Okay, to be clear.... My fiancee reposted this for me because I wanted help. Well, I forgot what all I posted in this thread before. Here's what I have...

I have 2008, 2009, and 2010 tax transcripts already. I see on the I-864 Poverty guidelines that 18,387 is 125% above poverty level, for 2 people. For 2009 and 2010 my tax transcripts show a GROSS income of 19,300 (roughly for both) For 2008 I am below that... a little over 16,000.

Anyway, she'll be living here with me, where I live with my mother and father still. Is this fine?


Also, I have pay stubs... Pay stubs from 2008 until now.

I have a letter from my bank that states things about when my account was started/previous loans/current loan.
I'll have a letter from employer (who is my father)

I'm going to print all the convo history from msn, skype, facebook.... I'm taking it to her, for the interview...

Any more help greatly appreciated....


One last question... My father has agreed before and still, that he would co/joint sponsor.... Even if I meet the mark of 125% above... could I still use him for extra security?

I would go ahead and have both you and your father fill out the I-134 as co-sponsor. It all depends how they are going to look at it, so its not worth taking chances.

Make sure she has her birth certificate, police reports, passport valid for at least 6 months after entry in the US. Fill out all the forms for the interview. There's a link at the top of the page with the embassy info and another link of other peoples reviews of their interview.

She should read what you filled out on the G325A and I-129F fporms so she knows what you wrote and the information about you cause any of that can come up in the interview. Good luck.

I was just looking over pictures that I have gathered for my I-129F and I'm just a little bit worried about some of them.

When my fiance was in the U.S., it was very clear from our pictures where we were. You could clearly see obvious landmarks in the background. That's because we had friends take the pics for us.

When I met him in Thailand however, it wasn't as obvious. That's because we mostly went out together alone and had nobody to take the photos for us so we had to take them ourselves. As a result, our pictures are close up and don't show much background.
There is one picture that has a Thai tuk-tuk in the background, but you really have to know what you're looking at to tell what it is.
Now I have solo pictures of us where there are some temples in the background and easier to tell we are in Bangkok. I was wondering if I submitted close up pics of us two and then a few solo pictures from the same day it could show better proof that we were indeed in Thailand.

Would that be something that could work?


Your pictures don't have to show where you were. Pictures of you should be with your fiance and within 2 years of the I-129F petition. Your boarding passes, passport stamps, receipts, iteneraries etc, and the dates should all match to show that you were both in the same countries at the same time. Good luck.

hi, sorry for this lame question, just wanna make sure. do i really have to put NA in every question that is not applicable in DS 156, DS 157, DS156K, i noticed they will just remove it in the end after. however i already printed it, so can i just put NA or N/A using my own handwriting? will they allow that or i have to answer and print new forms again? thanks in advance..


I think there is no harm in writing them in. N/A is the standard for Not Applicable, also use NONE when the question is applicable to you but you have NONE.

So I finally heard back from USCIS and we got an RFE. I have no idea what it could be. Hopefully I will receive the letter in the mail tomorrow with the details. Does anyone want to share some of their own RFEs? Also, was the RFE letter very detailed?


It really depends on what the RFE is, mines was just that I forgot to check the NO box on the 3rd page of the I-129F form that dealt with criminal activity. Funny but there's alot of people that miss that one.

Hey guys.... You might have experience with this... I know we're in August and this month is pretty special in Europe 'cause in many countries (like Spain) everybody's on holidays...
My question is related to package 3. I'm a K1 beneficiary and from DHL website, our Consulate here receive our package on 5th August. It's 19th August and I haven't gotten anything from them... Is this normal? Could they be on holidays as others Spanish Administrations? I'm freaking out now 'cause the average time to get it is usually one week or less.

You can try calling DOS with your NVC case number to see if the embassy has logged your case into the system.

I dontr think I have seen this particular question before. But, what means of delivery do they sedn our packets to the appropriate Consulates? I know if i just send regualr mail to Shiyan, China, it takes from 3 to 4 weeks to arrive? I dont suppose the NVC sends it the fastest way possible?:-) thanks..todd


DHL, there are several posts here where people try to track packages going to their embassy country around the date it was sent by NVC.

And I know since I am from Iran, they would do such a thing because they look for any little thing to send a RFE for people from Middle eastern countries.


You can put UNKNOWN, they will find it if you had one. If you are really worried about it you can explain the situation on a continuation sheet headed with your name and noting the question number.

USCIS still uses the A# to make it easier to identify you, if you know it. Like when you file the I-129F they certainly identify you with your long gone A#.

