So prostitution is legal in Germany, but if you are a German beneficiary who engages in prostitution, you can be denied a US visa based on your "crime of moral turpitude." I hate to nitpick here but...... How could this be if it is legal in the beneficaries country?? surely a crime would not have been committed so beneficiary would not be denied a visa.....if prostitiution is LEGAL in the particular country then she couldn't be charged with prostitution surely? I can only speak for australia where it is legal. They can be denied a visa or if they have a visa they can be denied entry if they are even thought to be a prostitute. K-1 Fiance(e) Visa Process & Procedures	Just got real bad news	Ok,again Sharon filed for the divorce while Jim was deployed.He received the divorce papers downrange,he signed the papers .Sharons signuture was already on them and the papers were notorized.Jim mailed that stuff back to her so she would turn the papers in.Her lawyer wanted 600$ from her which at the time she couldn't(or didn't want to?)pay because she had just lost her job with Sears. We unfortunatley don't know any more. Jim can't remember WHAT courthouse it was she filed through but he will try to get a hold of her tonight and try to find out so we can go from there. I know all of this sounds weird,but trust me we are everything BUT happy about this. All we want is to finally be together for good. Does anyone know how a case like this is handled in the State of VIrginia????????? Nat Hopefully Jim's ex will shine some light on the situation so you will know how you have to proceed. As long as she is happy to go forward with the divorce it shouldn't delay you too much even if you have to start it all over again.....hopefully it is just sitting on file waiting to be finalized. I don't know anything about divorce law in Virginia, but I managed to find lots of info online when I was researching Texas law. K-1 Fiance(e) Visa Process & Procedures	Just got real bad news	i am confused..when a party files for divorce...both parties are given the court date for the divorce haering..if he did not receive it or if no party showed for the hearing there was no divorce...pretty strange situation here... Is it possible that both parties talked to lawyers, drew up and signed the papers, but that the wife's lawyer never actually filed the papers because she didn't pay? If so, nothing was ever filed with the court, hence, no court date and no official record. Divorce law is not a federal action so it's handled at the state level. Each state has different laws. For example Florida does not recognize "separation". You are either married or divorced, there's no in-between in Florida. If the original paperwork was never filed you might have to file again and your state might have a mandatory waiting period. I am kind of feeling that no divorce has actually been filed....so it would have be started from scratch...which all being good and no probs would take up to 6 months at the most... Jim needs to talk to JAG about this since he's not deployed (I think) anymore... see if they can help him. And it's not like she needs a lawyer for a divorce case in the US if there's nothing to divide up... He should be able to get all the paperwork (from what state I'm not sure since he's in Germany.. probably his Home of Residence or Home of Record.. he'll understand what I'm talking about) and then refile himself and pay the filing fee's. Well JAG will not get involved...we tried that...I think what she is saying that filing has already taken place...so the wife needs to go finalize and if she won't the only option is to drop $800 and counterfile....like we have to do... If she filed and Jim got papers and signed them he should have returned papers to the court and not to her. I think it probably is the case that she just never went back to the court to finalize....so thats all she needs to go and do..... I have some experience of this because we are going thro exactly this at the moment....hopefully his ex will just go and prove it up and you guys can move on.... good luck... Yes it is horrible,and neither one of us knew about it.......Jim always thought he had only miss placed the Divorce Decree (really really bad with papers that man).He knew he saw the original divorce papers,they were signed and notorized so he really never once thought she didn't turn them in...... Now one more question: In case Sharon ( the "wife") doesn't have the original documents from back then anymore,does that mean Jim would have to file for divorce all over again?????? Can we just (well Sharon or my Fiance of course) put the paperwork from back then in or is that invalid in case it still exists somewhere? If she goes to finalize and everything is agreed upon, it shouldn't put you back too much Your fiance should recieve his own copy of the divorce decree when it is issued. I have to admit if I hadn't done any research into visa and immigration I would have merrily gone off to the States with my fiance on my tourist visa and got married.....because I thought, and so did my other half, that's all there was to it. It took me some convincing him that we couldn't/shouldn't do it that way.
