I knew you would wonder why I am calling instead of my fiance doing it. He is a USC. But he finds it so annoying to be inquiring about our case because he has done it many times and he thinks that people in the uscis are not very helpful. Thats why I tried to do it myself, just to help him a bit.

Regie, it is commendable that you wish to help out from such a far distance outside of the USA. Regardless of how annoying something like this can be, displaying a lazy attitude or unwillingness says a lot about a person. We are all dealing with this visa process. I will do WHATEVER it takes to succeed and complete this process. My fiancee' shares this attitude also. It is teamwork. No one person can do it alone. We are doing all we can to be together with our fiance's. I would never just sit and do nothing. Just because something is not going to go my way, I certainly will not pass it onto my fiancee' to do the work on their own. I like to find solutions to something that may be or is a problem. If I were in the same situation, I'd keep on calling no matter how annoying or unhelpful the people at USCIS appear to be. It costs nothing for your fiance' to call from here within the US. Besides, he is the petitioner. I am certainly the type of person that I will find answers to questions. I hope you do not begin to feel like you are taking on this process alone. If you do, chance of successfully completing this visa process are going to be slim. Not to mention being married afterwards and having the same type of situations placed upon you to solve problems in the home by yourself. I am sure most people will agree on here that successfully completing the K-1 visa requires a strong partnership between both the petitioner and the beneficiary. Marriage is going to require even more of partnership after getting the visa and being together.

Is your fiance' petitioner here in the US? Whoever the petitioner is, should be calling. I do not know if you are familiar with IP Phones. But in most places, like internet cafes, they have phones you can use that are really inexpensive to call anywhere in the world. And the sound quality is pretty good just like a regular phone. It looks like you may have to speak to a live operator. They always ask for certain ID numbers, etc. for security purposes. Without being able to pass the phone security, the person calling for you won't get any further trying to speak with the operator.

Your timeline shows it was sent to CSC less than a month ago. I guess I wonder if you're jumping the gun a bit.

I'm not sure I'm correctly interpreting what the problem is here, but if you enter the numbers that correspond to the numbers it should work. In other words, for W press 9, for A press 2, for C press 2. So you should enter 922##########. The # used here to replace whatever your numbers are.

I tried to searched on line through uscis website on the status of our case. It gave me a wrong result. We applied for a K1. The result says like this:

Reply from NVC may take at least a week then you will get your query answered. Also NVC can give you your interview date too. They can provide it to you faster than the embassy in your area. God bless.

I need some info. My fiancee just finished her medical exam. They took some x-rays of her chest and said they saw something abnormal and needed to do it again. So they x-ray her again but they dont tell her if everything was ok. All they say is for her to bring her x-ray plate with her to interview and then bring it to the USA. I have worked with NSO before, and have a few friends from the Civil Registrar, and as of 2007, yes the CENOMAR is necessary for someone to get married in the Philippines. Aside from the CAPACITY TO MARRY document which you as USC would need to present to the CIVIL REGISTRAR upon application. These are some of the documents that will be of advantage to both parties, so both of you can be assured that each one is single and is capable to marry.

I forgot what is the nearest NSO-CRS outlet she can go, but she better hurry because this document from the last time I remember will take days or even weeks.

As long as it is NSO issued Birth Certificate in Security Paper, it does not matter if there are blank entry. And as long as it coincides with the data and information you provided with the USCIS, you will be fine.

Relyn and I have what could be our last hearing on june 18, 2007. we do believe this is actually the last one. Me the optimist thought we would be done in december with the annulment..........lol.

my question is how long is it in all of your experience after the last hearing to wait for the judges decision. our attorney thinks it could be as much as three months.

Hi. I was into the same process too. Mine was submitted for decision Aug 2006, it wasnt made final until November that year. I am not sure as to Relyn's case, but if the lawyer says so, then maybe you can count on that. Actually, the decision will still be submitted to the solicitor general in manila and will wait until 15 days or more then it goes back again to the court for finality, for another 15 days posting. So give it another month from the time decision is made then she is done.

After 11 grueling months, we have been touched! I think my heart skipped a beat when I saw that date on there change to May 22, 2007. We have had disappointment after disappointment from both our lawyer and USCIS through out this process.
--Originally filed June '06
--Feb. 07 we found out our lawyer had filed at the wrong place
--Feb. 07 we found out that USCIS had closed our case back in Oct. 06 and never notified us of their action
--March 07 had to refile and start all over

So as you can see, getting something as simple as a touch is certainly a step in the right direction and I was thrilled. However, I think I am a bit apprehensive to get too excited over this...I don't want another disappointment and I am a little paranoid.

