand the K1 and AOS process and would appreciate anyone knowledgeable to validate my assumptions below:

1) We have filed the K1 and are hoping that she would get her VISA 6-9 moths later … (i know there are no guarantees)
2) In the mean time, I am planning to go back to China to work (she is also living in China) while we are in the K1 process
3) Assuming she gets the VISA, she has 6 months to use it - i.e. come to live in the USA
4) After getting to the US, we have 90 days to get married or she must leave
5) After getting married, it will take at least 4 months to get the AOS (during which time she cannot leave the USA)
6) Once she has the AOS, she can freely travel back to China for up to 6 months at a time with no issues (i know there are longer options as well)
7) While I am in China, I would still maintain a home in the USA

So assuming I have that correct,

A) At what times would I *have* to be in the USA other than to get married?

B) What is the likelihood of being denied during the AOS process (assume neither of us have any strange or unusual backgrounds ;-)

C) If I am living in China and the USA and traveling back and forth, will that jeopardize the process?

A) besides getting married, you as the USC don't really have any problems going back and forth except if your K1 application has issues and you'd have to go back to fix it (e.g. to get addtl docs)

b)the AOS is essentialy applying (adjusting) to LPR status (although conditional) since the two of you already mert the req of marriage so approval, assuming again that you have no issues, is a sure thing. it's just a matter of how long it would take to get approved depending on the no. of applications in your batch, among other things.

c)that reason alone, no (assuming you pay your taxes here still, hehe)

your date (dec 13) is fine but if you want to change it, change it after you have set the date for the interview w/USEM :)

How should write this name on the form?
1st name: Maria Theresa
Middle name: Dabandan (mother's maiden last name)
Last name: Vega (father's last name)

Should I drop my mom's maiden last name for the sake of filling up I-129f and put in Theresa as the middle name? Today, I argued with my fiance about this, because I want to be consistent based on my official records. Again, thanks for the advice.




write your name this way:

first name: Maria
second name: Theresa
last name: Vega
other names: Dabandan

because here in the US, their middle name is the second name given you (if you have one, which in your case you do). if you had only maria as your name then here in the US it would just be maria (first) no middlename dabandan (last). and then when you get married, your name will be maria (first) theresa (second) your husband's name (last)

Im preparing my I-129F. In regards to the photos that need to be sent with the petition. I have approximately 35 photos 4 to a page that I arranged that way in Adobe Acrobat. I have the following questions:

1. Can I group them 4 to a page?

2. Do I have to have a description for each photo or is a general time frame ok for the entire page of photos that it applies to?

3. How exact to times have to be for the photos?

Some of these go back 6+ years thats why Im asking.

Any help would be appreciated, any other tips for the photos would also greatly help.

My fiance and I met on the internet and yada yada... filed the K1 in April 2010, approved for the interview in Juarez June 2010... quick!

Background:

Here is the issue, she has a 7 year-old daughter, she wasn't married with the man, and he has never been in the daughters life but his name is on the birth certificate. She tried to find him to sign a "permission letter" to no avail. She has since started a custody case to have full custody of her daughter. The first lawyer she worked with basically strung her along for about 6 months ultimately ripping her off. She got another, but it is public aid, while it is free and it will happen eventually it is slow.. realllly slow. June 2011 her interview "expired" or so they said it would. I called Juarez and they said it is still open and valid and it will be for an undetermined amount of time unles I close it (I am not going to).

Here is my question:

Her public aid lawyer says she can get a permission letter from a judge to get a passport for her daughter and travel abroad, and that it only takes a month and $500 to get. We called Juarez and they said "well... you should have full custody or a permission letter from the father, but maybe the letter from the judge will work, just come in and find out, it is up to the interviewer".

Jeez... Juarez is like 1500 miles from her house and with her daughter and all it is really expensive. She asked a few lawyers in Mexico and they all say it will work no problem... but I don't think they know what they are talking about... maybe it will, I don't know.

