Re paper size no. It's likely A4 paper which is standard in Australia (and probably just about everywhere except the US) :P All my stuff was A4 and there wasn't an issue.

I just noticed on the G-325A Bio form I just got mailed back from my fiancee that on the line for the Applicant's last address outside the US of more than one year that I forgot to update the "to" month. I first drafted in January, but now it's March and it still says "01" for the month. Does anyone think it a problem if I used a black pen to change it to a "3" to agree with the date the form is signed. It's the same address as listed for her current address in the section of Applicant's address for the last five years. It's also the same address as on the I-129F. I'm thinking it's a minor thing and I don't want to have to waste the time and money to have her mail another signed copy back to change that one digit. Or maybe don't change it at all and just leave it as is since the it's apparent what and when her last residence outside the US is from the other part of the form.

The other thing I just realized is that my fiancee printed out the G-325A and the fiancee intent to marry letter on a size of paper not usually used here in the US. It's like a quarter inch narrower than 8 1/2 x 11, and about 3/4 inch longer than. Will this be a problem submitting the form if it's not on standard size 8.5 x 11 inch paper? It must be a size used in UAE where she is currently residing.

Would a copy of her visa and her work contract be good enough? She will try to see if she has anything else to place her there at same time as me, but she probably doesn't have much. She pays cash for everything as she has no credit cards or even a checking account. Her place she lives is paid by her compamy so no rent bills. she arrived 10 months before i met her so it's not likely she's keeping her boarding passes. I asked the hotel to book in both our names and they even checked her id. but then when i requested receipt later, it's only in my name. So if she can't find anythinng else, should her work visa and employment contract be enough? I mean plus my evidence and the photos?

I will soon be filing petition and have evidence of having met my fiancee consisting of my boarding passes, visa stamp, various receipts from being in the city where my fiancee resides, as well as photos of us together. My question is, since my fiancee is currently residing in a foreign (to her) country, do I need to show copies of her passport and visa stamps or residency card along with mine? I doubt she has copies of her boarding passes anymore as she moved there the year before I met her. She will ultimately interview in the country she is residing in currently and her address there is what is included on the I-129
F and G-325A. She's filipina currently living and working in Dubai, UAE. Do I need to show evidence of her being in Dubai also, along with mine?

It's my understanding that even if the alien leaves the country, there is not definite cut off of when they lose their permanant residency. That it's up to the US government officials to decide case by case whether to allow them back in based on facts and circumstances. This drives me crazy because my ex-mother-in-law whom I sponsored on 864. Even though she has left the US, I can't find a definite answer as to when I am off the hook. I know that simply leaving is not good enough. She can decide to try and re-enter the US or at least make a case as to why she should be allowed back in. If anyone has any wisdom to share, sure would appreciate it since it seems I will have to show her on my new 864 (for my fiancee) as an additional dependent. :wacko:

A sponsored alien is not counted as a dependent. They would count toward the household total on an affidavit of support.

Does the 1 extra person mean the difference as far as meeting the income requirement? If not, I wouldn't worry over it.


Well I am a bit concerned about it. My income is down a lot in the past couple years - and it varies year to year. So I am concerned about coming close to the threshold in any given year. That's why I was hoping for a way to find out out my ex-MIL.

About eight years ago, I filed affidavit of support for my then mother-in-law. Now I am petitioning my fiancee for a K-1 visa. I know my ex M-I-L went back to her country for an extended time. Is there any way I can find out if her residency has been terminated so that when I file a new affidavit of support for my fiancee, and ultimately wife, I know how many dependents I need to claim? My ex-wife is not someone I can ask and hope to get any information from.

My fiancee is residing in Dubai, UAE though she's a Philippine national. Is it ok if I include black and white copies of her various UAE identification cards as well as pages from her Philippines passport as part of our proof of having met in person? I heard it's sometimes illegal to copy IDs, so I don't want to do anything improper. I just want to prove we're both in Dubai at the same time. I have my boarding passes, but she doesn't have such anymore since she has been there for an extended time - since before I knew her. Copies of her IDs and her paycheck report from that period of time when I was there is all I have for her as proof of her being there. So to repeat, I want to be sure I am not doing anything wrong by including copies of her IDs.

They do not like staples. Anythingbeyond paper clips and a binder clip on the whole thing is nothing but window dressing. Upon arrival your package is dissected and put into their folder. Whatever you do will be taken apart and end up in the recycle bin. Your package will look like everyone else's shortlay after arrival. Just make sure it is all in the envelope.



You shouldn't even staple the multipage documents. Just concerned that related pages get out of order or misfiled.