The NOA1 is not needed for the interview, that was for your information only.
Don't send the original NOA2 cause you will need it for AOS.

We have been approved for the K1 visa and my fiance is coming over in 5 days. Do I need to change my address with the USCIS? I moved this past Saturday and the address that was on our petition and the one that my fiance was going to come over and live is not the one I just moved to.

Do I need to update? Or do I wait till we apply for AOS?


Until you file AOS you don't have a case pending with USCIS so they don't care where the petitioner is living, but they do care where the beneficiary is living. So if the beneficiary is living where he/she said will be living no need. If the beneficiary moves to a different address file form AR11.

Once you start AOS you can put in your new address.

They will have a record that she returned, and as there was no marriage, you have no obligations towards her or immigration regarding your second ex.

If you happen to find another foreigner you want to marry, there is no form, you just write a letter of explanation as part of your cover letter for the next petition. Explain why the two ex relationship ended, but mostly the newer one.


The letter you have to write is a IMBRA Waiver request, on IMBRA filing limitations. Since after 2 approved K1s you have to file this request. On the letter you just basically explain the previous K1s, attach any supporting documents, and why you should be allowed to file another. IMBRA is a law in attempt to prevent petitioners from abusing foreigners.

Thanks I'll try to stay dry. Its kind of hard to say what these things will do. I was working in Wilmington NC. The hurricanes eye came right on top of Wilmington and stuck there for 3 days but all we got is lots of rain, a few downed trees and a few roofs blown off.

I'm actually down south jersey, west of Atlantic city. Wilmington is built with hurricanes in mind but New Jersey and New York aren't at all so if it starts looking really bleak by afternoon tomorrow , I may just drive out west for a day! ;)

No you don't have to pay for it, you can check the box but don't worry about it at the interview stage. As far as I've heard you need to apply for SSN once in the US.

Two centimeters is not very much, I suggest you just cut 1 cm from each side that is less valuable. I dont think walgreens or cvs are able to do that and if they shrink it you will loose the resolution... old school trim I believe is the best option here!

I have no problem going to the court, nor paying large amounts of money to make this problem go away. I do not need to pay someone to get it for me, unless they have special skills that only allow them to get the document. It is just a train ride in there, and I've obviously been there before since I was able to get divorced there. That's not the problem. The problem is what the heck am I supposed to ask for?? I can't ask for something that doesn't exist, and if I ask for a divorce decree, they are going to give me what I already have.

I feel like I'm in a Monty Python skit, except I'm not laughing.

If you worked in a restaurant and a customer ordered a ham sandwich, and you brought them a ham sandwich, and they said "No I said a ham sandwich, take this back and bring me one", you'd think they are insane. Are you supposed to bring them back the same ham sandwich, a different ham sandwich that basically looks the same, or does the ham sandwich need to be improved upon in some unspecified way even though the customer is not making that complaint, but is instead saying he wants a ham sandwich.

But the divorce nisi happens before the decree. A decree would not set forth anything about a judgment of divorce nisi.




I can certainly do that, but I expect that will end in failure. The only document that is actually a divorce decree is what I already sent them, so sending them other stuff is not giving them specifically what they asked for. I need them to explain what they think a divorce decree actually is, if it isn't the divorce decree.


Just a thought, sometimes USCIS can misplace or overlook documents that you sent in. Send it in again and maybe attach a letter explaining your confusion and all, you'll probably get approved.

If you are divorced, you are diviorced. You can certainly later contact a senator or congressman and have them deal with USCIS, if for some reason there was still a problem.

Its very embassy specific. It sounds like you got that list from the pkt 3 you received from the embassy? It should also list what to send back. In general most of the documents and proof is taken to the interview.

Sounds like you have it all, if there was a name change, you might need a name change document. Also make sure you have translated any documents that need it. the passport should be valid for at least 6 months on issue of visa. Good luck.

Hi everyone...

I know someone on here will have an answer for me as i haven't been let down yet :) ...

We're putting about 5-6 photos in as evidence of us meeting in person for the petition... but my question is how did everyone put them in the package? I know they ask for them to have who it is and dates written on the back so i thought i better not stick them on a piece of paper, are there are photo display pages you can buy?

or am i really overthinking this and i should just shove them in a plastic wallet? :whistle: i just want it to look like nice and neat lol!

