Usually the instructions guide you on whether to write NONE or N/A. Read them again. If NOT, I'd suggest writing N/A so no one thinks your fiance's middle name is NONE.

Aug 2010, I filed a I129F k1 for my fiance from Egypt. He went to his interview and had his medical paperwork and he was told everything looked ok. He should hear back in two weeks. Then when we checked the US Embassy in Cairo, they had sent our file back to the US immigration for further review because they couldnt be sure our relationship was real. The US State department denied us because our file was pass the processing date.

So I am curious what is the best route now? to appeal the denial or to file a different form like a I-130? Both ways cost, so now I am looking at the quickest route despite the cost. All opinions are welcomed.

And by the way, we are married now in a civil union but haven't certified our marriage yet. I dont know if this is necessary to do if filing an I-130? Thanks.



I'm sorry but I didn't quite understand the married in a "civil union". Does that mean you had an Urfi marriage? Or did you go to the Egyptian Ministry of Justice for the marriage? The only way you can file for a CR1 visa is by doing the steps that are laid out in the US embassy in Cairo website. Then the marriage certificate will be accepted.

I bought a phone card at the local convenient store and sent him the 800 number and instructions on how to do it. My husband came through JFK too with a connecting flight to Orlando. Once he got through immigration he went to the Delta desk and showed his connecting flight and asked where to go for his next flight. The staff at JFK are very very nice and helpful. Once he got to his next gate he found a pay phone (yes they still have them there) and called me with the phone card and then he called his mother in Egypt to let her know that he landed safely.

You have to be consistent exactly. The name on the form has to match the passport, application, etc.

So put your first name as the first name, the next name is your middle name and both of the 2 last names as a last name with a space.

It all has to match. You cannot change it until you get over here and apply for citizenship. Then you can change it or shorten it as you go.

OK, so I have been researching this a little bit more, and there seem to be differing opinions on the question of what to tell the border patrol agent at the airport when we enter the US with the intention of getting married. The agent will most likely ask us for the purpose of our visit: on the one hand, I know to never lie to the agent, but on the other, i know not to willingly volunteer information and just get to the point.

So what do I/we say? How does that change if I am traveling on my own to meet her in the US, with the intention of getting married?


Just be honest...tell them you're there for your wedding and then it's back to Korea in xx amount of days to finish out your contract in Korea. Then ask if they would like to see your documentation. That's what I would do. That might be willingly volunteering up information, but you better believe if you mention marriage they're going to ask you to prove you aren't intending to stay in the U.S.

I'd probably even arm myself with application papers for the IR1...(or DCF, i think you said?) that you intend to file from Korea after you're married.

Make sure you are well educated about what your steps are and the limitations of the laws. Truth will set you free!! :)

You need to be able to show strong ties to whichever country you are planning to return to, in this case your job contract, return ticket and any other binding evidence would totally suffice.

I don't think I have been as scared as I was getting off the plane in the Philippines. All countries had a travel warning, kidnappings, robbings, third world. As soon as I stepped off the plane and I saw 10 other Americans with me, I calmed down. I never had any problems there. I am going back in January. The media and governments makes these places look worse than they are. 15 million people in one place and a few kidnappings in a year should not scare someone from going to a country if they use their common sense.

The most important key to traveling to a place like this is: Plan your trip, every step of it. Go straight to your locations and keep a low profile, keep your cell phones, cameras and other items hidden. Don't display money. You'll be fine if you use your common sense.

I just updated my Skype software. They moved the snapshot feature to take a picture in the latest version. Now you have to click on the plus sign below the active video window and there is a selection to take a picture. When I updated Skype, I didn't lose any pictures in my snapshot gallery nor my chat logs.

I have 22 years software development experience. I will look at this program that exports these logs and if I can greatly enhance the reporting features, I will create another program. So if you have suggestions, like printing pictures from the snapshot gallery, eight to a page, with their date and time stamp next to it, I would listen. I do this kind of stuff all the time. The biggest constraint is my time and how much benefit it would provide.

I think the best advice I have heard is to bring a couple of emails per week, a couple of chats per week... just a sampling. If I printed out my Skype chat logs it would be over 2,000 pages and that is only within 5-6 months. You can't take everything if you chat alot. Plus phone records and everything else.

I read, here and there, that there is a requirement to submit a letter from the beneficiary stating an intent to marry; on top of the Petitioner's own letter stating the same when the I-129f is mailed to their office. I have read the USCIS website in detail (over and over) and have not been able to fine any such wordage where it says that such a letter from the beneficiary is required. I do know that there is a requirement for the petitioner.

My petition was 4 years ago and I did submit a letter of intent from each of us. I just copied the same letter and rearranged the verbage a little so it did not appear as the same.