So I was wondering if I could hear from others about their touches. Did your first touch mean anything at all? Did you receive your NOA2 shortly after your touch? Did you have numerous touches?

I'm just trying to get a feel on how to read this....although I feel both my fiance and myself has been patient going through this for almost a year now without even a NOA2, we are still VERY impatient at the same time.

Hi, personally I admire your patience :thumbs: . I can feel what you are feeling right now after almost a year on this process.

My fiancee filed late Feb 07, NOA1 dtd Mar 05, touched on the 12th March, then 23rd May touched/updated. Hopefully its not RFE :-) . We have done it ourselves, though in the middle of the gathering of all documents we have considered the service of a lawyer. My fiancee is not very much of a paperwork type of guy,so I took time reading on line and found out that we can do it ourselves, and it wasnt so hard at all. Seem hard at first, but it wasnt at all later.

Let us hope and pray that we are getting the approval soon.

I need some input
we filed the K1 to prepare our selves for interview to make sure we have all things covered we did a marriage back ground check ...and guess what

make a long story short ..my girlfriend got married in 1994 to a man in Manila with in months she found out that he was married and he took off and left her she return home and she did more investigation and was informed that it was a fraud marriage so it wasn't valid and she wasn't married so she resorted to use her family name

so she explained to me that she wasn't married because he already was so life goes on till she meet me
so just to cover all bases we did a back ground check in Philippines of that marriage it came up that she was still even though it was fraud

we already filed for K1 and noted that she was single can we she continue to file while annulment is just about done
and explain the during interview what we come across with this problem and the annulment is done buy then and show paper work that it is complete ..truth we didn't really know it would show up


You said you had filed the K1, becoz you had been providing information that she is single, so maybe the USCIS does not asked for the CENOMAR. But then, during the embassy interview a CENOMAR will be definitely asked from her. NSO paper will show that she is married to that man from manila. Processing of annulment will take some time and she will not be able to show that marriage is terminated unless it is final.

I also suggest that you withdraw the petition at this point.

Just a piece of thought...

I have an annulment, it was final for almost a year after filing. Others get it for over a year depends on how lawyer handle the case and the court of course.

My fiancee didnt file the K1 not until we have the final annulment decrees becoz it will be one of the requirement in the filing of K1.

Since your fiance is from the Philippines, you are supposed to get and include a CENOMAR or certificate of no Marriage from NSO in the filing of K1. Or did they(the USCIS) asked it from you?

Just an opinion to share... if you apply for a process to correct your last name in your birth certificate, it will take a long time. If I am not wrong, you have to look for a lawyer to do the process.

The I-129f referenced in that post is for a K-3 spousal visa--not a K-1 fiance(e) visa. That's why the I-130 is also mentioned. They had to file I-130 before they could file the I-129f for the K-3. Your circumstances are not the same. You did not file I-130. Your I-129f was for a fiancee, so the visa rules/uses are not the same.


Exactly! They filed I-130 because it is a requirement in order to file for K-3, the petitioner must submit the I-130 prior to submitting I-129F. Keep in mind that, for both types of visa, K-1 and K-3 you use the same form but the procedure and effects of each visa are completely different.

My niece got married to a USC too. I helped them processed all the papers with regards to their getting married here. Yes they got married, but they still filed for K1, becoz they didnt register the marriage to the civil registrar. I agree with Eric and Teresa, you may marry but have a ceremonial one, dont register it with the civil registrar, be sure you keep hold of the marriage certificate so u will b sure it wont be submitted.

I have learned that visa is valid for only a year. I decided to include my son on the I129F becoz I understand that it will really be very hard for me to petition my son once I am already in the U.S and make a separate petition for a relative. The plan is to make him follow only after he finished his high school in 2 yrs or so. When I filled up the DS FORMS, I indicated there that he is to follow, so I didnt pay for the embassy fee for my son.

Noticed that except for the receipt number which we found on the NOA1 dated March 5, the date and the application type are all wrong.

Anyone here can tell me how to inform or let USCIS know about this error they committed on our case?
By the way, tried emailing them at this address: USCIS-complaint@state.gov, but there has been no reply for almost 2 wks now. I am really worried that this will slow down the processing more of our case.

Need someone's advise and help.

Call the customers service number. They should be able to forward the information to where it's appropriate and give you some information.

I tried searching on line through the USCIS website about the status of our case which is the I-129F which my fiance file Feb 27, 2007. It surprises me becoz the result is this:

Current Status: Approval notice sent.

On February 12, 2007, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
