Hi all,
Good news i called the Embassy people today and they told me the interview has been set on 4th Dec 2009 at 9:30 A.M. I sent the packet 3 on 3rd Nov and i called the embassy people 0n 17 Nov but they told me they haven't received the packet 3 and asked me to send the Scanned copies. I sent the docs again through mail (scanned copies) on the same day and they replied back to my mail that they have received the DS 230 on 18 Nov and it takes 2-4 weeks to schedule the applicant for an interview. Now the bad news is i was not expecting the interview on 4th Dec and i dont have my Medicals done and the docs which are required at the time of interview are not ready yet. As according to the rules i have heard the medicals and other proof have to be submitted at VFS 10 days prior to the interview date. I have to go to New Delhi for the medicals and VFS which is some 500 miles from Kashmir where i live. Now my question is can i push the interview date a week later. Any kind of help will be highly appreciated.

I am wondering if anyone can help me, i have my interview two weeks today and have been sorting out our forms. My fiance is in the air force and we have put on the I-134 the amount he earns (base pay) with his housing allowance and allowance for substance included. I am wondering if this is ok as over a year this adds $14,770 onto his base pay.

Should i be taking an I-134 with all of this included on it (as he does get it monthly) but on his tax forms only his base pay is shown or should i be taking an I-134 with only his base pay on it?

All help will be much appreciated.

Hi,

my medical examination is scheduled to happen in 12 days in London.

I was wondering if there was a maximum weight restriction? Reason I'm asking is I'm 5'6", weight around 12stone 10 lbs.....wear a size 14 clothes. Because it asks for weight and height in the medical form I checked online to see that wonderful magical "BMI" scale....which has informed me that I'm overweight. I worked my way down the scale to see what was classed as "healthy" and apparently I need to lose 23 lbs to no longer be overweight.

If I lost 23lbs, I'd look ill!! That aside, I'm worried that the physicians will simply look at a chart, decide I'm obese and this will impact on my application.

Does anyone know if there is any criteria and if I have anything to worry about?

I hope you do not mind me saying but this made me chuckle. HAVE YOU SEEN SOME OF THE AMERICAN PEOPLE!!? You are going to be fine, i am 'obese' on the docs chart and although i would like to lose a few pounds no-one would look at me and say i was obese. You are going to be just fine, i am sure for your height you look fine and they will not even bring it up.

Yes you do need to send in all the DS forms with packet 3 and for the dates, at least you're sure of the months as the academic calendar is easy to remember, so just just put a date around that timeline. That's what I did and I didnt have any problem with it.

Im just trying to get all my forms completed so i can send Packet 3 back to the Embassy. On DS-157, Q17 it asks you to list all the educational institutions you attend or have attended and list the mm-dd-yyyy.

My question is do you HAVE to list the day as i cant remember when i started and finished high school and other educational institutions that i have attended. Will they accept mm-yyyy?

I don`t think you need something like that. The foreign fiancee/fiance will only need a police certificate if she lived in another country at the age of 16 and above. But that will be before the embassy interview, not when you are sending the I-129F package. smile.gif

That's right. You'll be the one needing a police certificate. Try to go to the website of the US embassy in your country, and check it there. That's what I did. They have it under the immigrant visa application requirement.

I wouldnt recommend using an attorney as they really dont do much exept act as a post office for ya. I went through our I130 process with an attorney and its been hell trust me. Ive been stuck at NVC for 4 months due to small mistakes he overlooked in the forms we had filled out and some of the documentation that was needed. Its my advise to do as much research as you can on your own and then file for the K-1.

My fiance and I planned to hire a lawyer, but a friend recommended this site. It has been very helpful to us. Just try to read the guides and everything will be fine. If you've got questions, post them here. There will be a lot who will help you.

If you found this site and can post that question, the answer is NO. Read the guides and instructions. If you will qualify for the visa, you will know. If you do not qualify, you will know, and an attorney can't change it.

Attorneys always add to the cost and slow the case down 4-6 weeks, minimum. As you read the guides you will understand exactly why.

You will get the answers to your questions here, faster and more accurate than any attorney (unless he is also a VJ member and gets his advice here)


I am going to stay with my fiance for 5 weeks in the summer and i am the organised one so i will kick his butt into gear and sort all of this out. I personally think a lawyer will be a pain in the ####! This site has given me so much info and everyone is so helpful! Patrick and i have nothing hanging over us so it should be pretty simple.