Please help if you can, the public aid lawyer said her case is going to take 9 more months and it has been a long time already... bububub.

wherever you go, most of the time, a parent will be required to present proof of full custody of a child, or a death certificate of the missing parent, before they can bring the child out the country.

so if some people say things can be worked out somehow, believe them only if they can guarantee it =)

otherwise, the case has to take it's slow course unfortunately but at least it's gonna be legal =)

So, I talked to USCIS regarding a change of my fiance's address on the I-129F, and they told me to send a letter stating the reason for the change and the new address to the VSC. I sent it, certified mail, and it's been received. However, how can I get some type of confirmation that the address was updated successfully? Should I/Can I call the VSC?


that's exactly what you can do. if the address showing on your file is the new one, it means the change/update was successful =)

since you already have your case no. no need to wait for a packet 3...click on the documents you need to gather/get for the interview/cfo/medical and schedule for the interview with the embassy hotline already =)

i was reading this and thought you might need a reminder: make sure you/your fiancee does not submit/ bring any photos of(or even mention) that "ceremony" to the interview. many couples have had the difficulty to explain that no marriage occured during those ceremony-looking photos. and not to scare you, but some were denied because of one seemingly harmless photo. i just want you to be careful =)

At that time I did not know that I will be able to start school in January because usually the program starts in fall which is in late August so I plan to go back and wait for K1 VISA and come back as a fiance and then I will start school in fall. Due to the complicated process of applying to medical school, plan changed. I can't miss school and I did not plan to change status at all. we were thinking to get married because people say that I can't get F1 VISA while I have K1 pending.

When I entered as a tourist, I was asked what is the purpose of entering and I replied that I will be visiting school which is true and now I am accepted into school and will be study in winter 2012 that's why it's a little bit complicated because I will have to apply F1 VISA to study while I have K1 pending?

Then we think about getting married soon so that I don't have to go back and forth because traveling is expensive plus school schedule will be structured and I won't be able to leave school when it's time for K1 interview.

If I adjust status, will I have to file I130 which is spouse VISA? or I485 which is the adjustment of status?



when you were asked at POE, did you also say i will enrol and study? if you did then you're probably lucky. but think about it, you yourself know you're a tourist with a K1 pending and not only are you going to study but get married as well...honestly, do you think you are gonna be approved and all? I'd say better to be safe and and read travel.gov and uscis.gov to see the correct answers :)

I have a question about my VISA.

here is my situation

- My fiance filed K1 VISA for me in July 2011 and we are still waiting.
- I came in the US in August with B2 VISA.
- I am starting school in next winter (January 2012)

My question is if I get married during my stay of B2 VISA, can I change status to spouse VISA, this way I don't have to go back and apply for student VISA and don't have to go back for the interview for K1 VISA in my home country?

If I cannot change status then I have to go back soon to apply student VISA and then in a few months I will have to go back again to interview K1 VISA and I am afraid that time may be overlap with school exam and test.

I would appreciate all your suggestions.

this is as far as i remember (better check with the visa website to confirm info):

if you're on a B2 visa, you can't study (for credits), if you do and it's found out, that would jeopardize your K1 application. if you marry while waiting for your K1, that's not allowed either, and you'd have to withdraw your K1 and apply for a spouse visa.

in anycase, you're supposed to be in your country (or wherever your weedding occurs outside of the US) while your sponsor files the petition for you through k1 or k3/ir

My situation is as follows:

In 2004 I was married to a Chinese national in the USA. We moved back to China together and applied for a spouse visa. Before the visa was ever processed (never had the interview, etc.) we were divorced. I never heard anything back about the application. I have lived in China since then and now want to apply for my fiancee who I have been with for 2 years and lived with in China for 1 year. Will my previous application for my ex-wife cause trouble for the new application? Is there some sort of special paperwork I should send in regarding the old one? Should I include a letter explaining the situation? I wasn't quite sure what to do in this situation and any advice would be appreciated. Thanks!



when you send an application (see form I-129f) for your fiancee, you will see there items where you will have to indicate past marriages, ending dates etc as well as an item about past applications petitions. subsequently you will need to prepare the documents to support that those previous marriages ended and that your previous petition...(what happened to it?)

you have not much of a problem as long as you're able to give clear answers and supporting docs =)

your reservations are way too early. too in love perhaps? don't worry, that's normal.

just a tip before sending: go over the forms and check all your entries/information are accurate/correct, signatures in place,dates indicated, and then photocopy everything (it's not uncommomn that later on uscis/nvc will ask for stuff you were sure you sent =)