What I do, is put the 4 to 6 pictures in a plastic zip lock bag and staple the back side of the bag on the back of a regular white sheet of paper. I do the same things for the passport photos. On the blank side you can write down the description of whatever is attached. If the pictures don't have dates on them write the date on the back and also list who the people in the picture are.

Hey I just wanted to get other peoples inputs on what we should do. We received our NOA1 on April 13 but it hasn't been touched since April 16 and we still have not received our NOA2 and it seems like everyone else around our dates have. Should we be worried? I called a few weeks ago to the USCIS and they basically told us to keep waiting. Our five months will be up on Sept 13... should I call again just to see whats going on? What are the chances of them losing our petition? Thanks!


No you shouldn't worry its quite normal. Getting touched at this stage can only mean RFE or approval and you don't want an RFE cause it can add processing time to your case. Good luck it could be any day or week from now!

I am not quite there yet, we haven't even started our process, but I am a proud member of this site and often just read through things.
This summer is the first time I met my boyfriend, in April I booked a flight ticket and left my home at the end of June to finally meet him. I am still here while I am writing this and won't be leaving until September 22nd.

I had a bit of problems at the Homeland Security, because they were quite sure I was going to either stay here in the US or work here, but everything turned out well, they just told me I am not allowed to work here. So my problem is that they took away my flight ticket (I have an electronic flight ticket and got some copies of it, so this won't be a problem), my boarding pass! And this is what worries me. They took away my boarding pass and as I heard, boarding passes are a primary evidence of us meeting, which would be great to have, but they took it away from me at Homeland Security. Will a copy of flight ticket work instead of a boarding pass? I am of course planning on saving those I get on my way back home.

I am very scared we (in case we ever start this process) won't have enough primary evidence. First of all because we are both pretty young and cannot really afford going to hotels together and fly over the ocean to see each other very often.

I would be very grateful if anyone could write down a list of primary evidence, so I can start saving things. :)

You're not the US citizen though right? The US citizen, petitioner, is the one who petitions for the foreign beneficiary. So you are the beneficiary correct? The petitioner will have to send in evidence that you were both in the country at the same time and the same place. You should also fill out the G-325A and get passport photos while you are here so you don't have to send them to him. He's the one that will need the receipts of both of you with your names on them. Pictures are still a extremely important type of evidence, cause they speak a thouseand words and get into peoples minds. Get pictures of you and hime with his family. Get pictures of both of you with a background that can only be America. Pictures in front of his house wuth the house number and street name would be good. Since you are the one that came to America to see him you both will have to figure out some uniqe ways of proving you are both here and together but you can do it. I don't know if this will work but you both could try getting both of your signatures notarized on some document stating that you are both together in America or maybe see if a lawyer or somebody can vouch that you were both there in hig office, or maybe get your neighbors to vouch for you two being together, I don't know. I'm worried that I may have answered question #11 wrong on the I-134. It says this:

I __ intend __ do not intend to make specific contributions to the support of the person(s) named in item 3. (If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnish room and board, state for how long and, if money, state the amount in U.S. dollars and whether it is to be given in a lump sum, weekly or monthly, and for how long.)

Since there will be no "specific" support, I check "do not intend". Since we will be married, we obviously plan to live together. Does this constitute "room and board"? After he is permitted to work, we will naturally share all expenses.

But, since I checked "do not intend" does that make it sound as if I do not plan to support him at all???

I sent everything to my fiance several days ago....but then I started to question my response. I still have time to send him a new I-134...so I guess I just need to know if my answer was correct or not.

From the Example Forms link on the top of the page their suggestion was to leave the boxes unchecked and in the comment line put' N/A K-1 Visa process.

I put 'Do Intend' and put the N/A part, I forget the exact wording they pur but you can find it on the I-134 example form.

I'm new to this and am finding it overwhelming and worrying so this is very helpful.
It seems silly but on the package three - DS-230 Part one - it asks 'Present occupation' and I am looking and applying for jobs at the moment but obviously have none.
My mum thinks that this will mean that they won't think highly of me? Is this true?

Perhaps I'm over thinking things but I'm freaked out as even the medical was intimidating so I'm on the alert!

You are the beneficiary right, cause the DS-230 is about the beneficiary. They don't care whether the beneficiary is employed or not. Its the USC petitioner that needs a job and/or co-sponsor to be able to support you in the US.

Just filling out the DS230-part 1 form and in the section 32 after list all employment for last ten years there is a question, 'In what occupation do you intend to work in the United States?'

Thing is, I don't know and it's not like I have anything lined up. I was an online production exec but I'm not sure if I will be seeking employment in that area so is there a good response to put please? I am very keen to get a job once I can but I don't know at the moment.