I asked some people this very same question as i have been told that i can have 5 weeks off work to go and visit my fiance in the summer (i am english, he is american) and i got told basically, good luck in getting in to the US! I think (and im not 100% sure) that you have to have a tourist visa if visiting your fiancee while waiting on a K1 visa. Now, your situation is tricky, you have nothing to come home to, whatever you do do not tell them this! Obviously, your waiting to marry someone you love and you have nothing to come home too, its gonna ring alarm bells in their heads! If i was you i would check this out before you go cause you dont wanna get to the States and then be turned away. Like i said, we were going to start the visa process now but decided to start it in June as i will then already be in the States visiting and will be returning home but a few people i asked said i would be lucky to get through and i am sure i read that if you have a K1 visa pending you need a tourist visa whether your part of the VWP or not. Good luck though whatever you decide to do.

My fiance and i are starting to complete the forms for the K1 visa. At the moment we are in the process of completing all the docs for the I-129F but i have a question. I downloaded the example forms from here and on Part C, Question 1 it asks 'If you are serving overseas in the Armed Forces of the United States, please answer the following question: I presently reside or am stationed overseas and my current mailing address is....'

Now, what if my fiance is serving in the armed forces in NC in the United States, what do we put then? He has currently put 'I am not serving overseas' If anyone has had the same experience or knows the answer please let me know. I do not want this package to come back for something so picky and i know how picky they can be.

Hello

I am trying to complete the relevant forms to send off our petition and get the ball started with the K1 visa. I have downloaded the G-325A form from here but noticed that in the top right corner the expiration date is 05/31/09 so i went to the government website and the form said the same, i have tried to call the gov but no answer and am a little worried that if i send off this form it is out of date and will not be accepted. Does anyone know if the expiration date is when that form expires or if i am allowed to still use this form?

Hello, just to let you know that i have just come to the states from England to visit my fiance and for us to start the visa process. On arrival in the US i went through customs and was asked all the normal questions (why are you here, how long etc etc) I was told to go and wait downstairs and was held for about an hour and a half! I was asked why i was coming so long (work gave me 5 weeks unpaid to start this process and to spend time with my fiance) basically, they told me i shouldnt be here while starting the visa (which i know is ####### and referred them to the part on the form where i put when i arrived in the US, how long im staying etc) but they chose to believe i had quit my job and come here to marry! I even showed them all my visa evidence!

Now, i wanted to come back in Sept but have been told by the oh so kind officer not to bother and if i do i wont get past customs! I have also spoken to lawyers and they say to do it at your own risk as you may be turned away.....supposidly, the officer who spoke to my fiance said that the only reason he was letting me into the country was because my guy is in the US Air Force (personally i think he had a major power trip, if you think someone is coming to get married why let them in if there fiance is civilian or military?!?! But hey, im not complaining, i get to spend some much deserved time with the love of my life!)

I have read on here how some people have entered the US fine and this is just my personal opinion but needless to say i have been told not to return until the visa is granted and if i do try to i wont get in sad.gif I hope it works for you guys but just keep this in mind, its different for each person and as i found out it depends what officer you get at customs!

This was a massive suprise as we obviously were not expecting this. My advice, go with the timeline on the vermont website and then anything better is a massive bonus smile.gif

My advice, dont get a lawyer. We were going to but decided to save the money we would have spent on the wedding instead and now we have our NOA2 and did all of it on our own.

Make use of VJ, check your documents a hundred times if needs be before sending them off and have a little patience!

I was going to use a lawyer before i found this site and decided to save the money i would spend on the wedding. So far, with the help of VJ, i have my NOA2 and am expecting packet 3 any time. As long as you have a bit of patience and you check everything over before sending it off to the relevant people i am sure you will be fine!

I am pretty sure you cant, i am sure i read somewhere that the Embassy does not post anything to a PO box. I say this because my fiance thought he might have been sent on exercise and would only have a PO Box to send things too and it worried the hell out of me cause i read that they wouldnt post anything to a PO Box. Does your fiance not have any phone bills? If not, i would still send them, we did, after all they are extra evidence that you contact each other.

If the sponsor qualifies on income then the asset portion can be left out.

If you want to use an insurance policy the cash value of that policy must be used (not the pay out). You would need to submit proof of the cash value. That would be a recent statement from the insurance company.


I have my interview tomorrow so have already filled the insurance policy out, I've got everything else, probably too much info but we didn't get proof of life insurance. We were so concerned with getting pay slips, letter from employer, tax forms, W2's that this completely slipped our minds. Do you think this will screw us up at the interview?

did she look you up in the SAVE database ?

