She doesn't have to divulge anything to you and your fiance if she's uncomfortable. London tells you that sponsors can mail the I-134 and supporting evidence directly to the embassy but should clearly state the beneficiary name and case number so it gets in the proper file. Or others have sealed their information and put, "to be opened only by US Consulate official."

Thanks! I did see that on the embassy's website a few weeks ago and I just gave my cosponsor a big envelope along with all of the I-134 paperwork as well as a printout of London's requirements so she can seal everything up when the time comes. It certainly comforted her.

That just about settles all of my questions. Thanks to everyone who answered for the links and clarifications. smile.gif Now it's just a bunch of reading and waiting...

YuAndDan, the I-864 checklist says
"If you are a joint sponsor, substitute sponsor, or the relative of an employment-based immigrant requiring an affidavit of support, include proof of your citizenship status, U.S. national status or lawful permanent resident status. For U.S. nationals, a copy of your birth certificate, passport, or certificate of naturalization or citizenship."

Maybe they don't need it for the I-134? Either way, it can't hurt to include it. Thanks for clearing up the tax information, too. If she just requests simple tax transcripts for the past 3 years, a letter from her employer and a few paystubs, we'll be all set.

Hello,
Our check was cashed and we received our NOA1 a few days ago (!!!) so now we're starting to think about the other paperwork we'll eventually need. Since I'm a full time student and thus have little income, we're asking a relative to be our cosponsor for both the I-134 and (way down the road) the I-864. She makes well over 50K a year and has a lot of savings, owns a bit of real estate, has stocks, etc., but is still very hesitant to give out her full financial profile. I've read all the guides and example forms, but I just wanted to verify a few things.

On the example I-134 form, the sponsor entered their annual income as well as their mortgage amount but left the more detailed information (stocks/bonds, other assets) blank. If my cosponsor exceeds the poverty guidelines, she doesn't have to fill out ANY other monetary questions aside from her annual income, nor does she need to supply letters from her bank detailing how much is in her account, etc., right? I'm under the impression that all that is required of her is:

-the completed, notarized I-134 form (listing only her annual income in the financial section)
-a notarized copy of her tax return and/or W2s for the past year
-copies of her tax returns for the past 3 years
-a letter from her employer stating her position and salary
- a notarized copy of her birth certificate or passport to establish U.S. citizenship

And roughly the same information for the I-864. For her peace of mind, I just want to make sure she doesn't have to include any other personal information aside from her tax returns, birth certificate and a letter from her employer from now until the adjustment of status papers are filed.

I only sent five or six and the guides here recommend 2-5. Photographs are considered secondary evidence, as opposed to flight tickets, etc. so there's no need to send quite so many. Good luck!

Hello everyone! I posted this question in the July Filer's thread but didn't get a response so I figured I'd open it up a little bit. I appreciate any insight!

I'm a college student, so I put my home address instead of my college one for all of the I-129F forms. Sebastian has lived in London for about a year and a half, but still has all of his mail sent to his parents' home too. He listed his parents' house as his address on the I-129F because at the time of filing, he wasn't sure how long he'd be living at his flat in London.

I'm now gathering proof of an ongoing relationship so that everything is ready once we've received the NOA2. I have letters and packages that he's sent me, but all of them list different addresses for both of us than the ones we filed with. He sent the packages from London to my college. Maybe I'm just being a worry wart, but I'm concerned that they might take issue with the fact that our evidence has different addresses than we filed with. I'm wondering if it makes more sense to just omit the physical letters and packages to avoid confusion (we still have quite a bit of proof of an ongoing relationship- pictures, phone records, emails, I bought a plane ticket to visit him next month, wedding dress receipt, etc.) or if I should just include a letter explaining the discrepancies. I've read that the London Embassy hardly ever looks at all of this stuff anyways, but I'd rather be too cautious than not cautious enough.

Any thoughts? The fewer obstacles we run into the better!

Nope, the I-134 is used at the interview stage and does not need to be submitted at this time.

We also did not have anything notarized for the I-129F. Instead, on the cover letter, we wrote "Unaltered copy of petitioner's birth certificate" and such for things we photocopied. We did not use the FC-029 (hadn't even heard of it before your post).

I'm still finishing my undergrad, so it just makes more sense short-term. As for long-term, Sebastian lived in the U.S. for 5 years as a child and has always considered it 'home'. I'm studying nursing and from the sounds of things, my career will be much more lucrative here than in the U.K.

We're definitely keeping our options open, though. We're going to get his citizenship and take it from there smile.gif.

I don't think you can marry on a student visa. I also think you have to apply to and be accepted at an American university before a student visa is issued, although I could be wrong. Best of luck!

I would be a little concerned, if I were you. You need to show that you can support your fiance, and you have not actually met the poverty guidelines for this year yet if you've only been working for 1 month. While that may be your annual salary by the end of the year, if something else comes up with your daughter (heaven forbid) you will not be able to meet the requirements with your income alone. During the adjustment of status phase, tax transcripts from the past 3 years are to be included. Since you are borderline, you may want to look into getting a cosponsor.