I read section 5 of the newest 129F directions and I am convinced you need the letters. Nothing fancy, maybe 2 sentences is all that is necessary.

I am finally on my way to Atlanta! Approved visa last Oct 3, 2012.

Got to ask your opinions on my port of entry. My port of entry is LAX for five long hours! Am I gonna have my CIQ (customs, immigration and quarantine) there or in Atlanta? For those who have experienced the LAX as their port of entry, can you share yours?

LAX sees quite a few immigrants on a daily basis so they know what they are doing. Me and my fiancee (now wife!) went through LAX in sept 2009. The officer was not the politest individual you will meet but he was very "efficient". You will go to the non-us citizen line and depending on the time of day, wait for 45-60 minutes to get to the desk. He will ask some typical/standard questions but mostly he or she will be going through your large envelope the embassy gave you marked "do not open". Lots of stamping, paper shuffling and sorting. They will digitally fingerprint and photograph you. He or she will stamp your small white card (I-94) and passport. Don't lose your I-94!, it is very important. Hopefully they will staple it inside your passport so it will not be lost. Some POE's fail to do this and that card is easy to lose. They will remind you to get married within 90 days (as a K-1 which we were). That is about it. Go through the desk area and retrieve your bags on the baggage belt. Once through customs you will exit the terminal, turn right and walk down to the terminal for your connecting flight. We flew Delta to Atlanta so we went to terminal 5. It is a short walk if your bags have wheels.......

You will do all your processing in LAX.

I photocopied the envelopes of letters and cards she sent to me (holidays and birthdays etc). Chat logs and even the used calling cards I submitted. I kept the USPS receipts for small boxes I sent her.

All these and I am sure others can show a continuing relationship.

Print off emails or chats that show on going relationship. I sent about 10 plus some Xoom receipts. My chats and emails were dated to show the previous 6 months chats so every 2 to 3 weeks apart. You don't have to show daily chats. That's over kill. Good luck


I also included copies of cards we sent each other. Christmas/valentines/B-day etc. Be sure to copy the envelope with postal stamps.

Boarding Passes for BOTH of you if meeting in a Neutral/Not-living-there location.

Receipts for Food, lodging, gas in the actual location for both.

 

Affidavits of people you both know corroborating the meetings, etc.

If you want an awesome tool for backing up, saving and/or exporting text messages this is it!

 

You can export the text file via an Excel File, or plain text (Plain Text files can be imported BACK INTO your phone later if needed) say when you need to do a Factory reset.. or get a new phone.. or when you get mad and delete your entire history.. (Nooo, No person has EVER done this!!! heheheh)

 

You can transfer your ENTIRE text History out and then back into your new phone via your SD Card and/or even to Email then download the .txt file and import the messages! It has a "Conversation View" as well so it reads/looks just like the Conversation does on your phone.

 

Awesome for Visa Interview proof of on-going relationship and we also use it because my Fiances phone is not a "Smartphone" and he HATES to delete my messages... So I send him a back up copy of our entire history (via email) updated every few weeks so he/we always have saved our special moments!

They may question it.. They did in our Interview (we were engaged within 2 visits in 3 months.) And We were approved at the end... mostly they look for a real relationship. You will most likely have plenty of time before your Interview, so you can take more trips and take photos together while there.

A K1 entrant who does not marry and adjust status must leave within 30 days after the expiry of the 90 day period of the visa.  K1 is a single entry visa, which means that you may only use it once and cannot use it to re-enter the US (under the same K1) regardless of whether or not you stayed the whole 90 days.  K1 visas are not easy to get.  It entails fling several forms and complying with several requirements that costs a lot of money.  It is issued on condition that the fiancé who is issued the visa will enter the US, marry and adjust status.  Someone who has no intention of marrying cannot, or should not apply for this visa type because to do so will just be a waste of time, effort and money.  For tourism and visit of friends and family-- the B2 visa option is the more appropriate choice.

... but the one GLARING piece no one has bothered to mention so far... is that you will also piss off a ton of ACTUAL, REALLY REAL, True Couples who SINCERELY are PREPARED, READY, WILLING, WANTING and WAITING to MARRY or LIVE WITH their Spouse or Fiance/Fiancee they are applying for...

 

If you want to "Play House" or Trial Date... go to their country for a while or get a different Visa...

Thank u, i did that but still show me invalid case number

 

And you are sure that it's the right number without spaces between the SDO and the number, right? Not your EAC or WAC number. And you are selecting IV? Right?

 

The first three must be letters. Once I mistakenly typed 0(zero) instead of O and got a similar message. It also does not have to be capital letters.

 

Either way don't panic just yet, it may just be a glitch.  Give it a few hours and check again.