No, IMHO it is not enough proof. She could have these documents and not actually be in the UAE. Even if you prove she was there and you were there at the same time, what other evidence do you have that you two actually met? Photos of the two of you together with this information WOULD be enough. You need to prove the two of you are in the same country at the same time. Then prove you are in the same city at the same time. Then the same location at the same time. So you need proof that has name and date and location that matches up. I used a photo of us in front of the White House for our first meeting. Then a photo of us at the Grand Caynon for the second meeting the next year and finally the Almaty TV Tower and a picture of us at Medeo in Kazakhstan as well as the visas with entry stamps. No question that we met in person. You should do the same. Let there be no doubt that the two of you have met in person wihin the last two years. This is one of the main requiremetns for the K-1 and if there is any doubt then you will be asked for more information and if you cannot prodcue that then your petition will be denied. It sounds like you do not have any phots of the two of you together. Even if you get her passport stamps to prove she is in the UAE at the same time as you were, how are you gong to prove the two of you actually met? She has no receipts. Do you have receipts that show any common location the two of you were at during your stay? So far your evidence show the two of you in the same country nothing shows the two of you having actually met. I am looking at this a bit more strictly since she is not a citizen of the UAE and I see a bit of grey when it comes to they two of you having met.

It really does not matter what I think, it is the person looking at your file you have to convience and some are more strict than others.

Thanks Dave. Yes we do have photographs. These are considered secondary evidence due to the ability to manipulate them with Photoshop, etc. But yeah, we have photos together in Dubai in front of the hotel where we stayed, the Dubai Mall, Burjuman Mall, Dubai World Trade Center, out in the desert, on a camel, etc. So do you think that's good enough, then?

its not part of the proof of having met in person but rather a part of the evidence of support and by the way the pay slip that is required is from the PETITIONER and NOT from the beneficiary. Good luck :)


Sorry to confuse you. My intent is to include her Dubai, UAE identification cards along with her November, 2011 pay slip to show that she was there in November, 2011 when I was there - not to prove her income. I have copies of three different IDs she has to carry there (Work card, Visa card, National ID card), the pay summary, and a dated copy of her employment contract for the company over there in Dubai. I thought that would be good enough to show she is there. That is also where she would be interviewing.

if it's that difficult for her to get a copy of her passport when the time comes for her interview, will they even give it back to her for the interview? you can always send it in just in case. also don't most paycheck stubs say something like that? maybe as long as she's not employed in govt with a position that is sensitive.


That is one of my concerns - her getting her passport back and getting the couple days off to go to the interview. But I am trying to take it one step at a time, and deal with whatever comes when that time comes.

Photos with both of you i them would show the two of you actually in the same place. Why can't she ask her boss to make a complete copy of every page in HER passport or give it back to her? Having her entry stamps would be much better proof than the paystubs. Does she have any type of receipts that show she paid for items in Dubai while you were in Dubai? If that is all you have to prove the two of you have met in the last two years, I would go back and meet her again and get photos and receipts from the two of you. The meeting within the last two years must be proved or the petition is dead.

Thanks for your reply. You don't think copies of three different United Arab Emirates IDs (work permit, residence visa card, and UAE Identity card) is good enough evidence? One of them has the issue date and expiration date readily apparent on it. The other two show expiration date. I also have a dated copy of her employment contract. As far as receipts, she doesn't have checking account or credit cards, so receipts would not indicate her personally. I will try to get page from her passport, but I know she hates going to the employer as they are always suspicious and not real nice to the employees in general.

A copy of her pay slip does not prove that you've met in the last two years.

Passport stamps, boarding passes, photos, receipts are what is best.

I know that in itself is not evidence. I have copies of my stamps, boarding passes, and also photos. Since she is from Philippines and residing in Dubai and she doesn't have her boarding passes and her boss has her passport I am looking for other evidence to place her in Dubai at the same time as I. I have copies of her visa card, work card and her UAE identification card. I was using her monthly paystub to show that she was working during that month, thus in the country during the month my passport stamps shows.

As part of proof of having met within last two years, my beneficiary fiancee' gave me a copy of her payslip for the month that I was over in the country she is residing. Her payslip says "Private and Confidential". She works for a private chain of shops in Dubai. Does anyone think that I need to be concerned about this statement when I include my documentary evidence in the petition package - I mean will the US government care that it says that or should I omit such a document?

I have heard mixed opinions from other sources about including copies of receipts of financial contributions to our fiancee in the evidence of relationship. Someone said it is evidence of the relationship because of the financial cost that I incurred on my fiancee's behalf. Someone else suggested that it might be construed that she is conning me or that I am trying to buy her. This is what I have done so far:

My fiancee had taken out an usurious loan in order to pay for her move from the Philippines to Dubai for a job. Though it was a significant amount, it was a much greater burden in her relative financial state than to me. She didn't even tell me about it, I had learned of it from her friend. After much discussion, she had refused my offer repeatedly, she finally allowed me to pay it off. The lender was charging 10% interest PER MONTH! I also sent her funds to buy a laptop computer and to get internet in her living quarters. She had always gone to an internet cafe, and often she was there rather late and it wasn't entirely safe. From this I have been able to communicate more frequently with her. I also sent her a smaller amount to help her with her parents transfer fee as they had certain real estate retitled in their name from the grandparents. Lastly I sent her cash as a Christmas gift since she until just now had no mailing address to send a gift. She just opened a p.o. box last week. All of these contributions were made by Western Union for which I have the receipts of the transfers. The total of all is around $3,500.

Please let me know if you think that I should include any, all, or none of these contributions-receipts in with my evidence of relationship.