If not - go back, try again.

Usually, you can be found on or after Day 14 past yer POE date, unless is some weird/strange issues at the POE with the CBP folk.

Go back this week, ask to be looked up in the SAVE DATABASE in yer VISA NAME. If the clerk sputters about SAVE, ask for a supervisor.

DO NOT 'let them' go through 'DHS/USCIS Electronic Verification' on you, that takes 30 to 45 days, and is just a waste of time.

Come back every few days, get looked up in SAVE in VISA name, until they can find you.

re: married name - sure - can change LATER, not a problem, but try to get it first IN yer visa name.

Hi All

I have a question that i am hoping you can help me with. I have been in the States now since the 28 June (3 weeks) and went to apply for a Social Security Card today. The lady told me that I was not in the system so it could take up to 12 weeks to get a SSN. Now, do i cancel the application and try again in a couple weeks or do i completely wait until after my wedding and then apply (Sept 10th)?

If i do not have a SSN when applying for my Adjustment of Status how will this affect my application, if at all?

The lady in the SSA office today told me that it would cause problems if i receive my SSN in my maiden name and then straight away change it to my married name, would it be a problem to keep it in my maiden name for a few weeks?

I was hoping to get a SSN and then be put on the lease of our house and be named on our joint bank account, this would all be evidence that we were living together and in a relationship.

Any advice on this would be so helpful.

So, has your partner sent off for their police checks, have they set up their medical, have you gathered all of the info you need as supporting evidence for your 1-134 Affidavit of Support?

When your partner receives 'packet 3' it is only a letter with a link on it. I cannot remember what the link is but i am sure you can find it on here. I know you need to complete the following:

Complete and send back the following forms to the IVU at the address shown below:

* Form DS-230-I (Part I only) for each person applying for a visa, regardless of age
* Unsigned forms DS-156 (see article on Form DS-156 for information regarding the electronic completion of this form)
* Unsigned form DS-156K
* Form DS-157 (if applicable)
* Form IV-15 (if required documents are already assembled)

You only send back the IV-15 when you have all of the police certificates etc as this will then schedule your interview. I know they changed it end of last year that you had to of had your medical before your interview and the Embassy had to have received the results before the interview.

If you are wanting to know if London have received your case then you can call the expensive phone number 09042 450 100 (£1.20/min). I would suggest calling in the middle of the day as i always seemed to get through a lot quicker than after work (probably when everyone is calling). They will then be able to tell you if they have received your case, it can also put your mind at rest. I know when my fiance and i were going through the K1 process it was so stressful and i worried about every little thing! I have had a few months of non stress and now we are starting our AOS so more stress!!

My fiance and I need some advice.. we received our NOA2 on June 17, 2010. He then came here for 3 weeks and we figured by the time he got back to the UK he would have received packet 3 or a notice that the Embassy got the packet. But, he returned home yesterday and there wasn't anything. Today I called NVC (after hearing busy signals all day finally got through..) The woman said that our package was sent to the Embassy on June 23. We are not sure what to do next. I just read that they may have given it a new case number? Do I call back and ask for this.. or do I just have my fiance call the embassy to see what is going on? Or is there something else we should be doing? You all are always incredible at answering questions.. so I thank you in advance!!

Don't fret, it can take a while. I remember when i was in that stage i called and called and called!! Its painful waiting but trust me, you will receive it soon enough. You can actually find what 'Packet 3' is on here somewhere so you could start preparing everything. Do not send in your docs until you receive packet 3. I say do not send it back before you get packet 3 because i spoke to a really nice guy at the London Embassy and he assured me that people who send their packet 3's in before they receive their packet 3 from the embassy do not speed up their process. But it will mean you can send yours in the day after you receive packet 3. Hope that makes sense!!

When you get sent your visa it will be stuck in your fiances passport. In the plastic envelope along with your passport will be a brown envelope. DO NOT open the brown envelope. You need to give this to the border control officer at the port of entry into the USA. That's it really.....welcome to the States!

Hi there, had a question for you all. I'm well above the salary requirements, but I don't have very much savings (only about 10K - and it is in a checking account, not savings account). Is this going to be an issue at all? Are they going to care about this for proof that I can immediately support my fiancée?

As long as you can prove that you are on or above the poverty guidelines with your salary then you will not need to show any savings etc. For example my fiance earned $55,000 so we just showed pay slips, W2s, a letter from his boss confirming his salary and we did not complete anything else with regards to savings, a house etc.