Ok Texas received my fiance visa paperwork 22 Aug and I still have not received a NOA 1 should i be worrying right now and when will I be recieving this. Please help this is the second time I have sent paperwork I hope it dont get screwed upagain with all this. How long is the wait for approval once I get NOA 1.. thankk you


Was your check cashed? You said you sent paperwork in twice?

It can take more than a week to get NOA1 but the important thing is did they cash the check?

does the US embassy need the original I-134 or a copy will do? Also if my co sponsor and I both have to fill the I-134, we would have to submit one each right?


It really depends on the embassy, some event want them notarized. Did you get the pkt 3 instructions that might tell you everything they want. But I think they would want the originals and yes you would both have to fill seperate ones out, and attach all that supporting documentation with it.

Question regarding the I-134 form.
I'm currently a student with very little income. My fiance has been approved for k1 fiance visa.
Currently my parents are supporting me financially and have agreed to support my fiance as well upon her arrival.
When filling the first part of the I-134 form, my parents(mother or father) would have to fill out the form right? I know this is a stupid question
but I'd rather be safe than be sorry.

Also in part 3, it askes to list names of spouse and children accompanying or following. My fiance just recently gave birth. Our newly born baby
recently got her US passport (automatically became a citizen) and will be coming together to the states. If the baby has a US passport, is it necessary to
list the baby's name as a person following?

What other documents or evidences are needed when filing for I-134 other than the Bank Statement(last 12 month) and copy of income Tax.
If the sponsor is self-employed, does the sponsor need to submit a copy of personal income tax or the business income tax or both?



You and your co-sponsor both have to fill out the I-134. I'm not perfectly sure on the baby question, but the baby is accompanying her right, and I don't think the question has anything to do with her passport. The sponsor needs to show the assets and proof of income and all and that they earn enough to support you and all their dependents.

I don't know too much about it beyond that but just bouncing you up so that hopefully somebody else can give you move advice. Good luck.

DS230 Part II is not for K-1. Does not matter what you put for SSN it will NOT come automatically you will need apply in person


Some embassies do require DS-230 Part II, even for K-1, like mine.

I am a little confused on the SSN part on form DS 230 part 2. Question 43.

For 43a - have you ever applied for a social security no? - answer is NO
so 43b -would you like to receive a replacement card? - I've put no as I haven't got a card to replace...is this right?

Then the next part
Do you want Social security administration to assign you an SSN and issue a card? - the response should be 'yes' shouldn't it? Or do I apply for that when I've got married?

Thats exactly what I did. You will still have to apply for SSN, I don't know why they ask that question.

Oh well then I'll cross my fingers for you and hope it won't take the full 90 days for you. For me it should be relatively quick, I'm from India but they've already done the checks on me. Northern Cyprus would be more of a problem cause its occupied by Turkey, but she lives in Southern Cyprus and women tend to have have less problems. Thanks! B-)

They gave him a 90 day wait time I hope they give him the visa.


90 days wait time, I guess its typical for AP. Does he have sort of a common name? They check their names in a database and if there are no hits in it they get it quicker. Hope it turns out quicker than the 90 days.

Once this form is found, completed and then turned in do you know if the Embassy would do another interview or just give my fiance the visa? The embassy already took my fiance passport.


I can't tell you for sure and especially don't know what embassy it is. But I would think they would give you it soon since they kept the passport. I doubt they need another interview but its just mostly a guess on my part. What embassy is it? Some are much easier than others.

You're kidding verizon doesn't support it? Yes contact them when I used them before, they were very good about getting things working. You know this is crazy that they make you go through this to print out a form.

Yes I use internet explorer all the time. What version do you have. It says you need Internet Explorer 5 with service pack 2. The requirements below.

What you need:
Your Internet browser must support 128-bit encryption.
If you are using Internet Explorer (Windows), the minimum version that will work with this site is version 5.0, with service pack 2.
If you are using Netscape, the minimum version that will work with this site is version 6.2.
You must also have Adobe Acrobat Reader version 5.0 or higher installed on your PC in order to download and print the completed application form. If you do not have Adobe Acrobat Reader version 5.0 or higher, you may download a copy from Adobe's web site.

Its the only site there is, the DOS site, what is it saying? You have to meet the adobe reader and browser standards, is your software pretty recent? I was able to do it just now. Can you get to another computer?

P.S. Is the formatting of the page coming out right once you hit the continue button?