Should all the evidence and copies of documents that will be included in the I-129F package contain the name and birth date of petitioner like attachments to Form I-129F are supposed to? Or should they be left unmarked?

Also is it ok to label copies of documents "a", "b", "c", etc to reference back to a lead schedule that I prepared?

Tax law and immigration law are two different things. If his father doesn't qualify as a dependent under the tax law he needs to take him off the tax return, meaning he can't claim a deduction for him. The green card is a different issue. Here's link regarding the tax exemption:

Once the beneficiary has a greencard the I-864 cannot end except for the beneficiary becoming a US citizen, working 40 quarters, losing residency or dying.


How do you confirm whether someone has lost residency after they have left the country? My problem is, I filed the 864 for my ex-mother-in-law, whom has returned back to her home country. Now I will be filing for my fiancee'. How do I prove on the new I-864 that I am no longer liable for my ex MIL, since she's left the US for more than 2 years now?

I have mailed it. I just clipped the whole stack under a two hole punch in the top acco clip. Paper clipped the check to the top sheet. No staples. Put a few tabs at the bottom for the major sections. Mailed via certified mail, return receipt.

I'm putting together I-129F package for mailing today. I read that you shouldn't use heavy duty staples and that two-hole punch at the top with an ACCO clip is acceptable. I plan to do that, but should I at least staple pages that are directly related, like the 4 pages of the I-129 form itself and say any other documents of more than one page so they don't get separated? I mean use regular staples for these? Or should I leave everything unstapled and just bind the whole bunch in order, under the acco clip?

Second question: someone recommend using certified mail. Does that work when you are sending to the PO Box (USCIS, PO Box 660151, Dallas, TX 75266)? or should it be mailed to the other address they say in the instructions is for express mail. What does anyone recommend?

My fiancee is working and residing in another country currently. I filed the petition with the intent of her visa being processed and her interview taking place there. It shouldn't be a problem, but there is a remote chance that she might have to move back to her home country before she would be contacted for her interview and hopefully receiving her K-1 visa. What would happen? Would I need to file a new I-129F then since the relevant embassy would now be in her home country? Can a request be made to have the file transferred? I just would like an idea what I would be looking at if it came to this. I'm guessing an all new filing...

Yes, it must be within two years of the filing date. The other thing is, when it comes to the visa application it will look a whole lot better in proving your relationship that you were actually together recently. I mean, even if the petition got approved without another visit (which it wouldn't), when the CO sees that you haven't seen each other in over two years (pushing three years when he actually gets the file) he/she will be very skeptical I would imagine.

For my fiancee, they put it into the contract she had to sign, that the employer will hold her passport. I guess that's how they get around the law. But I agree, when I first heard that they are holding the passports, I was aghast. Seems like forced into slavery.

For my fiancee, I will make just getting out of their a priority. Forget any bonuses and will pay whatever contract penalty. I don't want her to give her passport back after that though. Just consider it a cost of getting the visa. Maybe some employers there are more understanding, but I don't trust my fiancee's employer.

My fiancee will have this same problem. In UAE, seems a lot of employers hold onto the employee's passports. It's tricky for the employee to get their passport, and also to get the time off of work, come time to go for the interview. My fiancee has to declare her vacation time at beginning of the year. Since she won't know her interview date until the middle, she has to come up with excuse to change her time.

How much dough can she really earn in a few months time. Maybe by Philippines standards it's something, but not by US wage standards. After you consider air fare, and whatever other expenses, it doesn't seem worth the risk of fouling up your immigration plans, whether it's possibly feasible or not. I think it's best just chill out and prepare for the big day.

My fiancee and I were reviewing various questions asked at K-1 visa interviews and one of them was "Why aren't you getting married in your home country?"

Why would they ask this, and are there any supposed good answers or bad answers?

If they were to ask that question of us, in our case, my fiancee is not currently working and residing in her country. So I would guess they wouldn't ask that. But since we plan to live in the US, it just is more convenient, than for me to take a month plus off of work to go do all the necessary steps to try and marry in her country. We have decided we would marry in US and then go have another ceremony/celebration later in her home.

I was just wondering if anyone here on VJ was ever asked this and how did they answer.

I guess I may not have been clear on my questions:

first, I was referring to the quantity of information that I give to my fiancee to take to the interview, not to submit with my petition which i already did. weekly samples? monthly?, or more frequent? how much detail of the chats? i want to have enough, but don't think i want or need to send 1000 pages. just wondering what is appropriate for the interview. for petition i sent monthly samples plus listing of emails history.

second, when i was asking about the screen shots, I meant the photos of us chatting, not the text portions. i have heard people say they take snapshots so to speak of the screens,which include date and time. i thought color might be more clear and discernible. just didn't know if that mattered.

Some people suggested printing out screen shots of live chats as part of evidence of relationship, since that is the primary mode of contact for many of us long distance couples now. I just wonder if it matters whether they are in color or just black and white.

Also how many should be kept for the record. I mean, if we chat daily, that would be a lot of pages. But if it is recommended then so be it.