I, personally, know little to nothing about how your estate or your daughter's benefits would factor into this however- so you may be fine. But based on income alone, I do not think you would meet the requirements. Hopefully someone else can come along to answer your questions about the estate and SS benefits. Best of luck!

A cosponsor should not lessen your chances of success.

We considered using a lawyer, but you should really read around on here. I have read more bad things than good things about lawyers. It means additional wait time because instead of sending things directly to the USCIS, you send them to the lawyer then wait for him to send them off. While the waiting is difficult, filling out the forms really isn't and I am astonished that lawyers can get away with charging thousands for their assistance. I think you will find many, many people on these boards who just read the guides, posted any questions they had in the appropriate forums, and were approved successfully. We're one of them! Of course, it's ultimately your decision.

I'd be very careful about having a nonlegal wedding beforehand. It depends on the laws of your country, but sometimes religious ceremonies are actually considered legal whether you intend for them to be or not. And if it turns out the religious ceremony is legal, using the K1 fiancee visa when you're actually married already is considered fraud and could result in a 10 year ban.

That being said, we are having a nonlegal elopement ceremony in Spain before Sebastian comes to the U.S. But we were very careful to make sure we don't even have an officiant, guests or a church wedding (marriage laws in Spain are very strict to begin with, so we're totally in the clear). Really, it'll just be two people dressed up talking to each other smile.gif.

I agree with what everyone else said about doing the legal part immediately and then planning your wedding afterward. The offended parents wouldn't even have to know, and you could file for AOS earlier. It's possible to plan it in 3 months, depending on your location and time of wedding, as some venues book up over a year in advance in the summertime. Best of luck! From what I've seen on here, it's possible the interview will take place before August but you can never be too certain. If they choose your case for additional background checks at the National Visa Center it could be longer. I know another user on here, Aubrey, had trouble with her fiance getting his police reports on time. Just do every step you can ahead of time so you're well prepared.

None of that is needed. At the interview they may ask you what your wedding plans are (they asked my fiance) but hopefully by the time you have your interview date, you have plans made. Even if it's just going to the courthouse.

We did include receipts from my wedding dress and our rings for him to bring to the interview- but they never even asked to see any of our additional evidence.

I was under the impression that the beneficiary had to live in the U.S. for at least 6 months out of the year? Even if he comes back to visit every 2 months, that doesn't sound feasible. Someone correct me if I'm wrong, though.

Just finished reading this thread and wanted to say good luck. If you're worried about $313, you should definitely do lots of research about how much this process will cost. As others have mentioned, there are lots of fees involved and it would be a shame for you to somehow be naive as to the hidden fees you will incur.

-The filing fee is currently $455.
-There's the cost of mailing the package and acquiring all passport photos (around here, it's $25/4 photographs, each. We paid an additional $20 to mail the packet to the Vermont Service Center).
-Your fiance's medical exam will likely cost $. We went through a different embassy than you, but it cost 180 pounds, or over $300. Any required vaccinations are additional.
-Police certificates, for the U.K. at least, cost us about $50.
-If you've been divorced, or she has, official divorce decrees have associated fees (we have never been married before, so I can't give you an estimate for that).
-At the interview itself, the fee is currently $131.
-For them to officially mail us the visa, we had to pay an additional 14 pounds (approximately $20).
-Plus, many things, such as birth certificates, etc. must be notarized (we budgeted about $30 for this).
-You will also have to mail your fiance all of your stuff, and international shipping can be quite pricey. We've spent well over $50 in shipping documents throughout the process.

After approval,
-Adjustment of Status currently costs $1010
-Marriage license/officiant fees are costing us $100.
*There's a lot more to this, but we're not at that stage yet. I'm not sure how much you know about the K1 at this point, but you must wed within 90 days of her arrival and apply for adjustment of status, so there's not a lot of leeway after she gets here that you'll be out another $1010.

I never had any problems flying through Heathrow, but I had an expired UK student visa in my passport usually just said I was visiting friends I'd met at uni to avoid any problems. Not exactly a lie, as my then-fiance is my best friend! smile.gif

As others have said, so long as you have a cosponsor to meet the income requirements and enough money to cover the K1 filing ($455), Adjustment of Status ($1010) and other costs like the medical, any required vaccinations etc. you'll be fine. I'm a full time student with zero income and we were approved without any problems.

What you are doing is fraudulent. "Bidding"?! Seriously? There are thousands of people who petition each year, and have to wait over 6 months because people like you are abusing the system for whatever mysterious reason.

We did it ourselves using the guides here at VJ and following the advice of the awesome members here. Don't waste your money on an attorney unless there is something outside the norm in your case. Make sure you ask for plenty of help/advice here. Don't be afraid to ask questions before you send in your documents!
Our process took 6 months from Noa1 to visa approval, & he should have his visa in hand Mon or Tues this week.
