This is an arranged marriage. You do not even want to see her. You do not even know her. You do not even have a relationship. You do not know her feelings on this. You have extreme financial problems. You do not know what is happening regarding any process, K1 or other. They do not know what is happening regarding this process either. You are still in school. Tell the parents to arrange this another time. Or tell them you want to make your own decisions about your life. You are in no position to handle this now. Just my humble opinion.

I am not sure about something! After my fiance comes here and we marry and apply for AOS, EAD, and AP, does he have to return if his k-1 visa is expired before AOS is approved? Or does having petitioned for AOS allow him to stay? Not sure how this works.


The K1 visa expired upon entry to the US. It is a one time use visa.
Upon entry you receive a I-94 in your passport. This is good for the ninety days in which to get married.
Once married, within the ninety days, the I94 is no longer needed as you are now married to a USC.
You then apply for your AOS.

At this point you need to show evidence of a relationship and that you have seen each other in the last two years. Seems to me a few photos you two with a baby and then a few with a child that is now 2 years should go a long way in proving this. Perhaps some other evidence of driving back and forth between Canada and the US would not hurt either. You don't need a truck load of photos.

Our experience at JFK was very good. They took her prints, her passport with visa inside, opened the envelope, told her to go to a very nice large room and wait. About 10-15 minutes later a woman came in, gave her back her passport with the I94 and said welcome to the US. I should add that there were few people waiting at this time so your wait could be longer if there are many visas to process. The whole thing took about 20-25 minutes. Every one was pleasant.

I am sorry that you are in this situation. You have 3 legitimate choices:

1. Wait 10 years or so after she gets her citizenship to petition her daughter
2. Live in the Phils.
3. Find some one else.

Her daughter is not a child but an adult and should be living her own life at this point. If mama's main concern is her daughter, to the point of contemplating doing something illegal as to jeopardize her living in the US and therefore your life as well, then maybe you need to reevaluate this relationship.

Letters of intent are required documents to be submitted with the K1. Think about it. The K1 process is to bring someone to the US to be married. The letters of intent are documents that specifically state that you will marry.

Now, going into the interview I am printing all 6,000 pages (double-sided) and compiling them in 5 separate 6-inch binders for my fiance to take with her. So my 100 pound fiance is taking in 50 pounds worth of supporting documentation... I LOVE IT!


NOBODY is going to look at that. Your fiancee is just carrying around a lot of stuff for nothing. Read what the rest of the people are doing. Sorry man, but this is just crazy.

Agreed. Some 300 pages is way over kill. We only sent in about 2-3 pages. At her interview she had about 19 and the CO only wanted to see one.Everyone is different but you need to give them want they want, not what you think they will need.

They keep the envelope. You do not get it back. The I94 is not in the envelope. It is a paper they will attached to her passport at the POE. It's good for 90 days which is the time frame for you marriage.

Ron, this is a piece of cake. I went to Kiev to pick up my then fiancee, just like your doing. Towards landing you will fill out the immigration/custom form on the plane. I landed at JFK. I asked the woman handling the lines which one should we go on and she said it did not really matter but use the US citizen line as it was faster. Once our turn came, I went first. Then Alena gave them her envelope, did a quick electronic fingerprint scan, then was asked to wait in a nice room. we went together of course. After about 10 minutes a woman came out with her passport and said welcome to the US. Got the bags, and left.

In the excitement of it all, I guess you guys did not look very carefully when the visa were issued. If it was caught at the embassy or as soon as they arrived ( don't know exactly how it works in the Phils) this could have been avoided. But it is definitely wrong. Visas are good for 90 days so they should expire sometime around the 5-6 of May. Please contact the embassy ASAP and get this corrected. They know they screwed up. Sorry about that.

Absolutely impossible. He has to come through POE with the K1 for it to be activated. I am surprised he still has a valid B2 VISA. You will have 90days within which to get married once he makes it through POE. Wishing you guys luck



Actually the K1 is already " active". He has 6 months to use it. Once he hits the POE, it expires and is replaced by the I94. It is only good for one entry to the US. Then you have 90 days to get married. I am also a bit surprised that the B2 was not invalidated once he received the K1. I suspect, but cannot confirm, that if he tried to come for a visit on the B2, he might be stopped since the K1 is now in the system. I doubt you can have it both ways.

Usually when your application reaches the embassy it is the embassy who sends you the packet 3 which contains all the documents that the specific embassy requires. there is also a checklist which you send back that informs them you are ready to proceed. Then the packet 4 is sent out, which is basically your interview date. Once you have your interview, and are approved, you then have 6 months to arrive in the US. AFTER you arrive, your 90 days to get married kicks in.

When you file the 129 it asks about children.You put in their names and they can get their visa the same time as the parent. Usually they all go to the same interview. If they are older, say 17-18, it is possible they may have their own interview but K2 interviews are not nearly as intense as a K1.And yes they can all travel together unless you choose not to.

You would be applying for K2 visas for the kids that is filed along with the K1 for your fiancee. Assuming they are below 21 years old and not married. If you are just starting the process, hopefully they are no older than 19 as they need to be here before 21, and this process can take some time. Even though the father has no contact, it is important that you have something that gives your fiancee full custody of the children.

As a response to question 18 I am putting: We first met online in March of 2011 and chatted for a few months. Then, I went to xxx to visit in May of 2011. We spent a lot of time together-including travelling together-during the summer of 2011. We continued our relationship through our engagement (Feb. x, 2012) with visits in Oct., Nov., Dec. of 2011 and in Feb. of 2012. This seems sufficient to me. I will of course be including passport stamps, boarding passes, hotel receipts as evidence of having met in person. Does this seem RFE proof? Thank you.

All "processing" is pretty much the same regardless of the POE. Opening the envelope, taking fingerprints ( usually electronic) maybe a photo and then waiting a bit for your I94 stamp.The delays are more due to the traffic than anything else. You can arrive and be the only flight at that time, or be jammed with 20 other flights. There are no specific wait times. Took my wife about 20-30 minutes for the whole thing.

This whole process is long, expensive, filled with doubts and pitfalls. It is not for everyone. In some respects it can be easy, in others a ######. It all depends on...just about anything. If you must have a wife from another country, there are hundreds of countries to choose from, millions of women to choose from and each with their own beauty, culture, baggage ?, concerns and the list can go on. If you are not ready to undertake this journey, don't. If you are then I wish you good fortune. But PLEASE do your homework first.

#35. Yes. He filed and was denied on the first 129 Petition. They will have a record of this.

I do not remember if there is room for an explanation, but if not, I would use a separate piece of paper and simply say that the current petitioner submitted a 129 on (date) and was denied due to incomplete paperwork but was subsequently approved when the second petition was submitted correctly.

Yes. You need to some homework on what is involved in this process and one of those items is being able to support the two of you on your own or getting a co-sponsor to do it for you.
